CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Director of Public Works/City Engineer DATE: March 5, 2024
SUBJECT: Approval of Amendment No. 1 to the Cooperative Agreement No. C-9-1845 with Orange County Transportation Authority for the Laguna Niguel Summer Trolley (Project V Community-Based Transit/Circulators, Project No. 19-LNIG-CBT-3954)
RECOMMENDATION
Staff recommends that the City Council:
1. Approve Amendment No. 1 to the Cooperative Agreement No. C-9-1845 with Orange County Transportation Authority for the Laguna Niguel Summer Trolley (Project V Community-Based Transit/Circulators, Project No. 19-LNIG-CBT-3954); and,
2. Authorize the City Manager to execute Amendment No. 1 to the Cooperative Agreement No. C-9-1845 with Orange County Transportation Authority for the Laguna Niguel Summer Trolley (Project V Community-Based Transit/Circulators, Project No. 19-LNIG-CBT-3954), subject to the City Attorney making non- substantive changes.
BACKGROUND
On February 19, 2020, the City entered into a Cooperative Agreement C-9-1845 with the Orange County Transportation Authority (OCTA) regarding funding allocations of the City's Project V Community-Based Transit/Circulators Project, the Laguna Niguel Summer Trolley. In response to the pandemic-related impacts, on January 25, 2021, OCTA's Board of Directors authorized the City to the delay start of its Summer Trolley to May 2022 and made revisions of Comprehensive Transportation Funding Programs (CTFP) Guideline requirements related to Project V. These CTFP Guideline requirements changes are being made for all cities which participate in this Program.
ANALYSIS
The following items are the main modifications being incorporated by this Amendment 1 to the Cooperative Agreement C-9-1845:
• The contract Term is extended for an additional two (2) years effective January 1, 2026 through December 31, 2028. It should be noted that there is no increase to the total authorized OCTA funding amount; the term extension simply allows the City a longer timeframe to use the authorized funding.
• The main operating performance measure is modified from boardings per revenue vehicle hour to a cost per boarding subsidy and, new time frames and formats for reporting the operating performance measure are established. • Annual OCTA cost per boarding subsidy maximum reimbursement rate is being raised from $9 per boarding to a new rate that starts at $10.24 per boarding in FY2021-22 and increases 1.85% each year to $11.22 per boarding in FY2027-28.
• As is the case with the current Agreement, the operation and maintenance costs submitted for reimbursement under this Project V grant shall not exceed 90%.
• Annual OCTA cost per boarding minimum performance standard, where operating cost per boarding shall not exceed twice the per boarding subsidy reimbursement rate, is established at $20.47 per boarding for FY2021-22 and increases 1.85% each year to $22.85 for FY2027-28.
• If any of the minimum performance standards above are exceeded, OCTA will notify the City of non-performance and the City then has sixty (60) days to request City Council direction to continue, restructure or cancel the service. The City will have forty-five (45) days to provide a written response to OCTA following City Council direction.
• Timeframes for quarterly invoice submittals by the City and reimbursement by OCTA are established. The City must submit its invoices for reimbursement to OCTA within ninety (90) days following the close of a quarterly service period.
OCTA shall reimburse the City within sixty (60) days of receipt of an acceptable invoice from the City.
• The City shall develop methods to measure on-time performance and an annual customer satisfaction survey(s).
Staff recommends that the City Council approve Amendment 1 to the Cooperative Agreement C-9-1845 with Orange County Transportation Authority for the Laguna Niguel Summer Trolley (Project V Community-Based Transit/Circulators, Project No. 19-LNIG- CBT-3954) (Attachment "A").
This project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines - California Code of Regulations, Chapter 3 (Guidelines for Implementation of CEQA), Article 19 (Categorical Exemptions), Section 15601(b)(3).
ALTERNATIVES CONSIDERED
The City Council could not approve execution of Amendment 1 to the Cooperative Agreement C-9-1845. This alternative is not recommended because it would delay Project V reimbursement from OCTA for Laguna Niguel Summer Trolley expenses.
FISCAL REVIEW
There is no fiscal impact associated with the recommended action. The total project cost remains $984,535 with up to 90% funded by the Project V grant from OCTA and at least a 10% match by the City. There are sufficient funds in the Fiscal Year 2023-24 Public Works Department operating budget to cover this fiscal year's required match. Further, staff will budget the annual City match each year.
LEGAL REVIEW
The City Attorney's Office has reviewed the Amendment and has approved it as to form.
CONCLUSION

SCOPE OF WORK
LAGUNA NIGUEL SUMMER TROLLEY
PROJECT SUMMARY
The Laguna Niguel Summer Trolley Service is a summer program service that will operate between Memorial Day weekend and Labor Day weekend (approximately 15 weeks) and would run from Thursday through Sunday for a total of five (5) summers. The service includes a total of two (2) vehicles and one (1) back up vehicle. The vehicles will hold a total of twenty (20) passengers and will include branding/wrapping of the vehicle to clearly distinguish itself from local buses and/or shuttle services.
The City would outsource administration and operations of the trolley service to a contractor. The trolley service contractor will also develop and provide a real-time vehicle tracking application for passenger use.
This application would provide real-time vehicle location and arrival/departure times for stop locations.
In addition, the transit service contractor will develop and provide General Transit Feed Specification (GTFS) data for the service route. The GTFS data will assist with integrating the proposed service with other public transportation routes/systems such as OCTA or other Project V routes; this data can also be used by various trip planning software.
As the City will be outsourcing for the administration and operations of the trolley service to a contractor, maintenance and maintenance facilities will not be needed by the City. Maintenance of vehicles will be performed by the vendor at the vendor's maintenance facility. In addition, a single back-up trolley will be made available by the vendor in the event of vehicle breakdown/shut-down.
The proposed route times and connections are provided as follows, actual times and location may vary slightly:
