CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: March 19, 2024
SUBJECT: 2023 Housing Element Annual Progress Report
RECOMMENDATION
Staff recommends that the City Council authorize staff to submit the 2023 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and the Governor's Office of Planning and Research (OPR) by April 1, 2024.
BACKGROUND
State law requires each jurisdiction to prepare and file APRs describing the status and progress in implementing its Housing Element to both HCD and OPR. Specifically, the City must prepare and file the Housing Element APR using forms and definitions adopted by HCD. The 2023 APR must be submitted by April 1, 2024, to HCD and OPR.
The Laguna Niguel General Plan Housing Element, covering the 2021-2029 planning period, was adopted by the City Council on October 19, 2021. Amendments to the Housing Element were adopted at the March 21, 2023, and December 5, 2023, City Council hearings. HCD certified the City's Housing Element on February 22, 2024.
ANALYSIS
The City's Housing Element APR, included in Attachment A, was drafted in accordance with the State's APR form for the 2023 reporting period and accounts for recent state laws (AB 1743, AB 2011, SB 6, and SB 649). Program highlights include the following:
• Housing development applications submitted (Table A):
• Griffin Senior Living Community (108-unit development - 77 senior living units + 31 senior memory care units) was submitted (for purposes of the APR, submitted is when the application is deemed complete) and approved in 2023.
• Single-family units: 5 units were submitted and approved in 2023. • Annual building activity reports for new housing units (Table A2):
• Multi-family units: 309 received building permits and 270 received a certificate of occupancy in 2023.
• Single-family units: 9 received building permits in 2023. • Accessory dwelling units: 10 received building permits and 2 received a certificate of occupancy in 2023.
• Regional Housing Needs Allocation (RHNA) progress (Table B):
• Very-low income: 7 units were issued building permits. • Low income: 1 unit was issued a building permit.
• Moderate income: 2 units were issued building permits. • Above-moderate income: 318 units were issued building permits. • Housing Element Program implementation status including local efforts to remove governmental constraints to the maintenance, improvement, and development of housing (Table D):
• Table D includes the status of program implementation for the following six programs identified in the December 2023 adopted 2021-2029 Housing Element: Provision of Adequate Housing, Housing for Persons with Special Needs, Affordable Housing Development, Conserve and Improve Existing Housing to Low and Moderate Income Households, Affirmatively Furthering Fair Housing, Housing Element Monitoring and Reporting. Subsequent minor modifications to the Housing Element programs in Table D will be made in 2024 per the February 22, 2024 certified Housing Element.
• LEAP reporting (Table LEAP):
• The City received $300,000 in LEAP grant funds and continues to allocate the funds towards a new land management software system (Energov).
The software implementation is currently in progress.
ALTERNATIVES CONSIDERED
The City Council may decide not to authorize the submittal of the 2023 Housing Element APR to HCD and OPR by the April 1, 2024 deadline. Opting for this alternative is not recommended, as it may expose the City to the risk of losing grant funding,
potential litigation, and non-compliance with SB 35.
FISCAL REVIEW
There is no fiscal impact as a result of this action.
LEGAL REVIEW
The City Attorney has approved this report to form.
CONCLUSION
Staff recommends that the City Council authorize staff to submit the 2023 Housing Element APR to HCD and OPR by April 1, 2024.
