CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: April 16, 2024
SUBJECT: Award of Maintenance Services Agreement to Real Green, Inc. for Citywide Backflow Device Inspection, Repair, and Installation Services

RECOMMENDATION
Staff recommends that the City Council:

1. Award the Maintenance Services Agreement for Citywide Backflow Device Inspection, Repair, and Installation Services to Real Green, Inc. in the not-to- exceed amount of $20,000 per year for Fiscal Years 2024-25 through 2026-27, subject to extension administratively for two additional one-year periods;

2. Approve a not-to-exceed 20% contingency of the total contract in the amount of $4,000 per fiscal year for unforeseen conditions or extra work and authorize the Public Works Director/City Engineer to approve additional work with Real Green Inc. for a total not-to-exceed amount of $24,000 per fiscal year, if needed; and,

3. Authorize the City Manager to execute the agreement and future amendments to the Maintenance Services Agreement with Real Green Inc., subject to the City Attorney making non-substantive changes.

BACKGROUND
The City of Laguna Niguel owns and maintains approximately 100 backflow prevention devices at City parks and facilities. A backflow prevention device uses valves in different configurations to prevent contaminants from flowing backwards into the potable (drinking) water system. The California Department of Health Services requires each of these devices to be tested annually to ensure proper device operation for public safety. To comply with this regulation, the City annually completes backflow device testing, inspections and repairs. A summary of the annual test results and repairs are then provided to the Moulton Niguel Water District to record compliance.

Contract services play a key role in the delivery of maintenance as they provide access to a service that is efficient, responsive, and available as needed. In support of City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan, the Public Works Department requires a maintenance contractor to inspect, repair, and install City-owned backflow devices.

ANALYSIS
In February 2024, staff published a Request for Proposal (RFP), shown as Attachment "A", to identify the most qualified contractor to provide backflow device inspection, repair and installation services. The goal of the RFP was to award a qualified contractor to adequately fulfill the City's needs and respond to requests quickly and efficiently.

The RFP for Citywide Backflow Device Inspection, Repair, and Installation Services requested bidders to furnish pricing for the annual inspection of the City's backflow devices, and rates for repairs and installations. The proposed rates and maintenance costs include all labor, tools, materials, and equipment necessary to provide the required backflow device inspection, repair and installation services.

In response to the RFP, four qualified proposals were received. The proposals were evaluated based on the following five criteria: (1) Cost, (2) Completeness of the Proposal, (3) Qualifications & Experience, (4) Quality of Goods and Support Facilities, and (5) the Proposer's Financial Stability. The Proposals Evaluation Summary is provided as Attachment "B". The table below summarizes the contractors, evaluation ranking and annual inspection pricing for comparison purposes.

Evaluation Annual Inspection Pricing for
Contractor
Ranking Comparison Purposes
Real Green Inc. (Recommended) 1 $4,000
A.C. Landscape, Inc. 2 $5,000
Verne's Plumbing, Inc. 3 $9,500
Pro-Craft Construction, Inc. 4 $102,095
Pursuant to Laguna Niguel Municipal Code Section 3-6-9, maintenance contracts of an estimated expenditure of $10,000 or more must be awarded based on the responsiveness of the submitted proposals to the RFP, the qualifications and experience of the contractors, and cost. After thoroughly reviewing the proposals received and based on all relevant factors, staff believe Real Green, Inc. represents the best overall value to provide backflow device inspection, repair and installations services to the City.

Real Green Inc. has provided the City with exceptional service on numerous landscape maintenance contracts over the past decade, including maintenance of the City's wetlands and habitat areas. Staff are confident that Real Green, Inc. will continue to provide the City with exceptional service at a great value while providing the Citywide Backflow Device Inspection, Repair, and Installation Services.

Staff recommends that the City Council award a Maintenance Services Agreement to Real Green, Inc. in the not-to-exceed amount of $20,000 per year for Fiscal Years 2024- 25 through 2026-27, subject to extension administratively for two additional one-year periods. In addition, each Agreement will include a not-to-exceed 20% contingency of the total contract in the value of $4,000 per fiscal year for additional work for a total not-to- exceed amount of $24,000 per fiscal year (Attachment "C").

ALTERNATIVES CONSIDERED

1. The City Council may direct staff to reject all proposals and rebid the RFP for Citywide Backflow Device Inspection, Repair, and Installation Services. Staff believes that rebidding the RFP will not result in more desirable bids.

2. The City Council may decide not to approve the Maintenance Services Agreement for Citywide Backflow Inspection, Repair, and Installation Services. This alternative is not recommended because the City would not have a contractor to perform backflow device inspection, repair, and installation services that are vital to complying with the California Department of Health Services regulations.

FISCAL REVIEW
Beginning in Fiscal Year 2024-25, funds will be budgeted in the Public Works Department budget for this contracted service.

LEGAL REVIEW
The City Attorney's Office has reviewed the Maintenance Service Agreement and has approved the document as to form.

CONCLUSION
Staff recommends that the City Council:

1. Award the Maintenance Services Agreement for Citywide Backflow Device Inspection, Repair and Installation to Real Green, Inc. in the not-to-exceed amount of $20,000 per year for Fiscal Years 2024-25 through 2026-27, subject to extension administratively for two additional one-year periods;
