SUBJECT: Update on the City's Legislative Advocacy Efforts
RECOMMENDATION
Staff recommends that the City Council receive and file this update on the City's Legislative Advocacy Efforts.
BACKGROUND
On February 19, 2019, the City Council adopted the City's Legislative Platform. The purpose of the legislative platform is to provide an outline and means for summarizing the City's core legislative principles and positions on legislative matters for the purpose of advocacy efforts at the regional, state, and federal levels. The legislative platform serves as the foundation for the City to support or oppose various state and federal legislation.
The legislative platform was developed to be consistent with and support the City's long- term strategic mission and vision, as well as to maintain the City's Municipal Code.
The Legislative Platform contains "Guiding Principles," which are values that are paramount when determining whether taking action on legislation is required. The Guiding Principles are:
• Preserve and Enhance Local • Support Responsible Funding Control Opportunities
Fiscal Responsibility • Maintain Quality Public Safety
• Promote Economic Development
The Legislative Platform also includes "Policy Statements," which capture positions on issues the City has previously stated concern for or acted upon. These issues include:
• Local Control • Homelessness
• Local Revenue • Public Safety
Fiscal Responsibility and • Sober Living Homes
Sustainability • Air Traffic Noise
Economic Development • • Utilities
• Funding Opportunities • Environment
• Drug Abuse • Local Elections
Since the City Council's adoption of the legislative platform, City Staff has been able to take timely action on legislation and regulatory issues. This has allowed staff to effectively and efficiently communicate the City's positions to legislators and policymakers in Sacramento and Washington D.C. on crucial legislation and regulatory efforts that affect the City and its residents.
ANALYSIS
As we approach the halfway point of the 2024 Legislative Session, it is important to provide an update on the City's legislative advocacy efforts. Staff continues to work collaboratively and diligently with regional and statewide associations to identify bills of interest as outlined in the City's Legislative Platform.
Using the adopted Legislative Platform, 63 proposed bills are currently being tracked (Attachment A). Staff continues to monitor these bills and take advocacy steps when necessary to ensure the City's identified long-term strategic needs and vision are being advocated.
Thus far, in the 2024 legislative session, the City has submitted ten advocacy letters to the state legislator. The letters can be divided into three broad categories: Fentanyl, Public Safety, and Sober Living Homes/Treatment Facilities.
Fentany!
• Assembly Bill 3171 - Controlled Substances: Fentanyl (Support): AB 3171 (Soria) Increases the penalties for selling, distributing, or transporting fentanyl, an analog of fentanyl, or a substance containing fentanyl or an analog of fentanyl if the amount of fentany! weighs more than 28.35 grams.
• Senate Bill 1502 - Controlled Substances: Xylazine (Support): SB 1502 (Ashby) would add xylazine, a substance increasingly found in combination with fentanyl, to the list of Schedule III substances of California's Uniform Controlled Substances Act.
Public Safety
• Assembly Bill 1774 - Vehicles: Electric Bicycles (Support): AB 1774 (Dixon) would prohibit the sale of a product or device that can modify the speed capability of an electric bicycle so that the bicycle no longer meets the definition of an electric bicycle.
• Assembly Bill 2330 - Endangered Species: Incidental Take: Wildfire Preparedness Activities (Support): AB 2330 (Holden) would streamline permits for local agencies to remove vegetation and perform fuel management activities in fire hazard severity zones adjacent to urban communities. • Senate Bill 1461 - State of Emergency and Local Emergency: Landslide (Support): SB 1461 (Allen) adds "landslides to the conditions constituting a state of emergency or a local emergency.
Sober Living Homes/Treatment Facilities
• Assembly Bill 2081 - Substance Abuse: Recovery and Treatment Programs (Support): AB 2081 (Davies) requires an operator of a licensed alcoholism or drug abuse recovery or treatment facility (RTF) or certified alcohol or other drug (AOD) program to disclose on its Internet website if a legal, disciplinary, or other enforcement action has been brought by the Department of Health Care Services (DHCS), whether the RTF or program was determined to be in violation, and must include the date and nature of the violation
• Assembly Bill 2121 - Substance Use Disorder Treatment: Licensing (Support): AB 2121 (Dixon) would additionally require the facility to confirm that it is located more than 300 feet from any alcoholism or drug abuse recovery or treatment facility or any community care facility, as specified, and would require the department to notify in writing the city or the county in which the facility is located of the issuance of a license, as specified.
• Assembly Bill 2574 - Alcoholism or Drug Abuse Recovery or Treatment Programs and Facilities: Disclosures (Support): AB 2574 (Valencia) would require an organization that operates, conducts, owns, or maintains a certified program or a licensed facility to disclose to the department whether the licensee, or a general partner, director, or officer of the licensee owns or has a financial interest in a recovery residence and whether it has contractual relationships with entities that provide recovery services to clients of certified programs or licensed facilities if the entity is not a part of a certified program or a licensed facility. • Senate Bill 913 - Substance Use Disorder Treatment: Facilities (Support): SB 913 (Umberg) would augment state licensing efforts by requiring the Department of Health Care Services to adopt a process that would allow cities to request approval to conduct site visits of unlicensed sober living homes based on the city's reasonable belief that the home is providing one or more nonmedical services requiring licensing and would allow the city attorney to enforce compliance with existing state licensing laws.
• Senate Bill 1334 - Substance Use Disorder Treatment: Licensing (Support):
SB 1334 (Newman) would authorize local jurisdictions to require a use permit or conditional use permit for any recovery residence that services seven or more residents. SB 1334 would also allow local jurisdictions to require recovery residences to be located at least 1,000 feet from another state-licensed alcohol or drug recovery facility or recovery residence.
As the legislative session progresses, staff will continue to take appropriate action on legislation in line with the City's Legislative Platform and will provide similar legislative advocacy effort updates as necessary in the future.
In addition, the City Council on February 20, 2024, adopted Resolution No. 2024-1462, Opposing California Proposition 1 and on April 16, 2024, adopted Resolution No. 2024- 1470 and 2024-1471, opposing ACA 1 and ACA 13, respectively.
