CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: May 21, 2024
SUBJECT: Award of Maintenance Services Agreement to Real Green, Inc. for Citywide Weed Abatement Services
RECOMMENDATION
Staff recommends that the City Council:
1. Award the Maintenance Services Agreement for Citywide Weed Abatement Services to Real Green, Inc. in the not-to-exceed amount of $70,436 per year for Fiscal Years 2024-25 through 2026-27, subject to extension administratively for two additional one-year periods;
2. Approve a not-to-exceed 20% contingency of the total contract in the amount of $14,087 per fiscal year for unforeseen conditions or extra work and authorize the Public Works Director/City Engineer to approve additional work with Real Green Inc. for a total not-to-exceed amount of $84,523 per fiscal year, if needed; and,
3. Authorize the City Manager to execute the Maintenance Services Agreement and future amendments to the agreement for Citywide Weed Abatement Services with Real Green Inc., subject to the City Attorney making non-substantive changes.
BACKGROUND
The City of Laguna Niguel owns and maintains approximately 45 acres of open spaces, within eleven distinct areas. The Orange County Fire Authority (OCFA) regulations stipulate that homes and structures adjacent to open spaces require a defensible space of at least 100 feet for fire protection. In order to comply with these regulations and to maintain the overall aesthetics and benefit for the community, weed abatement is performed in these areas on an annual basis.
Weed abatement is accomplished using several tools, including mechanical mowing, hand removal, and, most recently, goat grazing. Beginning as a pilot program in 2019, goat grazing for weed abatement was conducted on several City open space areas. Due to the success of this pilot, the City will continue to use goat grazing as an optional weed abatement tool within the open spaces adjacent to La Hermosa Park, Reef View Node Park, and Kite Hill.
Contract services play a key role in the delivery of weed abatement in the City's open spaces as they provide access to a service that is efficient, responsive, and available as needed. In support of City Council Goal 3 (Open Space and Environmental Preservation) of the City's adopted Strategic Plan, the Public Works Department requires a weed abatement contractor to maintain the City's open spaces. Maps of the City's weed abatement areas are provided as Attachment "A".
ANALYSIS
In March 2024, staff published a Request for Proposal (RFP), shown as Attachment "B" to identify the most qualified contractor to provide weed abatement services to include goat grazing. The goal of the RFP was to award a qualified contractor to adequately cover the City's needs and respond to requests quickly and efficiently.
The RFP for Citywide Weed Abatement Services requested bidders to furnish base bids for each of the City's weed abatement areas, including pricing for all necessary administration, labor, tools, materials, and equipment necessary to provide the required weed abatement services.
In response to the RFP, four qualified proposals were received. The proposals were evaluated based on the following five criteria: (1) Cost, (2) Completeness of the Proposal, (3) Qualifications & Experience, (4) Quality of Goods and Support Facilities, and (5) the Proposer's Financial Stability. The Proposals Evaluation Summary can be found in Attachment "C". The table below displays the evaluation ranking, contractor and base bid cost and goat grazing cost for all received proposals.
Goat Grazing Total Cost

1 $37,965 $32,471 $70,436

4 Services, Inc.
Pursuant to Laguna Niguel Municipal Code Section 3-6-9, maintenance contracts of an estimated expenditure of $50,000 or more must be awarded based on the responsiveness of the submitted proposals to the RFP, the qualifications and experience of the contractors, and the cost. After thoroughly reviewing the proposals received and based on all relevant factors, staff believe Real Green, Inc. represents the best overall value in providing weed abatement services to the City. Real Green Inc. has provided the City with exceptional service on numerous landscape maintenance contracts over the past decade, including maintenance of the City's wetlands and habitat areas maintenance.
Staff are confident that Real Green, Inc. will continue to provide the City with exceptional service and great value while providing the weed abatement services.
Staff recommends that the City Council award the Maintenance Services Agreements to Real Green, Inc. in the not-to-exceed amount of $70,436 per year for Fiscal Years 2024- 25 through 2026-27, subject to extension administratively for two additional one-year periods. In addition, the Agreement will include a not-to-exceed 20% contingency of the total contract in the value of $14,087 per fiscal year for additional work for a total not-to- exceed amount of $84,523 per fiscal year. The Maintenance Services Agreement with Real Green Inc. can be found in Attachment "D"
ALTERNATIVES CONSIDERED
1. The City Council may direct staff to reject all proposals and rebid the RFP for Citywide Weed Abatement Services. Staff believes that rebidding the RFP will not result in more desirable bids.
2. The City Council may decide not to approve the Maintenance Services Agreement with Real Green, Inc. for Citywide Weed Abatement Services. This alternative is not recommended because Citywide Weed Abatement Services are vital to complying with the Orange County Fire Authority's regulations.
FISCAL REVIEW
Funding for this contracted service has been included in the Fiscal Year 2024-25 Public Works Department budget.
LEGAL REVIEW
The City Attorney's Office has reviewed the Maintenance Service Agreement and has approved the document as to form.
CONCLUSION
Staff recommends that the City Council:
1. Award the Maintenance Services Agreement for Citywide Weed Abatement Services to Real Green, Inc. in the not-to-exceed amount of $70,436 per year for Fiscal Years 2024-25 through 2026-27, subject to extension administratively for two additional one-year periods;
2. Approve a not-to-exceed 20% contingency of the total contract in the amount of $14,087 per fiscal year for unforeseen conditions or extra work and authorize the Public Works Director/City Engineer to approve additional work with Real Green Inc. for a total not-to-exceed amount of $84,523 per fiscal year, if needed; and,
3. Authorize the City Manager to execute the agreement and future amendments to the Maintenance Services Agreement with Real Green Inc., subject to the City Attorney making non-substantive changes.
