CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
TO: Honorable Mayor and Council Members
FROM: Justin J. Martin, Assistant City Manager
DATE: May 21, 2024
SUBJECT: Proposition 218 Public Hearing for Proposed Adjustments to Solid Waste Collection Rates

RECOMMENDATION
Staff recommends that the City Council open the public hearing, take public testimony, close the public hearing, and in the absence of a majority protest, adopt Resolution No. 2024-1474, approving increases to the solid waste collection service rates.

BACKGROUND
Since 2000, the City has had an exclusive Franchise Agreement with CR&R Inc. (CR&R) to provide solid waste collection services to residents and businesses throughout the City.

On November 20, 2018, the City entered into a new Franchise Agreement with CR&R to continue to meet the State of California mandates regarding the diversion of solid waste from landfills. By entering into this new Franchise Agreement, the City was able to take a proactive approach to implementing Senate Bill 1383 organic waste disposal regulations and continue to meet state mandates regarding the diversion of solid waste from landfills.

This approach has served the City well.

On January 1, 2024, the City began the sixth year of the Franchise Agreement. The term of the Franchise Agreement is for a period of ten years through December 31, 2028, with the option of CR&R earning two one-year extensions based on CR&R's program implementation performance standards. CR&R has earned the first of the one-year extension opportunities, and the term of the Franchise Agreement has since been extended until December 31, 2029.

The costs to continue to meet state mandates and to provide solid waste services continue to increase annually, and rate increases are needed to meet the increased costs ensuring reliable and compliant solid waste services. The adopted Franchise Agreement outlines a process to annually adjust rates for inflation. According to the Franchise Agreement, such rates shall become effective following the completion of a Proposition 218 public hearing process, which is contingent upon the City not receiving a majority protest against the rate increase as part of such proceedings.

California Proposition 218 requires the City to conduct a public hearing at a minimum of every five years to continue with the automatic inflation-adjusted rate process, which is further detailed below. The City last conducted a Public Hearing on May 7, 2019, permitting rate adjustments commencing July 1, 2019, with changes scheduled through and including July 1, 2023 - June 30, 2024. Noteworthy is that under this automatic annual inflation adjustments process, rates have experienced both increases and decreases. The most recent rate decrease for residential rates was July 1, 2021.

ANALYSIS
Rate Change Calculations
The Proposition 218 public hearing scheduled for May 21, 2024, proposes that the annual automatic inflation-based rate adjustments continue through July 1, 2028 (Attachment A).

Rates are adjusted annually to account for increased disposal costs, collection costs, and processing costs.
• Disposal costs are adjusted in connection with the per ton cost of the landfill disposal fee charged by the County of Orange and is capped at 12% per year. • Collection costs are adjusted using a weighted distribution of the Producer Price Index (PPI) for Natural Gas and PPI for Finished Goods Less Food and Energy and are capped at a 25% increase or decrease per year.
• Processing costs are adjusted using PPI for Finished Goods based on the annual average percentage change for the prior two years and are capped at a 4% increase. Rate adjustments in the ensuing four years under this public hearing will be adjusted under the same process outlined above.

It is important to note that the cumulative annual inflation adjustments described above do not cause the overall rates to exceed the City's cost of providing solid waste service.

Under the proposed rate adjustment, not all rates will experience an increase. Several rates will remain the same, while others will decrease. Most residential customers will experience an increase between 0.96% and 1.14%, and most commercial generators will experience an increase between 0.50% and 0.70%. In most instances, these rate changes are approximately 30 cents more per month. A complete list of rates is attached as Exhibit 1 to Resolution No. 2024-1474 (Attachment B).

Proposition 218 Public Hearing Process
Proposition 218 requires that the City provide all properties receiving the service for which the fee is charged with a minimum of 45 days written notice prior to the City Council holding a public hearing on the proposed rate increase. On March 29, 2024, Proposition 218 Notices for the proposed solid waste collection service rate increase were mailed to the record owners of parcels and the solid waste collection services ratepayers who are not property owners but are otherwise responsible for paying the solid waste collection service charges. Additionally, the notice provided the time, date and location of the public hearing to be held before the City Council.

The last day of the required 45-day waiting period under Proposition 218 was May 13, 2024, after which the City Council can hold the public hearing. Property owners and solid waste collection services ratepayers have the ability until the closing of the public hearing to "protest" the proposed rate increase. After the public hearing is closed, staff will count the number of protests filed. If a majority of the solid waste customers submit valid protest letters, as described in the public hearing notice, the City Council cannot consider approving the proposed rate increase; otherwise, the City Council may consider adopting Resolution No. 2024-1474, which will approve the rate adjustment and continue to allow the annual rates adjustment through July 1, 2028. Failing to adopt the proposed rate increase without a majority protest by solid waste collection service ratepayers would breach the adopted Franchise Agreement.

ALTERNATIVE CONSIDERED
The City Council may decide not to adopt Resolution No. 2024-174, increasing the solid waste service rates. Staff advises against this alternative, as failing to adopt Resolution No. 2024-1747 without a majority protest would be considered a breach of the Franchise Agreement.

FISCAL REVIEW
The Solid Waste Franchise Agreement with CR&R establishes that the City will receive a fee of five percent of CR&R's gross revenues derived from services provided under the Franchise Agreement (a "Franchise Fee"). The Franchise Fee is utilized to recover the City's costs associated with the administration of the Franchise Agreement and compliance with the California State diversion mandates. The proposed increase in the solid waste services rates will result in a proportionate increase in the Franchise Fee paid to the City. The City has appropriately budgeted the increase in Franchise Fee revenue as part of the Fiscal Year 2024-2025 budget.

LEGAL REVIEW
This report and Resolution No. 2024-1447 were drafted in collaboration with the City Attorney's Office.

CONCLUSION
Staff recommends that the City Council open the public hearing, take public testimony, close the public hearing, and in the absence of a majority protest, adopt Resolution No. 2024-1474, approving increases to the solid waste collection service rates.

NOTICE OF PUBLIC HEARING

PROPOSED ADJUSTMENTS TO SOLID WASTE COLLECTION RATES
The City Council of the City of Laguna Niguel is considering adopting adjustments to the solid waste collection service rates. The City Council will conduct a public hearing to consider adopting such adjustments as follows:

Date & Time: May 21, 2024, 7:00 p.m. or as soon thereafter as the matter may be heard Location: City Council Chambers, 30111 Crown Valley Pkwy, Laguna Niguel, CA 92677 The City Council may adopt the proposed adjustments following the conclusion of the public hearing unless there is a majority protest, as explained below. If adopted, the proposed adjustments will take effect on July 1, 2024. This notice provides information on the proposed adjustments and describes how to protest the proposed adjustments.

REASON FOR THE PROPOSED ADJUSTMENTS TO THE SOLID WASTE COLLECTION

SERVICE RATES
Since 2000, the City has had an exclusive Franchise Agreement with CR&R Inc. (CR&R) to provide solid waste collection services to residents and businesses throughout the City. To continue to meet State of California mandates regarding the diversion of solid waste from landfills, the City entered into a new exclusive Franchise Agreement with CR&R in November 2018. The costs to continue to meet state mandates and to provide solid waste services continue to increase and the proposed rate increases are needed to meet the increased costs ensuring reliable and compliant solid waste services. Since July 1, 2019, the monthly solid waste collection services rates have been automatically adjusted in accordance with the provision outlined in the Franchise Agreement (detailed below).

California Proposition 218 requires the City to conduct a Public Hearing every five years to continue this automatic rate adjustment. The City last conducted a Public Hearing on May 7, 2019, permitting rates commencing July 1, 2019, with increases scheduled through and including July 1, 2023. The Public Hearing scheduled for May 21, 2024, proposes for these adjustments to continue to occur through July 1, 2028.

HOW THE PROPOSED ADJUSTMENTS TO SOLID WASTE SERVICE RATES WERE

CALCULATED
The rate structure for solid waste collection services depends on the type of customer. Single-family residential customers utilize a 3-cart bundle, and the rates are based on the size of the solid waste cart selected by the customer (e.g., 35, 65, or 95 gallon cart). The rates for multi-family residential customers and commercial customers are based on the type of containers) and size of containers) selected by the customer and the frequency of collection per week.

The total rates charged to customers includes three cost components: (i) Disposal Cost, (ii) Collection Cost, and (ili) Processing Costs. Each cost component is subject to annual automatic inflation adjustments as described below. Commencing July 1, 2024, and continuing through July 1, 2028, the rates automatically will be adjusted for inflation as follows: (1) the Disposal Cost component will be adjusted in connection with the per ton cost of the landfill disposal charge ("tipping fee") charged by the county. The annual change is based on a percentage change between the tipping fee on which the current rates are based and the new tipping fee imposed by the county. The annual percentage increase City of Laguna Niguel Notice of Public Hearing Page 2
Proposed Adjustments to Solid Waste Collection Rates
of the tipping fee shall not exceed 12% per year; (2) the Collection Cost component will be adjusted using a combination of the Producer Price Index ("PPI) for Natural Gas (Series ID WPU0531) (weighted at 15% of the current Collection Cost) and the Producer Price Index for Finished Goods Less Food and Energy (Bureau of Labor Statistics Series ID WPUFD4131) (PPI for Finished Goods, weighted at 85% of the current Collection Cost). The annual percentage change is based upon the year over year annual average change in the indexes based upon the two preceding years. In the event the calculated average percentage change in the PPI index is negative, the rate adjustment for the non- fuel portion shall be zero. The fuel portion of rates shall be adjusted based upon the percentage change whether a positive or negative change to be capped at a 25% increase or a -25% decrease; and (3) the Processing Cost component will be adjusted using the PPI for Finished Goods based upon the annual average percentage change for the prior two years. The annual percentage increase shall not exceed 4% and if the percentage change is a negative number there shall be no rate change for that year. The cumulative annual inflation adjustments described above shall not cause the overall rates to exceed the cost of providing solid waste service. A full description of the annual automatic inflation adjustment calculations can be viewed in the CR&R agreement to provide solid waste services available on the City's website at cityoflagunaniguel.org/Franchise-Agreement-w-CRR--112018.

The proposed rate increases are included in Exhibit A. A copy of the complete proposed rate schedule, including optional services, viewed City's website

PROTEST PROCEDURE
At the public hearing, the City Council will hear and consider all objections or protests to the proposed solid waste service rate adjustments. Any property owner or property tenant that is directly responsible for payment of solid waste service rates (each, a "solid waste customer") may submit a written protest against the proposed solid waste service rate adjustments.

To be counted, a written protest must:
1) Identify the solid waste customer;
2) Identify the property, by street address or assessor's parcel number (APN) that the protest concerns;
3) Include the name and signature of the solid waste customer; 4) Clearly state the solid waste customer's opposition to the proposed adjustments; and 5) Be received prior to the conclusion of the public hearing.

A majority protest exists if, at the conclusion of the public hearing, there are written protests submitted (and not withdrawn) by a majority of the solid waste customers. No more than one written protest per parcel of property will be counted in calculating whether a majority protest exists. The City Council cannot adopt the proposed solid waste service rate adjustments if a majority protest exists.

Written protests may be delivered to the City Clerk at the public hearing before the conclusion of the public hearing or may be mailed or personally delivered to the City Clerk at the following address:

A RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA

DECLARING THE RESULTS OF THE PROCEEDINGS FOR APPROVAL

OF THE SOLID WASTE COLLECTION SERVICE RATE INCREASE IN

ACCORDANCE WITH ARTICLE XIII D OF THE CALIFORNIA CONSTITUTION,

INCREASING THE SOLID WASTE SERVICE RATES, AND APPROVAL OF

AUTOMATIC INFLATIONARY ADJUSTMENTS
WHEREAS, the City Council approved a new Solid Waste Franchise Agreement with CR&R, Inc. on November 20, 2018; and,
WHEREAS, the adopted Franchise Agreement with CR&R, Inc., outlines a process to annually adjust rates for inflation; and,
WHEREAS, on May 7, 2019, the City Council conducted a California Proposition 218 Public Hearing and adopted Resolution No. 2019-1284, permitting rate adjustments commencing July 1, 2019, with changes scheduled through and including July 1, 2023; and,
WHEREAS, Article XIII D, Section 6 of the California Constitution (Article XIII D) requires the City Council to consider written protests to the proposed rate increases set forth in Exhibit A attached and incorporated herein by this reference; and, WHEREAS, Article XIII D requires that prior to imposing or increasing any fee, the City shall provide written notice (the "Notice") by mail of the proposed rates to the record owner of each parcel upon which the rates are proposed for imposition and any customer directly liable for the payment of such rates, the amount of the rates proposed, the basis upon which the rates were calculated, the reason for the imposition or increase, and the date, time, and location of a public hearing on the proposed rates; and WHEREAS, pursuant to Article XIlI D, such public notice is required to be provided to the affected property owners and solid waste collection services ratepayers directly liable for the payment of such rates not less than 45 days prior to the public hearing on the proposed rates; and
WHEREAS, the City did provide such notice to the affected property owners and solid waste collection services ratepayers responsible for the proposed rates in compliance with Article XIII D; and
WHEREAS, on May 21, 2024, the City Council held a public hearing to consider the results of protest proceedings conducted in accordance with California Constitution Article XIII D, Section 6(a)(2); and,
WHEREAS, at the public hearing, the City Council considered all oral testimony, written materials, and written protests concerning the imposition of the proposed rates, and at the close of the public hearing, the City did not receive written protests against the approval of the proposed rates from a majority of the affected property owners and solid waste collection services ratepayers; and
WHEREAS, the City Council now desires to approve the proposed rates and authorize automatic annual inflationary rate adjustments commencing July 1, 2024, with changes scheduled through and including July 1, 2028.

NOW, THEREFORE, BE IT RESOLVED THAT:

Section 1. The City Council hereby finds and determines that the above Recitals are true and correct and are incorporated herein.

Section 2. The City Council finds the inflationary adjustments are required to keep pace with the costs of providing sustainable and reliable solid waste collection services, including the ability to comply with continuing State mandated solid waste collection service programs and requirements. And that such rates are not in excess of the reasonable costs of providing such services.

Section 3. The proposed rates described in Exhibit A shall become effective July 1, 2024, and the annual automatic inflationary increases are approved to be implemented each July 1 thereafter, through and including July 1, 2028. The City shall provide, or cause to be provided, written notice each year to property owners and solid waste collection service rate payers who are not property owners but are otherwise responsible for paying the solid waste collection rates, at least thirty (30) days in advance of each annual inflationary increase taking effect.

Section 4. Each cost component (the Disposal Cost, Collection Cost, and Processing Costs) is subject to annual automatic inflation adjustments as described below. Commencing July 1, 2024, and continuing through July 1, 2028, the rates automatically will be adjusted for inflation as follows: (1) the Disposal Cost component will be adjusted in connection with the per ton cost of the landfill disposal charge ("tipping fee") charged by the County of Orange (the "County"). The annual change is based on a using a combination of the Producer Price Index ("PPI") for Natural Gas (Series ID WPU0531) (weighted at 15% of the current Collection Cost) and the Producer Price Index for Finished Goods Less Food and Energy (Bureau of Labor Statistics Series ID WPUFD4131) (PPI for Finished Goods, weighted at 85% of the current Collection Cost).

The annual percentage change is based upon the year over year annual average change in the indexes based upon the two preceding years. In the event the calculated average percentage change in the PPI index is negative, the rate adjustment for the non-fuel portion shall be zero. The fuel portion of rates shall be adjusted based upon the percentage change, whether a positive or negative change to be capped at a 25% increase or a -25% decrease; and (3) the Processing Cost component will be adjusted using the PPI for Finished Goods based upon the annual average percentage change for the prior two years. The annual percentage increase shall not exceed 4%, and if the percentage change is a negative number, there shall be no rate change for that year. The cumulative annual inflation adjustments described above shall not cause the overall rates to exceed the City's cost of providing solid waste service.

Section 5. If any section, subsection, subdivision, sentence, clause, or phrase in this Resolution or any part thereof is for any reason held to be unconstitutional or invalid, ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Resolution or any part thereof. The City Council hereby declares that it would have adopted each section irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses, or phrases be declared unconstitutional, invalid, or ineffective.

Section 6. This Resolution shall supersede any and all provisions of any previous resolution and/or ordinance approved by the City Council that may conflict with, or be contrary to, this Resolution.

Section 7. The City Council finds that the subject activity outlined in this Resolution is not a Project within the meaning of the California Environmental Quality Act ("CEQA") Guidelines, Section 15378, and is therefore not subject to review under CEQA.

Section 8. The City Clerk shall certify the adoption of this Resolution, which shall become effective immediately upon adoption.

PASSED, APPROVED AND ADOPTED this 21st day of May 2024.
