CITY OF LAGUNA NIGUEL

CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
DATE: June 4, 2024
SUBJECT: Adoption of Resolution No. 2024-1475, Adopting a List of Projects for Fiscal Year 2024-25 Funded by SB 1: The Road Repair and Accountability Act of 2017

RECOMMENDATION
Staff recommends that the City Council:

1. Approve the recommended list of projects for Fiscal Year 2024-25 to be funded by SB 1: The Road Repair and Accountability Act of 2017; and,

2. Adopt Resolution No. 2024-1475, Adopting a List of Projects for Fiscal Year 2024- 25 Funded by SB 1: The Road Repair and Accountability Act of 2017.

BACKGROUND
On April 28, 2017, Governor Brown signed Senate Bill 1 (SB 1), also known as the Road Repair and Accountability Act of 2017. SB 1 sets aside per gallon fuel excise taxes, diesel fuel sales taxes, and vehicle registration fees with inflationary adjustments to tax rates in future years to address basic road maintenance, rehabilitation, and critical safety needs on state and local streets.

On November 1, 2017, the State Controller began depositing these funds into the newly created Road Maintenance and Rehabilitation Account (RMRA). Each month, a percentage of the RMRA funds are apportioned by formula to the City for basic road maintenance, rehabilitation, and critical safety projects in Laguna Niguel.

ANALYSIS
Prior to receiving RMRA funding for Fiscal Year 2024-25, the City must submit a list of eligible projects along with a resolution of the adopted project list, as shown in Attachment "A", to the California Transportation Commission (CTC). This list includes the following newly proposed projects that will be partially or fully funded by SB1 funds in Fiscal Year 2024-25:

Page 2 ends

Residential Overlay Program - Construction Phase
Description: To maintain citywide residential roadways per the City's Pavement Management Plan.

Location: Zones 5 and 6 of the City's Residential Annual Resurfacing Program.

Specific sections and limits of roadways will be prioritized and selected during development of the construction plans based on identified needs.

Estimated Useful Life: 15-20 Years
Anticipated Start of Project: December 2024
Anticipated End of Project: May 2025
Traffic Signal Equipment Upgrades Program - Pre-Construction Phase & Construction Phase
Description: To upgrade existing citywide traffic signal infrastructure by replacing antiquated appurtenances including traffic cabinets, signal controllers, battery backups and other components.

Location: Citywide on the MPAH arterial roadways
Estimated Useful Life: 20-30 Years
Anticipated Start of Project: July 2025
Anticipated End of Project: February 2026
The projects support City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan. In addition to the submittal of a project list and resolution, the City will be responsible for the submittal of a project expenditure report to the CTC each fiscal year, and for complying with all requirements, including reporting requirements, for RMRA funding.

ALTERNATIVES CONSIDERED
The City Council may decide not to adopt Resolution No. 2024-1475. This alternative is not recommended as it would result in the City not receiving an apportionment of RMRA funds from the CTC in Fiscal Year 2024-25.

FISCAL REVIEW
The estimated cost of newly proposed projects in Fiscal Year 2024-25 is $450,000. The City will receive an estimated $1,655,877 in RMRA funding in Fiscal Year 2024-25 from SB 1. Any funds expended beyond this year's allocation will be drawn from prior year's SB 1 remaining fund balance.

LEGAL REVIEW
The City Attorney's Office has approved the resolution as to form.
