To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: November 19, 2024
SUBJECT: Approval of Amendment No. 2 to the Professional Services Agreement with LSA Associates, Inc. to Provide Environmental Consulting Services for 25 Old Ranch Road - North Pacific Developments, Inc.
RECOMMENDATION
Staff recommends that the City Council:
1. Approve Amendment No. 2 to the Professional Services Agreement with LSA Associates, Inc. to provide environmental consulting services for 25 Old Ranch Road for an amount not-to-exceed $66,033.30;
2. Approve a not-to-exceed 10% contingency of the total contract with LSA Associates, Inc. in the amount of $6,603.33, if needed;
3. Authorize the City Manager to execute Amendment No. 2 to the Professional Services Agreement and future amendments to the agreement between the City and LSA Associates, Inc., subject to the City Attorney making non-substantive changes; and,
4. Approve a budget appropriation for a pass-through amount of $66,033.30. The costs associated with these services will be paid by the property owner.
BACKGROUND
The Community Development Department is processing a Site Development Permit for North Pacific Developments, Inc., to develop a 12,443 square foot residential project located at 25 Old Ranch Road (Parcel 1 of Parcel Map 81-154), an 11-acre undeveloped hillside property within the Bear Brand Ranch community. The proposal includes District, has a General Plan Land Use designation of Residential Detached (RD) and is adjacent to the City of San Juan Capistrano surrounded by existing residential
development.
In accordance with the California Environmental Quality Act (CEQA) Guidelines, City staff has determined that an Initial Study and Mitigated Negative Declaration would be the appropriate environmental analysis necessary for the subject proposal and that a consultant should be selected to prepare it. Any professional contracts that exceed an amount of $50,000 must be approved by City Council.
ANALYSIS
On August 14, 2024, the City issued a request for proposals (RFP) to the City's list of requalified on-call CEQA consultants. Qualifying proposals were received from the following three (3) firms in response to the RFP:
• Proposal No. 1: LSA Associates, Inc. ($66,033.30)
• Proposal No. 2: Michael Baker International ($82,535.00) • Proposal No. 3: PlaceWorks, Inc. ($77,720.00)
The proposals were evaluated by City staff based on relevant factors, including:
• Qualifications, staffing, and historical knowledge conducting comprehensive environmental analyses for projects within the city;
• Familiarity and experience producing similar work for properties within the subject project's community;
• Quality and clarity of the proposal, including the firm's ability to provide additional relevant information;
• Approach and understanding of the work to be performed as outlined in the RFP; • Cost to provide requested service; and
• Schedule for overall project and time required for each task.
City staff recommends the award of Amendment No. 2 of the Professional Services Agreement for Environmental Consulting services to LSA Associates, Inc. (Attachment "A"). LSA Associates, Inc. was selected based on several key factors. These considerations most notably included: 1) firm's extensive experience preparing environmental documents for similar type projects within the city; 2) projects previously completed by the firm for properties within the distinct community of the subject project; 3) the quality and clarity of the proposal; and 4) firm's comprehensive understanding of the project. In particular, LSA Associates, Inc. completed an environmental analysis for the adjacent property located at 20 Old Ranch Rd. in 2018, and therefore, has extensive knowledge of the community's development within the environmentally sensitive hillside community. Furthermore, LSA completed environmental analyses for the project located at 2 Saint Tropez in the City of Laguna Niguel in 2021, as well as for other similar residential projects in the Cities of Cypress and Redlands, California.
The environmental analysis and documentation for the Initial Study/Mitigated Negative Declaration (IS/MND) are projected to take approximately eight (8) months to complete (including the required public review period) at a cost not to exceed $66,033.30. Based
on City staff's experience, the consultant's schedule and cost estimate are appropriate given the scope of services requested and proposed. The project applicant has been made aware of the proposals received and is in support of City staffs recommendation Once the IS/MND is completed it will be considered along with the project entitlements by the Planning Commission.
Although the selected consultant is one of the approved on-call consultants, the contract exceeds the City Manager's signing authority of $50,000, therefore this item requires approval by the City Council. The proposal, including the scope of work and cost estimate, are detailed in Exhibit "A", of Attachment "A" to this report.
ALTERNATIVES CONSIDERED
The City Council may decide not to approve Amendment No. 2 to the PSA with LSA Associates, Inc. and may select an alternative environmental consultant to perform the requested tasks. However, staff does not believe this action would result in a superior outcome.
FISCAL REVIEW
Associated expenses for LSA Associates, Inc.'s services will be offset by an equal amount of revenue deposited by the applicant resulting in no overall net impact to the City's operating budget. A budget appropriation of $66,033.30 is requested for Fiscal Year 2024-25 for Budget Account No. 100-21-6700 (expense). A corresponding revenue adjustment of $66,033.30 is proposed for Budget Account No. 100-21-3316 (revenue).
LEGAL REVIEW
The City Attorney has reviewed and approved the Amendment and this staff report as to form.
CONCLUSION
Staff recommends that the City Council:
1. Approve Amendment No. 2 to the Professional Services Agreement with LSA Associates, Inc. to provide environmental consulting services for 25 Old Ranch Road for an amount not-to-exceed $66,033.30;
2. Approve a not-to-exceed 10% contingency of the total contract with LSA Associates, Inc. in the amount of $6,603.33, if needed;
3. Authorize the City Manager to execute Amendment No. 2 to the Professional Services Agreement and future amendments to the agreement, between the City and LSA Associates, Inc. subject to the City Attorney making non-substantive changes; and,
4. Approve a budget appropriation for a pass-through amount of $66,033.30. The
costs associated with these services will be paid by the property owner.

RE: 25 Old Ranch Road Project
Dear Kyle,
This letter summarizes LSA's understanding of the project at 25 Old Ranch Road and the tasks necessary to complete the required California Environmental Quality Act (CEQA) documentation. The proposed project is located on an undeveloped 11-acre residential hillside property (project site) in Laguna Niguel. The parcel is within the (RS-1) Residential Single-Family zoning district in the Bear Brand Ranch neighborhood. The proposed project would include site grading and preparation of two pads on which a new custom, 12,443-square-foot single-family home would be built. The proposed project would also include other site improvements, including retaining walls, a driveway, drainage, ard landscaping. It is understood that this project requires discretionary review and approval and is thus subject to CEQA, and an IS/MND has been identified as the appropriate level of environmental clearance for the project. The following provides the scope of work necessary to complete the CEQA documentation for the project.
Task 1.0: 25 Old Ranch Road Project Initiation and Project Description Project initiation tasks will include collecting and reviewing all the information developed for the proposed project, as well as applicable planning and regulatory documents (e.g., City of Laguna Niguel General Plan and Zoning Ordinance). LSA will also request the project application from the Project Applicant. LSA will host a kickoff meeting via teleconference to initiate the project.
LSA will prepare a project description, proposed project components, and required City approvals. A location map and graphics illustrating the project will also be prepared based on materials provided by the Project Applicant. LSA will provide the draft project description to City staff for review and comment and will prepare a final project description.
Deliverable: Kickoff meeting; Draft and final project description.
Task 1.1: Technical Report Sufficiency Review
LSA will review the technical reports supplied by the Project Applicant to confirm they are adequate for use in preparing the IS/MND. Task 2.3.1: Air Quality, Energy, and GHOs
Air Quality
Following the South Coast Air Quality Management District (SCAQMD) CEQA Air Quality Analysis Handbook, LSA will prepare an air quality analysis for the project in response to the Initial Study checklist questions. The air quality analysis will include the following components: (1) an assessment of baseline air quality in the area based on data from the SCAQMD and California Air Resources Board CARB); (2) a quantitative assessment of project construction and operational impacts using th alifornia Emissions Estimator Model (CalEEMod) and based on SCAQMD thresholds of significance (3) a localized significance threshold (LST) analysis to evaluate the potential impacts on nearby sensitive receptors from emissions from both short-term construction activities and long-term on-site operations; (4) based on the anticipated construction activity and the proximity of the nearby residential receptors, LSA will prepare a construction health risk assessment (HRA) that will summarize cancer risk and noncancer risk (chronic and acute) and will compare the results of the HRA with the SCAQMD's recommended thresholds; (5) an assessment of potential odor impacts; and (6) a Energy
LSA will evaluate the proposed project impacts related to energy use in response to the Initial Study checklist questions. LSA will qualitatively evaluate construction-period energy usage. LSA will also estimate operational-related natural gas and electricity consumption using default energy intensities in CalEEMod. Fuel use associated with vehicle trips will be calculated based on the project's trip generation estimates and vehicle fuel consumption data. This discussion will also address the project's compliance with applicable energy efficiency standards.
Greenhouse Gas Emissions
LSA will evaluate the project's impacts on global climate change and greenhouse gas emissions in response to the Initial Study checklist questions. LSA will provide a quantitative assessment of greenhouse gas emissions associated with all relevant sources related to the project for which project data are available, including construction activities, using CalEEMod and based on the SCAQMD'S interim numeric thresholds of significance. LSA will also provide a qualitative assessment of the project's consistency with relevant plans and regulations, adopted for the purpose of reducing greenhouse gas emissions.
Deliverables: Draft and Final Air Quality, Energy, and GHGs Technical Memorandum in Microsoft Word and Adobe Acrobat PDF formats
Task 2.1.2: Biological Resources
