CITY OF LAGUNA NIGUEL
CITY COUNCIL AGENDA ITEM
To: Honorable Mayor and Council Members
FROM: Jonathan Orduna, Community Development Director
DATE: March 4, 2025
SUBJECT: 2024 Housing Element Annual Progress Report (APR)
RECOMMENDATION
Staff recommends that the City Council authorize staff to submit the 2024 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and the Governor's Office of Planning and Research (OPR) by April 1, 2025.
BACKGROUND
State law requires each jurisdiction to prepare and file APRs describing the status and progress in implementing its Housing Element to both HCD and OPR. Specifically, the City must prepare and file the Housing Element APR using forms and definitions adopted by HCD. The 2024 APR must be submitted by April 1, 2025, to HCD and OPR.
The Laguna Niguel General Plan Housing Element, covering the 2021-2029 planning period, was adopted by the City Council on October 19, 2021. Amendments to the Housing Element were adopted at the March 21, 2023, and December 5, 2023, City Council meetings. HCD certified the City's Housing Element on February 22, 2024.
ANALYSIS
The City's Housing Element APR, included in Attachment A, was drafted in accordance with the State's APR form for the 2024 reporting period and accounts for recent state laws. Program highlights include the following:
• Housing development applications submitted (Table A):
• Single-family units: 2 units were submitted and approved in 2024. • Annual building activity reports for new housing units (Table A2):
• Multi-family units: 309 received a certificate of occupancy in 2024.
• Single-family units: 7 received building permits in 2024. • Accessory dwelling units: 6 received building permits, and 8 received a certificate of occupancy in 2024.
• Regional Housing Needs Allocation (RHNA) progress (Table B):
• Very-low income: 5 units were issued building permits. • Moderate income: 2 units were issued building permits. • Above-moderate income: 6 units were issued building permits. • RHNA Allocation by Income Level Status:

• Housing Element Program implementation status including local efforts to remove governmental constraints to the maintenance, improvement, and development of housing (Table D):
Table D includes the status of program implementation for the following six housing programs identified in the February 2024 Certified adopted 2021-2029 Housing Element: Provision of Adequate Housing Sites, Housing for Persons with Special Needs, Affordable Housing Development, Conserve and Improve Existing Low-and Moderate-Income Housing, Affirmatively Furthering Fair Housing, Housing Element Monitoring and Reporting.
ALTERNATIVES CONSIDERED
The City Council may decide not to authorize the submittal of the 2024 Housing Element APR to HCD and OPR by the April 1, 2025 deadline. Opting for this alternative is not recommended because it could expose the City to the risk of losing grant funding, housing element decertification, and potential litigation.
FISCAL REVIEW
There is no fiscal impact as a result of this action.
LEGAL REVIEW
The City Attorney has approved this report to form.
CONCLUSION
Staff recommends that the City Council authorize staff to submit the 2024 Housing Element APR to HCD and OPR by April 1, 2025.
