CITY COUNCIL AGENDA ITEM
Honorable Mayor and Council Members
Jacki Scott, Public Works Director/City Engineer
May 6, 2025
Approval of the Construction and Reimbursement Agreement with Moulton Niguel Water District for the Crown Valley Pipelines Replacement Project

RECOMMENDATION
Staff recommends that the City Council:

1. Approve the Construction and Reimbursement Agreement with Moulton Niguel Water District (MNWD) in the amount of $172,000 for additional paving work on Crown Valley Parkway for the MNWD Crown Valley Pipelines Replacement Project;

2. Authorize the Public Works Director/City Engineer to process change orders for unforeseen conditions in an amount not to exceed 20% of the agreement for $34,400, for a total not-to-exceed amount of $206,400 if needed; and,

3. Authorize the City Manager to execute the Construction and Reimbursement Agreement with Moulton Niguel Water District.

BACKGROUND
The Moulton Niguel Water District (MNWD) Crown Valley Pipelines Replacement Project involves installing approximately 1.75 miles of new dual 12-inch sewer force mains and a 12-inch water transmission main along Crown Valley Parkway within the Cities of Laguna Niguel and Dana Point.

In April 2023, the MNWD Board of Directors awarded a construction contract to T.E.

Roberts to complete the project. Work on the project began in September 2023 and remains on track for completion by June 2025. Public outreach efforts were highly coordinated between MNWD and the City, ensuring timely communication with the community and contributing significantly to the project's overall success.

ANALYSIS
The replacement of the critical water and sewer systems was a major infrastructure effort that affected the northbound and southbound lanes, as well as the median, along Crown Valley Parkway from Hillhurst Drive to Camino Del Avian. As part of the initial project Page2
scope, MNWD planned pavement restoration only in the areas directly impacted by the physical pipeline installation. Over the past several months, City staff collaborated extensively with MNWD to establish the final paving limits for the project, requesting to also include slurry sealing and restriping of the non-impacted area of southbound Crown Valley Parkway between Hillhurst Drive and Club House Drive to meet current standards.

A location map is provided as Attachment "A".

To ensure a seamless restoration along the entire Crown Valley Parkway project corridor, the City requested that MNWD also manage the additional paving and restriping work for the non-impacted area using its contractor, T.E. Roberts, under the current construction contract. This approach is anticipated to streamline efforts, promoting efficiency and result in cost savings. The area shown in blue on the Attachment "A" location map is the non impacted area that MNWD is not required to repave as they did not do any work in that area; however, the City wishes to slurry seal this area so that the condition of the roadway is consistent. The area shown in red on the Attachment "A" location map will be slurry sealed by MNWD as required under their encroachment permit with the City.

Under the terms of the proposed reimbursement agreement, MNWD would oversee the execution of the work through its ongoing contract with T. E. Roberts, while the City would cover the costs associated with the additional paving and restriping, including inspection and testing responsibilities so that MNWD does not incur extra oversight expenses.

MNWD staff is in support of the approach and is recommending that the MNWD Board of Directors approve the reimbursement agreement at its meeting on May 8, 2025.

Pursuant to Laguna Niguel Municipal Code Section 3-6-6, the purchasing officer may authorize the purchase of supplies, equipment, or services for which the city would normally follow its own bid procedures from a vendor who has been awarded by another public agency a contract for the purchase of the same supplies, equipment, or services if said agency utilized procedures substantially the same as those normally utilized by the City in awarding its contract to the vendor. In other words, the City is authorized to procure services through a contractor already selected by another public agency provided that similar procurement procedures were followed.

Staff recommends that the City Council approve the reimbursement agreement with MNWD in the amount of $172,000 for the additional paving work, authorize the Public Works Director/City Engineer to process change orders for unforeseen conditions in an amount not to exceed 20% of the agreement, and authorize the City Manager to execute the reimbursement agreement. The reimbursement agreement is provided as Attachment "B".

Approval of the proposed agreement supports City Council Goal 2 (Fiscal Sustainability) and Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan. This project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines - California Code of Regulations, Chapter 3 (Guidelines for Implementation of CEQA), Article 19 (Categorical Exemptions), Section 15601 (b )(3).

Page3

ALTERNATIVES CONSIDERED
The City Council may decide not to approve the reimbursement agreement and direct staff to manage the additional paving work under a City contract. Staff believes that re advertising the project will not yield lower bids. Additionally, delaying the restoration would result in additional impacts to the community such as a longer construction duration and increased costs due to contractor mobilization.

FISCAL REVIEW
The estimated cost of the non-impacted roadway restoration on Crown Valley Parkway is $172,000. There are sufficient funds in the Fiscal Year 2024-25 Public Works Department Capital Improvement Program budget to cover the reimbursement to MNWD in accordance with the agreement.

LEGAL REVIEW
The City Attorney's Office has reviewed and approved the reimbursement agreement as to form. The reimbursement agreement was also reviewed and approved as to form by MNWD's attorney.

CONCLUSION
Staff recommends that the City Council:

1. Approve the Construction and Reimbursement Agreement with Moulton Niguel Water District (MNWD) in the amount of $172,000 for additional paving work on Crown Valley Parkway for the MNWD Crown Valley Pipelines Replacement Project;
