CITY COUNCIL AGENDA ITEM
Honorable Mayor and Council Members
Jacki Scott, Public Works Director/City Engineer
June 17, 2025
SUBJECT: Orange County Transportation Authority OC Go (Measure M2) Eligibility Package Submittal

RECOMMENDATION
Staff recommends that the City Council:

1. Adopt Resolution No. 2025-1505, adopting a Seven-Year Capital Improvement Program for Fiscal Years 2025-26 through 2031-32 for compliance with the Measure M2 eligibility requirements;

2. Adopt Resolution No. 2025-1506, concerning the status and update of the Circulation Element and Mitigation Fee Program for the City of Laguna Niguel; and,

3. Direct staff to submit the City's OC Go (Measure M2) Eligibility Package to the Orange County Transportation Authority prior to June 30, 2025.

BACKGROUND
In November 2006, Orange County voters approved Measure M2, also known as OC Go, which authorized the 30-year continuation of a one-half percent retail transaction and use tax to fund needed transportation improvements. These programs provide competitive funding for various improvements such as street widening, intersection modification, traffic signal synchronization projects, and environmental cleanup projects. In order to receive OC Go funds from the Orange County Transportation Authority (OCTA), local jurisdictions must comply with the eligibility criteria as summarized below.

Local jurisdictions are required to adopt some or all of the following prior to July 1 of each year in order to continue to be eligible for funding:

1. Seven-Year Capital Improvement Program -Annually ;

2. Maintenance of Effort Certification - Annually;

3. An Eligibility Checklist - Annually;

4. A resolution confirming that the City is in compliance with the Master Plan of Arterial Highways and Mitigation Fee Program - Biennially;

Page 2 ends

5. A Congestion Management Plan Compliance Checklist - Biennially;

6. An Updated Pavement Management Plan - Biennially; and,

7. An Updated Local Signal Synchronization Plan - Every three years As part of this year's submittal package to OCT A, the City is required to submit documentation for items 1, 2, 3, 4, and 5 as listed above. Items 6 and 7 will be required for submittal next year in June 2026.

The City risks losing access to funds from the Comprehensive Transportation Funding Programs and annual OC Go Local Fair Share formula funds if the eligibility requirements are not submitted in a timely manner. Maintaining OC Go eligibility supports City Council Goal 2 (Fiscal Sustainability) and Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.

ANALYSIS
Seven-Year Capital Improvement Program
The City is required to prepare a Seven-Year Capital Improvement Program (CIP) to remain eligible for OC Go funding. This CIP includes all transportation-related projects and programs funded with Comprehensive Transportation Funding Programs (CFTP) and annual OC Go Local Fair Share formula funds. The projects include street widening, intersection modification, traffic signal synchronization projects, and environmental cleanup projects. The purpose of the CIP is to identify intended or potential use of OC Go funds. For each project listed in the CIP, projected funding amounts for design, right-of way, and construction costs are included, where applicable. Some of the projects included in the CIP are the Major Arterial Rehabilitation Program, Bus Shelter Replacement Program, Residential Annual Resurfacing Program, and the Summer Trolley Program.

Staff is recommending adoption of Resolution No. 2025-1505, which identifies transportation-related projects and programs (Attachment "A").

Maintenance of Effort Certification
The purpose of the Maintenance of Effort (MOE) certification is to document and demonstrate that cities continue to spend at least the same amount of General Fund money for the maintenance of local roads and transportation-related streets projects as they did prior to the passage of OC Go. The original MOE benchmark requirement was based upon a historic five-year average of General Fund expenditures from Fiscal Year 1985-86 to Fiscal Year 1989-90. The benchmark requirement is now adjusted once every three years (beginning in 2014) based upon the lesser of the Caltrans Construction Cost Index or general revenue growth for the City over the prior three-year period.

In March 2025, the OCTA Board of Directors approved a benchmark requirement of $990,064 for the City of Laguna Niguel.

Page3
Each June, the City must certify that it will meet its MOE requirement in the upcoming fiscal year. OCTA requests excerpts of the City's budget showing how the MOE benchmark will be met.

The Fiscal Years 2025-27 Public Works Operating and Capital Improvement Program budgets include the following eligible General Fund expenditures in Fiscal Year 2025-26 to satisfy the MOE requirement:

Street Lighting $ 770,250
Street Sweeping $ 349,174
Median Island Maintenance $ 290,000
Fiscal Year 2025-26 Total $ 1,409,424
Based on the above budget amounts, the City can certify that it will meet its MOE benchmark requirement as the Fiscal Year 2025-26 budget of $1,409,424 exceeds the MOE benchmark requirement of $990,064 (Attachment "B").

Master Plan of Arterial Highways (MPAH) and Mitigation Fee Program Every two years, the City must submit a resolution attesting that no unilateral reduction in lanes has been made on any MPAH arterial streets over the last two fiscal years (Fiscal Years 2023-24 and 2024-25). The resolution is designed to ensure that the County's systems of roads remain intact to handle the existing and future traffic volumes. There have been no changes to the number of lanes during the two-year reporting period.

Every two years, the City must submit a resolution certifying that the City has an existing mitigation fee program that assesses traffic impacts of new developments and requires a fair share payment of necessary transportation improvements attributable to the new development.

Staff is recommending adoption of Resolution No. 2025-1506, attesting that no unilateral reduction in lanes has been made on any MPAH arterial streets over the last two fiscal years and reaffirm the City's mitigation fee program (Attachment "C").

Congestion Management Program (CMP) Compliance
The goals of Orange County's Congestion Management Plan (CMP) are to support regional mobility and air quality by reducing traffic congestion and provide a mechanism for coordinating land use and development decisions. Each jurisdiction must comply with conditions and requirements to be considered eligible for funding. Some of the requirements include reviewing Level of Service for roadways, Land Use Analysis and their impacts to transportation systems, and Modeling and Data Consistency guidelines.

Every two years, the City complies with the requirements of the CMP through a checklist submission (Attachment "D"). The checklist confirms that the City of Laguna Niguel conforms to the criteria established by OCTA so that the City can qualify for the allocation of revenues generated from Measure M2.

Page4

ALTERNATIVES CONSIDERED
The City Council may decide not to submit the annual eligibility package. This is not recommended as this alternative would risk the City losing access to OC Go funds including local fair share and grant funding opportunities.

FISCAL REVIEW
The Seven-Year CIP lists several transportation improvement projects. For each improvement project, the primary funding sources are listed. This information can be found in Exhibit A of Attachment "A".

LEGAL REVIEW
The City Attorney's Office has reviewed the resolutions and has approved the resolutions as to form.

CONCLUSION
Staff recommends that the City Council:

1. Adopt Resolution No. 2025-1505, adopting a Seven-Year Capital Improvement Program for Fiscal Years 2025-26 through 2031-32 for compliance with the Measure M2 eligibility requirements;

2. Adopt Resolution No. 2025-1506, concerning the status and update of the Pavement Management Plan for the City of Laguna Niguel; and,

3. Direct staff to submit the City's OC Go (Measure M2) Eligibility Package to the Orange County Transportation Authority prior to June 30, 2025. ~<Mt?f)Juyww
