Adoption of Resolution No. 2025-1507, Adopting a List of Projects for Fiscal Year 2025-26 Funded by SB 1: The Road Repair and Accountability Act of 2017
RECOMMENDATION
Staff recommends that the City Council:
1. Approve the recommended list of projects for Fiscal Year 2025-26 to be funded by SB 1: The Road Repair and Accountability Act of 2017; and,
2. Adopt Resolution No. 2025-1507, Adopting a List of Projects for Fiscal Year 2025- 26 Funded by SB 1: The Road Repair and Accountability Act of 2017.
BACKGROUND
On April 28, 2017, Governor Brown signed Senate Bill 1 (SB 1 ), also known as the Road Repair and Accountability Act of 2017. SB 1 sets aside per gallon fuel excise taxes, diesel fuel sales taxes, and vehicle registration fees with inflationary adjustments to tax rates in future years to address basic road maintenance, rehabilitation, and critical safety needs on state and local streets.
On November 1, 2017, the State Controller began depositing these funds into the newly created Road Maintenance and Rehabilitation Account (RMRA). Each month, a percentage of the RMRA funds are apportioned by formula to the City for basic road maintenance, rehabilitation, and critical safety projects in Laguna Niguel.
ANALYSIS
Prior to receiving RMRA funding for Fiscal Year 2025-26, the City must submit a list of eligible projects along with a resolution of the adopted project list, as shown in Attachment "A", to the California Transportation Commission (CTC). This list includes the following newly proposed projects that will be partially or fully funded by SB1 funds in Fiscal Year 2025-26:

The projects support City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan. In addition to the submittal of a project list and resolution, the City will be responsible for the submittal of a project expenditure report to the CTC each fiscal year, and for complying with all requirements, including reporting requirements, for RMRA funding.
ALTERNATIVES CONSIDERED
The City Council may decide not to adopt Resolution No. 2025-1507. This alternative is not recommended as it would result in the City not receiving an apportionment of RMRA funds from the CTC in Fiscal Year 2025-26 .
FISCAL REVIEW
The estimated cost of newly proposed projects in Fiscal Year 2025-26 is $2,164,083. The City will receive an estimated $1,733,612 in RMRA funding in Fiscal Year 2025-26 from SB 1. Any funds expended beyond this year's allocation will be drawn from prior year's SB 1 remaining fund balance.
LEGAL REVIEW
The City Attorney's Office has approved the resolution as to form.
CONCLUSION
Staff recommends that the City Council:
1. Approve the recommended list of projects for Fiscal Year 2025-26 to be funded by SB 1: The Road Repair and Accountability Act of 2017; and,
2. Adopt Resolution No. 2025-1507, Adopting a List of Projects for Fiscal Year 2025- 26 Funded by SB 1: The Road Repair and Accountability Act of 2017. ~it«w~
