CITY COUNCIL AGENDA ITEM
Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
March 3, 2026 DATE:

SUBJECT: Approval of Final Tract Map No. 17721 and Subdivision Improvement & Maintenance Agreement

RECOMMENDATION
Staff recommends that the City Council:

1. Approve Final Tract Map No. 17721;

2. Accept the dedication of easements for emergency vehicle access, storm drain maintenance access, and Scenic Corridor preservation;

3. Approve the Subdivision Improvement & Maintenance Agreement; and,

4. Find recommended actions are consistent with The Cove at El Niguel Final EIR (SCH No. 2021110122), and require no further CEQA review pursuant to Public Resources Code section 21166 and CEQA Guidelines section 15162.

BACKGROUND
On September 13, 2022, the Planning Commission adopted Resolution No. 22-14 conditionally approving Tentative Tract Map No. 17721 for the development of a 22-unit townhome residential community known as The Cove at El Niguel on a 4.2-acre property located along Crown Valley Parkway at Playa Blanca (Attachment "A").

The proposed residential development is limited to an approximately 2.0-acre pad area along Crown Valley Parkway and is located predominantly outside a landslide buttress area. The remaining approximately 2.2 acres of the site will remain undeveloped. The site is zoned Residential Multi-Family (RM).

The development project includes street and landscape improvements in the public right of-way along Crown Valley Parkway. All public right-of-way improvements will be constructed by the developer, and the landscape improvements installed on the project will be maintained by the private property owner in perpetuity.

Page2
The developer has submitted the Final Tract Map No. 17721 for The Cove at El Niguel in accordance with the Subdivision Map Act and Title 9 of the City's Municipal Code. On the Final Tract Map, the developer has offered easements to the City of Laguna Niguel for emergency vehicle access, storm drain maintenance access, and Scenic Corridor preservation at no cost to the City.

ANALYSIS
Pursuant to section 66458 of the California Government Code, if a final map is found to be in substantial conformance with the conditionally approved tentative map, the Subdivision Map Act, and applicable local ordinances, that the City Council must approve the final map at the meeting in which it is received or at the next regular meeting.

All applicable conditions required prior to recordation of the final map have been satisfied.

Therefore, staff recommends that the City Council approve Final Tract Map No. 17721 and accept the proposed public easement dedications (Attachment "B"). Staff also recommends that the City Council approve the Subdivision Improvement & Maintenance Agreement that specifies the construction and maintenance responsibilities of the developer and property owner (Attachment "C").

The recommended action supports City Council Goal 5 (Economic and Community Development) of the City's adopted Strategic Plan.

CEQA COMPLIANCE
The City of Laguna Niguel, as the lead agency for The Cove at El Niguel project, certified an Environmental Impact Report ("EIR") (SCH# 2021110122), adopted a Mitigation Monitoring and Reporting Program ("MMRP"}, and approved The Cove at El Niguel project on September 13, 2022. The EIR fully analyzed the potential environmental impacts of The Cove at El Niguel (including the impacts associated with the Tentative Tract Map TTM 17721) under CEQA and concluded that all potential environmental effects could be fully mitigated to less than significant levels with implementation of measures outlined in the MMRP. The recommended actions, including approval of Final Tract Map No. 17721 and the Subdivision Improvement & Maintenance Agreement, are consistent with the project and are a contemplated part of the whole of the action that was evaluated in The Cove at El Niguel.

No additional environmental review is necessary for the recommended actions under Public Resources Code section 21166 and CEQA Guidelines section 15162 because none of the conditions set forth in CEQA Guidelines section 15162 exist. The recommended actions do not involve substantial changes to The Cove at El Niguel that would require major revisions to the previously certified EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. Further, there have been no substantial changes in the circumstances under which The Cove at El Niguel was undertaken that would require major revisions to the EIR, and no new information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the EIR was certified, has arisen.

ALTERNATIVES CONSIDERED
The City Council may decide not to approve Final Tract Map No. 17721 or the Subdivision Improvement & Maintenance Agreement. This alternative is not recommended because the final map conforms to all requirements of the Subdivision Map Act of the State of California and the local subdivision ordinance.

FISCAL REVIEW
There is no fiscal impact as a result of the recommended actions. The developer is responsible for all costs associated with the approval of the Final Tract Map No. 17721 and terms of the agreement.

LEGAL REVIEW
The City Attorney's Office has reviewed and approved this report and agreement as to form.

CONCLUSION
Staff recommends that the City Council:

1. Approve Final Tract Map No. 17721;

2. Accept the dedication of easements for emergency vehicle access, storm drain maintenance access, and Scenic Corridor preservation;
