CITY COUNCIL AGENDA ITEM
Honorable Mayor and Council Members
Jonathan Orduna, Community Development Director
March 17, 2026
2025 Housing Element Annual Progress Report (APR)

RECOMMENDATION
Staff recommends that the City Council authorize staff to submit the 2025 Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and the Governor's Office of Land Use and Climate Innovation (LCI) by April 1, 2026.

BACKGROUND
State law requires each jurisdiction to prepare and file APRs describing the status and progress in implementing its Housing Element to both HCD and LCI. Specifically, the City must prepare and file the Housing Element APR using forms and definitions adopted by HCD. The 2025 APR must be submitted by April 1, 2026, to HCD and LCI.

The Laguna Niguel General Plan Housing Element, covering the 2021-2029 planning period, was adopted by the City Council on October 19, 2021. Amendments to the Housing Element were adopted at the March 21, 2023, and December 5, 2023, City Council hearings. HCD certified the City's Housing Element on February 22, 2024.

ANALYSIS
The City's Housing Element APR, included in Attachment A, was drafted in accordance with the State's APR form for the 2025 reporting period and accounts for recent state laws. Program highlights include the following:
• Regional Housing Needs Allocation (RHNA) progress (Table B):

Page2
o RHNA Allocation by Income Level Status:

Affardabmty RHNA RHNA Progress Remaining RHNA
Cate,gor,y Allo·cation (6/30/21-12/31/25) (1 /1 /26-6/30/29) Very Low 348 47 301
Low 202 3 199
Moderate 223 7 216
Above Moderate 434 507 0
• Housing Element Program implementation status including local efforts to remove governmental constraints to the maintenance, improvement, and development of housing (Table D):
o Table D includes the status of program implementation for the following six housing programs identified in the February 2024 Certified adopted 2021- 2029 Housing Element: Provision of Adequate Housing Sites, Housing for Persons with Special Needs, Affordable Housing Development, Conserve and Improve Existing Low- and Moderate-Income Housing, Affirmatively Furthering Fair Housing, Housing Element Monitoring and Reporting.

ALTERNATIVES CONSIDERED
The City Council may decide not to authorize the submittal of the 2025 Housing Element APR to HCD and LCI by the April 1, 2026, deadline. Opting for this alternative is not recommended, as it could expose the City to the risk of losing grant funding, housing element decertification, and potential litigation.

FISCAL REVIEW
There is no fiscal impact as a result of this action

LEGAL REVIEW
The City Attorney has approved this report to form.

CONCLUSION
Staff recommends that the City Council authorize staff to submit the 2025 Housing Element APR to HCD and LCI by April 1, 2026.
