CITY COUNCIL AGENDA ITEM
Honorable Mayor and Council Members
FROM: Jacki Scott, Public Works Director/City Engineer
June 16, 2026 DATE:

SUBJECT: Orange County Transportation Authority OC Go (Measure M2) Eligibility Package Submittal

RECOMMENDATION
Staff recommends that the City Council:

1. Adopt Resolution No. 2026-1529 , adopting a Seven-Year Capital Improvement Program for Fiscal Years 2026-27 through 2032-33 for compliance with the Measure M2 eligibility requirements ;

2. Adopt Resolution No. 2026-1530 , concerning the status and update of the Pavement Management Plan for the City of Laguna Niguel;

3. Adopt Resolution No. 2026-1531 , concerning the update of the Local Signal Synchronization Plan Update for the City of Laguna Niguel; and,

4. Direct staff to submit the City's OC Go (Measure M2) Eligibility Package to the Orange County Transportation Authority prior to June 30, 2026.

BACKGROUND
In November 2006, Orange County voters approved Measure M2, also known as OC Go, which authorized the 30-year continuation of a one-half percent retail transaction and use tax to fund necessary transportation improvements . These programs provide competitive funding for various improvements such as street widening , intersection modification , traffic signal synchronization projects, and environmental cleanup projects. In order to receive OC Go funds from the Orange County Transportation Authority (OCTA), local jurisdictions must comply with the eligibility criteria as summarized below.

Local jurisdictions are required to adopt some or all of the following prior to July 1 of each year in order to continue to be eligible for funding:

1. Seven-Year Capital Improvement Program - Annually;

2. Maintenance of Effort Certification - Annually;
Page2

3. An Eligibility Checklist - Annually;

4. A resolution confirming that the City is in compliance with the Master Plan of Arterial Highways and Mitigation Fee Program - Biennially;

5. A Congestion Management Plan Compliance Checklist - Biennially;

6. An Updated Pavement Management Plan - Biennially; and, -

7. An Updated Local Signal Synchronization Plan - Every three years As part of this year's submittal package to OCTA, the City is required to submit documentation for items 1, 2, 3, 6, and 7 as listed above. Items 4 and 5 will be required for submittal next year in June 2027.

The City risks losing access to funds from the Comprehensive Transportation Funding Programs and annual OC Go Local Fair Share formula funds if the eligibility requirements are not submitted in a timely manner. Maintaining QC Go eligibility supports City Council Goal 2 (Fiscal Sustainability) and Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan.

ANALYSIS
Seven-Year Capital Improvement Program
The City is required to prepare a Seven-Year Capital Improvement Program (CIP) to remain eligible for QC Go funding. This CIP includes all transportation-related projects and programs funded with Comprehensive Transportation Funding Programs (CFTP) and annual OC Go Local Fair Share formula funds. The projects include street widening, intersection modification, traffic signal synchronization projects, and environmental cleanup projects. The purpose of the CIP is to identify intended or potential use of OC Go funds. For each project listed in the CIP, projected funding amounts for design, right-of way, and construction costs are included, where applicable. Some of the projects included in the CIP are the Major Arterial Rehabilitation Program, Bus Shelter Replacement Program, Residential Annual Resurfacing Program, and the Summer Trolley Program.

Staff is recommending adoption of Resolution No. 2026-1529, which identifies transportation-related projects and programs (Attachment "A").

Maintenance of Effort Certification
The purpose of the Maintenance of Effort (MOE) certification is to document and demonstrate that cities continue to spend at least the same amount of General Fund money for the maintenance of local roads and transportation-related streets projects as they did prior to the passage of OC Go. The original MOE benchmark requirement was based upon a historic five-year average of General Fund expenditures from Fiscal Year 1985-86 to Fiscal Year 1989-90. The benchmark requirement is now adjusted once every three years (beginning in 2014) based upon the lesser of the Caltrans Construction Cost Index or general revenue growth for the City over the prior three-year period.

Page3
In March 2026, the OCTA Board of Directors approved a benchmark requirement of $1,182,730 for the City of Laguna Niguel.

Each June, the City must certify that it will meet its MOE requirement in the upcoming fiscal year. OCTA requests excerpts of the City's budget showing how the MOE benchmark will be met.

The Fiscal Years 2025-27 Public Works Operating and Capital Improvement Program budgets include the following eligible General Fund expenditures in Fiscal Year 2026-27 to satisfy the MOE requirement:

Street Lighting $ 770,250
Street Sweeping $ 349,174
Median Island Maintenance $ 298,700
Fiscal Year 2026-27 Total $ 1,418,124
Based on the above budget amounts, the City can certify that it will meet its MOE benchmark requirement as the Fiscal Year 2026-27 budget of $1,418,124 exceeds the MOE benchmark requirement of $1,182,730 (Attachment "B").

Pavement Management Plan (PMP) Update
The City is responsible for the maintenance and repair of approximately 141.5 centerline miles of pavement which includes 37.4 miles of Master Plan of Arterial Highways (MPAH) and 104.1 miles of local streets. In order to maintain City streets in good condition, the Public Works Department developed a Pavement Management Program, a work plan that identifies deficiencies and recommends projects to improve the Pavement Condition Index (PC.I) of City streets, with a goal to bring the citywide PCI up to 80 or greater. The Pavement Management Program supports City Council Goal 4 (Infrastructure and Technology) of the City's adopted Strategic Plan. Benefits of the Pavement Management Program include:
• Improving the Citywide PCI year-over-year
• Satisfying MOE reporting requirements
• Saving money because it costs less to maintain streets in good condition than to repair those that have failed
• Meeting needs of the community
Every two years, the City must update a certified Pavement Management Plan (PMP) that conforms to the criteria established by OCTA including some of the following elements:
• Current status of road pavement conditions
• A seven-year plan for road maintenance and rehabilitation • Projected pavement conditions resulting from proposed improvements • Alternate strategies and estimated costs for future pavement construction projects A summary of the elements above are included in the PMP Final Report. The current Citywide PCI is 78. OCTA requires the City to have its PMP updated on a biennial basis Page4
in order to qualify for the allocation of revenues generated by QC Go. Staff recommends adoption of Resolution No. 2026-1530, which updates the City's PMP (Attachment "C").

A copy of the PMP is available in the City Clerk's Office for review.

Local Signal Synchronization Plan Update
In 2023, the City adopted an update to its Local Signal Synchronization Plan (LSSP) and forwarded the update to OCTA to remain eligible for funding. The updated LSSP conforms to and is consistent with the Regional Signal Synchronization Master Plan. Every three years, the City must adopt an update to its LSSP to comply with the requirements of the OC Go program through the eligibility submission process. The updated plan documents the activities of the City regarding its traffic signal system including signal timing along synchronized streets and reports on the status and performance of signal synchronization activities.

In this update, two corridors (Crown Valley Parkway and Moulton Parkway/Golden Lantern) are nearing completion, three corridors (Alicia Parkway, La Paz Road, and Cabot Road) are in progress, and three corridors (Aliso Creek, Camino Del Avian, and Niguel Road) are eligible for future grant funding.

Staff is recommending adoption of Resolution No. 2026-1531 (Attachment "D"). A copy of the LSSP is available in the City Clerk's Office for review.

ALTERNATIVES CONSIDERED
The City Council may decide not to submit the annual eligibility package. This is not recommended as this alternative would risk the City losing access to QC Go funds including local fair share and grant funding opportunities.

FISCAL REVIEW
The Seven-Year CIP lists several transportation improvement projects. For each improvement project, the primary funding sources are listed. This information can be found in Exhibit A of Attachment "A".

LEGAL REVIEW
The City Attorney's Office has reviewed the resolutions and this report and has approved the documents as to form.
