BACKGROUND
The City of Laguna Niguel is proposing to widen the north side of Crown Valley Parkway to provide one additional westbound through lane between the Interstate 5 (1-5) southbound off-ramp and approximately 100 feet west of the Oso Creek Channel Bridge.

The Project will address traffic flow and congestion issues as well as provide improved pedestrian and traffic safety. The Project will increase vehicle and pedestrian safety and contribute to the sound and sustainable development of the community and public welfare.

The Project will widen the bridge over the Oso Creek Channel and provide a sidewalk over the bridge for pedestrians. The Project will also widen the bridge over the adjacent railroad tracks, and widen Forbes Road south of Crown Valley Parkway to allow for dual left turn lanes onto Crown Valley Parkway.

Additionally, the Project will widen Forbes Road north of Crown Valley Parkway to allow for dual left turn lanes onto Crown Valley Parkway in the northbound and southbound directions. The existing median on Forbes Road will be removed and reconstructed to half its current size, and traffic signal modifications will be made where Crown Valley Parkway intersects with both Forbes Road and the 1-5 southbound off-ramp. A new retaining wall will be constructed between the Forbes Road intersection and the Crown Valley Overhead Bridge, and Crown Valley Parkway will be rehabilitated from the 1-5 southbound off-ramp and Cabot Road. Lastly, a continuous raised median will be constructed along Crown Valley Parkway from Cabot Road to Forbes Road, and the entire width of Crown Valley Parkway will be repaved with a 2-inch grind and overlay.

At the H&S Property, the Project will include widening Forbes Road to allow for dual left turn lanes onto Crown Valley Parkway, removing and reconstructing the existing Forbes Road median to half its current size, installing traffic signals at Forbes Road, and widening of Crown Valley Parkway and repaving the entire width of Crown Valley Parkway with a 2-inch grind and overlay. At the Carpenter Property, the Project will include widening of Crown Valley Parkway and repaving the entire width of Crown Valley Parkway with a 2- inch grind and overlay.

For the H&S Property, the City obtained an appraisal prepared by Stephanie Kavanaugh of CBRE, Inc. to establish the fair market value of the partial fee interest and twelve-month temporary construction easement the City is seeking to acquire. An offer of just Page3
compensation was made to the property owners for the acquisition of the partial fee interest and twelve-month temporary construction easement necessary for the Project on May 1, 2026. This was the latest updated offer and the parties have been in unsuccessful negotiations since an initial offer was made April 30, 2025. The last in person meeting with the property owner was on February 5, 2026.

For the Carpenter Property, the City initially obtained an appraisal prepared by Rick Donahue, MAI of CBRE, Inc., to establish the fair market value of the partial fee interest and a six-month temporary construction easement the City is seeking to acquire. An initial offer of just compensation was made to the property owners for the acquisition of the partial fee interest and a six-month temporary construction easement necessary for the Project on April 17, 2025. The parties have been in unsuccessful negotiations since that date. The City obtained an updated appraisal prepared by Stephanie Kavanaugh of CBRE, Inc., and made an updated offer to the property owners on May 1, 2026. Another updated offer was sent to the property owners on May 11, 2026, based on a further updated appraisal. Although negotiations continue, no agreement has been reached.

Following standard public records and due diligence searches for ownership information, a Notice of the Resolution of Necessity Hearing set for June 16, 2026, was mailed to the property owner, H&S Energy, LLC.

Additionally, following standard public records and due diligence searches for ownership information, a Notice of the Resolution of Necessity Hearing set for June 16, 2026, was mailed to the property owners Eva C. ANALYSIS
California eminent domain law provides that a public entity may not commence an eminent domain proceeding until its body has adopted a Resolution of Necessity, which resolution may only be adopted after the governing body has given each party with an interest in the affected property or the representatives a reasonable opportunity to appear and be heard on the following matters:

1. The public interest and necessity require the proposed property.

2. The project has been planned and located in a manner most compatible with the greatest public good and the least private injury.

3. The property interests to be acquired are necessary for the project.

4. The offer of just compensation has been made to the property owner.

Notices of the hearing were mailed on May 27, 2026, by first class to the property owners in accordance with California Code of Civil Procedure section 1245.235.

The four required findings referenced above are addressed herein.

Eminent Domain Action
The public project relating to the proposed eminent domain action is identified as the Crown Valley Parkway Westbound Widening Project. The Project will address traffic flow and congestion issues as well as provide improved pedestrian and traffic safety. The Project will increase vehicle and pedestrian safety and contribute to the sound and sustainable development of the community and public welfare.

The City obtained appraisals of the affected Properties from CBRE, Inc. Offers of just compensation were then made to the property owners for the acquisition of the Property Interests pursuant to California Government Code section 7267.2.

Litigation guarantees were ordered to determine and confirm the identities of the record owners of the Properties. Following a standard public records and due diligence search for ownership information, a notice of this public hearing was mailed to the affected property owners.

Page 5 ends

The power of eminent domain is used by the City only as a last resort to obtain interests necessary for projects after 1) negotiations have stalled; or 2) the owner has requested that the City proceed directly to eminent domain for tax or other advantages; or 3) the eminent domain process is necessary to clear title to the property. In this case, offers of just compensation were made to the owners for the full Fair Market Value as determined by independent appraisals. California's definition of Fair Market Value is one of the most inclusive definitions in the United States and requires the appraiser to consider the highest and best use of the property and to consider the highest price a willing buyer and seller would agree to. The City's appraisals must use this definition of Fair Market Value.

Since an agreement has not yet been reached with the property owners, it is necessary to proceed with the eminent domain process to meet critical project deadlines. Pursuant to Section 1245.235 of the California Code of Civil Procedure, a notice of this hearing was sent by first class mail on May 27, 2026 to the record owners of both Properties and stated the City's intent to consider the adoption of a resolution, the right of the property owners to appear and be heard, and notice that failure to file a written request to appear may result in a waiver of the right to appear and be heard.

City staff and legal counsel will continue with efforts to negotiate a voluntary acquisition with the owners of both properties.

Description of Properties to be Acquired
H&S Property
The affected Property is located at 25991 Crown Valley Parkway, Laguna Niguel, CA 92677 and is described as Orange County Assessor Parcel Number 636-034-08. The Property consists of .84 acres and is improved with a Chevron gas station, convenience store, and car wash constructed in 1969.

The City intends to acquire a: (1) 6,366 square foot partial fee interest; and (2) 1,724 square foot, twelve-month temporary construction easement, affecting the Property. It is believed the proposed acquisitions will have some impact on the existing improvements on the Property, but can be addressed by mitigation that will result in no damages to the Property as improved. The Property is currently owned by H&S Energy, LLC.

Hearing and Required Findings for H&S Property
The recommended actions of the City Council pertain to the acquisition of a partial fee right of way interest and twelve-month temporary construction easement affecting a portion of the H&S Property. A true and correct copy of the legal definition, legal description, and depiction of the H&S Property Interests sought to be acquired is attached to the Resolution of Necessity 2026-1533 ("Attachment A") as "Exhibit 1 ".

The above-described four required findings for the adoption of a resolution of necessity are addressed as follows:

1. The Public Interest and Necessity Require the Proposed Project Approval of the Resolution of Necessity 2026-1533 to acquire the (1) partial fee right of way interest and (2) twelve-month temporary construction easement serves the public interest and is necessary for completion of the Project. The Project is identified as the Crown Valley Parkway Westbound Widening Project.

The Project will widen the north side of Crown Valley Parkway to provide one additional westbound through lane between the Interstate 5 (1-5) southbound off-ramp and approximately 100 feet west of the Oso Creek Channel Bridge. The Project will widen the bridge over the Oso Creek Channel and provide a sidewalk over the bridge for pedestrians. The Project will also widen the bridge over the adjacent railroad tracks and widen Forbes Road south of Crown Valley Parkway to allow for dual left turn lanes onto Crown Valley Parkway.

Additionally, the Project will widen Forbes Road north of Crown Valley Parkway to allow for dual left turn lanes onto Crown Valley Parkway in the northbound and southbound directions. The existing median on Forbes Road will be removed and reconstructed to half its current size, and traffic signal modifications will be made at the intersections of Crown Valley Parkway with both Forbes Road and the 1-5 Southbound off-ramp. At the H&S Property, the Project will include widening Forbes Road to allow for dual left turn lanes onto Crown Valley Parkway, removing and reconstructing the existing Forbes Road median to half its current size, installing traffic signals at Forbes Road, and widening of Crown Valley Parkway and repaving the entire width of Crown Valley Parkway with a 2- inch grind and overlay.

The Project addresses traffic flow and congestion issues and will provide improved pedestrian and traffic safety. The Project will increase vehicle and pedestrian safety and contribute to the sound and sustainable development of the community and public welfare.

2. The Project is Planned or Located in a Manner That Will be Most Compatible With the Greatest Public Good and the Least Private Injury
The Project has been designed to minimize impacts to the H&S Property. Only what is necessary for the Project is being acquired. Furthermore, the Project is believed to have some impact on the existing improvements on the Property, but can be addressed by mitigation that will result in no damages to the Property as improved, and no occupants will be displaced by the Project. The location of the Project is dictated by the location of the existing right of ways that will be improved by the Project.

3. The Real Property to be Acquired is Necessary for the Proposed Project Acquisition of the partial fee right of way interest and twelve-month temporary construction easement in the H&S Property is necessary for the Project, as the H&S Property abuts Crown Valley Parkway between Oso Creek and the southbound 1-5 off ramp. After conducting an analysis of all available alternative sites, it has been determined that the H&S Property Interests are best suited for the Project and are necessary for the Project. The location of the Project is greatly impacted by the suitability and the location of the existing right of ways that will be improved by the Project.

4. The Offer of Just Compensation Has Been Made
An appraisal was prepared by CBRE, Inc. to establish the fair market value of the partial fee right of way interest and twelve-month temporary construction easement that the City is seeking to acquire. As discussed above, an offer of just compensation was made to the property owners to purchase the partial fee right of way interest and twelve-month temporary construction easement as established by the approved appraisal and as required by Section 7267 .2 of the California Government Code. Although a negotiated settlement may still be possible for the H&S Property Interests, it would be appropriate to commence the procedure to acquire the H&S Property Interests through eminent domain, to ensure that the City has possession of the real property, which is necessary in order for the City to construct the Project.

The assessor parcel number, the party to whom the offer was made, and the date of the offer is provided in the table below.

Hearing and Required Findings for Carpenter Property
The recommended actions of the City Council pertain to the acquisition of a partial fee right of way interest and a six-month temporary construction easement affecting a portion of the Carpenter Property. A true and correct copy of the legal definition, legal description and depiction of the Carpenter Property Interests sought to be acquired is attached to the Resolution of Necessity 2026-1532 ("Attachment B") as "Exhibit 1 ".

The above-described four required findings for the adoption of a resolution of necessity are addressed as follows:

1. The Public Interest and Necessity Require the Proposed Project Approval of the Resolution of Necessity to acquire the (1) partial fee right of way interest and (2) a six-month temporary construction easement serves the public interest and is necessary for completion of the Project. The Project is identified as the Crown Valley Parkway Westbound Widening Project.

The Project has been designed to minimize impacts to the Carpenter Property. Only what is necessary for the Project is being acquired. Furthermore, the Project is not believed to have any impact on the existing improvements on the Carpenter Property, and no occupants will be displaced by the Project. The location of the Project is dictated by the location of the existing right of ways that will be improved by the Project.

Page 9 ends

3. The Real Property to be Acquired is Necessary for the Proposed Project Acquisition of the partial fee right of way interest and a six-month temporary construction easement in the Carpenter Property is necessary for the Project as the Carpenter Property abuts Crown Valley Parkway between Oso Creek and the southbound 1-5 off ramp, and the subject portions of the Carpenter Property are unoccupied. After conducting an analysis of all available alternative sites, it has been determined that the Carpenter Property Interests are best suited for the Project and are necessary for the Project. The location of the Project is greatly impacted by the suitability and the location of the existing right of ways that will be improved by the Project.

4. The Offer of Just Compensation Has Been Made

CEQA ANALYSIS
The City Council, by action on November 15, 2011, adopted Resolution No. 2011-104 7, certifying the Laguna Niguel Gateway Specific Plan Final Program Environmental Impact Report PEIR 11-01 (State Clearing House No. 1998111080), providing CEQA compliance for this Project.

Page 10 ends

ALTERNATIVE CONSIDERED
The City Council may decide not to adopt Resolution Nos. 2026-1532 and 2026-1533.

This alternative is not recommended as it would result in the Project being delayed and, as a result, the City may lose its grant funding.

FISCAL REVIEW
The Fiscal Years 2025-27 Capital Improvement Program Budget includes sufficient funds for the proposed Crown Valley Westbound Widening Project. The total project budget for the Right-of-Way Phase is $3,128,730.

LEGAL REVIEW
The City Attorney's Office has written and approved the resolutions and this report as to form.

TEMPORARY CONSTRUCTION EASEMENT AFFECTING THE
REAL PROPERTY LOCATED AT 26022 CAPE DRIVE, LAGUNA
NIGUEL, ORANGE COUNTY, CALIFORNIA 92677 AND MORE
PARTICULARLY DESCRIBED AS ASSESSOR PARCEL NO. 636-
034-06, FOR THE CROWN VALLEY PARKWAY WESTBOUND

WIDENING PROJECT, IN THE CITY OF LAGUNA NIGUEL,

ORANGE COUNTY, CALIFORNIA
WHEREAS, the City of Laguna Niguel ("City") proposes to acquire a partial fee right of way interest and a six-month temporary construction easement affecting a portion of the property ("Property Interests") located at 26022 Cape Drive, in the City of Laguna Niguel, Orange County, California, 92677, more particularly identified as Assessor Parcel No. 636-034-06 (the "Property"). The Property Interests are being acquired for the Crown Valley Parkway Westbound Widening Project in the City of Laguna Niguel, Orange County, California ("Project"), pursuant to the authority granted to it by Section 37350 of the California Government Code and sections 1240.010,1240.020 and 1240.030 of the California Code of Civil Procedure; and WHEREAS, pursuant to Section 1245.235 of the California Code of Civil Procedure, the City scheduled a public hearing for June 16, 2026, at 7:00 p.m., at the City of Laguna Niguel City Hall, located at 30111 Crown Valley Parkway, Laguna Niguel, California, and gave to each person whose property is to be acquired and whose name and address appears on the last equalized county assessment roll, notice and a reasonable opportunity to appear at said hearing and be heard on the matters referred to in Section 1240.030 of the California Code of Civil Procedure; and WHEREAS, said hearing has been held by the City and each person whose property is to be acquired by eminent domain was afforded the opportunity to be heard on said matters; and
WHEREAS, the City may now adopt a resolution of necessity pursuant to Section 1240.040 of the California Code of Civil Procedure.

NOW, THEREFORE, THE CITY DOES HEREBY RESOLVE AND DECLARE AS FOLLOWS:

SECTION 1. Compliance with California Code of Civil Procedure and California Environmental Quality Act. There has been compliance by the CITY with the requirements of Section 1245.235 of the California Code of Civil Procedure and the California Environmental Quality Act ("CEQA").

Page 2 ends

SECTION 2. Public Use. The public use for which the Property Interests are to be acquired is for the Crown Valley Parkway Westbound Widening Project, which will widen the north side of Crown Valley Parkway to provide one additional westbound through lane between Interstate 5 (l-5) southbound off-ramp and approximately 100 feet west of Oso Creek Channel Bridge, in the City of Laguna Niguel, Orange County, California. The Project will also provide double left turn lanes on Forbes Road north and south of Crown Valley Parkway. Section 37350 of the California Government Code authorizes the City to acquire by eminent domain real property necessary for such purposes.

SECTION 3. Description of Property. Attached and marked as Exhibit 1 are the legal definition, legal description and depiction of the Property Interests to be acquired by the City, which describes the general location and extent of the Property Interests to be acquired with sufficient detail for reasonable identification. The temporary construction easement shall be exercised for a period of six consecutive months, beginning no fewer than three days after the date the City provides written notice of commencement of possession and use of the temporary construction easement to the property owner(s).

The duration of the rights under the temporary construction easement shall not extend beyond six consecutive months, or upon the filing of a Notice of Completion, whichever is earlier.

SECTION 4. Findings. The City hereby finds and determines each of the following:
(a) The public interest and necessity require the proposed Project; (b) The proposed Project is planned or located in the manner that will be most compatible with the greatest public good and least private injury;
(c) The partial fee interest and a six-month temporary construction easement described in Exhibit 1 are necessary for the proposed Project;
(d) The offer required by section 7267.2 of the California Government Code was made.

SECTION 5. Use Not Unreasonably Interfering with Existing Public Use. Some or all of the real property to be acquired may be subject to easements and rights-of-way appropriated to existing public uses. The legal descriptions of these easements and rights-of-way are on file with the City and describe the general location and extent of the easements and rights-of-way with sufficient detail for reasonable identification. In the event the herein described use or uses will not unreasonably interfere with or impair the continuance of the public use as it now exists or may reasonably be expected to exist in the future, counsel for the City is authorized to acquire the easement interest subject to such existing public uses pursuant to section 1240.510 of the California Code of Civil Procedure.

SECTION 6. More Necessary Public Use. Some or all of the real property to be acquired may be subject to easements and rights-of-way appropriated to ~xisting public Resolution No. 2026-1532

uses. To the extent that the herein described use or uses will unreasonably interfere with or impair the continuance of the public use as it now exists or may reasonably be expected to exist in the future, the City finds and determines that the herein described use or uses are more necessary than said existing public use. Counsel for the City is authorized to acquire the real property appropriated to such existing public uses pursuant to section 1240.610 of the California Code of Civil Procedure. Staff is further authorized to make such improvements to the real property being acquired that it determines is reasonably necessary to mitigate any adverse impact upon the existing public use.

SECTION 7. Further Activities. Counsel for the City is hereby authorized to file legal proceedings necessary to acquire the hereinabove described real property in the name of and on behalf of the City by eminent domain, and counsel is authorized to institute and prosecute such legal proceedings as may be required in connection therewith.

Legal counsel is further authorized to take such steps as may be authorized and required by law, and to make such security deposits as may be required by order of court, to permit the City to take possession of and use said real property at the earliest possible time. Counsel is further authorized to correct any errors or to make or agree to non-material changes in the legal description of the real property that are deemed necessary for the conduct of the condemnation action or other proceedings or transactions required to acquire the subject real property. Counsel is further authorized to take any steps necessary to legally reduce the extent of the interests or property to be acquired where necessary and as requested by the City.

SECTION 8. Effective Date. This Resolution shall take effect immediately upon adoption.

PASSED, APPROVED AND ADOPTED this 16th day June, 2026.
