CITY COUNCIL AGENDA ITEM
Honorable Mayor and Council Members
Jonathan Orduna, Community Development Director
September 15, 2026
Authorization to Submit the 2025-2026 Community Development Block Grant Consolidated Annual Performance and Evaluation Report to the U.S Department of Housing and Urban Development

RECOMMENDATION
Staff recommends that the City Council authorize staff to submit the Community Development Block Grant (CDBG) Program Year 2025-2026 Consolidated Annual Performance and Evaluation Report (CAPER) to the U.S Department of Housing and Urban Development (HUD).

BACKGROUND
At the conclusion of each CDBG program year, HUD requires the City to prepare and submit a CAPER for the prior year's CDBG program. The report summarizes the use of program year funds and documents related achievements. HUD uses the report to assess the City's ability to carry out its program in compliance with applicable regulations and requirements. The data is also reported to Congress.

The Community Development Department administers the City's CDBG program, including preparing and submitting the CAPER.

ANALYSIS
The City of Laguna Niguel received a CDBG allocation of $350,812 from HUD for FY 2025-2026. An additional $44,417 in prior-year CDBG funds was also available for programming during FY 2025-2026.

In compliance with HUD regulations, staff has prepared the Program Year 2025-2026 CAPER, provided as Attachment "A," detailing the City's CDBG accomplishments for the July 1, 2025, to June 30, 2026 reporting period. Highlights include the following:
• City-funded public service providers assisted 1,502 lower-income Laguna Niguel residents through senior, youth, healthcare, and homeless prevention services. l;
Page2
• Four CDBG-funded capital improvement projects were undertaken during the reporting period. Three projects were completed, and one remains underway:
o Accessible Pedestrian Signal (APS) Pushbuttons (FY 2024-2025 project):

APS Pushbuttons were installed at five locations. The project was completed during the reporting period.
o Accessible Pedestrian Signal (APS) Pushbuttons (FY 2025-2026 project):

APS Pushbuttons were installed at six locations. The project was completed during the reporting period.,
o ADA Sidewalk and Ramp Improvements (FY 2024-2025 project): Sixteen sidewalk curb ramps were reconstructed in the National Park and Flying Cloud areas to comply with ADA requirements. The project was completed during the reporting period.
o ADA Sidewalk and Ramp Improvements (FY 2025-2026 project): The project includes reconstructing 16 sidewalk curb ramps in the Niguel Coast and Quissett Bay areas to comply with ADA requirements. Construction began in May 2026 and is scheduled for completion in November 2026.

Project accomplishments will be reported in the next reporting period. • Fair Housing Council of Orange County assisted 105 Laguna Niguel households through fair housing education and enforcement services. , • HUD's Housing Choice Voucher Program, administered by the Orange County Housing Authority, provided rental assistance to 93 lower-income Laguna Niguel households.

To comply with HUD's 15-day public review requirement, a notice announcing the availability of the Draft Program Year 2025-2026 CAPER was published in the Laguna Niguel News and posted at City facilities and on the City's website on August 27, 2026.

To date, staff has not received any comments.

ALTERNATIVES CONSIDERED
The City Council may decide not to authorize submission of the CAPER to HUD. This action could prevent the City from receiving future CDBG funding until the required documents are adopted and submitted to HUD for review and approval.

FISCAL REVIEW
CDBG funds are disbursed to the City by the Federal Government on a reimbursement basis.

LEGAL REVIEW
The City Attorney's Office has reviewed and approved this report as to form.

Progress the jurisdiction has made in carrying out its strategic plan and its action plan. 9L520(a)
The 2025-2026 Consolidated Annual Performance and Evaluation Report (CAPER) has been prepared to assist residents of the City of Laguna Niguel and the U.S. Department of Housing and Urban Development (HUD) in assessing the City's use of federal grant funds to meet priority housing and community needs identified in the City's 2025-2029 Consolidated Plan. The CAPER for Fiscal Year (FY) 2025-2026 provides an overview of the City's accomplishments from July 1, 2025, through June 30, 2026, utilizing federal Community Development Block Grant (CDBG) funds.

The 2025-2026 reporting period is the first year of the City's 2025-2029 Consolidated Plan cycle. The 2025-2026 Annual Action Plan outlined an expenditure plan for the City's CDBG funds - an FY 2025-2026 allocation of $350,812 plus $44,417 in prior-year CDBG funds. The Action Plan identified activities to be carried out during the reporting period utilizing CDBG funds, including public facilities improvements, public service grants, and program administration (including fair housing services).

The Consolidated Plan established the following five-year goals:
• Infrastructure and Facility Improvements: Improve public infrastructure and facilities that benefit 8,000 low and moderate-income Laguna Niguel residents • Housing-related Programs: Improve or expand the supply of housing affordable for lower income households by assisting 12 housing units
• Public Services: Provide access to public social services for 8,000 low and moderate-income Laguna Niguel residents
• Homeless Continuum of Care: Provide access to housing and supportive services for 1,125 • residents or persons with ties to Laguna Niguel who are at risk of homelessness or who are experiencing homelessness
• Administration and Planning: Provide CDBG program oversight and coordination, and fair housing services to 500 individuals
Table 1 illustrates the City's progress in meeting the one-year goals and objectives delineated in the 2025-2026 Annual Action Plan and the Consolidated Plan's Five-year goals. Attachment 1 provides detailed expenditure and accomplishment information.

Pursuant to the CARES Act of 2020, the City received $551,531 in c·DBG-Coronavirus (CDBG-CV) funds in 2020. CDBG-CV funds supported activities that prevented, prepared for, or responded to local impacts of the COVID-19 pandemic. Through the end of FY 2025-2026, the City had expended 99.89 percent of its CDBG-CV allocation. No activities were carried out during the FY 2025-2026 reporting period, and $609.35 remained unspent. The grant is slated to end in Fall 2026.

Narrative
According to the U.S. Census Bureau, most Laguna Niguel residents are White - 67.4 percent (2024 American Community Survey 5-Year Estimates). This data source reports that 14.7 percent of the City's population is Hispanic/Latino, and 11.3 percent is Asian (the City's two largest minority populations).

Based on Table 2, approximately 64.0 percent of CDBG-funded program participants are White, and a significant number of assisted individuals are Hispanic/Latino (44.3 percent) and Asian (3.6 percent). A closer look at the accomplishment data for individual activities provides additional insights. Among safety net programs such as health care and emergency housing assistance programs, approximately 40 percent of program beneficiaries are lower-income Hispanic/Latino households, consistent with current City demographics. This data indicates that these households may be economically unstable and seek services to help stabilize their financial situation. This is consistent with the Consolidated Plan Needs Assessment findings, which found that many lower-income Hispanic/Latino households are housing cost-burdened, i.e., spending a significant portion of their income on housing, leaving little for other necessities such as food, healthcare, and childcare.

The City leveraged CDBG funds with other resources whenever possible. During the FY 2025-2026 reporting period, $222,518 in State of California Permanent Local Housing Allocation Program (PLHA) funds supported an array of supportive services and housing progral')'ls for homeless households, households at risk of becoming homeless, and disabled homeowners. (This amount includes administration expenditures of $9,125.) During the reporting period, PLHA funds assisted 707 individuals. Services included homeless outreach services, emergency food, emergency utility and rent assistance, and housing rehabilitation grants for two disabled homeowners.

Discuss the difference between goals and outcomes and problems encountered in meeting these goals.

The City did not utilize CDBG funds to rehabilitate housing during the reporting period; however, the City supported the Orange County Housing Authority's Housing Choice Voucher program and used other tools to support affordable housing development. During the 2025-2026 reporting period, the OCHA assisted 93 very low-income Laguna Niguel renter households with rental assistance: 17 families, 19 disabled, and 57 elderly households. Additionally, State PLHA funds were used to rehabilitate two owner-occupied homes. These resources were used consistently with the City's Annual Action Plan.

Discuss how these outcomes will impact future annual action plans.

Include the number of extremely low-income, low-income, and moderate-income persons served by each activity where information on income by family size is required to determine the eligibility of the activity.

Reaching out to homeless persons (especially unsheltered persons) and assessing their individual needs
The City did not use CDBG funds during the 2025-2026 reporting period to carry out homeless outreach; however, the City funded homeless outreach and engagement services with PLHA funds. The City's Homeless Outreach Worker engaged and assessed unsheltered individuals, provided referrals, supportive services, housing navigation, and other interventions to 114 individuals. The City also allocated PLHA funds for the OC Sheriff Department (OCSD) Homeless Liaison Officer. OCSD engaged over 100 homeless individuals during the reporting period.

The City also partnered with regional homeless service providers, such as Family Assistance Ministries (FAM) and South County Outreach (SCO), which have established outreach programs that engage homeless families with children throughout the region.

Addressing the emergency shelter and transitional housing needs of homeless persons The City did not use CDBG funds to provide or directly support emergency shelter or transitional housing for persons experiencing homelessness.

Helping low-income individuals and families avoid becoming homeless, especially extremely low-income individuals and families and those who are: likely to become homeless after being discharged from publicly funded institutions and systems of care (such as health care facilities, mental health facilities, foster care and other youth facilities, and corrections programs and institutions); and, receiving assistance from public or private agencies that address housing, health, social services, employment, education, or youth needs A portion of the City's CDBG public service grant funds was allocated to assist Laguna Niguel households at risk of homelessness. During FY 2025-2026, the City allocated funding for FAM and SCO. • FAM: Assisted 10 lower-income residents with case management and food; three residents also received financial assistance to pre.vent the loss of utilities or housing. FAM also received PLHA funding, which it used to assist 456 Laguna Niguel residents with case management and supportive services such as food, workforce training, and referrals. Eight of these residents benefited from financial assistance to prevent the loss of housing or critical utility services. • SCO: Assisted five lower-income residents with case management, food, and financial assistance to prevent the loss of utilities or housing. SCO also used PLHA funding to assist 23 Laguna Niguel residents who were at risk of losing shelter or critical utility services.

Laguna Niguel's Consolidated Plan homeless strategy indicates that the City will support "safety net" services to prevent homelessness or assist persons experiencing homelessness. As outlined above, the City funded its Homeless Outreach program and the OCSD Homeless Liaison Officer with PLHA resources. These programs offer support services, referrals, housing navigation services, and other interventions to address homeless issues throughout the community.

The Orange County Housing Authority reports that it provided 93 low-income Laguna Niguel renter households with rental assistance during the reporting period. This assistance included vouchers for seven formerly homeless households and 13 veteran households, the latter via the Veterans Affairs Supportive Housing (VASH) program for homeless, disabled veterans. Additionally, nine households received rental assistance via the Emergency Housing Voucher (EHV) program, which targets housing assistance to households that are homeless, at risk of becoming homeless, or are fleeing domestic violence, stalking, or human trafficking.

Actions taken to remove or ameliorate the negative effects of public_ policies that serve as • barriers to affordable housing such as land use controls, tax policies affecting land, zoning ordinances, building codes, fees and charges, growth limitations, and policies affecting the return on residential investment. 91.220 (j); 91.320 (i) Constraints to providing adequate and affordable housing primarily result from market and regulatory factors. These constraints may result in housing that is not affordable to low- and moderate-income households or may render residential construction economically infeasible for developers. Constraints on housing production significantly impact households with low or moderate incomes or special needs.

The City of Laguna Niguel works to remove barriers to affordable housing by implementing its Housing Element, which is consistent with California law. The Housing Element identifies actions to reduce housing development costs via incentives that help produce safe, high-quality, affordable housing. - The City is committed to removing governmental constraints that hinder housing production and offers a one-stop streamlined permitting process to facilitate efficient entitlement and building permit processing. The City of Laguna Niguel reviews proposed fee increases for permits and applications to assess the impact on producing new housing units and/or rehabilitating existing units. The City considers fee waivers for projects that promote housing priorities identified in the Housing Element and Consolidated Plan. Several recently approved apartment complexes received density bonuses to provide five to ten percent of units to very low or low-income households. No projects were initiated or completed during the reporting period that took advantage of these incentives.

Actions taken to address obstacles to meeting underserved needs. 91.220(k); 91.320(j) Obstacles to addressing underserved needs include a lack of funding for constructing affordable housing and se_nior housing. Laguna Niguel does not qualify to receive HOME funds, which can be used to create affordable housing. To overcome these obstacles, the City has adopted State density bonus provisions.

The City has also adopted additional incentives to develop affordable housing in the Gateway Specific Plan; however, as indicated above, no new rental housing units were constructed via these incentive programs during the reporting period. During the past three years, PLHA funds have been allocated to community-based housing nonprofits to rehabilitate the primary residence of lower-income disabled homeowners. Two units were rehabilitated during the reporting period.

Actions taken to reduce lead-based paint hazards. 91.220(k); 91.320(j) The majority of Laguna Niguel's housing stock was built after 1985. Consequently, the housing stock does not contain a significant number of housing units with potential lead-based paint (LBP) hazards.

According to HUD data, approximately 3,195 "pre-1980
11 units in Laguna Niguel that children occupy may
contain LBP. (Children under five are most vulnerable to the health hazards of LBP.) The City supports HUD and EPA efforts to disseminate public information on the health hazards of LBP.

CAPER 2025-2026
0MB Control No: 2506-0117 (exp. 09/30/2021) Draft 8/28/26 13 Actions taken to reduce the number of poverty-level families. 91.220(k); 91.320(j) According to the U.S. Census Bureau, approximately 6.4 percent of Laguna Niguel residents have incomes below the poverty level; this includes roughly 6.3 percent of City residents aged 65 and older and 7.5 percent of children under 18. [ll
The City implements its anti-poverty strategy through economic development and job training programs. Specifically, the City supports service agencies that provide employment training for low- and moderate-income residents. For example, the City provides referrals to the County of Orange for CalWorks and the Orange County Workforce Investment Board.

During the 2025-2026 reporting period, CDBG funding was allocated to provide safety-net services for residents to assist lower-income and at-risk residents. Supported services include Meals on Wheels for seniors, reduced-cost childcare for low-income families, employment placement services for adults with intellectual and developmental disabilities, and homelessness prevention assistance (e.g., food bank, rent/utility assistance) for lower-income near-homeless households. [1. POVERTY STATUS IN THE PAST 12 MONTHS, 2024 American Community Survey 5-Year Estimates, S1701.] Actions taken to develop institutional structure. 91.220(k); 91.320(j) The City relies on various approaches to overcome institutional structure gaps and enhance service delivery coordination. The Community Development Department, as the lead agency, met with various City departments and outside agencies to gather input on community needs, improve service coordination, prevent service duplication, and resolve issues within the interagency institutional structure. The City monitors subrecipients to ensure accountability and productivity and to recommend adjustments as necessary. The City supported OCHA's administration of the federal rental assistance voucher and certificate program.

Actions taken to enhance coordination between public and private housing and social service agencies. 91.220(k); 91.320(j)
The City is developing and revitalizing its Gateway Area to increase economic development within the district and develop affordable housing. The City's Consolidated Plan goals, programs, and policies align with the affordable housing plan in the City's General Plan Housing Element. As indicated above, the City coordinates with the OCHA on housing activities through participation in the OCHA Advisory Committee.

For example, during the program year, the City provided a "Certification of Consistency" for OCHA's five year PHA Plan. The City also provides up to 15 percent of its annual CDBG allocation to various social service agencies.

Identify actions taken to overcome the effects of any impediments identified in the jurisdictions analysis of impediments to fair housing choice. 91.520(a) Consolidated Plan regulations require CDBG recipients to (1) examine and attempt to alleviate housing discrimination within their jurisdiction; (2) promote fair housing choice for all persons; (3) provide CAPER 2025-2026

The QC-Assessment Fair Housing (OC-AFH) is the primary document for this purpose.

Attachment 3 provides an overview of the City's steps to address fair housing impediments during the FY 2025-2026 reporting period. The City implemented these actions with assistance from the Fair Housing Council of Orange County.

0MB Control No: 2506-0117 (exp. 09/30/2021) Draft 8/28/26 15 CR-40 - Monitoring 91.220 and 91.230
Describe the standards and procedures used to monitor activities carried out in furtherance of the plan and used to ensure long-term compliance with requirements of the programs involved, including minority business outreach and the comprehensive planning requirements
Action Plan activities are monitored to ensure the City meets its CDBG program objectives. The City successfully implemented CDBG administrative requirements to stay within the 20 percent administrative cap. Similarly, the City limited public service expenditures to the 15 percent cap. The Community Development and Finance departments continued to improve documentation procedures to meet compliance requirements.

The City conducts on-site monitoring of sub-recipients biennially unless program or administrative issues are identified or the grant recipient is new to CDBG. The City last conducted on-site monitoring during the FY 2024-2025 reporting period. In general, subrecipients complied with program requirements.

Some programs did not meet planned performance goals. The next monitoring is anticipated to be conducted in FY 2026-2027.

The City did not hinder the implementation of the Consolidated Plan through action or willful inaction.

The City made every effort to implement quality programs and complete projects within estimated time frames.

Citizen Participation Plan 91.l0S(d); 91.HS(d)
Describe the efforts to provide citizens with reasonable notice and an opportunity to comment on performance reports.

The 2025-2026 CAPER was made available for public comment for fifteen days, from August 28, 2026, through September 11, 2026, as required by HUD regulations. A copy of the CAPER was available for in person review at the Laguna Niguel City Hall (Community Development Department) and on the City's website. Public notice of the CAPER's availability was published on August 27, 2026. A copy of the proof of publication for the notice and a summary of public comments are provided in Attachment 4. The CAPER was presented to the City Council at its September 15, 2026, meeting. The public was notified and invited to attend the meeting and provide additional comments.

0MB Control No: 2506-0117 (exp. 09/30/2021) Draft 8/28/26 16 CR-45 - CDBG 91.520(c)
Specify the nature of, and reasons for, any changes in the jurisdiction's program objectives and indications of how the jurisdiction would change its programs as a result of its experiences.

The City made no administrative or substantial amendments to the FY 2025-2026 Annual Action Plan or the Consolidated Plan during the reporting period.

Broadband Access
According to Broadband Now.com, broadband internet service is available in 99.8 percent of the City.

Cox Communications' broadband service covers 99.8 percent of the City; AT&T Internet provides fiber optic cable to 84.7 percent of Laguna Niguel properties. Additional providers offer satellite or 5G-based broadband service. Most broadband service providers in Orange County participated in the Affordable Connectivity Program (ACP); however, program funds have been exhausted as of February 2024. The ACP provided eligible households with a $30 discount on monthly broadband internet service. Without program reauthorization, most broadband providers continue to offer reduced-cost service to qualified low-income households. Cox offers Internet service to qualified households for $9.95 per month. AT& T's Access program provides basic broadband internet service for low-income families for $30 per month.

The City also encourages developers and property owners to incorporate broadband infrastructure into new or substantially rehabilitated housing projects, especially affordable housing projects.

Hazard Mitigation
The Local Hazard Mitigation Plan (LHMP) is a comprehensive plan that assesses local capabilities against impacts from natural and man-made threats and hazards and identifies actions (mitigation measures) that may help reduce or eliminate these impacts. The LHMP considers various threats and hazards, as well as how climate change may increase the community's risk level. Hazards considered include wildfires, earthquakes, flooding, droughts, windstorms, and infectious diseases. The plan also considers man-made threats such as energy, technology, and civil disturbance. The LHMP identifies several plans, programs, and policies that can help mitigate the impacts of hazards and threats to the community. The policies include enforcing various building codes, implementing plans (e.g., the General Plan and specific plans), and programs (e.g., Vegetation Management Maintenance Guidelines and the Weed Abatement Program). The LHMP does not explicitly assess the impacts of climate change on lower-income residents of Laguna Niguel. However, the plan has been developed to reduce or eliminate the long-term risk to the life and property of all residents, regardless of income status. The City Council adopted the LHMP in September 2023.
