Amendment No. 2 to On-call Services Agreement with Ak Security Alarm, LLC. for Minor Construction and Repair Services.
Approve and authorize the City Manager to execute Amendment No. 2 to the Agreement for On-Call Services with AK Security Alarm, LLC. for minor construction and repair services in an amount not to exceed $550,000.00 per fiscal year in such final form as approved by the City Attorney.
REPORT TO CITY COUNCIL
To:Honorable Mayor and Members of the City Council
From:Jason Simpson, City Manager
Prepared by:Shannon Buckley, Assistant City Manager
Date:July 9, 2024
Subject:Amendment No. 2 to On-call Services Agreement with Ak Security Alarm, LLC. for Minor Construction and Repair Services.
Recommendation
Approve and authorize the City Manager to execute Amendment No. 2 to the Agreement for On- Call Services with AK Security Alarm, LLC. for minor construction and repair services in an amount not to exceed $550,000.00 per fiscal year in such final form as approved by the City Attorney.
Background
On August 8, 2022, the City prepared a request for proposals for On-Call minor construction and repair services. On September 13, 2022, the City Council approved an agreement with AK Security Alarm LLC for $405,000.00 ending September 13, 2023, with the option of two 1-year extensions. The City has exercised one of the options by extending the contract to September 13, 2024.
On June 11, 2024, the City Council approved Amendment No. 1 with AK Security Alarm, LLC. increasing annual compensation to $450,000.00. This Amendment also changed the terms of the agreement to coincide with the City’s fiscal year-end.
Discussion
On-Call contracts allow the City to mobilize construction and repair services quickly and efficiently under pre-negotiated terms and conditions. The City may require services due to an urgent matter or because the City is unable to provide or perform those services internally. For a city who needs to engage a general or specific construction and repair service, the benefits of having an on-call contract in place include:
•A wide span of technical expertise.
•Resource availability and flexibility.
•Commitments as needed for services.
AK Amendment No. 2 On-Call
•Accelerated procurement and authorization.
•Independent and objective assessments and proposals.
•Validation of resolution-oriented actions.
The On-Call minor construction and repair services are essential to maintain city amenities and efficiently construct low-cost minor projects.
AK Security and Alarm has provided essential contractor services for various projects around the City. This contract will allow the contractor to perform a variety of on-call communication and electronic data repair and minor construction work. AK Security and Alarm has performed as a contractor and sub-contractor on several large city and agency projects at the Rosetta Canyon Sports Park, Launch Pointe RV Resort, City Hall, The Neighborhood Community Center, The Anchor, and various other city projects.
This Amendment ensures continued on-call minor construction and repair services support to immediate operational demands. The sustainment of these essential general requirements provides city-wide minor construction, rehabilitation, and immediate maintenance augmentation of repair services.
Fiscal Impact
Funds are budgeted in the Fiscal Year 2023-24 Annual Operating Internal Service Budget.

CITY OF LAKE ELSINORE – NEW LIBRARY
Dear Gus:
Engineering Resources of Southern California, Inc. (ERSC), is pleased to provide this proposal for conceptual design and preparation of contract and supporting documents for a new public library. ERSC understands that the City of Lake Elsinore intends to construct a new public library and parking coupled with botanical garden at the intersection of Main Street and Sumner Avenue. The library and botanical garden will be located south of Sumner Avenue between Main Street and Spring Street and the parking facilities will be located on the southwest corner of Spring Street and Sumner Avenue.
Existing surface features observed are limited and include paved streets on Spring Street, Sumner Avenue and Main Street. These public improvements include curb, gutter and sidewalk on the west side of Main Street, the south side of Sumner Avenue and the east and west sides of Spring Street.
Otherwise, the location is dominated by native grasses and vacant ground. The specific location of the proposed facilities and improvements are described below.
• The library is located on the southwest corner of Main Street and Sumner Avenue. • The Botanical Garden is located on the southeast corner of Spring Street and Sumner Avenue. • The parking facilities are located on the southwest corner of Spring Street and Sumner Avenue.
In general, ERSC’ s Scope of Work will include preparation of conceptual designs and construction documents ( plans and specifications ), utility plans, erosion control plan, engineer’s cost estimate, hydrology report, stormwater pollution prevention plan, and a water quality management plan (WQMP, per Santa Ana Regional Water Quality Control Board Order No. R8 -2010-0033). Unless otherwise indicated by the City, we have assumed the City will provide topography for areas included in the project.
Based on public documents and a site visit, ERSC believes the project is constructable as envisioned by the City. However, there are certain issues th at will affect how ERSC approaches the conceptual (30%) and final design of the proposed f acility. These include grading , layout of parking facilities and water quality documentation. There issues are discussed in detail below.
GRADING – The site is characterized by generally flat terrain except along the e asterly edge of the evacuation channel. Based on our conversation, it is our understanding that the City intends to raise the
Page | 2
library site and the location of the botanical garden should be graded to sheet flow to the west. Further, the parking facilities located west of Spring Street will be graded to flow southerly so drainage can enter the evacuation channel via existing surface facilities. Raising the site will require import. Import for this project will be provided from the City Hall project and potentially the parking project at City Park.
PARKING FACILITIES – The project is subject to the parking requirement outlined in the City of Lake Elsinore Municipal Code Section 17.148. There is no specific requirement identified for libraries.
Therefore, the required number of parking stalls is unknown at this time. Parking ratios or area requirements will be investigated during the 30% Design Phase.
WATER QUALITY DOCUMENTS – The project is subject to the requirements of various water quality permits issued by the Santa Ana Regional Water Quality Control Board for construction activities and post-construction site management. These requirements include preparation of a Stormwater Pollution Prevention Plan (SWPPP) for construction activities and a Project Specific Water Quality Management Plan for post construction site management.
The required WQMP must meet the treat and release standards included in the Guidance Document due to the project location in the watershed tributary to Lake Elsinore which limits treatment options to bio-retention. As discussed, the site will likely require two sep arate bio-retention facilities. One located on the east side of Spring Street to serve the library and botanical garden, and another located between Springs Street and the evacuation channel to serve the parking area. In addition, there is also the potential for one, or both, of these facilities to require a small pump station. The need for pumping facilities will not be known until we get into the final design.

Independent Contractor Agreement for Instruction with National Junior Basketball League
Approve and authorize the City Manager to execute an agreement/contract with National Junior Basketball League in an amount not to exceed $60,000 for basketball league, practices, games, and instruction in such final form as approved by the City Attorney and authorize the City Manager to execute change orders not exceeding a 10% contingency of $6,000 for uncertainties and adjustments.
REPORT TO CITY COUNCIL
To:Honorable Mayor and Members of the City Council
From:Jason Simpson, City Manager
Prepared by:Johnathan Oliver Skinner, Director Of Community Services Date:July 9, 2024
Subject:Independent Contractor Agreement for Instruction with National Junior Basketball League
Recommendation
Approve and authorize the City Manager to execute an agreement/contract with National Junior Basketball League in an amount not to exceed $60,000 for basketball league, practices, games, and instruction in such final form as approved by the City Attorney and authorize the City Manager to execute change orders not exceeding a 10% contingency of $6,000 for uncertainties and adjustments.
Background
The City of Lake Elsinore contracts with private instructors to perform recreational instruction at City-owned facilities such as the Lake Community Center, Dream Extreme Neighborhood Center, and Lake Elsinore Senior Center. The City of Lake Elsinore collects all registration fees for the classes through Rec1, a software program. Upon the City’s receipt of the invoice, the City then pays each of the contract instructors 75 percent of the participation Registration Fees collected.
The City retains 25 percent of the fees for facility maintenance and staffing costs.
Discussion
National Junior Basketball (NJB) is an existing business providing basketball instruction, practice, and games at the Lake Community Center and our joint-use Terra Cotta Middle School Gymnasium. In NJB’s inaugural season with the City, they registered over 100 participants. With their success, ability to offer multiple seasons, addition of camps and workshops, and capacity to accommodate more than 200 participants per season, we anticipate that NJB will grow in popularity. Thus, we anticipate the instructor portion of registration fees will exceed the City Manager’s authority threshold. The Independent Contractor Agreement is attached as Attachment 1 and provides authorization for payment of the instructor share of registration fees up to $60,000.
National Junior Basketball League Contract

Fiscal Impact
Since the City collects the Registration Fees, pays the instructor their 75 percent dues, and retains 25 percent to cover staffing and maintenance, the expenses are countered with the appropriate revenue stream and therefore, no fiscal impact is anticipated.

Subject:Independent Contractor Agreement for Instruction with Lorena Hancock Recommendation
Approve and authorize the City Manager to execute an agreement with Lorena Hancock in an amount not to exceed $50,000 for recreation classes in such final form as approved by the City Attorney and authorize the City Manager to execute change orders not exceeding a 10% contingency of $5,000 for uncertainties and adjustments.
Discussion
Ms. Hancock is an existing business providing pre-school and ballet folklorico dance instruction at the Lake Community Center and Dream Extreme Neighborhood Center. Due to Ms. Hancock’s class popularity, she has consistently exceeded the City Manager’s signing authority threshold of $30,000, including this last fiscal year. We anticipate that she will continue to maintain and potentially grow in popularity. Thus, we anticipate this instructor to exceed the City Manager’s signing authority threshold this year as well. As you may find attached as Attachment 1, Lorena Hancock’s Independent Contractor Agreement is not to exceed $50,000.
Lorena Hancock Agreement for Instruction
Fiscal Impact
Since the City collects the Registration Fees, pays the instructor their 75 percent dues, and retains 25 percent to cover staffing and maintenance, the expenses are countered with the appropriate revenue stream and therefore, no fiscal impact is anticipated.

Background
The City of Lake Elsinore has expanded its offering of live performances in the form of local event as well as large scale regional events drawing thousands of local and regional visitors to Lake Elsinore. The production scale of the events and performances often times exceed the available resources of the City. Industry professionals such as Heyday have the resources and knowlege to step in and fill the gaps needed to elevate the production quality of the event and performers.
In July 2024, the City entered into a short-term agreement with Heyday Records & Events to provide live performance support services. In recognition of the quality of services and responsiveness, it is desired to formalize the services in this Professional Services Agreement.
Discussion
Heyday Records & Events provides live performance support services and capabilities that can be tailored to the City’s precise needs to help enhance events and performances.
As the City continues to build local and regional events for the enjoyment of the entire community, it is important the quality is representative of the talent and visitors to these events. Heyday has a long history in the Temecula Valley of quality production and products for these types of services.

0 law arises from the sole negligence or willful misconduct of the City or its officers, employees, agents, or volunteers and (2) the actions of Consultant or its employees, subcontractor, or agents have contributed in no part to the injury, loss of life, damage to property, or violation of law. It is understood that the duty of Consultant to indemnify and hold harmless includes the duty to defend as set forth in Section 2778 of the California Civil Code. Acceptance by City of insurance certificates and endorsements required under this Agreement does not relieve Consultant from liability under this indemnification and hold harmless clause. This indemnification and hold harmless clause shall apply to any damages or claims for damages whether or not such insurance policies shall have been determined to apply. By execution of this Agreement, Consultant acknowledges and agrees to the provisions of this Section and that it is a material element of consideration.
16. Insurance Requirements.
a. Insurance. Consultant, at Consultant’s own cost and expense, shall procure and maintain, for the duration of the contract, unless modified by the City’s Risk Manager, the following insurance policies.
i. Workers’ Compensation Coverage. Consultant shall maintain Workers’ Compensation Insurance and Employer’s Liability Insurance for his/her employees in accordance with the laws of the State of California. In addition, Consultant shall require each subcontractor to similarly maintain Workers’ Compensation Insurance and Employer’s Liability Insurance in accordance with the laws of the State of California for all of the subcontractor’s employees. Any notice of cancellation or non-renewal of all Workers’ Compensation policies must be received by the City at least thirty (30) days prior to such change. The insurer shall agree to waive all rights of subrogation against City, its officers, agents, employees and volunteers for losses arising from work performed by Consultant for City. In the event that Consultant is exempt from Worker’s Compensation Insurance and Employer’s Liability Insurance for his/her employees in accordance with the laws of the State of California, Consultant shall submit to the City a Certificate of Exemption from Workers Compensation Insurance in a form approved by the City Attorney.
ii. General Liability Coverage. Consultant shall maintain commercial general liability insurance in an amount not less than one million dollars ($1,000,000) per occurrence for bodily injury, personal injury and property damage. If a commercial general liability insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit. Required commercial general liability coverage shall be at least as broad as Insurance Services Office Commercial General Liability occurrence form CG 0001 (ed. 11/88) or Insurance Services Office form number GL 0002 (ed. 1/73) covering comprehensive General Liability and Insurance Services Office form number GL 0404 covering Broad Form Comprehensive General Liability. 0 iii. Automobile Liability Coverage. Consultant shall maintain automobile liability insurance covering bodily injury and property damage for all activities of the Consultant arising out of or in connection with the work to be performed under this Agreement, including coverage for owned, hired and non-owned vehicles, in an amount of not less than one million dollars ($1,000,000) combined single limit for each occurrence.
Automobile liability coverage must be at least as broad as Insurance Services Office Automobile Liability form CA 0001 (ed. 12/90) Code 1 (“any auto”). No endorsement may be attached limiting the coverage.
iv. Professional Liability Coverage. Consultant shall maintain professional errors and omissions liability insurance appropriate for Consultant’s profession for protection against claims alleging negligent acts, errors or omissions which may arise from Consultant’s services under this Agreement, whether such services are provided by the Consultant or by its employees, subcontractors, or sub consultants. The amount of this insurance shall not be less than one million dollars ($1,000,000) on a claims-made annual aggregate basis, or a combined single limit per occurrence basis. b. Endorsements. Each general liability and automobile liability insurance policy shall be with insurers possessing a Best’s rating of no less than A:VII and shall be endorsed with the following specific language:
i. Notwithstanding any inconsistent statement in any required insurance policies or any subsequent endorsements attached thereto, the protection offered by all policies, except for Workers’ Compensation, shall bear an endorsement whereby it is provided that, the City and its officers, employees, servants, volunteers and agents and independent contractors, including without limitation, the City Manager and City Attorney, are named as additional insureds. Additional insureds shall be entitled to the full benefit of all insurance policies in the same manner and to the same extent as any other insureds and there shall be no limitation to the benefits conferred upon them other than policy limits to coverages.
ii. This policy shall be considered primary insurance as respects the City, its elected or appointed officers, officials, employees, agents and volunteers.
Any insurance maintained by the City, including any self-insured retention the City may have, shall be considered excess insurance only and shall not contribute with it. iii. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring company.
iv. The insurer waives all rights of subrogation against the City, its elected or appointed officers, officials, employees or agents. v. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the City, its elected or appointed officers, officials, employees, agents or volunteers.
vi. The insurance provided by this Policy shall not be suspended, voided, canceled, or reduced in coverage or in limits except after thirty (30) days written notice has been received by the City.

Consultant shall provide certificates of insurance with original endorsements to City as evidence of the insurance coverage required herein.
Certificates of such insurance shall be filed with the City on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with the City at all times during the term of this Agreement.

If the parties are unable to agree upon a mediator, the dispute shall be submitted to JAMS or its successor in interest. JAMS shall provide the parties with the names of five qualified mediators. Each party shall have the option to strike two of the five mediators selected by JAMS and thereafter the mediator remaining shall hear the dispute. If the dispute remains unresolved after mediation, either party may commence litigation.

1 indemnify, defend, and hold harmless City for the payment of any employee and/or employer contributions for PERS benefits on behalf of Consultant or its employees, agents, or subcontractors, as well as for the payment of any penalties and interest on such contributions, which would otherwise be the responsibility of City.

Consultant further covenants and represents that in the performance of its duties hereunder no person having any such interest shall perform any services under this Agreement.
Consultant is not a designated employee within the meaning of the Political Reform Act because Consultant:
a. will conduct research and arrive at conclusions with respect to his/her rendition of information, advice, recommendation or counsel independent of the control and direction of the City or of any City official, other than normal agreement monitoring; and b. possesses no authority with respect to any City decision beyond rendition of information, advice, recommendation or counsel. (FPPC Reg. 18700(a)(2).)
12. Professional Ability of Consultant. City has relied upon the professional training and ability of Consultant to perform the services hereunder as a material inducement to enter into this Agreement. The foregoing obligation of Consultant shall not apply when (1) the injury, loss of life, damage to property, or violation of law arises from the sole negligence or willful misconduct of the City or its officers, employees, agents, or volunteers and (2) the actions of Consultant or its employees, subcontractor, or agents have contributed in no part to the injury, loss of life, damage to property, or violation of law.

Any insurance maintained by the City, including any self-insured retention the City may have, shall be considered excess insurance only and shall not contribute with it. iii. Certificates of such insurance shall be filed with the City on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with the City at all times during the term of this Agreement.

Recommendation
Approve and authorize the City Manager to execute an agreement with Fehr & Peers in an amount not to exceed $132,000 for on-call traffic engineering services in such final form as approved by the City Attorney.
Background
Currently, the City does not have a staffed or dedicated Traffic Engineer and utilizes contract traffic engineering services in support of traffic operations, development review, and CIP project engineering support. Discussion
Fehr & Peers will provide on-call traffic engineering services that includes addressing citizen’s requests regarding traffic issues, review traffic impact analysis and assist in preparation of conditions of approval for development projects, review traffic signal and signing & striping plans to ensure conformance with latest standards and requirements, research grant opportunities available to the city, and provide grants application support for funding such as HSIP. Fehr & Peers will provide the much-needed support for traffic engineering services and continue to serve as main traffic lead related to Alberhill Villages Specific Plan and Alberhill Ridge projects.
Fehr & Peers Agreement
Fiscal Impact
The cost of services is estimated at $132,000 per annum. A combination of FY 2024-2025 CIP project budgets, developer deposits, and Gas Tax funds will support the traffic engineering services as proposed.

Neither City nor any of its officers, employees, or agents shall have control over the conduct of Consultant or any of Consultant’s officers, employees, or agents, except as set forth in this Agreement. Consultant shall not at any time or in any manner represent that it or any of its officers, employees, or agents are in any manner officers, employees, or agents of the City. Consultant shall not incur or have the power to incur any debt, obligation, or liability whatsoever against City, or bind City in any manner. b. Notwithstanding any other federal, state and local laws, codes, ordinances and regulations to the contrary and except for the fees paid to Consultant as provided in the Agreement, Consultant and any of its employees, agents, and subcontractors providing service under this Agreement shall not qualify for or become entitled to, and hereby agree to waive any claims to, any compensation, benefit, or any incident of employment by City, including but not limited to eligibility to enroll in PERS as an employee of City and entitlement to any contribution to be paid by City for employer contribution and/or employee contributions for PERS benefits.
10. PERS Eligibility Indemnification. In the event that Consultant or any employee, agent, or subcontractor of Consultant providing services under this Agreement claims or is determined by a court of competent jurisdiction or the California Public Employees Retirement System (PERS) to be eligible for enrollment in PERS as an employee of the City, Consultant shall indemnify, defend, and hold harmless City for the payment of any employee and/or employer contributions for PERS benefits on behalf of Consultant or its employees, agents, or subcontractors, as well as for the payment of any penalties and interest on such contributions, which would otherwise be the responsibility of City.
11. Interests of Consultant. Consultant (including principals, associates and professional employees) covenants and represents that it does not now have any investment or interest in real property and shall not acquire any interest, direct or indirect, in the area covered
3 7
5 8
7 by this Agreement or any other source of income, interest in real property or investment which would be affected in any manner or degree by the performance of Consultant’s services hereunder.
Consultant shall therefore provide properly skilled professional and technical personnel to perform all services under this Agreement. All work performed by Consultant under this Agreement shall be in accordance with applicable legal requirements and shall meet the standard of quality ordinarily to be expected of competent professionals in Consultant’s field of expertise.
13. Compliance with Laws.

14. Licenses. Consultant represents and warrants to City that it has the licenses, permits, qualifications, insurance and approvals of whatsoever nature which are legally required of Consultant to practice its profession. The foregoing obligation of Consultant shall not apply when (1) the injury, loss of life, damage to property, or violation of
3 7
5 8
7 law arises from the sole negligence or willful misconduct of the City or its officers, employees, agents, or volunteers and (2) the actions of Consultant or its employees, subcontractor, or agents have contributed in no part to the injury, loss of life, damage to property, or violation of law.

22. Prohibited Interests. Consultant maintains and warrants that it has not employed nor retained any company or person, other than a bona fide employee working solely for Consultant, to solicit or secure this Agreement. Further, Consultant warrants that it has not paid nor has it agreed to pay any company or person, other than a bona fide employee working solely for Consultant, any fee, commission, percentage, brokerage fee, gift or other consideration contingent upon or resulting from the award or making of this Agreement. 23. Equal Opportunity Employment. Such non-discrimination shall include, but not be limited to, all activities related to initial employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff or termination.
24. Prevailing Wages. Consultant is aware of the requirements of California Labor Code Section 1720, et seq., and 1770, et seq., as well as California Code of Regulations, Title 8, Section 16000, et seq., ("Prevailing Wage Laws"), which require the payment of prevailing wage rates and the performance of other requirements on "public works" and "maintenance" projects.
Consultant agrees to fully comply with all applicable federal and state labor laws (including, without limitation, if applicable, the Prevailing Wage Laws). It is agreed by the parties that, in connection with the Work or Services provided pursuant to this Agreement, Consultant shall bear all risks of payment or non-payment of prevailing wages under California law, and Consultant hereby agrees to defend, indemnify, and hold the City, and its officials, officers, employees, agents, and volunteers, free and harmless from any claim or liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. The foregoing indemnity shall survive termination of this Agreement.
25. Severability. If any term or portion of this Agreement is held to be invalid, illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall continue in full force and effect.
26. Controlling Law Venue. This Agreement and all matters relating to it shall be governed by the laws of the State of California and any action brought relating to this Agreement shall be held exclusively in a state court in the County of Riverside.
27. Authority to Enter Agreement. Consultant has all requisite power and authority to conduct its business and to execute, deliver, and perform the Agreement. Each party warrants that the individuals who have signed this Agreement have the legal power, right, and authority to

Subject: Proposal to Provide On-Call Traffic Engineering Services P24-2498-OC
Dear Ramon:
This proposal reflects my conversation with Yu Tagai related to on-call services for the City of Lake Elsinore. Currently, we have a contract with the city to peer review traffic studies that are submitted to the city. However, additional services may be needed to assist the city in other matters, such as responding to resident requests or assisting with specific grant pursuit requests (like HSIP grant pursuits). As such, please accept this proposal to provide as -needed traffic support for these potential services.
Our proposed scope of work is summarized below but all tasks coming from this on -call will be individually scoped and budgeted based on the unique aspects of the effort.
SCOPE OF WORK
TASK 1 – ON-CALL TRAFFIC ENGINEERING SERVICES
As part of this task, Fehr & Peers will provide the following services:
1. Receive citizens’ requests regarding traffic issues.
2. Process service requests including field reviews, research, analysis, and correspondence with requestors.
3. Respond to public requests for information regarding projects and attend community outreach meetings as required.
4. Field review traffic circulation around schools. Perform analysis and provide recommendations.
Remon Habib, P.E.

5. Analyze intersections and roadway segments as needed for multi -way stop warrants, traffic signal warrants, and traffic calming. Coordinate with a traffic count subconsultant for count data.
6. Attend staff meetings and provide updates to the City Manager and City Engineer as needed.
7. Present reports and provide recommendations to Planning Commission and City Council as needed.
8. Provide coordination with the County of Riverside, RCTC, WRCOG, Caltrans, adjacent Cities, and law enforcement agencies.
9. Develop traffic standards for signal equipment and signing & striping to promote consistency and uniformity citywide.
10. Review/design traffic control plans for special events.
11. Oversee traffic operation (signal operation and maintenance, signing & striping, and markings).
12. Coordinate with the County of Riverside signal maintenance staff and on -call signal operations staff to address any signal or timing issues.
13. Review all long corridors for possible signal coordination and missing interconnect.
14. Review traffic impact studies and assist in the preparation of conditions of approval for development projects.
15. Prepare and/or review fair share obligations for the development projects.
16. Attend Planning Commissions and City Council Meetings for Development Projects .
17. Review traffic control plans for work within the City right of way and assist with the Encroachment Permit process.
18. Review traffic signal and signing & striping plans to ensure conformance with city, state, federal, and other applicable standards and requirements.
19. Work with Riverside County and on -call signal maintenance technicians for traffic signal and traffic signal system timing plans.
20. Prepare traffic signal design, signal timing sheets, coordination of signal timing, and traffic signal operation troubleshooting.
21. Provide construction support services on City Projects as needed.
22. Research neighborhood traffic calming measures for potential implementation.
23. Create and maintain an equipment inventory log for all existing traffic signals.
TASK 2 – ON-CALL ENGINEERING SERVICES FOR GRANT APPLICATIONS As part of this task, Fehr & Peers will provide the following services:
Remon Habib, P.E.
City of Lake Elsinore
1. Research grant opportunities available to the city. Apply for HSIP and other grants when available.
2. Research possible grants for other systemic improvements for pedestrian heads, APS push buttons, signal improvements, and other safety improvements.
3. Assist in preparing Caltrans forms and other necessary documentation for grant receipt requirements.
FEHR & PEERS’ RATES
All rates used in this on-call agreement are identified below and will remain in effect for up-to three years:
• Principal - $250 - $400 per hour
• Sr. Associate - $210 - $320 per hour
• Associate - $185 - $285 per hour
• Sr. Engineer/Planner - $160 - $250 per hour
• Engineer/Planner - $135 - $200 per hour
• Project Coordinator - $130 - $190 per hour
• Counts - $250 per peak hour per intersection
• Mileage at IRS standard rate
• Other ODCs (printing, telephones, etc.) billed at 5% of the labor charges
FEE ESTIMATE
Given the on-call nature of this proposal, estimating the needed time to assist the c ity for specific tasks is difficult to accomplish at this stage. However, we have anticipated spending the foll owing staffing resources on an annual basis:
• Task 1 – On-Call Traffic E ngineering Services. We anticipate eight hours of staff support per week to assist with these tasks at an average billing rate of $275 per hour. This would yield an estimated cost of approximately $9,300 per month or $112,000 per year. • Task 2 – Grant Support. These services are highly dependent on the grant pursuit type and the complexity of the improvement location . However, for budgeting purposes, we anticipate assisting with one HSIP grant a year which typically requires between $20,000 and $30,000 to assist the city in preparing.
Based on the information above, we would request an annual on-call authorization to assist the city with these key tasks for a not-to-exceed amount of $132,000 per year.

City of Lake Elsinore
We look forward to our continued work with the City of Lake Elsinore . If you have any questions, please call me directly at 949-308-6312.

Professional Services Agreement with Lynn Merrill & Associates, Inc. for Technical Support for the City’s National Pollutant Discharge Elimination System (NPDES) Compliance
Approve and authorize the City Manager to execute a Professional Services Agreement with Lynn Merrill and Associates for NPDES related compliance and consulting in an amount not to exceed $44,000 for a two-year contract term in final form as approved by the City Attorney.
REPORT TO CITY COUNCIL
To:Honorable Mayor and Members of the City Council
From:Jason Simpson, City Manager
Prepared by:Remon Habib, City Engineer
Date:July 9, 2024
Subject:Professional Services Agreement with Lynn Merrill & Associates, Inc. for Technical Support for the City’s National Pollutant Discharge Elimination System (NPDES) Compliance
Recommendation
Approve and authorize the City Manager to execute a Professional Services Agreement with Lynn Merrill and Associates for NPDES related compliance and consulting in an amount not to exceed $44,000 for a two-year contract term in final form as approved by the City Attorney.
Background
Lynn Merrill and Associates have been providing NPDES Permit and Lake Elsinore-Canyon Lake TMDL support since FY 20-21. There is a forthcoming Tri-County MS4 Permit which is currently undergoing detailed reviews and comments with the counties of Riverside, San Bernardino and Orange. It is projected this new permit will be adopted in 2025. This new permit will necessitate additional inspections, WQMP and reporting requirements.
Stormwater discharges in the City are authorized under the NPDES Municipal Separate Storm Sewer System (MS4) Permit issued by the State Santa Ana Regional Water Quality Control Board. The current and forthcoming Tri-County MS4 Permits requires the City to implement activities to eliminate and prevent pollutants from entering the storm drain system. Among other actions, this permit mandates that the City inspect construction sites and industrial and commercial facilities and outfalls within its legal jurisdiction, review water quality management plans, attend mandatory meetings and training, prepare and submit annual reports, maintain databases of training, construction sites, commercial and industrial sites and post construction water quality facilities.
PSA Lynn Merrill and Associates
Discussion
Lynn Merrill and Associates, Inc., have been satisfactorily performing NPDES support and inspection services for the City for the last five (5) years. Lynn Merrill’s proposal evidenced their ability to meet all requirements to perform as needed NPDES professional services for the City with a fee schedule in line with current staff costs.
Currently, NPDES commercial and industrial site inspections and various other NPDES related tasks are conducted by Lynn Merrill and Associates under the current agreement.
This agreement with contracted support will ensure the City performs existing and upcoming MS4 Permit mandated activities. Failure to perform mandated compliance activities will place the City in non-compliance of the permit, a fineable violation.
Fiscal Impact
There will be no impact to the General Fund. The cost is approved through the County Service Area 152 Assessment (Fund 155).
