REPORT TO CITY COUNCIL
To:Honorable Mayor and Members of the City Council
From:Jason Simpson, City Manager
Prepared by:Remon Habib, City Engineer
Date:September 10, 2024
Subject: Professional Services Agreement for Surface Mining Inspection (SMARA) and Compliance Monitoring Consulting Services, EnviroMINE, Inc.

Recommendation
Approve and authorize the City Manager to execute a Professional Services Agreement with EnviroMINE, Inc. to perform SMARA compliance monitoring and inspection services in an amount not to exceed $35,000 annually in final form as approved by the City Attorney.

Background
EnviroMINE, Inc. has provided SMARA services and conducted annual inspections on the mines in Lake Elsinore since 2009. They are very familiar with the history of each mine site.

SMARA requires an annual review of financial assurances to ensure that adequate surety is available should the operator default on the reclamation requirements. Review and adjustment of financial assurances can be time-consuming. This depends, in large part, on the operator’s willingness to provide adequately detailed and justified estimates.

EnviroMINE, inc. is uniquely qualified to review financial assurances. EnviroMINE, Inc. authored the estimating procedure used by the State Mining and Geology Board as adopted in their Financial Assurance Guidelines and updates over 80 financial assurance cost estimates each year for private operators.

Discussion
EnviroMINE, Inc., has been satisfactorily performing SMARA support and inspection services for the City for the last twelve (12) years. EnviroMINE’s proposal evidenced their ability to meet all requirements to perform as-needed SMARA professional services for the City with a fee schedule in line with current staff costs.
