REPORT TO CITY COUNCIL
To:Honorable Mayor and Members of the City Council
From:Jason Simpson, City Manager
Prepared by:Shannon Buckley, Assistant City Manager
Date:August 12, 2025
Subject:Public Works Construction Agreement with Van Engineering Inc. for the Construction of the Parking Lot Project (CIP Project No. Z40037) Recommendation
Approve and authorize the City Manager to execute the Public Works Construction Agreement with Van Engineering, Inc. in an amount not to exceed $526,292.00 in such final form as approved by the City Attorney; authorize the City Manager to execute change orders not to exceed the 10% contingency amount of $52,692.00; and authorize the City Manager to accept the improvements into the City Maintained System and the City Clerk to file the Notice of Completion with the County Recorder for the listed project.

Background
Staff contracted Engineering Resources of Southern California Inc. to design the parking lot and maximize the usability of the former railroad easement behind City Park. The project will utilize the vacated railroad easement at the rear of City Park, transforming underutilized land into valuable community infrastructure with 40 parking spaces for automobiles.

Discussion
In short, the significant elements of the Parking lot project will include excavation, grading, retaining wall, asphalt, biofilter wetland, and striping. Additionally, the project will include reconstructing an ADA-accessible sidewalk through the park. The construction of the parking lot will provide 40 additional parking spaces, improving public access to both the park and businesses along Main Street.

The bid protest alleges the low bidder failed to list a subcontractor for the project scope. Staff thoroughly reviewed, researched, and consulted with the City’s design and construction resources to determine that the protest has no merit. For your reference, the City’s bid protest denial response (with E2 Contracting protest letter) is attached herein (Attachment C).
