Subject:Council Direction on Filling Vacancy Resulting from Council Member Johnson's Election to the State Assembly District 63
Recommendation
Direct staff on how to proceed in filling the vacancy on the City Council created by Council Member Johnson’s election to the State Assembly. The Council has the following options:

1. Direct the City Clerk to prepare the necessary Resolution to call a special election to fill the vacancy; or

2. Direct the City Clerk to solicit applications from interested and eligible residents and appoint two (2) Council Members to serve on an Appointment Committee to review applications, conduct interviews as needed, and provide a recommendation for nomination to the full City Council to appoint a qualified individual to serve the remainder of the unexpired term, with the seat scheduled to appear on the November 2026 ballot for the remainder of the term.

Background
On August 26, 2025, Council Member Johnson was elected to represent Assembly District 63.

She was sworn into office and submitted her letter of resignation to the City on September 8, 2025. As a result of her election and transition to the State Legislature, her seat on the City Council has become vacant effective September 8, 2025.

Pursuant to City Council Policy No. 200-11, within five (5) days of the vacancy, a special vacancy notice must be posted and published, and pursuant to California Government Code Section 36512, the City Council must either fill the vacancy by appointment or call a special election within 60 days.

Additionally, since the vacancy occurred in the first half of the term and more than 130 days prior to the next general municipal election (November 3, 2026), an appointment would be effective only until that election. At that point, a successor elected by the voters would serve the remainder of the term through December 2028.

Discussion
The appointment process provides the City Council with a cost-effective and expedient method of ensuring uninterrupted representation, while a special election allows the electorate to select the representative directly, though at a significant fiscal cost.

If the Council chooses to proceed with an appointment, the following timeline is provided for consideration based on the 60-day requirement under state law.

Fiscal Impact
The fiscal impact depends on the option selected. An appointment will have minimal cost associated with advertising and administrative support. Alternatively, the Riverside County Registrar of Voters provided a preliminary estimate for conducting a special election to fill this vacancy of approximately $32,000. This amount represents a significant unbudgeted expenditure and would require identifying funding sources or a budget amendment if the Council elects to call a special election.

36512. (a)  If a vacancy occurs in an appointive office provided for in this chapter, the council shall fill the vacancy by appointment. A person appointed to fill a vacancy holds office for the unexpired term of the former incumbent. (b)  If a vacancy occurs in an elective office provided for in this chapter, the council shall, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. (1)  If the council calls a special election, the special election shall be held on the next regularly established election date not less than 114 days from the call of the special election. A person elected to fill a vacancy holds office for the unexpired term of the former incumbent.
(2)  If the council fills the vacancy by appointment, the person appointed to fill the vacancy shall hold office pursuant to one of the following:
(A)  If the vacancy occurs in the first half of a term of office and at least 130 days prior to the next general municipal election, the person appointed to fill the vacancy shall hold office until the ne xt general municipal election that is scheduled 130 or more days after the date the council is notified of the v acancy, and thereafter until the person who is elected at that election to fill the v acancy has been qualified. The person elected to fill the v acancy shall hold office for the une xpired balance of the term of office.
(B)  If the vacancy occurs in the first half of a term of office, but less than 130 days prior to the ne xt general municipal election, or if the v acancy occurs in the second half of a term of office, the person appointed to fill the vacancy shall hold office for the unexpired term of the former incumbent.
(c)  Notwithstanding subdi vision (b) and Section 34902, a city may enact an ordinance that does any of the following:
(1)  Requires that a special election be called immediately to fill every city council vacancy and the office of mayor designated pursuant to Section 34902. The ordinance shall provide that the special election shall be held on the ne xt regularly established election date not less than 114 days from the call of the special election. (2)  Requires that a special election be held to fill a city council v acancy and the office of mayor designated pursuant to Section 34902 when petitions bearing a specified number of verified signatures are filed. The ordinance shall provide that the special election shall be held on the ne xt regularly established election date not less than 114 days from the filing of the petition. A governing body that has enacted such an ordinance may also call a special election pursuant to subdi vision (b) without waiting for the filing of a petition.
(3)  Provides that a person appointed to fill a v acancy on the city council holds office only until the date of a special election which shall immediately be called to fill the remainder of the term. The special election may be held on the date of the next regularly established election or re gularly scheduled municipal election to be held throughout the city not less than 114 days from the call of the special election. (d)  (1)  Notwithstanding subdivision (b) and Section 34902, an appointment shall not be made to fill a v acancy on a city council if the appointment w ould result in a majority of the members serving on the council having been appointed. The vacancy shall be filled in the manner provided by this subdivision. (2)  The city council may call an election to fill the vacancy, to be held on the next regularly established election date not less than 114 days after the call. (3)  If the city council does not call an election pursuant to paragraph (2), the vacancy shall be filled at the next regularly established election date. (e)  (1)  If the city council of a city that elects city council members by or from districts elects to fill a vacancy on the city council by appointment as a result of a city council member resigning from office, the resigning city council member may cast a vote on the appointment if the resignation will go into effect upon the appointment of a successor. A city council member shall not cast a v ote for a family member or any other person with whom the city council member has a relationship that may create a potential conflict of interest.
(2)  If a city council member elects to cast a v ote under this subdivision, the city council member shall be prohibited from the follo wing actions for a period of tw o years after the appointment of a successor:
(A)  Advocating on any measure or issue coming before the city council in which the city council member may have a personal benefit.
(B)  Entering into a contract of any kind with the city or a city vendor. (C)  Accepting a position of employment with the city or a city vendor. (D)  Applying for a permit that is subject to the approval of the city council. (3)  This subdivision shall not apply to any city council member who is resigning from the city council due to char ges of, or con viction for, corruption or criminal behavior, or who is subject to a recall election.

BACKGROUND

The City of Lake Elsinore does not currently have a policy regarding the filling of vacancies on the City Council, nor has the City adopted an ordinance addressing such matter as permitted under Government Code Section 36512.

PURPOSE

To define policies and procedures for the filling of a vacancy on the City Council.

POLICY

Definition Of Vacancy

The City Council shall determine that a vacancy has occurred in accordance with definition afforded “vacancy” under California law, including, without limitation, Government Code Section 1770. For example, California law states that a vacancy occurs in the events of resignation, non- residence, military service, abandonment, incompatible offices, acceptance of free transportation, criminal conviction and death.

Questions as to whether a vacancy has occurred shall be directed to the City Attorney.

Policies And Procedures

1. Appointment within thirty ( 30) days; Exception. In conformity with California law, the City Council shall fill the unscheduled vacancy by appointment within thirty ( 30) days of the occurrence of the vacancy .

Notwithstanding the foregoing, a vacancy occurring on or after July 1 of the last year of a member’s term shall not be filled by appointment; but rather shall be filled by the general municipal election for that Council seat.

2. Notice of unscheduled vacancy . Within five (5) days of the occurrence of a vacancy in the City Council, a special vacancy notice shall be posted published in a newspaper of general circulation, posted on cable television public access channel and in the office of the City

Clerk, the Lake Elsinore Library, and in such other places as directed by the City Council.

3. Application Period. The application period will run for a period of two weeks from the date the notice of vacancy is posted. If there is more than one concurrent vacancy, the application period may be longer, but in no event for a period longer than twenty (20) days after the occurrence of a vacancy . Applications shall be available from the City Clerk’s office.

4. Submission of Application; List of Applicants . Applicants shall be required to complete and return the application by the established deadline. Applications sent by fax or email will not be accepted. The City Clerk shall compile a list of applicants from the applications received (the “List of Applicants”).

5. Appointment Committee. At the next regular meeting following the occurrence of a vacancy, the City Council shall appoint two (2) City Council Members to nominate an appointee from the List of Applicants.

6. Evaluation of Applicants. The Appointment Committee members shall evaluate the applications and may interview parties selected from the List of Applicants. After consideration of the foregoing, the Appointment Committee members shall select the candidate(s) for nomination to the City Council.

7. Nominations. After the deadline of receipt of applications, the City Clerk shall schedule the matter at a Council meeting. All applications received will be submitted and made a part of the Council agenda packet. The Appointment Committee’s selection /nomination shall be conducted open to the public at the City Council meeting. A vote will be called for each nomination. The applicant(s) receiving an affirmative vote from a majority of the C ouncil present shall be appointed.

8. Term. The person so appointed shall serve until the expiration of the predecessor’s term.

9. Councilmember Prohibition. No person serving as a Councilmember during the occurrence of a vacancy on the City Council shall be eligible for appointment to fill such vacancy.

10. Special Election. In the event no applications from eligible candidates are received or the City Council otherwise fails to fill the vacancy by appointment in accordance with this Policy the thirty (30) day period required by California law, then the City Council shall on the 30 th day
call for a special election.
