Subject: Resolutions of Necessity to Acquire Property - APN 374-173-004 (Berthanna Taylor) and APN 373-151-014 (Letticia Cervantes)
Recommendation
1. Conduct a public hearing on the proposed Resolutions of Necessity;
2. Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DECLARING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION BY EMINENT DOMAIN OF ASSESSOR PARCEL NO. 373-151-014 FOR THE CITY OF LAKE ELSINORE CITY CENTER PARKING PROJECT.
3. Adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DECLARING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION BY EMINENT DOMAIN OF ASSESSOR PARCEL NO. 374-173-004 FOR THE CITY OF LAKE ELSINORE CITY CENTER PARKING PROJECT.
Background
The City Council is being asked to consider the adoption of two (2) Resolutions of Necessity to acquire interests in and to real property by eminent domain for the City Center Parking Project ("Project").
Both properties are located within the boundaries of the Downtown Elsinore Specific Plan. That Specific Plan states the City’s intent and goals in providing public parking:
“To promote a safe and pleasant pedestrian environment throughout the Downtown Elsinore Specific Plan; creating parking lots and structures that supply an adequate Resolutions of Necessity
number of parking spaces for existing and new developments and that are located at a walkable distance of commercial uses and cultural activities.” (Section 4.5.2.) Once acquired and after improvements are installed, the proposed Project will provide critical public parking in support of the Lake Elsinore Cultural Center and the new City Hall along with existing commemorable uses, all within a walkable distance.
An aerial vicinity map is attached as Attachment 1.
APN 373-151-014 (hereinafter Parcel 014)
APN 373-151-014 is located at the northeast corner of Main Street and Prospect Street. The parcel is 6,950 square feet, or 0.16 acres. The owner is Letticia Cervantes, who acquired the property in 2006. The subject property is unimproved with no site improvements.
The City completed the appraisal and made an offer to the owner in the amount of $78,200.
However, the owner has not been willing to allow the City to acquire the property at the appraised value.
Parcel 014 is described in the legal descriptions and depictions attached as Exhibit “A” to the attached applicable resolution.
APN 374-173-004 (hereinafter Parcel 004)
APN 374-173-004 is directly behind the Cultural Center located along the south side of Heald Avenue. The site is nearly rectangular in shape, with a site area of 4,500 square feet, or 0.10 acres. The owner of record, Berthanna Taylor, acquired the property by a quitclaim deed in 1995.
The property is unimproved with no site improvements. Ms. Taylor is believed to be deceased; however, notice has been provided to the property owner’s last known address at which property tax bills are sent and which have been timely paid.
The City completed the appraisal and made an offer addressed to the last known owner in the amount of $50,000. However, there has been no response.
Parcel 004 is described in the legal descriptions and depictions attached as Exhibit “A” to the attached applicable resolution.
Negotiations
City representatives have presented written offers to acquire the two properties. The property owners of record have declined to negotiate with the City and, as a consequence, the parties have been unable to agree on the purchase price and terms of the proposed acquisition. Because the City has been unable to acquire the necessary properties needed for the Downtown Parking Project, acquisition by eminent domain is recommended.
Discussion
The City may exercise its power of eminent domain to acquire property necessary to carry out any of its powers or functions. The initiation of the eminent domain process is accomplished by Resolutions of Necessity
the City Council’s adoption of a Resolution of Necessity by a two-thirds majority vote, which Resolution may only be adopted after the City Council has given the property owners a reasonable opportunity to appear and be heard on the following matters:
(1) the public interest and necessity require the proposed project; (2) the proposed project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (3) the real property to be acquired is necessary for the project; and (4) the offer required by Government Code Section 7267.2 has been made to the owners of record.
Staff recommends the following:
Finding No. 1: Public Interest and Necessity Require the Project. The Project is necessary to serve increased parking demands in the Downtown and will promote continued economic health of downtown businesses and access to government facilities consistent with the Downtown Elsinore Specific Plan which promotes the objective of “park-once-and-walk.” Finding No. 2: The Project is Planned and Located in the Manner That Will be Most Compatible With the Greatest Public Good and the Least Private Injury. The Project properties are located on sites that are currently unimproved. Parcel 004 is located on the same block as the new City Hall, allowing for safe walking directly from this parking lot to City Hall without having to cross Main Street. Parcel 014 is located directly adjacent to the Cultural Center and already serves as an unregulated parking lot. No other properties are impacted, and no new services will be required to complete the Project.
Finding No. 3: The Properties are Necessary for the Project. Acquisition of the properties is necessary to alleviate anticipated parking shortages that will accompany the completion of the City Hall project and the reuse of the Cultural Center and are otherwise consistent with the public parking objectives set forth in the Downtown Elsinore Specific Plan.
Finding No. 4: The City Has Negotiated to Purchase the Property. Government Code Section 7267.2 requires the City to make a good faith offer of just compensation and to attempt to acquire the properties through a negotiated purchase. The offers required by Section 7267.2 of the Government Code was made to the owners of record based on an approved appraisal conducted.
The City’s initial offers to the owners of record were for the full appraised value. The owners of record have declined to accept the City’s initial offers and have further declined to engage in additional negotiations.
Notice of this public hearing was mailed to the property owners of record informing them of their right to appear and be heard on these issues. After all of the testimony and other evidence have been presented by all interested parties, the City Council must make a determination whether to adopt the proposed Resolutions of Necessity to acquire the required properties by eminent domain. In order to adopt the Resolutions, the City Council must, based on all of the evidence before it, and by a vote of two-thirds of its members, make the findings and determinations stated above.
Resolutions of Necessity
Environmental Determination
The Project is exempt from the California Environmental Quality Act (CEQA) pursuant to Cal.
Code Regs. Tit. 14, Section 15311 (Class 11: Accessory Structures). Class 11 consists of construction, or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including but not limited to: (a) On-premise signs; (b) Small parking lots; (c) Placement of seasonal or temporary use items such as lifeguard towers, mobile food units, portable restrooms, or similar items in generally the same locations from time to time in publicly owned parks, stadiums, or other facilities designed for public use.
Fiscal Impact
The funding for acquisition in the Project properties is available and would be paid from City Hall & Public Works Facilities impact fees. In addition to the acquisition costs, the City will be obligated to pay litigation expenses to prosecute an eminent domain action. The litigation budget is extremely difficult to predict and will depend on a variety of factors. As included in the Resolutions, the City Attorney’s Office requests authorization to engage special counsel services to represent the City in the proposed acquisitions and to revise the existing Engagement Agreement with the law firm of Murphy & Evertz to an amount not to exceed $50,000 for each case.

WHEREAS, said hearing has been held by the City and each affected property owner was afforded an opportunity to be heard on said matters; and WHEREAS, at the close of the public hearing and after the opportunity for open and public discussion among the City Council, the City Council voted, by more than the statutorily required two-thirds’ majority of the City Council membership, to adopt this resolution, and the City may now adopt a Resolution of Necessity pursuant to section 1240.040 of the California Code of Civil Procedure.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. Compliance with California Code of Civil Procedure. There has been compliance by the City with the requirements of section 1245.235 of the California Code of Civil Procedure regarding notice and hearing.
SECTION 2. Public Use. The public use for which the Property Interest is to be acquired is for the construction of the Project, located at the corner of Prospect Street and Main Street, in the City of Lake Elsinore, California. SECTION 3. Description of Property. Attached and marked as Exhibit “A” are the legal description and plat map of the Property Interest, which describe the general location and extent of the property with sufficient detail for reasonable identification.
SECTION 4. Findings. The City hereby finds and determines each of the following:
(a) Finding No. 1: Public Interest and Necessity Require the Project. The Property Interest is necessary to serve increased parking demands in the Downtown area and will promote continued economic health of downtown businesses and access to government facilities consistent with the Downtown Elsinore Specific Plan which promotes the objective of “park-once-and-walk.”
(b) Finding No. 2: The Project is Planned and Located in the Manner That Will be Most Compatible With the Greatest Public Good and the Least Private Injury. The Property Interest is located on a site that is currently unimproved. Acquisition of the Property Interest is necessary to alleviate anticipated parking shortages that will accompany the completion of the City Hall project and are otherwise consistent with the public parking objectives set forth in the Downtown Elsinore Specific Plan. (d) Finding No. 4: The City Has Negotiated to Purchase the Property. Government Code Section 7267.2 requires the City to make a good faith offer of just compensation and to attempt to acquire the properties through a negotiated purchase. The offer required by Section 7267.2 of the Government Code was made to the owner of record based on an approved appraisal conducted. The City’s initial offer to the owner of record was for the full appraised value. The owner of record has declined to accept the City’s initial offers and have further declined to engage in additional negotiations.
SECTION 5. Use Not Unreasonably Interfering with Existing Public Use(s). Some or all of the real property to be acquired may be subject to easements and rights-of-way appropriated to existing public uses. In the event the herein described use or uses will not unreasonably interfere with or impair the continuance of any public use as it may now exist or may reasonably be expected to exist in the future, counsel for the City is authorized to acquire the herein described real property subject to such existing public uses pursuant to section 1240.510 of the California Code of Civil Procedure.
SECTION 6. More Necessary Public Use. Some or all of the real property to be acquired maybe subject to easements and rights-of-way appropriated to existing public uses.
To the extent that the herein described use or uses will unreasonably interfere with or impair the continuance of any public use as it may now exist or may reasonably be expected to exist in the future, the City finds and determines that the herein described use or uses are more necessary than said existing public use. Counsel for the City is authorized to acquire the herein described real property appropriated to such existing public uses pursuant to section 1240.610 of the California Code of Civil Procedure. Staff is further authorized to make such 3 improvements to the real property being acquired that it determines are reasonably necessary to mitigate any adverse impact upon the existing public use.
SECTION 7. Environmental Determination. The environmental effects of the Project were contemplated and analyzed and determined to fall within an exemption to California Environmental Quality Act (“CEQA”) (Public Resources Code, § 21000 et seq.), and the State CEQA Guidelines (14 CCR § 15000 et seq.) as set forth in Section 15311 (Class 11:
Accessory Structures).
SECTION 8. Further Activities. Counsel for the City is hereby authorized to acquire the hereinabove described real property in the name of and on behalf of the City by eminent domain, and counsel is authorized to institute and prosecute such legal proceedings as may be required in connection therewith. Legal counsel is further authorized to take such steps as may be authorized and required by law, and to make such security deposits as may be required by order of court, to permit the City to take possession of and use said real property at the earliest possible time. Counsel is further authorized to correct any errors or to make or agree to non-material changes in the legal description of the real property that are deemed necessary for the conduct of the condemnation action, or other proceedings or transaction required to acquire the subject real property.
SECTION 9. Effective Date. The Mayor shall sign this Resolution, and the City Clerk shall attest thereto, and this Resolution shall take effect and be in force on the date of its adoption.

SECTION 2. Public Use. The public use for which the Property Interest is to be acquired is for the construction of the Project, located at the corner of Heald Avenue and Main 2 Street, in the City of Lake Elsinore, California. Sections 37112, 37350, 37350.5, 37353, 37361, 37364, and 38010 of the California Government Code authorize the City to acquire by eminent domain property necessary for such purposes.

Counsel for the City is authorized to acquire the herein described real property appropriated to such existing public uses pursuant to section 3 1240.610 of the California Code of Civil Procedure. Staff is further authorized to make such improvements to the real property being acquired that it determines are reasonably necessary to mitigate any adverse impact upon the existing public use.
SECTION 7. Environmental Determination. Accessory Structures).
