RECOGNITION OF THE VOLUNTEERS IN PARKS PROGRAM
PARTICIPANTS
RECOMMENDED ACTION(S):
Recognize the volunteers who performed the quarterly park inspections for the Volunteer in Parks ("VIP") Program for Fiscal Year 2022-2023 EXECUTIVE SUMMARY:
Staff recommends that the City Council recognize the dedicated volunteers in the Volunteer in Parks (“VIP”) program for Fiscal Year 2022-2023. At the City Council's direction in 2020, staff invited community members from the 2018 and 2019 Lake Forest Leadership Academy to assist in surveying our City parks. The program currently has 15 volunteers for the 31 City parks. This year, we had one volunteer exit the program while two new volunteers joined. Most of the volunteers inspect more than one park and email their quarterly park surveys via phone, tablet, or computer. When necessary, volunteers provided staff with feedback regarding any items that need attention at the park. This year, staff received reports describing the parks to be in good condition. If there were any issues, they typically would consist of requests for repairs due to vandalism.
Attached is the list of VIP program participants (Attachment 1) for Fiscal Year 2022-2023 and a sample certificate (Attachment 2). Staff would like to thank all our volunteers for another successful year in the program.

DEPARTMENT: Public Works
SUBJECT:
REJECT ALL BIDS AND AUTHORIZE RE-BIDDING FOR PITTSFORD PARK SHADE STRUCTURE CANOPY REHABILITATION PROJECT (PW 2022-09) RECOMMENDED ACTION(S):
1. Reject all bids for the Pittsford Park Shade Structure Rehabilitation Project (PW-2022-09).
2. Authorize staff to solicit new bids for this project.
EXECUTIVE SUMMARY:
The Pittsford Park Shade Structure Rehabilitation Project, part of the Park Gazebo Repair/Replacement Project in the FY 2021-23 Capital Improvement Projects (“CIP”) budget, would rehabilitate the existing shade structure at Pittsford Park. The project was advertised through Planet Bids, an electronic procurement management system the City utilized at the time the procurement was issued.
On May 31, 2023, the City received bids from six (6) firms ranging from $45,575 to $400,000. In reviewing the bid packages, only one bidder provided examples of the experience and technical expertise required to complete the highly technical repairs to the shade structure. Staff recommends the City Council reject all bids and authorize rebidding the project with a revised scope requiring proof of experience in similar projects.
BACKGROUND:
The picnic area shade shelter at Pittsford Park is an original structure from the late 1980’s/early 1990’s. Age, termite impacts, and weather damage have compromised the large wooden crossmembers that support the wood and metal canopy cover.
The proposed project would replace all the primary support beams, requiring the hydraulic lifting of the large canopy roof and lowering the rehabilitated roof back onto seismically secure pilasters. In addition, the structure would be repainted Item: 11
36 and new lighting would be installed. The engineer’s estimate for the Pittsford Park Shade Structure Rehabilitation Project was $250,000 to $300,000. The project is estimated to be completed in 60 to 90 working days and when completed, the structure should have a useful life of 20-25 years.
DISCUSSION:
On May 31, 2023, the City received bids from six (6) firms, ranging from $45,575 to $400,000. Of the six bids, three of the firms submitted very low bids while the other three submitted bids closer to the engineer’s estimate of the project. The three low bids of $45,575, $65,700, and $82,811 raised serious questions about whether these firms were responsible bidders and sufficiently qualified to perform the work safely. The experience of the three lowest bidders represented minor facility repair work and not structural work as defined in the scope of work. The three higher bids were generally in-line with the engineer’s estimate for the project. However, only one of the firms included experience on a project similar to the Pittsford Park Project.
Given the wide variance of the bids received and the unclear technical capacity of many of the bidders to complete this project safely, staff recommends the City Council reject all bids and rebid the project. If approved, staff plan to reissue a new set of bid documents that provides more emphasis on the technical work required to lift the roof of the shade structure and affix new horizontal support beams properly to ensure stability.
FISCAL IMPACT:
There is minor fiscal impact for the recommended action.

AWARD OF CONTRACTS FOR CONTRACT ADMINISTRATION AND
CONSTRUCTION INSPECTION SERVICES FOR ARTERIAL RESURFACING
PROJECTS
RECOMMENDED ACTION(S):
1. Award a Professional Consultant Services Agreement with a compensation amount of $252,853.55 to Interwest Consulting Group for Contract Administration and Construction Inspection Services.
2. Award a Professional Consultant Services Agreement with a compensation amount of $194,620 to Z&K Consultants Inc. for Contract Administration and Construction Inspection Services.
3. Authorize the Mayor to sign, and the City Clerk to attest, the award of contracts to Interwest Consulting Group and Z&K Consultants Inc.
EXECUTIVE SUMMARY:
The City utilizes consultants to provide Contract Administration and Construction Inspection Services for 2021-2028 Capital Improvement Plan (“CIP”) projects. On May 3, 2023, the City issued a Request for Proposal (“RFP”) to secure multiple firms for six (6) arterial resurfacing projects. Multiple firms would be beneficial to ensure firms will be able to provide qualified consultants when needed and staff each project properly without stretching its resources. It also provides an opportunity to engage a larger number of well-qualified consultants with local presence and diversify the team of professionals that provide services to the City.
The City received five (5) proposals in response to the RFP solicitation. Those five (5) firms were evaluated utilizing the City’s Purchasing and Contracting Guidelines (“Purchasing Guidelines”). Each firm was individually evaluated and scored as part of the City’s proposal evaluation process.
The two highest rated firms were Z&K Consultants Inc. ("Z&K”) and Interwest Consulting Group ("Interwest”). Based on the satisfactory review of Z&K’s and Interwest’s proposals, staff recommends the City Council approve the proposed Professional Consultant Services Agreements (“Agreements”) with each firm for Contract Administration and Construction Inspection Services for the specific Item: 12
40 projects listed below (Attachments 1 and 2). Z&K and Interwest both received favorable reviews when staff performed reference checks (Attachment 2). The Agreements include the following compensation amounts and a three-year term with two optional one-year extensions:
1. Interwest - $252,853.55 for Trabuco Road Resurfacing (Bake to Peachwood); Trabuco Median Improvements (at Ascension Cemetery); Trabuco Trail Asphalt Repairs (Bake to Peachwood); Lake Forest Drive Resurfacing (Bake to Portola Parkway); and Lake Forest Drive Resurfacing (Serrano Road to Fernleaf Drive) projects.
2. Z&K - $194,620 for Bake Parkway Resurfacing (South Pointe Dr to Rancho Parkway S Phase 1 and 2) project.
All projects are included as part of the individual project budgets within the City’s 2021-2028 CIP, which includes the funding sources for each project.
BACKGROUND:
The City utilizes consultants to provide Contract Administration and Construction Inspection Services for the implementation of CIP projects. In a memo dated April 22, 2023, the City Manager approved the RFP for Contract Administration and Construction Inspection Services and authorized staff to solicit proposals.
On May 3, 2023, the City issued the RFP on the City’s electronic bid management system, PlanetBids, to secure consultants for the following six (6) arterial resurfacing projects:
1. Trabuco Road Resurfacing (Bake Parkway to Peachwood);
2. Trabuco Median Improvements (at Ascension Cemetery);
3. Trabuco Trail Asphalt Repairs (Bake Parkway to Peachwood);
4. Lake Forest Drive Resurfacing (Bake Parkway to Portola Parkway);
5. Lake Forest Drive Resurfacing (Serrano Road to Fernleaf Drive); and
6. Bake Parkway Resurfacing (South Pointe Drive to Rancho Parkway South Phase 1 and 2).
DISCUSSION:
On May 31, 2023, the City received proposals in response to the RFP from the following five (5) firms:
•Interwest
•KOA
Item: 12
41 •SYRUSA
•Transtech
•Z&K
The proposals were subsequently reviewed by a selection panel consisting of staff from the Public Works and City Clerk Departments:
•City Clerk
•Assistant City Engineer/Engineering Services Manager
•Principal Civil Engineer
During review of the technical proposals, the selection panel scored proposals based on criteria described in the RFP. Pursuant to the City's Purchasing Guidelines, the City invited all five firms to the interview phase of the selection process to discuss their respective approaches to the requested services. The two highest rated firms were Z&K and Interwest. Each firm recommended for the projects listed below were selected based on their well-prepared presentations, excellent examples of similar engagements, thorough responses to the interview questions, and proposed costs. The two most qualified and cost-effective firms after the technical review, interview phase, and cost proposals were assigned to the projects.

Z&K 76 89 66 231 144 132 123 399 120 519
Interwest was the chosen consultant for the first two construction contracts, which will include the following five projects:
1. Trabuco Road Resurfacing (Bake to Peachwood)
2. Trabuco Median Improvements (at Ascension Cemetery)
3. Trabuco Trail Asphalt Repairs (Bake to Peachwood)
4. Lake Forest Drive Resurfacing (Bake to Portola Parkway)
5. Lake Forest Drive Resurfacing (Serrano Road to Fernleaf Drive) It is the City’s intent to bid Trabuco Road Resurfacing (Bake Parkway to Peachwood); Trabuco Median Improvements (at Ascension Cemetery); Trabuco Trail Asphalt Repairs (Bake Parkway to Peachwood); and Lake Forest Drive Resurfacing (Bake Parkway to Portola Parkway) projects as a single package to be awarded to a single contractor. Lake Forest Drive Resurfacing Project (Serrano Road to Fernleaf Drive) is anticipated to be awarded separately after construction of the first set of projects. Hence, Interwest is being awarded to provide support for the first two construction contracts scheduled to go to bid.
Z&K was the chosen consultant for the two construction contracts for both phases of the sixth project: Bake Parkway Resurfacing (South Pointe Drive to Rancho Parkway South Phase 1 and 2).
Due to the large project scope, it is the City’s intent to bid and complete the Bake Parkway Resurfacing (South Pointe Drive to Rancho Parkway South) in two phases via two construction contracts.
Z&K currently holds multiple contracts with the City for CA/CI services of a similar nature for other CIP projects. Based on the tentative schedule of CIP projects, it Item: 12
43 is anticipated that at least three of the upcoming CIP projects (i.e. two residential slurry seal projects and one arterial streets slurry seal project) which Z&K will be providing CA/CI services for will potentially have overlap with the first two construction contracts for projects 1 through 5 in this report. Hence, staff recommends awarding the services for projects 1 through 5 to Interwest and awarding the services for the last two construction contracts to Z&K. This approach provides for better resource management and accommodates project schedules.
Compensation for Contract Administration and Construction Inspection Services are based on a time and materials basis for four (4) specific tasks for each project defined in the solicitation. At the conclusion of the interview process, the interviewed firms had the opportunity to submit a last, best, and final cost proposal. Those cost proposals or the original, if a revised proposal was not submitted, were utilized for the selection of the most qualified, cost-effective firms. Staff checked references for both firms, and both received positive reviews based on projects completed for other agencies (Attachment 3) CIP Funding Overview:
Projects identified in the current fiscal year (2023-24) have funds allocated to begin the projects. Projects budgeted in Fiscal Year 2024-25 will have funds allocated when the City Council approves next years’ operating budget. Any future funding would be allocated by the City Council, as necessary.
The proposed Agreements with Interwest and Z&K provide for a three-year term with two one-year term extensions. The Agreements include the following compensation amounts:
1. Interwest - $252,853.55
2. Z&K - $194,620
If approved, the term of the Agreements would begin on September 6, 2023, and end on September 5, 2026, unless extended. Interwest and Z&K’s scopes of work are provided within Exhibit A of the proposed Agreements for each project selected (Attachments 1 and 2). The Agreements describe the process for securing extra work from the consultant and the City’s Purchasing Guidelines allow the City Manager to authorize up to 10% of additional work beyond the compensation amount. Consistent with the City’s Purchasing Guidelines, the Finance Department prepared the Agreements and the City Attorney’s Office reviewed and approved them as to form.

44 FISCAL IMPACT:
Funds to pay for Contract Administration and Construction Inspection Services are included as part of the individual project budgets included in the City’s 2021- 2028 Capital Improvement Plan. The proposed Agreements with Interwest and Z&K include the following compensation amounts and a three-year term, with two optional one-year extensions: Interwest - $252,853.55 and Z&K - $194,620.

CITY COUNCIL AGENDA REPORT
MEETING DATE: 9/5/2023
DEPARTMENT: Community Development
SUBJECT:
The Meadows General Plan Amendment (“GPA”) 06-23-5639 and Nakase Area Plan Amendment (“AP”) 06-23-5640 to allow (1) changes in the land use designation for the school site located within The Meadows residential community on the southeast corner of Bake Parkway and Rancho Parkway from Public Facility to Low Density Residential (2-7 du/ac); (2) a change in zoning designation from School Site to Neighborhood 6; (3) all related applicable changes to the Area Plan text, tables, and exhibits; and (4) conversion of public to private streets as applicable.
RECOMMENDED ACTION(S):
Table the item to allow for consultation with tribal governments as required by Senate Bill (“SB”) 18.
EXECUTIVE SUMMARY:
This is a request to table General Plan Amendment (“GPA”) 06-28-5639 and Area Plan (“AP”) 06-23-5640 to allow staff to consult with tribal governments as required by Senate Bill (“SB”) 18. Following consultation with tribal governments, staff will re-notice the item for hearing before the City Council for determination.
Currently, staff is processing GPA 06-28-5639 and AP 06-235640 to allow (1) changes in the land use designation for the school site located within The Meadows residential community on the southeast corner of Bake Parkway and Rancho Parkway from Public Facility to Low Density Residential (2-7 du/ac); (2) a change in zoning designation from School Site to Neighborhood 6; (3) all related applicable changes to the Area Plan text, tables, and exhibits; and (4) conversion of public to private streets as applicable.
BACKGROUND:
The Meadows was approved by the City Council on January 21, 2020, under General Plan Amendment 05-17-5033, Zone Change 05-17-5034, Area Plan 05- 18-5166, and Vesting Tentative Tract Map 18142. Approval allowed for a master plan development of a maximum of 776 units, including up to 675 residential Item: 13

units and up to 101 senior affordable apartments, a 10-net acre elementary school site, seven privately owned parks for public use, and open space.
Additionally, the City Council certified an Environmental Impact Report (“EIR”) for the Nakase Area Plan (Screencheck No. 2018071035) and approved a Development Agreement with Toll Brothers West, Inc. (“Toll Brothers”).
The Meadows residential community is bounded by Bake Parkway to the north, Rancho Parkway to the east, Serrano Creek Trail to the south, and the former Panasonic Business Park to the east as shown in Exhibit 1 below.

DISCUSSION:
Prior to the City Council approval of The Meadows residential community in January 21, 2020, staff contacted Native American Tribal Governments in accordance with SB 18 (under GPA 05-17-5033 and AP 05-18-5166). On July 19, 2018, staff consulted with the Gabrieleno Band of Mission Indians – Kizh Nation, the only tribal government to request a consultation. In response, staff incorporated the EIR mitigation measure requested by the tribe (mitigation measure 4.5.1, Attachment 1). This mitigation measure required, among other requirements, that Toll Brothers hire an archaeologist/historian and Native American to monitor site grading operations in the event historical resources or unique archaeological resources were discovered during the grading operation.
No such resources were discovered during the grading of the 122-acre site, including the 10-net acre school site, and no additional grading is proposed.
Houses alongside the school site have been built and the school site has been completely excavated and will be backfilled. Dirt from the school site was used Item: 13

for home construction activities and now that homes have been built, the school site will be filled with dirt to accommodate new construction on the school site.
Although staff consulted with the Gabrieleno Band of Mission Indians – Kizh Nation as part of the environmental process for the original GPA in 2018, the current project to amend the General Plan land use designation and Area Plan for the former school site is a new GPA and an Area Plan Amendment, which under a strict interpretation of SB 18 would require a new consultation process.
Staff has consulted with Toll Brothers representatives, and they concur that a new consultation should be requested in an abundance of caution. In accordance with SB 18, staff will notify tribal governments in the area of the proposed GPA and AP amendment prior to the City Council determination on the proposed amendments. Accordingly, tribal governments will have 90 days from the date the City’s notification is received to request a consultation. However, the letter will request that tribal governments expedite their review, as the tribe, Gabrieleno Band of Mission Indians-Kizh Nation, was onsite during construction of The Meadows to monitor grading operations as was required by EIR Mitigation Measure 4.5.1 (Attachment 1) and City Council Resolution 2020-19 (Attachment 2). Once this process is completed, staff will re-notice the GPA and AP for hearing before the City Council.
FISCAL IMPACT:
The cost of processing the proposed amendments and tribal consultations is being reimbursed by Toll Brothers. All future entitlement deposit/fees will be paid by the applicant.

Mitigation Measure 4.5.1 Archaeological Resources, Tribal Cultural Resources, and Human Remains. Prior to issuance of a grading permit for any site within the Project area, a qualified archaeologist shall be retained by the Applicant for that grading permit to provide professional archaeological services. The archaeologist shall be present at the pre-grading conference to establish procedures for archaeological resource surveillance. Those procedures shall include provisions for temporarily halting or redirecting work to permit sampling, identification, and evaluation of resources deemed by the archaeologist to potentially be historical resources or unique archaeological resources under the California Environmental Quality Act (CEQA). The archaeologist also shall conduct on-site archaeological monitoring for the grading operation. Should historical resources or unique archaeological resources be discovered during the grading operation, grading activities shall be modified to allow expeditious and proper analysis and/or salvage of the resources. Disposition of the resources shall be within the discretion of the City of Lake Forest.
Prior to Approval of Grading or Improvement plans, the Applicant shall implement a grading monitoring plan to mitigate potential impacts to undiscovered buried archaeological resources and tribal cultural resources on the Nakase Nursery/Toll Brothers Project to the satisfaction of the City of Lake Forest. This program shall include, but shall not be limited to, the following actions:
1. Provide evidence to the Lead Agency that a qualified archaeologist and Native American monitor has been
contracted to implement a grading monitoring program to the satisfaction of the City of Lake Forest. A letter from the Project Archaeologist shall be submitted to the City of Lake Forest Director of Community Development. The letter shall include the following guidelines:
a. The qualified archaeologist/historian and Native American monitor shall attend the pre-grading meeting with the
contractors to explain and coordinate the requirements of the monitoring program.
b. The consulting archaeologist and Native American monitor shall monitor all areas identified for development.
c. An adequate number of monitors (archaeological/
historical/Native American) shall be present to ensure that Item: 13
108
all earth-moving activities are observed and shall be on site during all grading activities.
d. During the original cutting (used in this mitigation to refer to the “cut” part of “cut and fill”) of previously undisturbed deposits, the archaeological monitor(s) and Native
American monitor(s) shall be on site full time. Inspections will vary based on the rate of excavation, the materials excavated, and the presence and abundance of artifacts and features. The frequency and location of inspections shall be determined by the Principal Investigator.
e. During the cutting of previously disturbed deposits, the archaeological monitor(s) and Native American monitor(s) shall be on site as determined by the Principal Investigator of the excavations. Inspections will vary based on the rate of excavation, the materials excavated, and the presence and abundance of artifacts and features. The frequency and location of inspections shall be determined by the Principal Investigator in consultation with the Native American
monitor.
f. Isolates and clearly non-significant deposits shall be minimally documented in the field, and the monitored
grading can then proceed.
g. In the event that previously unidentified, potentially significant cultural resources (including tribal cultural resources) are discovered, the archaeologist, in consultation with the Native American monitor(s), shall have the
authority to divert or temporarily halt ground disturbance operations in the area of discovery to allow for evaluation.
The archaeologist shall contact the City of Lake Forest Director of Community Development at the time of
discovery. After consultation with the property owner,
archaeologist, and Native American monitor(s), disposition of the resources shall be within the discretion of the City of Lake Forest. For significant cultural resources, a Research Design and Data Recovery Program to mitigate impacts shall be prepared by the archaeologist, in consultation with the Native American monitor(s), then carried out using
professional archaeological and culturally sensitive
methods.
Item: 13
109
h. If any human bones are discovered, the Principal
Investigator shall contact the County Coroner. In the event the remains are determined to be of Native American
origin, the Most Likely Descendant, as identified by the Native American Heritage Commission, shall be contacted in order to determine proper treatment and disposition of the remains.
i. Before construction activities are allowed to resume in the affected area, the artifacts shall be recovered and features recorded using professional archaeological methods. The Principal Investigator shall determine the amount of
material to be recovered for an adequate artifact sample for analysis.
j. In the event that previously unidentified non-tribal cultural resources are discovered, those resources shall be
processed and curated at a facility that meets federal
standards per 36 CFR Part 79, and therefore shall be
professionally curated and made available to other
archaeologists/researchers for further study. The collections and associated records shall be transferred, including title, to the John D. Cooper Archaeological and Paleontological Curation Center, to be accompanied by payment of the fees necessary for permanent curation. Evidence shall be in the form of a letter from the curation facility identifying that the materials have been received and that all fees have been paid.
k. In the event that previously unidentified cultural resources are discovered, a report documenting the field and analysis results and interpreting the artifact and research data within the research context shall be completed and
submitted to the satisfaction of the City of Lake Forest prior to the issuance of any building permits. The report shall include California Department of Parks and Recreation
Primary and Archaeological Site Forms.
l. In the event that no cultural resources are discovered, a brief letter to that effect shall be sent to the City of Lake Forest by the consulting archaeologist that the grading monitoring activities have been completed.
2. Provide evidence to the City of Lake Forest that the following notes have been placed on the Grading Plan:

CITY COUNCIL AGENDA REPORT
MEETING DATE: 9/5/2023
DEPARTMENT: City Manager
SUBJECT:
CROSSING GUARD SERVICES DISCUSSION
RECOMMENDED ACTION(S):
Receive and File.
EXECUTIVE SUMMARY:
The City of Lake Forest has provided crossing guard services at various intersections to facilitate pedestrian-safe travel to and from public schools since incorporation. Crossing guard services are currently provided by All City Management Services, Inc. (“ACMS”) via a Professional Services Agreement (“ACMS Agreement”) (Attachment 1). The City entered into the ACMS Agreement on June 9, 2020. The ACMS Agreement was amended on September 25, 2020, to incorporate a midday shift to accommodate temporary school scheduling changes in response to COVID-19 (Attachment 2). The ACMS Agreement was amended again on June 20, 2023, to increase the hourly rate paid by ACMS to its staff (Attachment 3).
On June 20, 2023, City Councilmembers Voigts requested the City Attorney return with a report at a subsequent meeting to describe the City’s legal responsibilities associated with the provision of crossing guard services (Attachment 4). The City Attorney’s Office has completed the necessary research to provide a response to the City Council at tonight’s meeting.
In summary, local governments in California are not required to provide crossing guards related to public schools by statute but are exposed to potentially significant legal liability if crossing guard services are not provided. If a student is injured due to a vehicle-related incident at a crosswalk the City is responsible for managing and no crossing guard was present, the City is exposed to potential lawsuits from the injured party. As a result, most local agencies in California provide crossing guard services through a contract service or with in-house staff.
Staff recommends the City Council receive and file this report from the City Attorney’s Office.
Item: 14
239
BACKGROUND:
The City has contracted for crossing guard services near public schools at various locations throughout the city since incorporation. These services include providing equipped and trained personnel for crossing pedestrians in marked crosswalks, as well as supervisory personnel to ensure crossing guard activities are taking place at the required places and times. Pursuant to the ACMS Agreement, the City is charged on a per-hour basis for crossing guard services.
Crossing guards provide one hour of service in the morning and one hour of service in the afternoon on school days. This is considered a “split shift” in the State of California. A split shift is a work schedule that is interrupted by non-paid and non-working time, longer than a meal period or regular break and within the same workday. According to the California Department of Industrial Relations, a business is required to pay one hour of wages to employees making minimum wage for each split shift.
On June 9, 2020, the City entered into the ACMS Agreement with a $858,843 compensation amount over a three-year term (Attachment 1). On September 25, 2020, the City Manager authorized the First Amendment to the ACMS Agreement, which adjusted the scope of work to include a midday shift at each site and added $81,636.66 in compensation (Attachment 2). The midday shift was implemented in response to Saddleback Valley Unified School District’s (“SVUSD”) hybrid school day model, which was temporarily in place during the COVID-19 pandemic. Pursuant to the ACMS Agreement, there are 23 crossing guard stations at 20 designated locations in the morning and afternoon during school days. Table 1 lists the locations of each guard, including the three intersections that have two guards providing service.

On June 20, 2023, the City Council approved the Second Amendment to the Agreement with ACMS (Attachment 3). The Second Amendment increased the hourly rate for crossing guard services from $23.62 per hour to $29.12 per hour.
ACMS cited increased difficulty in hiring and retaining staff as the basis for their original rate increase request of $30.44 per hour. Staff plan to commence a new procurement process to secure crossing guard services later this year.

After approving the Second Amendment to the Agreement with ACMS on June 20, 2023, Council Member Voigts and Council Member Yu requested the City Attorney return with a report at a subsequent meeting to describe the City’s legal responsibilities associated with the provision of crossing guard services (Attachment 4).
DISCUSSION:
The City Attorney’s Office has completed the necessary research to inform the City Council of the legal liabilities associated with the provision of crossing guards for public schools. Research by the City Attorney’s Office indicates that the City possesses the statutory authority, but not a duty, to establish crossing guard programs for schools within its jurisdiction. The California Vehicle Code (“CVC”) authorizes cities to adopt rules and regulations by ordinance or resolution regarding the placement of non-student crossing guards for the protection of persons who are crossing a street or highway in the vicinity of a school (CVC § 21100(i)).
Although the City is not statutorily required to establish and fund school crossing guard programs, failing to do so could expose the City to liability in the unfortunate event that a student is involved in a collision at an established, but unattended, school crosswalk. While the success of such a lawsuit would depend on the factual circumstances surrounding the incident, there is a possibility that a court could find the City liable under the theory that the City created a dangerous condition and had a duty to protect students with crossing guard services. To mitigate this liability, most local agencies in California choose to provide crossing guard services.
Since its incorporation, the City has provided crossing guards near public schools at various locations throughout the community. Such crossing guards play an important role by helping children cross the street at key locations and reminding drivers that pedestrians are present. The design and implementation of a school crossing guard program is at the discretion of the local jurisdiction. Limited federal and state guidance is available pertaining to the operation of a crossing guard program, specifically where crossing guards should be assigned. This guidance includes the California Manual on Uniform Traffic Control Devices (“CA MUTCD”), which provides general guidance on evaluating the need for a crossing guard at school crossings.
FISCAL IMPACT:
There is no fiscal impact associated with the recommended action.
