MEETING DATE: 6/18/2024
DEPARTMENT: Public Works
SUBJECT:

ACCEPTANCE OF LENNAR HOMES IMPROVEMENTS AND RELEASE OF
BONDS FOR TRACT 18162
RECOMMENDED ACTION(S):

1. Accept as complete the tract improvements and monumentation constructed by Lennar Homes of California, Inc., A California Corporation, for Tract 18162.

2. Authorize the City Clerk to release the Subdivision Faithful Performance and Subdivision Labor and Materials Bonds, both in the amount of $1,197,021, and the Subdivision Improvement Monumentation Bond in the amount of $63,000.

3. Authorize the City Clerk to release the Subdivision Improvement Warranty Bond in the amount of $119,702.10 one year after acceptance of the public improvements for Tract 18162 with the concurrence of the Director of Public Works/City Engineer.

EXECUTIVE SUMMARY:

On October 1, 2019, the City Council approved Final Tract Map No. 18162 (Attachment 1) for a 102-numbered and 16-lettered lot subdivision, and a Subdivision Improvement Agreement with Lennar Homes of California, a California Limited Corporation (“Lennar”). These approvals enabled Lennar to construct 101 single-family homes and a Community Center. Of the sixteen lettered lots, nine are for open space and landscape purposes, six are for private street purposes, and one is for park purposes. All sixteen lettered lots will be maintained by the Homeowners Association (“HOA”).

In accordance with the agreement, Lennar submitted a Subdivision Improvement Faithful Performance Bond and a Subdivision Improvement Labor and Materials Bond, both in the amount of $1,197,021 to guarantee construction of the tract improvements. These improvements include street, curb and gutter, sidewalk, streetlight, and common open space improvements. All improvements are private and will be maintained by the HOA. Lennar also submitted a Subdivision

Improvement Monumentation Bond in the amount of $63,000 to establish monuments for the tract.

Lastly, Lennar submitted a Subdivision Improvement Warranty Bond in the amount of $119,702.10 to guarantee repair or replacement of the tract improvements for defective work for a one-year period after acceptance of the improvements. On April 19, 2024, the City received a letter from Lennar requesting release of bonds associated with the tract improvements and monumentation for Tract 18162 (Attachment 2). There were several items required of Lennar before the City would accept the improvements. These included repairs to concrete and asphalt improvements. Staff determined the tract improvements now comply with the approved plans and are completed to the satisfaction of the Public Works Department. The HOA will maintain all tract improvements.

Lennar’s engineer, Michael Baker International, provided a letter (Attachment 3) stating that all survey monuments required by Tract 18162 were set and that payment had been made in full for all monuments. Staff recommends the City Council accept the completed improvements and monumentation for Tract 18162 and authorize the release of the Subdivision Improvement Faithful Performance, Subdivision Improvement Labor and Materials, and the Subdivision Improvement Monumentation Bonds. Staff also recommends the City Council authorize the City Clerk to release the Subdivision Improvement Warranty Bond one year after acceptance of the improvements with the concurrence of the Director of Public Works/City Engineer.

FISCAL IMPACT:

There is minimal fiscal impact to the city as all improvements will be maintained by the HOA.
