STAFF REPORT
RE: Public Hearing: Ordinance amending Section 9.04.030 of the Lakeport Municipal Code – Restrictions on Use of Public Restrooms
MEETING DATE: 02/18/2025
SUBMITTED BY: Police Chief Dale Stoebe
PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to conduct a public hearing to consider adopting a proposed Ordinance amending a certain section to Lakeport Municipal Code Chapter 9.04 and adding certain subsection text to the same to address loitering, lingering, being idle at, in or within a prescribed distance of any public restroom within the incorporated city limits of Lakeport without a lawful purpose, or blocking ingress or egress to any public restroom within the incorporated city limits of Lakeport.
BACKGROUND/DISCUSSION: Within the past eighteen months, the City of Lakeport (the City) has experienced an increase in subjects loitering, lingering, and being idle at, in, or close to public restrooms. Additionally, during that time, the City has also experienced an increase in the number of people encountered while sitting or lying on the floors inside public restrooms. Not only has this resulted in calls for service to the Lakeport Police Department for public safety concerns for self and others, Lakeport Police Department Officers, in their regular patrol activities, have observed and encountered people being idle near and within public restroom, and blocking entrances and exits to the same. At times, the police department has been summoned to contact those individuals due to aggressive behavior or loitering behaviors at entrances and exits of public restrooms, including individuals that are perceived of opposite gender to the restroom that they are blocking.
The current City of Lakeport Municipal Code lacks an enforceable section to regulate this described conduct, which significantly limits the police department’s ability to properly provide for public safety. Additionally, current state laws related to similar conduct are only enforceable when a sexual gratification component can be established, which further prevents the provision of effective public safety services. This ordinance will provide officers with the ability to request loitering individuals to leave the area, while making it unlawful to return in less than 72-hours, and exempts this conduct when it is the result of a bona fide medical emergency. This Meeting Date: 02/18/2025 Page 2 Agenda Item # VI.A.
388944.1
ordinance will allow sworn police staff to return public restroom space to its intended and safe use by the community.
Changes to the specific code section would be as follows:
9.04.030 Restrictions on use of public restrooms.
A. It is unlawful for any person to fail to cooperate in maintaining restrooms and washrooms in a neat and sanitary condition.
B. Male persons shall not resort to any restroom or washroom facilities set apart for women, and female persons shall not resort to restrooms and washroom facilities set apart for men; provided, that this shall not apply to children accompanied by an adult person.; further, no person shall loiter in or about such facilities nor shall any person use such facilities for purposes other than those intended. (Ord. 456 §6, 1970)
Additions of subsections C and D would be as follows:
C. It shall be unlawful for any person to loiter at, in, or within fifteen (15) feet of any public restroom, or intentionally block, hinder, or otherwise interfere with the ingress or egress of anyone attempting to use any public restroom. It shall further be unlawful to return to a public restroom within seventy-two (72) hours after having been ordered to leave by a peace officer for loitering at, in, or within fifteen (15) feet of that restroom. As used in this subsection, “loiter” means to delay, to linger, to sit, to lay, or to idle about in any City park, on City property or property otherwise designated for public use, without a lawful purpose for being present. This subsection is not intended to prohibit any person from engaging in any lawful purpose that may be conducted within fifteen (15) feet of a public restroom, such as (1) using the public restroom; (2) waiting in line to use the public restroom; or (3) accompanying or assisting another person who is using a public restroom.
D. The prohibitions set forth in subsections (C) of this section shall not apply to any person whose conduct arises out of a medical emergency.
OPTIONS:
1. Hold public hearing and adopt the proposed Ordinance amending Lakeport Municipal Code Section
9.04.030 as presented;
2. Provide input and refer this Ordinance back to staff for modification;
3. Do not adopt the proposed Ordinance.

MEETING DATE: 02/18/2025
SUBMITTED BY: Joey Hejnowicz, Community Development Director PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to hold a public hearing and adopt a resolution of the City Council of the City of Lakeport approving the issuance of the California Municipal Finance Authority exempt facility bonds in an aggregate principal amount not to exceed $35,000,000 for the purpose of financing or refinancing the acquisition, construction, improvement and equipping of Parkside Apartments and certain other matters relating thereto.
INTRODUCTION:
The California Municipal Finance Authority (Authority) requested the City of Lakeport City Council approve the issuance of the Bonds by the Authority to satisfy the public approval requirement of Section 147(f) of the Internal Revenue Code of 1986 (Code) and the requirements of Section 4 of the Joint Exercise of Powers Agreement Relating to the California Municipal Finance Authority, dated as of January 1, 2004. The City Council of the City of Lakeport is the elected legislative body of the City and is one of the applicable elected representatives required to approve the issuance of the Bonds under Section 147(f) of the Code because the project is located within the territorial limits of the City.
The CMFA is a joint power authority formed to assist local governments, non-profit organizations, and businesses with the issuance of both taxable and tax-exempt debt. The debt to be issued will be the sole responsibility of the borrower and the City of Lakeport will have no financial or legal obligations or responsibilities regarding the repayment of the debt. All financing documents will carry disclaimers that the loan is not an obligation of the City. The City of Lakeport will bear no costs in the issuance of the proposed debt.
PROJECT BACKGROUND:
The proposed Parkside Apartments project is part of the larger Parkside Residential Project, a mixed-use subdivision located on 15.16 acres (APN 005-030-51), which was previously evaluated in an Initial Study and Meeting Date: 02/18/2025 Page 2 Agenda Item # VI.B.
Mitigated Negative Declaration prepared pursuant to the California Environmental Quality Act (CEQA) and adopted by the City of Lakeport Planning Commission on August 10, 2022. The Parkside Residential Project is based on a 96-lot single-family residential subdivision that was originally approved by the City in 2005. Following approval of this original residential subdivision in 2005, 14 homes were constructed on the east side of the Parkside Residential Project site. The remaining vacant portion of the Parkside Residential Project site was proposed for an increase in density, which triggered the City to reevaluate the project in 2022. This revised Parkside Residential Project amended the 96-lot single-family subdivision to include 176 total dwelling units, including 48 attached single-family units and 128 multi-family units located in 6-, 8-, and 12-unit two-story buildings. The revised Parkside Residential Project also included a community facility, leasing office, parking and landscaping, and internal access roads.
Proposed Parkside Project
The proposed Parkside Project plans for the construction of 64 units of affordable housing on an approximately
3.02-acre portion of the Parkside Residential Project site. Specifically, the Project would include three primary components: affordable workforce/family housing; community support services with a common area community building and auxiliary spaces; and site amenities, such as sidewalks, picnic benches, a half-court basketball court, and playground.
These primary components consist of the following:
• Sixty‐four multifamily residential units (California Building Code Occupancy Classification R‐2 “Residential”) in five separate two‐story structures, located on the proposed site in locations close to common area amenities and waste refuse facilities. These structures would be connected by pedestrian sidewalks to vehicle parking, a half‐court basketball court, and picnic benches A stand-alone community building, approximately 2,111 square feet in size, which would consist of a community room with kitchen, leasing/manager’s office with storage, an exercise room, and a laundry facility with Americans with Disabilities Act (ADA)-compliant washers and dryers. Directly adjacent to the community building would be a 1,901-square-foot tot lot playground with age-appropriate activity systems and structures.
Parkside Project Environmental Initial Study
A thorough and complete environmental Initial Study for the Parkside Project was performed in accordance with the California Environmental Quality Act. The purpose of this Initial Study (IS) is to provide a basis for determining whether to prepare an Environmental Impact Report (EIR) or a Negative Declaration. An IS is intended to satisfy the requirements of the CEQA (Public Resources Code, Div. 13, Sec. 21000-21177) and the State CEQA Guidelines (California Code of Regulations, Title 14, Sec 15000-15387).
The IS examined the potential impacts of the Parkside Project including, but not limited to, impacts to biological resources, noise, cultural resources transportation/traffic, wildfire, air quality, hazards & hazardous materials and more. Ultimately, the IS was adopted by the Lakeport Planning Commission through a Mitigated Negative Declaration finding that the Parkside Project would not create significant environmental harm, or that the environmental impact has been mitigated to a less than significant level.
During public meetings on the Parkside Project, residents have expressed concerns about potential traffic impacts, especially during emergencies, and building high-density housing in a fire-prone area. These concerns are understandable, and safety remains a top priority for City staff. The Initial Study addresses these issues, as summarized below.
A Traffic Impact Analysis for the Parkside Project, conducted by Ruettgers & Schuler Civil Engineers (April 2022), assessed 176 residential units (48 single-family and 128 multifamily). The project is projected to generate 101 AM peak hour trips, 125 PM peak hour trips, and 1,410 daily trips. The analysis found no conflicts with circulation system policies, including transit, roadway, bicycle, and pedestrian facilities, as several improvements Meeting Date: 02/18/2025 Page 3 Agenda Item # VI.B.
are planned. While construction may cause temporary traffic disruptions, the project will not result in inadequate emergency access. The site and surrounding area meet all design criteria and standards for emergency access.
Parkside is located outside a Fire Hazard Zone, as determined by CAL Fire, and is classified as a Non-Very High Fire Hazard Severity Zone within the County of Lake's Local Responsibility Area. The Lakeport Fire Protection District serves the area, with any location in the City accessible within three to five minutes. The proposed residential development is situated along Fenway Street and Yankee Avenue, near Parallel Drive and State Route 29 on ramps, providing quick access for emergency evacuation without increasing wildfire risk. Additionally, the flat terrain offers easier access for firefighters, slows fire spread, allows effective use of firebreaks, and ensures safer conditions for aerial support, all of which significantly reduce wildfire risk.
Parkside Project Emergency Vehicle Access Bridge
Although not required by the Initial Study, in an effort to address neighborhood concerns about emergency access, the project developer plans to build an Emergency Vehicle Access (EVA) Bridge across Forbes Creek, connecting Wrigley Street with Craig Avenue. This bridge will be for emergency vehicles only. A 12-foot-wide gravel access road will be constructed from the end of Wrigley Street to the bridge and will continue to Craig Avenue. Gates or removable bollards will prevent non-emergency vehicle access.
The bridge will feature a 12-foot clear width with crash-rated railings, constructed from steel with steel or concrete decking. It will span the creek without requiring work inside the channel, supported by concrete abutments placed at least 5 feet beyond the creek bank. The bridge will be built to HS20-44 load rating standards per AASHTO, with the underside elevated at least 1 foot above the 100-year flood elevation.
On January 10, 2024, the Lakeport Planning Commission adopted a Mitigated Negative Declaration, confirming that the bridge project will not significantly impact the environment, as per the Initial Study by the Lakeport Community Development Department. The developer is now progressing with the bridge project and complying with federal floodplain management requirements, as a small section of the parcel is within a floodplain.
Parkside Project Financial Considerations
The Parkside project currently has a budget of $34,442,205 that would construct 64 units. 63 of those units will be rented as affordable units and the remaining unit will be reserved for the on-site manager. The 63-unit lowincome breakdown is as follows:

In addition to the construction of housing units, the project also includes a budget of $5,208,171 for on and offsite improvements. The off-site improvements currently included in the project are the connection of Wrigley St. to Craig Ave with the installation of an Emergency Vehicle Access (EVA) bridge and roadway, sidewalk, water, Meeting Date: 02/18/2025 Page 4 Agenda Item # VI.B.
sewer and storm water improvements to Fenway Ave and Yankee Ave. These infrastructure improvements are the impetus to future development of the adjacent sites including the 38 units of market rate cluster homes.

HOUSING ENVIRONMENT AND ECONOMICS:
The broader conversation around housing, particularly affordable housing, is complex and multifaceted. Housing shortages and affordability challenges are influenced by Federal and State policies, impacting local municipalities in significant ways. However, the benefits of affordable housing go beyond providing shelter; these projects can profoundly affect employment, household financial stability, public health, and overall economic activity. Since 2015, Lake County has lost more than 1,800 homes to wildfire. Some estimates indicate more than 60 percent of Lake County has burned in the decade from 2011 to 2021. Approximately 1,400 low-income renter households in Lake County do not have access to an affordable home. Approximately 75% of low-income households in Lake County are paying more than half of their income on housing costs. Below is an analysis of how affordable housing projects, such as the Parkside, positively impact Lakeport and the surrounding areas.
1. Employment and Economic Growth:
Affordable housing construction and development contribute directly to job creation. According to the National Association of Home Builders (NAHB), for every 100 affordable rental units built, approximately 161 local jobs are supported during the construction phase, and 44 permanent jobs are created post-construction in industries such as property management, maintenance, and local service providers. These jobs stimulate the local economy, benefiting Lakeport by increasing employment opportunities for residents.
Additionally, the construction industry itself stimulates a multiplier effect within the local economy. For every dollar spent on residential construction, a significant portion circulates back into the community through local purchases, supplies, and services. This economic activity supports local businesses, further enhancing economic resilience.
2. Reducing High-Cost Burden Households:
Affordable housing alleviates the financial strain on households facing severe cost burdens. Households that spend more than 30% of their income on housing costs are classified as "cost burdened." In Lake County, the rate of cost-burdened renters is notably high—close to 50%, according to U.S. Census data.
By providing housing at affordable rates, the Parkside Project will reduce the number of families experiencing severe cost burdens. Affordable rents allow families to allocate more of their income toward essential needs such as food, healthcare, education, and transportation. When households have more discretionary income, they are more likely to spend locally, directly boosting the municipal economy. The Center for Housing Policy reports that for every dollar saved on housing, up to $0.25 is reallocated to local spending on consumer goods and services, further strengthening the local economy.
Meeting Date: 02/18/2025 Page 5 Agenda Item # VI.B.
3. Improved Health Outcomes:
There is a well-established link between affordable housing and improved health outcomes. Stable, quality housing reduces stress and contributes to better mental and physical health. Families living in affordable housing are less likely to experience overcrowded living conditions, which are associated with negative health outcomes, including respiratory conditions and increased vulnerability to communicable diseases.
The Robert Wood Johnson Foundation report that individuals living in safe, affordable housing are less likely to visit emergency rooms and have fewer chronic health issues such as asthma and cardiovascular disease. In turn, this reduces the strain on local health services, which often bear the cost of treating residents who lack stable housing. Affordable housing also enhances residents' access to preventative care and healthier lifestyles, as they can allocate resources toward medical services, nutritious food, and wellness activities.
4. Enhancing Educational Outcomes:
Stable housing is crucial for children’s academic success. Research by the National Low Income Housing Coalition shows that children in stable housing perform better in school, have higher graduation rates, and are less likely to experience the disruptions of moving frequently, which can negatively impact academic performance.
Affordable housing, by providing long-term stability, enables children to remain in their schools, fostering better educational outcomes.
Improved educational outcomes are a long-term benefit to the municipality, as higher graduation rates and educational attainment levels contribute to a stronger, more educated workforce in the future. This ultimately supports higher income levels for residents, increased productivity, and local economic growth.
5. Increasing Long-Term Community Resilience:
Affordable housing developments contribute to the overall resilience of a community. In times of economic downturn, affordable housing acts as a stabilizer, ensuring that residents are not forced out of their homes due to market fluctuations. This stability is particularly important in Lakeport, where housing markets may become volatile due to external economic factors such as rising inflation, interest rates, or labor shortages.
By investing in affordable housing, the City creates a foundation for sustained economic growth and resilience.
Residents who are financially stable are better equipped to handle economic shifts, contributing to a more adaptable and robust local economy. This, in turn, leads to stronger tax revenues for the City, as local businesses benefit from increased consumer spending.
STAFF RECOMMENDATION:
Staff recommend that the City Council adopt the resolution approving the issuance of bonds by the CMFA for the benefit of the borrower, Lakeport Fenway Avenue, LP. Such an adoption is solely for the purpose of satisfying the requirements of the Code and the City of Lakeport will have no financial or legal obligations or responsibilities regarding the repayment of debt.

PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
Receive an informational presentation from the City of Lakeport and Lakeport Fire Protection District regarding 2024 wildland fire incidents and ongoing mitigation efforts.
BACKGROUND:
The 2024 fire season presented significant wildfire threats to portions of the City, including the loss of two residential structures and smoke damage to several others. Quick action from local and regional responders, along with favorable weather conditions, prevented these incidents from escalating into more severe wildfires.
However, each event underscored the ongoing risk and the need for proactive mitigation efforts.
City and Fire District staff will provide an overview of these incidents and discuss strategies to enhance wildfire preparedness and prevention efforts. Topics for discussion include:
• Enhancing the City's Hazardous Weed Abatement Program to strengthen fire prevention measures. • Update on regional wildfire evacuation planning efforts, including the Lake Area Planning Council's (Lake APC) development of a Wildfire Evacuation and Preparedness Plan, ongoing City and County efforts to update the regional Local Hazard Mitigation Plan, and the development of a Climate Vulnerability Assessment Plan as part of the County of Lake General Plan Update. • Consideration of amendments to Lakeport Municipal Code Chapter 8.11 that currently prohibit all outdoor burning within city limits.
• Exploration of a Wildfire Protection Plan and the potential formation of a Community Firewise District.
• Review of the recently published Local Responsibility Fire Hazard Mapping and its implications for City policies and mitigation efforts.

PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
(a) Adopt a Resolution to Approve the Operational Area Agreement Formalizing County, City, and Special District Coordination and (b) Authorize the City Manager to Sign the Agreement BACKGROUND/DISCUSSION:
The Operational Area Agreement is designed to formalize and strengthen the partnership between Lake County, the City of Lakeport, City of Clearlake, and special districts for coordinated emergency management. STAFF REPORT
RE: Approval of Personnel Cost Budgeting Policy MEETING DATE: 2/18/2024 SUBMITTED BY: Kelly Buendia, Administrative Services Director PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to approve the proposed Personnel Cost Budgeting Policy, which provides a structured approach to estimating Cost-of-Living Adjustments (COLA) as part of the City's annual budget process.
BACKGROUND:
The City of Lakeport is committed to maintaining fiscal responsibility while ensuring that employee compensation keeps pace with economic conditions. The proposed policy formalizes a transparent and consistent method for incorporating estimated COLA adjustments into the annual budget when a formal agreement has not been reached through labor negotiations.
This policy was introduced by CIRA to the City of Lakeport. The policy is designed to provide placeholders for potential COLA adjustments based on the West Region Consumer Price Index (CPI) or a more localized index if one becomes available. These estimates will serve as budgetary planning tools but will remain subject to labor negotiations before final implementation.
DISCUSSION:
The policy establishes the following key provisions:
• If no COLA has been negotiated in a Memorandum of Understanding (MOU), an estimated COLA will be included in the draft budget.
• The estimated COLA will be based on the prior year’s CPI, with the City Manager’s Office presenting options ranging from 1% to 4%.
• For example, if the CPI for the previous year is 3.7%, the City Manager’s Office will include a 3.7% increase in personnel costs in the subsequent budget unless otherwise negotiated. • If the CPI is negative, the City Manager may exclude a COLA in the annual budget. • The City Council retains discretion to approve, modify, or suspend the estimated COLA based on the City's financial position.
RESPONSES TO CONCERNS:
During discussions between the Administrative Services Director and the bargaining unit representative, several clarifications were requested:
Meeting Date: 02/18/2025 Page 2 Agenda Item VII.B.1.
389109.1
• Clarification on CPI Selection: The policy now specifies that the City will use the West Region CPI unless a more localized index for Lake County is developed in the future. • Equity of COLA Estimates: Concerns were raised regarding capping COLA adjustments at 4% while potentially omitting COLA in negative CPI years. The City acknowledges these concerns but maintains the necessity of this approach to ensure fiscal flexibility. Additionally, labor negotiations remain the ultimate determining factor in final salary adjustments. • Budgetary vs. Automatic COLA: The policy strictly serves as a budgeting tool and does not act as an automatic COLA trigger for employees. Final adjustments will continue to be subject to negotiation.
FISCAL IMPACT
This policy does not impose any immediate fiscal impact but provides a structured method for estimating personnel costs, enhancing budget transparency and predictability. Final COLA decisions will be determined during negotiations and reflected in budget amendments as necessary.
ENVIRONMENTAL COMPLIANCE
The approval of this policy is not a project subject to the California Environmental Quality Act (CEQA) pursuant to subsections (b)(2) and (b)(4) of section 15378 of Title 14 of the California Code of Regulations, as the definition of “project” does not include administrative activities, such as personnel-related actions or general policy and procedure making, or government fiscal activities which do not involve any commitment to any specific project which may result in potentially significant physical impact on the environment.
CONCLUSION
The Personnel Cost Budgeting Policy provides a necessary framework for responsible financial planning while maintaining flexibility in labor negotiations. Staff recommends that the City Council approve the policy to improve transparency and consistency in budgeting personnel costs.

1. Approve the Personnel Cost Budgeting Policy.
2. Provide alternative direction.

CITY OF LAKEPORT BUDGET POLICY
COST-OF-LIVING ADJUSTMENT ESTIMATES FOR PERSONNEL
I. Policy Objective
The City of Lakeport establishes this policy to provide Cost-of-Living Adjustment (COLA) estimates as part of its annual budgeting process. Including a structured COLA estimate ensures that funds are allocated appropriately to account for inflationary impacts on personnel costs. The COLA estimate serves as a placeholder adjustment until formal labor negotiations take place. While it provides an interim measure to address cost-of-living changes, final salary adjustments remain subject to negotiation with employee bargaining units.
II. Annual Budget Process
If no COLA has been agreed upon in a Memorandum of Understanding (MOU), the City will incorporate an estimated COLA into the budget process as part of personnel costs. This estimate will be presented to the City Council for consideration and approval. The estimated COLA percentage will be based on the annual Consumer Price Index (CPI) as of December of the prior year, as determined by the U.S. Department of Labor, Bureau of Labor Statistics.
The CPI used for COLA determinations will reflect the West Region Consumer Price Index (CPI) or a more localized index applicable to Lake County (should one become available). The City Manager’s Office will present COLA options ranging from 1% to 4%, based on the prior year’s CPI. For example, if the CPI for the previous year was 3.7%, the City Manager’s office will include a 3.7% increase in personnel costs in the subsequent annual budget, where no COLA has been previously negotiated.
If the CPI reflects a negative adjustment, the City Manager may opt to exclude a COLA in the annual budget.
Subject to the negotiation process, the City Council retains full discretion to approve, modify, or suspend the estimated COLA based on the City’s financial position. If economic conditions or budget constraints require adjustments, the City Council may increase or decrease the estimated COLA accordingly. The final COLA determination will be made as part of the budget adoption process and any negotiations with bargaining units.
III. Evaluation
Estimated COLA adjustments will be reviewed annually based on changes in the CPI over the designated evaluation period, unless a COLA has already been established through a Memorandum of Understanding (MOU). The City of Lakeport reserves the right to modify or suspend COLA estimates based on budgetary constraints or economic conditions.
IV. Implementation
The City Manager’s Office and the Finance Department will be responsible for communicating any estimated COLA included in the budget.

RE: Sewer Lift Station Pump Purchase – Linda Lane MEETING DATE: 2/18/2025 SUBMITTED BY: Paul Harris, Utilities Director
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to authorize the City Manager to sign a purchase order required for the procurement of a new 45 HP HOMA sewer lift station pump.
BACKGROUND/DISCUSSION:
The City of Lakeport utilizes 8 sewer lift stations to transfer sewer from the collection system to the wastewater treatment plant. Each station is equipped with 2 pumps for redundancy in case of a pump failure. In addition, we also maintain a backup pump for immediate replacement if a pump should fail. This level of redundancy is critical in preventing sanitary sewer overflows. Lift station failures usually contribute to the largest spills due to the volumes associated with operations if a failure occurs.
Recently, an existing Flyght 47 HP pump failed at our Linda Lane lift station. It was promptly replaced with a new pump from our back-up inventory. We then delivered the failed pump to Industrial Electric Motors to conduct an evaluation for repair. They provided a quote for $47,763.51 to refurbish the pump. We estimate this pump to have a service life of 18 years to date. A brand-new Flyght pump would exceed this cost.
We simultaneously sought out quotes to replace this pump with a new equivalent HOMA brand. We received quotes from Ryan Process for $30,028 and Thomas Associates for $27,925, respectively. Appropriations were approved for the purchase of a lift station pump for this current fiscal year in the amount of $30,000 from the sewer fund. With that said, we would like to proceed with the purchase of a new HOMA pump from Thomas & Associates in the amount of $27,925.

RE: Contract Amendment for the Forbes Creek Headwall Repair Project ER-40A0(046)
MEETING DATE: 02/18/2025
SUBMITTED BY: Ron Ladd, Public Works Director
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to authorize the City Manager to execute an amendment to the Professional Services Agreement with Dokken Engineering for additional right-of-way services for the Forbes Creek Headwall Repair Project.
BACKGROUND/DISCUSSION:
After the flooding in 2019, the City received federal funding through the Emergency Relief program to repair two areas damaged by the storms. The first project consists of replacing a headwall on the east side of Main Street at Forbes Creek (Forbes Creek Headwall Repair Project). The second project consists of replacing a culvert and headwall on Hartley Street, north of the Anastasia Drive intersection (Hartley Street Culvert Repair Project). The subject of this requested amendment is the Forbes Creek Headwall Repair Project, hereinafter referred to as the “project.”
City Council approved a Professional Services Agreement with Dokken Engineering on January 18, 2022 for environmental and right of way services for a not-to-exceed amount of $98,801.87. City staff and Dokken Engineering have diligently worked together through the federal and state requirements for environmental review, studies, and reporting requirements.
City staff determined the City Engineer would complete the design phase of this project with coordination from Dokken Engineering. During this phase, additional survey work was required to assess the effects of the project’s design on an additional adjoining property. This work was not included in Dokken’s original scope of work, therefore Amendment 1 was issued for $1,956.22.
Amendment 2 was issued to extend the contract terms of the Professional Services Agreement by two (2) years until January 31, 2026. There was no cost change associated with Amendment 2.
Finally, the subject of this request is Amendment 3. Initially, the project was estimated to only affect one parcel requiring right of way. Through the design process, an additional need for right of way was identified for the construction of the project. Due to the federal funding, all right of way acquisition, including temporary construction easements to fee rights, must follow the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 as amended in 1987 (Uniform Act), as well as comply with all requirements of Meeting Date: 02/18/2025 Page 2 Agenda Item # VII.D.1.
389094.1
Title VI of the 1964 Civil Rights Act. Due to these requirements, the specialized support services costs are much higher than the actual costs of the real property rights. Amendment 3 will cover the additional support needed from Dokken Engineering to properly acquire the additional right of way for the Forbes Creek Headwall Repair Project.
Staff recommends the City Council authorize the City Manager to sign Amendment 3 to the PSA with Dokken Engineering for Forbes Creek Headwall Repair Project.
ENVIRONMENTAL COMPLIANCE:
This project is exempt from the California Environmental Quality Act (CEQA) pursuant to subsections (b) and (c) of Section 15269 of Title 14 of the California Code of Regulations (Emergency Projects) as emergency repairs to publicly or privately owned service facilities necessary to maintain service essential to the public health, safety or welfare (emergency repairs include those that require a reasonable amount of planning to address an anticipated emergency) and specific actions necessary to prevent or mitigate an emergency.

2. Provide other direction.

The request to increase right of way funding was submitted to Caltrans April 16, 2024, with a 2- step approval system. The first step of approval was reported to City staff January 24, 2025, with the second step pending review. Once approved, the City will be reimbursed at 88.53% of the right of way acquisition and support cost.

behind the review. An appraisal review is recommended to ensure that the appraisal is based on sound appraisal theory, contains appropriate documentation to support the appraisers’ conclusions and complies with regulatory codes. A recommendation of just compensation is then made based on the reviewed, collected, assembled, correlated, and analyzed data.
Task 4.6 Negotiations
Dokken will complete acquisition services for one (1) parcel; APN 025-331-080. All “Good Faith Negotiations” will be completed by Dokken’s Right of Way Team. After completion of the waiver valuation process and just compensation determination, Dokken will prepare the offer package and meet with all owners in person to present and explain the offer package details. The offer package will include the offer letter, written summary of just compensation with supporting valuation information, Title VI information, “Your Property – Your Transportation Project” booklet. Dokken will negotiate with the property owner to arrive at a mutually agreeable settlement and prepare necessary purchase agreements such as Grant Deeds, Easement Deeds, and Temporary Construction Easement Deeds. Dokken will obtain receipt of delivery of offer and/or present and secure tenant information statements, as applicable, during the initial meeting.
Dokken will work closely with the Client to aid in the recommendation of the appropriate course of action with regard to the various acquisitions with property owners requesting additional compensation and/or services beyond the initial offer package. Recommended settlement packages with justifications and impasse letters will be provided to the Client for review. Working with the property owners to agreeable terms will be Dokken’s focus.
Task 4.7 Escrow Coordination
Upon reaching an agreement on the terms and conditions of the acquisition with the property owner, Dokken will be available to assist the Client in opening escrow. Dokken will supply fully executed agreements along with other supporting information to escrow in order to close each transaction. Dokken will work closely with the Client to assist in the timely closing of all transactions. For the convenience of the property owner, our right of way team has a California Notary who will be available to notarize any documentation that is required.
Fully executed deeds and easements will be delivered to the Client for acceptance prior to recording. In the event escrow services are not required, Dokken is available to perform these services and record the required documentation.
