The K-OTIC 3v3 Basketball Tournament:

Summary:

This basketball tournament will be 3v3 old-school style basketball games. We will bring the culture of music and sports to our community for all to enjoy. There will be 10 age groups 4 boys; 4 girls) and a senior group. The date would be Saturday, October 11th, from 8am to 6pm. We plan to have a DJ playing family-friendly music along with local hip-hop group K-Town as the hosts/MCs of the event. Surprise visits from Mac Mall and other Bay Area Legends in music will be in attendance. We plan on having 1-4 vendors some of them will be food so we would like to know what permits we would have to get for everything to go smoothly. A portion of the proceeds will be donated to a local charity that benefits the youth. I have done many events over the years throughout Northern California like Relay For Life, The Families of SMA walkathon, Muscular Dystrophy Association Summer Camp, and ran a local sock drive that put crazy and wild socks on hundreds of kids in Oakland Children's Hospital and more. I’ve also done many benefit concerts that help benefit local communities that need it. Last event, I fed and performed for the homeless in downtown Sacramento with other Sacramento artists. I love to bring awareness to those in need like many people have been there for me growing up. All in all, we want to bring something to our community that is different yet fun for everyone no matter age or group. I've done a lot of events and fundraising in my career and having you be a part of this event will be just what we need to help bring the community together.

AWWA is hosting a Water Infrastructure Conference starting on September 14th – 17th where staff will attend a 3- Day Rate-Setting Essentials Seminar which will connect financial planning, cost-of-service and rate design. RE: Delinquent Utility User Accounts MEETING DATE: 08/05/2025 SUBMITTED BY: Danielle Dizon, Finance Director
PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to hold a public hearing on delinquent utility accounts and review and approve a Resolution identifying delinquent utility accounts for submission of the list to the Lake County Auditor-Controller for inclusion on the property tax roll.

BACKGROUND/DISCUSSION:

California Health and Safety Code section 5473 et seq; and Chapters 13.20, 13.04 and 8.16 of the Lakeport Municipal Code authorize the City to have the delinquent charges for water, sewer and solid waste collected by means of inclusion on the property tax roll by Lake County. A requirement of doing so is a public hearing and Council's approval of a resolution identifying the accounts in question and confirming their delinquency.

The accounts included herein have been identified by the Finance Department as delinquent as of May 31, 2025.

To collect these unpaid accounts, the City is required to notify the delinquent account holders and give them an opportunity to bring their account current. The City provided this notice, which provides account holders until 4:30 pm on August 5th to bring their account current. Therefore, a current Delinquent Utilities Account List will be provided at the time of the meeting with any accounts for which payment has been made removed.

Utility bills and delinquency notices are mailed monthly. Final notice to delinquent accounts, as of May 31, 2025, were sent to property owners on June 17, 2025. Notices of the public hearing were published in the Lake County Record Bee on June 18, 2025 and June 25, 2025.

Approval of the resolution requires a 2/3 vote of the members of the legislative body.

OPTIONS:

1. Confirm the list of delinquent utility accounts and approve the proposed Resolution.

2. Do not approve but provide direction to staff.

STAFF REPORT
RE: Declaration of Surplus Property – 910, 912, and 916 Bevins Street (Old Transfer Station Property)
MEETING DATE: 08/05/2025
SUBMITTED BY: Kevin M. Ingram, City Manger
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being requested to consider and adopt a resolution declaring surplus property and direct staff to issue a Notice of Availability to local agencies, housing sponsors, and the California Department of Housing and Community Development (HCD) in accordance with the Surplus Land Act.

BACKGROUND:

The Surplus Land Act (SLA) in state law (Government Code section 54220, et seq.) requires that before a local agency such as the City takes any action to dispose of property, it must declare the property either “surplus land” or “exempt surplus land.” Unless the surplus land is exempt, the agency must give written notice of its availability to any local public entity, including schools and park districts within whose jurisdiction the property is located, as well as to housing sponsors that have notified HCD of their interest in surplus property. The Notice of Availability (NOA) must be given prior to the agency “participating in negotiations” to dispose of the property.

An entity receiving notice from the agency has 60 days to notify the agency of its interest in purchasing the property, and the agency is required to negotiate in good faith for not less than 90 days with any entity that has responded. Notwithstanding the obligation to negotiate in good faith, the local agency is not required to sell or lease the property to the agency, or do so for less than fair market value.

If an agency fails to provide the proper notices, there is a significant penalty that requires a local agency to forfeit 30% of the purchase/lease proceeds for the first violation and 50% for any subsequent violations.

The SLA’s definition of “exempt surplus property” includes, but is not limited to: property that is less than onehalf acre in area and is not contiguous to land owned by a state or local agency that is used for open-space or low- and moderate-income housing purpose; property that is transferred to another local, state or federal agency for that agency’s use; property exchanged for another property for that agency’s use; property developed with certain affordable housing projects; or property that is a former street or easement that is conveyed to an adjacent property owner.

Pursuant to Government Code Section 54230, local agencies must report annually information about all locally owned surplus land sites.

406690.1
DISCUSSION:

For decades, the property located at 910, 912, and 916 Bevins Street—commonly referred to as the old Transfer Station—played a functional role in the City’s solid waste operations. The site was historically utilized by Lakeport Disposal as a transfer station prior to the construction of the Waste Connections facility on Soda Bay Road in South Lakeport approximately 15 years ago. Since that time, the City has had no operational need for the property, and it is not currently identified as a priority site in the City’s adopted Economic Development Strategic Plan.

In the years since its decommissioning, the property has been leased—most notably to Wine Country Compressors, a local company that provides equipment services to the regional wine industry. However, interest in the site has increased recently, likely spurred by nearby development activities including Lake County Tribal Health’s expansion and the future courthouse project. While the City has received inquiries from parties interested in purchasing the property, it cannot proceed with negotiations or a sale or long-term lease without first completing requirements under the California Surplus Land Act (SLA). Following discussion by the City Lands Ad Hoc team, a recommendation has been made to initiate the SLA declaration process. This action does not obligate the City to sell the property, but it is a necessary first step to preserve that option and respond appropriately to future opportunities.

Site Location Information: Staff has reviewed properties owned by the City of Lakeport and identified three (3) potential properties that could be identified as surplus. All sites collectively make up what is commonly referred to as the old Transfer Station Property (910 Bevins Street).

APN Address Acres

025-472-09 912 Bevins Street 0.36
025-472-10 916 Bevins Street 0.05
In order to proceed with the sale of any of the aforementioned properties, the City must first declare it surplus and provide the notices described above before engaging in negotiations with a potential buyer.

Attached is a resolution making the findings that the property is surplus land.

Environmental Review: Sales of surplus government property are exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14 Section 15312 of the California Code of Regulations.

OPTIONS:

1. Adopt the proposed resolution and direct staff to issue a Notice of Availability to the entities listed in Government Code section 54222 and to file a copy with the California Department of Housing and Community Development.

2. Direct staff to make modifications or revisions to the proposed Resolution.

3. Tak no action or take action to deny the proposed Resolution.

4. Alternatively, City Council could provide other direction.

STAFF REPORT
RE: Discussion and Consideration of a Letter to State Officials Regarding Adoption of Local Responsibility Area Fire Hazard Severity Zone Maps
MEETING DATE: 08/05/2025
SUBMITTED BY: Kevin M. Ingram, City Manager
PURPOSE OF REPORT: ☐Information only ☒ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to discuss and consider the sending of a letter to State Officials expressing concern over the mandate to adopt fire hazard severity zoned maps.

BACKGROUND/DISCUSSION:

On June 3, 2025, the City Council held the first reading of the ordinance to adopt CAL FIRE’s Local Responsibility Area (LRA) Fire Hazard Severity Zone (FHSZ) maps as required under state law. The second reading and formal adoption occurred on June 17, 2025, and the adopted ordinance was submitted to the State Fire Marshal in accordance with statutory requirements.

Although the City complied with the process, members of the City Council expressed significant concerns about the state-mandated adoption framework. Specifically, Councilmembers noted frustration with the requirement for extensive local public outreach, despite the fact that local jurisdictions are not permitted to substantively modify the maps or incorporate community feedback in a meaningful way.

Additionally, the Council questioned the efficacy of the maps’ 50-year hazard modeling horizon, raising concerns that it may unintentionally discourage private property owners from making necessary defensible space or fire resilience improvements—given that such actions are unlikely to result in any future modification to the mapped hazard designation.

In response to these concerns, the City Council directed the City Manager on June 3 to prepare a formal letter to the State Fire Marshal highlighting these issues and requesting a more collaborative process for future updates.

A draft letter, prepared for Council review and consideration, is attached to this report.

OPTIONS:

1. Approve the attached letter and authorize the Mayor to sign and submit it

2. Provide direction to staff for revisions for the letter.

3. Take no action.

4. Or alternatively, the Council may provide staff alternative direction.

RE: Concerns Regarding the Adoption Process for Local Responsibility Area Fire Hazard Severity Zone (LRA FHSZ) Maps
Dear State Fire Marshal Berlant,
On behalf of the Lakeport City Council, I am writing to express our growing concern and frustration regarding the process local jurisdictions are required to follow in adopting CAL FIRE’s Local Responsibility Area (LRA) Fire Hazard Severity Zone maps.

While we fully support the goals of wildfire hazard planning and recognize the importance of hazard mapping to guide long-term mitigation efforts, we find the required process to be misaligned with those objectives in several critical ways. Local jurisdictions, such as Lakeport, were required to engage in in-depth public outreach and adopt the maps via ordinance, yet we were afforded no meaningful authority to adjust the maps based on local knowledge or incorporate public feedback into the final product. This creates a perception—accurately, in our view—that public input is solicited merely as a formality rather than a substantive component of the process.

Furthermore, the 50-year hazard modeling horizon used to support the maps, while valuable from a long-term planning standpoint, may unintentionally undermine community-level wildfire mitigation efforts. If property owners understand that defensible space improvements or structural hardening efforts will not influence their property’s hazard designation for the foreseeable future, their motivation to invest in proactive mitigation measures is significantly reduced. This disconnect could stall the kind of neighborhood-level action we all want to encourage.

We urge you to allow for a more collaborative process that respects local decision-making and recognizes the value of on-the-ground expertise. Providing cities with greater flexibility in evaluating and applying hazard designations based on local conditions will lead to more practical, effective, and equitable outcomes for the communities most directly affected.

DATE: Wednesday, July 16, 2025
TO: Mayors, Council Members, City Clerks, and City Managers RE: DESIGNATION OF VOTING DELEGATES AND ALTERNATES
League of California Cities Annual Conference and Expo, Oct. 8-10, 2025 Long Beach Convention Center
Every year, the League of California Cities convenes a member-driven General Assembly at the Cal Cities Annual Conference and Expo. The General Assembly is an important opportunity where city officials can directly participate in the development of Cal Cities policy.

Taking place on Oct. 10, the General Assembly is comprised of voting delegates appointed by each member city; every city has one voting delegate. Your appointed voting delegate plays an important role during the General Assembly by representing your city and voting on resolutions.

To cast a vote during the General Assembly, your city must designate a voting delegate and up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. Voting delegates may either be an elected or appointed official.

Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council. Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone.

Following council action, please submit your city’s delegates through the online submission portal by Wed., Sept. 24. When completing the Voting Delegate submission form, you will be asked to attest that council action was taken. You will need to be signed in to your My Cal Cities account when submitting the form.

Submitting your voting delegate form by the deadline will allow us time to establish voting delegate/alternate records prior to the conference and provide pre-conference communications with voting delegates.

Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration is open on the Cal Cities website.

Council Action Advised by September 24, 2025
For a city to cast a vote, one voter must be present at the General Assembly and in possession of the voting delegate card and voting tool. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the voting delegate desk. This will enable them to receive the special sticker on their name badges that will admit the voting delegate into the voting area during the General Assembly.

Please view Cal Cities’ event and meeting policy in advance of the conference.

Transferring Voting Card to Non-Designated Individuals Not Allowed. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the General Assembly, they may not transfer the voting card to another city official.

Seating Protocol during General Assembly. At the General Assembly, individuals with a voting card will sit in a designated area. Admission to the voting area will be limited to the individual in possession of the voting card and with a special sticker on their name badge identifying them as a voting delegate.

The voting delegate desk, located in the conference registration area of the Long Beach Convention Center in Long Beach, will be open at the following times: Wednesday, Oct. 16, 8:00 a.m.-6:00 p.m. and Thursday, Oct. 17, 7:30 a.m.-4:00 p.m. On Friday, Oct. 18, the voting delegate desk will be open at the General Assembly, starting at 7:30 a.m., but will be closed during roll calls and voting.

The voting procedures that will be used at the conference are attached to this memo.

Please share these procedures and this memo with your council and especially with the individuals that your council designates as your city’s voting delegate and alternates.

Once again, thank you for submitting your voting delegate and alternates by Wednesday, Sept. 24. If you have questions, please contact Zach Seals at [email protected].

These policies directly guide Cal Cities’ advocacy to promote local decision-making, and lobby against statewide policies that erode local control.

The resolutions process and General Assembly is one way that city officials can directly participate in the development of Cal Cities policy. If a resolution is approved at the General Assembly, it becomes official Cal Cities policy. Here’s how resolutions and the General Assembly work.

The petitioned
resolution is an
alternate method
to introduce policy
proposals during
the annual conference. The
petition must be signed by
voting delegates from 10% of
member cities, and submitted to
the Cal Cities President at least
24 hours before the beginning
of the General Assembly.

Petitioned Resolutions

STAFF REPORT
RE: Silveira Community Center Update and Interim Plan MEETING DATE: 08/05/2025 SUBMITTED BY: Kelly Buendia, Administrative Services Director PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to receive an update on the Silveira Community Center interim operations, approve continuation of the interim use plan, adopt a six-month advance reservation limit, and authorize the City Manager to waive the $150 cleaning fee for low-impact events that do not involve food or messy activities.

BACKGROUND:

At the January 21, 2025 meeting, the Lakeport City Council reviewed and acted on an update regarding the Silveira Community Center (SCC), focusing on current limitations, community needs, and proposed interim solutions to enhance usability of the facility until major infrastructure upgrades are completed.

The SCC, originally donated in 2019, has seen gradual improvements, including a commercial kitchen, general maintenance, Wi-Fi installation, solar panels, and HVAC and electrical upgrades. However, ongoing plumbing problems and non-ADA compliant restrooms, combined with a lack of dedicated staffing, have limited the ability to host larger or off-hours events. Despite these challenges, community interest in using the center has grown, prompting the need for updated interim policies and operational adjustments. Following staff recommendations and community input, the Council took the following actions:
• Approved a temporary limit on group size for rentals to no more than 50 attendees, in response to restroom and plumbing constraints.
• Approved restricting rental hours to City business hours only, to reduce staffing burdens and avoid the need for off-hours support.
• Approved the half day use option. This option has been well received and has been utilized. • Authorized installation of an ADA-compliant portable restroom, which has been purchased and placed adjacent to the facility to supplement failing interior plumbing during events and accommodate access. • Approved a new Fee Waiver Policy, giving City Council members limited discretion to waive facility use fees for eligible nonprofits and community groups, while preserving financial oversight. The waiver process has been utilized for two reservations.
• Directed staff to begin discussions with the Lake County Arts Council, which expressed interest in displaying art at the SCC and potentially assisting with staffing.

Meeting Date: 08/05/2025 Page 2 Agenda Item # VII.B.1.

DISCUSSION:

Six-Month Update
Over the past six months, usage of the Silveira Community Center has increased modestly, with growing demand for meeting and training space—particularly from county departments and local agencies. The half-day rental option has proven popular among users and those inquiring about availability. While the facility is generally unavailable on weekends, exceptions have been made in cases where City staff were already scheduled and available to provide support.

A detailed usage report is attached for reference and staff will continue to monitor the demand type. Staff has also received feedback suggesting that waiving the standard $150 cleaning fee would be beneficial for groups that do not serve food or conduct activities likely to create a mess.

Several safety and facility upgrades have been completed, including improvements to the exterior doors, installation of necessary signage and electrical cover plates, fire extinguisher inspections, and the addition of an ADA-compliant portable restroom. Additional upgrades funded in the adopted budget are scheduled for August and include painting the ceiling and installing double doors for the table and chair storage closet.

To improve scheduling and access, the City has purchased and launched RecDesk software, now accessible via the Parks and Facilities webpage: https://www.cityoflakeport.com/parks/index.php. While the SCC calendar is currently viewable online, full online reservation functionality is still under development. Staff contact information is posted in several locations, and a full application process is expected to launch by late fall.

Arts Council Partnership Discussion
Staff has met multiple times with representatives of the Arts Council to explore a potential partnership with the City. The Arts Council recently learned that their current landlord intends to sell the building they lease for gallery space. Facing an impending relocation, they approached the City to discuss the possibility of leasing a portion of the Silveira Community Center for continued gallery operations.

Preliminary discussions have focused on the idea of exchanging Arts Council staff and volunteer time in lieu of rent. The proposal envisions the Arts Council operating the Community Center in exchange for use of approximately 800–1,000 square feet of space. With comparable retail space leasing at around $1 per square foot, the City would seek equivalent in-kind services.

While details are still being developed, potential responsibilities for the Arts Council could include serving as the primary point of contact for the public, managing reservations and site visits, conducting pre- and post-rental inspections, processing applications and contracts, maintaining the rental calendar, performing light cleaning, and coordinating with City staff on maintenance needs. Once Arts Council staff and volunteers are trained on policy and procedures, it is also the goal to open up rentals to after hours and weekends.

The Arts Council has identified mid-September as a target move-in date.

Community Development Block Grant (CDBG) Discussion
The City continues to make progress on long-term improvements to the Silveira Community Center, supported by a $1.27 million Community Development Block Grant (CDBG) awarded to fund critical plumbing and ADA compliance upgrades.

Attached is a conceptual rendering and an early-stage concept sheet outlining a proposed interior finish package for the restroom remodel. The concept reflects a design direction emphasizing clean lines, neutral tones, durable materials, and modern, low-maintenance fixtures. While still in the preliminary phase, this document helps establish a visual and material baseline for the upcoming design process.

Meeting Date: 08/05/2025 Page 3 Agenda Item # VII.B.1.

The City Engineer is currently developing the scope of work for procuring architectural services to lead the design phase. The initial concept materials were requested to help clarify design expectations and support the creation of a more defined and accurate project scope.

Also included is a tentative schedule outlining the anticipated timeline for procurement, design, environmental, permitting and construction. The current target for project completion is spring 2027, though staff acknowledges that construction timelines are often subject to unforeseen delays.

To help manage community expectations and minimize disruption to renters, staff recommends limiting reservations to no more than six months in advance. Public Works staff has indicated that this shorter reservation window will allow for better forecasting of construction impacts and ensure greater certainty in honoring existing bookings.

T-Mobile Grant Discussion
In June 2025, the City submitted a grant application to T-Mobile to enhance the visibility and accessibility of the Silveira Community Center. The proposal includes improved facility signage, the installation of wayfinding elements to better connect the center with nearby amenities such as downtown and local parklands, and the addition of an informational kiosk at the center. The kiosk would provide space for community partners to share announcements, activities, and upcoming events, further integrating the center into the broader network of civic engagement and public resources.

These recommendations support the continued, responsible operation of the Silveira Community Center while long-term facility upgrades are underway, ensuring accessibility for the community and manageable service levels for City staff.

Why the Community Center Grant-Funded Work Will Take Until Spring 2027 State Oversight and Regulatory Compliance (HCD/CDBG)
This project is funded through a Community Development Block Grant (CDBG) administered by the California Department of Housing and Community Development (HCD), which imposes extensive federal and state compliance requirements. These include environmental review, labor compliance, procurement regulations, and detailed reporting. Each of these components adds significant time to the project schedule.

Environmental Review and Historic Preservation
Prior to construction, a full environmental review must be completed in accordance with both NEPA and CEQA. This includes coordination with multiple agencies for Section 106 Historic Preservation review and floodplain assessments. These steps can take six months to over a year, depending on agency response times and findings.

Procurement and Design Requirements
The City must follow formal procurement procedures for selecting architects, engineers, and contractors. All steps—such as RFP issuance, consultant selection, contract execution, and HCD approval—must comply with grant guidelines, which extend timelines beyond what is typical for non-grant-funded projects.

Labor Standards and Pre-Construction Documentation
Because the project uses federal funds, it is subject to Prevailing Wage laws. This requires extensive documentation and coordination, including wage determinations, preconstruction conferences, and the setup of reporting systems before any physical work can begin.

Design and Permitting Timeline
Once consultants are selected, the design phase will begin. ADA upgrades in older buildings often present unique challenges that require careful review and coordination.

City and County permitting for these improvements—especially those related to access, egress, and restrooms—may take several months due to code upgrades and review cycles.

Construction Bidding and Scheduling
After design and permitting, the project must be advertised for public bidding in accordance with CDBG requirements. Once a qualified bidder is selected and approved, construction can begin. Scheduling may be impacted by the need to maintain partial building use during construction, which may require phasing the work.

Grant Reimbursement Model
CDBG is a reimbursement-based program, which means the City must first incur expenses before being reimbursed by the state. This often requires additional internal tracking, documentation, and review, and delays may occur if HCD requests clarifications or backup materials.

Limited Staff Capacity
Administering a CDBG project requires substantial staff time for coordination, compliance, and reporting. Given the City’s limited staff resources and the number of active projects, work must be scheduled carefully alongside other competing priorities. 406564.1
