Subject: Response to 2024–2025 Grand Jury Final Report
Report Titles: Highway Havoc: First Responders’ Adaptation During Cattle Truck Overturns and Lithium-ion Battery Fires: Learning to Manage the Risk Dear Honorable Members of the Lake County Civil Grand Jury, In accordance with California Penal Code §§933 and 933.05, the Lakeport City Council hereby submits its formal response to the findings and recommendations outlined in the 2024–2025 Grand Jury Final Report, specifically those sections pertaining to our sub-entity, the Lakeport Police Department, under the report titles Highway Havoc: First Responders’ Adaptation During Cattle Truck Overturns and Lithium-ion Battery Fires: Learning to Manage the Risk.

Highway Havoc: First Responders’ Adaptation During Cattle Truck Overturns Findings:
• F-1: Cattle trailer turnovers are extremely resource-intensive and require the cooperation and effective coordination of all responding agencies and volunteers.

Lakeport City Council Response: We concur with the findings. • F-2: First responders require expertise and training in trapped, injured, or loose animal handling and rescue.

Lakeport City Council Response: We concur with the findings. • F-3: The command team needs to have immediate and reliable communication via Starlink satellite to acquire volunteer assistance and containment materials to keep people and animals safe.

Lakeport City Council Response: We concur with the findings and acknowledge the utility of satellite-based communication systems. However, we also recognize that Starlink and similar technologies do not provide absolute reliability in coverage or connection.
• F-4: Prepositioning response trailers stocked with appropriate tools and fencing along major livestock transportation thoroughfares would help expedite an effective response.

Lakeport City Council Response: We concur with the findings. • F-5: No animals should be released from the truck until the scene is secure in order to prevent secondary injury to responders, livestock, or the public.

Lakeport City Council Response: We concur with the findings. • F-6: If euthanasia is necessary, complicated circumstances come into play that should be understood prior to the rollover, with clear lines of authority delineated.

Lakeport City Council Response: We concur with the findings. • F-7: The unique challenges and potential dangers posed by injured and distressed livestock are included in the draft Emergency Response Guide being finalized by a team of fire-district first responders within Lake County.

Lakeport City Council Response: We concur with the findings. • F-8: This Lake County Emergency Response Team further arranged to receive training in equine rescue at UC Davis.

Lakeport City Council Response: We concur with the findings. • F-9: To date, neither an OES Large-Animal Response Annex nor internal policies and procedures addressing livestock animal emergencies have been completed by Animal Care and Control.

Lakeport City Council Response: We concur with the findings. • F-10: Animal Care and Control currently lacks a veterinarian who could provide necessary assistance to the first responders and the livestock during trailer rollovers.

Lakeport City Council Response: We concur with the findings. • F-11: Animal Care and Control has not reactivated its LEAP animal disaster service that could have responded to the first two rollovers.

Lakeport City Council Response: We concur with the findings.

Recommendations:
• R-1: That all fire and law-enforcement first responders within Lake County undergo classroom training, tabletop exercises, demonstrations, and hands-on practice to enable them to make critical assessments and decisions to keep themselves and the public safe during emergency stock-trailer incidents.

Lakeport City Council Response: The recommendation requires further analysis (to be completed in 6 months) to evaluate which forms of training are available and practical for staff to attend.
• R-2: That fire and law-enforcement first responders be enabled to access reliable Starlink satellite communication capability throughout the County.

Lakeport City Council Response: The recommendation requires further analysis (to be completed in 6 months) to look into future training options while fully cooperating with the agency of responsibility, as the Lakeport Police Department is not the agency responsible for implementation of this recommendation,. • R-3: That all fire, Sheriff’s Department, and OES responding personnel within Lake County undergo training to recognize the unique behavior issues that develop in severely stressed and injured livestock.

Lakeport City Council Response: We concur with the recommendation and suggest that the Lake County Sheriff’s Office and Office of Emergency Services, as the lead response agencies for rural and unincorporated areas, should assume primary responsibility in this training initiative.
• R-4: That the Emergency Response Guide in preparation by the fire services be finalized and distributed widely within County government, law enforcement, and relevant animal welfare groups.

Lakeport City Council Response: We fully support this recommendation and look forward to the guide’s completion. We welcome the opportunity to train alongside other first responder agencies to enhance coordinated response during such incidents.

Lithium-ion Battery Fires: Learning to Manage the Risk
Findings:
• F-1: Lithium-ion batteries power a wide range of consumer products, from electric vehicles to e-bikes/e-scooters/electric wheelchairs to e-cigarettes to portable electronic devices to cellphones to solar energy/battery storage facilities.

Lakeport City Council Response: We concur with the findings. • F-2: The number of fires caused by lithium-ion batteries is growing.

Lakeport City Council Response: We concur with the findings. • F-3: Lithium-ion fires have unique attributes and are difficult to extinguish.

Lakeport City Council Response: We concur with the findings. • F-4: These fires have four major impacts: injuries/deaths, emergency agencies’ response, service disruption, and monetary losses.

Lakeport City Council Response: We concur with the findings. • F-5: The public generally is not well informed about safe storage, charging, and disposal of lithium-ion batteries in consumer products.

Lakeport City Council Response: We concur with the findings. • F-6: Drafting and disseminating emergency response plans to fire departments and lawenforcement agencies would enhance the professionals’ understanding of and reactions to these critical incidents.

Lakeport City Council Response: We concur with the findings. • F-7: Fire blankets and certain foams can be helpful in providing adjuncts to fair agencies’ response to these fires, in addition to relying on water alone.

Lakeport City Council Response: We concur with the findings.

Recommendations:
• R-3: That the Lakeport and Clearlake police departments and the Sheriff’s Office coordinate with OES to distribute education and mitigation materials to their employees.

Lakeport City Council Response: This recommendation will be implemented. The Lakeport Police Department will coordinate with the Lake County OES and Fire Chiefs’ Association to determine appropriate educational materials based on the agency’s specific operational role and responsibilities on or before March 1, 2026. • R-4: That the fire and law-enforcement agencies within the County collect and disseminate data on the ignition source of lithium-ion battery fires.

Lakeport City Council Response: This recommendation will not be implemented because it is not warranted or reasonable as determining ignition sources is the specialized responsibility of trained fire personnel. Law enforcement officers are not trained in fire cause investigation and training them in this field would not be an efficient use of public resources.

We thank the Lake County Civil Grand Jury for its diligence and thoughtful evaluation of these critical public safety topics. The Lakeport Police Department remains committed to collaboration, preparedness, and operational excellence in protecting our community.

Respectfully submitted,

KIM COSTA
Mayor

MEETING DATE: 08/19/2025
SUBMITTED BY: Kelly Buendia, Administrative Services Director/City Clerk PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to Conduct a public hearing and introduce (first reading) an ordinance amending Sections 9.04.010 and 9.08.110 of Title 9 of the Lakeport Municipal Code related to alcohol possession and consumption in City parklands.

BACKGROUND/DISCUSSION:

With the addition of Xabatin Community Park and the increased frequency of community events across City parklands, staff has reviewed the Lakeport Municipal Code to ensure consistency and clarity regarding alcohol possession and consumption in public spaces.

The proposed ordinance amendment updates language in Sections 9.04.010 and 9.08.110 to:
• Clarify that alcohol possession and consumption in City parklands is prohibited unless explicitly authorized by the City Council and Police Department.
• Ensure consistent regulation of alcohol use across all City-owned parks and recreational areas, including the newly completed Xabatin Community Park.
• Provide the City with clearer enforcement authority while maintaining flexibility for permitted events where alcohol service is allowed.
• Increases the maximum fine for a misdemeanor violation of Section 9.04.010 from $500 to $1,000, consistent with Government Code section 36901.

RE: Local Public, Educational, Government (PEG) Channel Agreement Amendment & Extension
MEETING DATE: 08-19-2025
SUBMITTED BY: Kevin M. Ingram, City Manager
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to authorize the City Manager to sign the Third Amendment to the 2019 Local Public, Education, Government (PEG) Channel Agreement extending the term of the agreement through June 30, 2030 and modifying certain reporting deadlines therein.

BACKGROUND/DISCUSSION:

The County of Lake and Cities of Lakeport and Clearlake entered into an agreement in 2015 to operate a Local Public, Educational, Governmental Cable Television Channel (PEG). The most current agreement included an ending on June 30, 2025. The proposed amendment would extend the term of the agreement for five additional years to June 30, 2030. All other terms of the agreement remain unchanged.

The agreement outlines parameters for funding of the PEG Channel and continues the PEG Board membership as was created in 2019. The proposed amendment continues the current mechanisms in place for funding with the City of Lakeport contributing $2,000 annually. The amendment would also modify annual reporting deadlines: Rather than requiring an annual PEG status report and budget submittal by April 1 of each year, the PEG status report could be provided any time throughout the month of April and budget submissions would be due by June 1 of each year.

OPTIONS:

1. Authorize the City Manager to sign the Third Amendment to the PEG Agreement extending the term of the agreement through June 30, 2030 and modifying certain reporting deadlines.

2. Deny or recommend changes to the 2019 PEG Agreement

STAFF REPORT
RE: After Action Report – July 4th, 2025, Fireworks Operations MEETING DATE: 08/19/2025 SUBMITTED BY: Police Chief Dale Stoebe
PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to review and file this after-action report concerning the Independence Day (July 4th period) police and fire department fireworks operations summary.

BACKGROUND/DISCUSSION:

EVENT:

1. The 30-day period surrounding the 4th of July (June 17-July 16).

2. Independence Day Celebration at Library Park on July 4th.

3. Safe & Sane Fireworks (July 1-4)
SUMMARY:

During the 30-day period surrounding the Independence Day holiday, both the police and fire departments maintained staffing and were alert and prepared for fireworks related issues. In addition to Independence Day, there were illegal fireworks used in the city. However, that use was less significant leading up to the Holiday, and less significant after. The heaviest use of illegal fireworks was on the 4th of July. During the 4th of July City Celebration event, there were two arrests made for alcohol related offenses and resisting lawful police officer actions. There were three reports of assault and battery allegations at Library Park that resulted in no reportable injuries.

PARKLANDS:

On July 4, 2024, the City of Lakeport hosted its annual Fourth of July celebration at Library Park and Xabatin Community Park in the City limits of Lakeport. The Lakeport Police Department deployed its entire staff to work at the event along with mutual aid from numerous allied agencies, with a total compliment of 30 sworn police officers. The fire department joined with LPD in a unified command, had dispatch staff present at the Command Post, and staged to respond to the event if needed. A safe and sane fireworks lighting location was again present at the East end of 4th Street. At Library Park the only significant concern was that during the event we had 2 separate physical altercations, and one that occurred in Xabatin Park. Fewer than the average number of illegal fireworks were discharged near the parklands, including the 4th St. Safe & Sane Community Fireworks area. With Meeting Date: 08/19/2025 Page 2 Agenda Item # VII.B.

a traditional number of Law Enforcement Officers, including mutual aid response, there was standard enforcement of illegal fireworks activity.

LEGAL FIREWORKS:

SAFE & SANE:

We are unaware of any significant public safety concerns due to safe and sane fireworks this year. There were areas of the city where people continued to use these fireworks after they became illegal, 11pm, but those areas were policed and warnings mostly yielded compliance. In the aftermath of the sale of Safe & Sane fireworks, sufficient work was done by the sales groups in cleaning up the areas around town.

ILLEGAL FIREWORKS:

Illegal fireworks in the city remained a concern this year, though showed a marked decrease compared to last year’s event. We had reports and observations of illegal fireworks being set off around the city parklands into the night of July 4th. Police officers responded, when possible. The most significant problem areas for illegal fireworks remained Willow Tree Plaza, Will-O-Point Resort, and along the lakeshore between First Street and Clear Lake Avenue. Due to short staffing issues the police and fire departments were unable to form an additional special illegal fireworks enforcement team this year. However, the additional Law Enforcement Mutual Aid provided by Cal-Fire resulted in one 2-person undercover team focused on illegal firework prevention and enforcement. There were approximately twelve fireworks, especially illegal fireworks, calls-for-service. There were eight fireworks related arrests or detentions. There were three calls for dumpster fires referred to Lakeport Fire Protection District response, being twice at Marshalls/Tractor Supply and one at the Safeway Center.

Throughout the night, LE Staff seized more than fifty-five pounds of illegal fireworks, approximately fifty seized by Cal-Fire LE Units, and 5 seized by local law enforcement personnel, which were transferred for destruction.

The City Council is being asked to adopt a resolution declaring certain property surplus and approving its sale or disposal.

Once vehicles, equipment, or other assets have reached the point where they are of no practical use to the City, they must be declared surplus before they can be disposed of. Adoption of the attached resolution will enable the City to move forward with selling or disposing of the listed items.
