STAFF REPORT
RE: Second Reading and Adoption of Ordinance No. ___ Amending Lakeport Municipal Code Section 3.05.011(E) — Automatic Adjustment of Public Project Cost Thresholds
MEETING DATE: 11/18/2025
SUBMITTED BY: Ron Ladd, Public Works Director
PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

Adopt, following the second reading, Ordinance No. ___ amending Section 3.05.011(E) of the Lakeport Municipal Code to clarify that the dollar thresholds established in subsections A, B, and C automatically adjust as necessary to comply with any adjustment mandated by the State Controller pursuant to Public Contract Code Section 22020.

BACKGROUND:

At its regular meeting on November 4, 2025, the City Council introduced Ordinance No. ___ by title only and waived the first reading.

Lakeport Municipal Code (LMC) Section 3.05.011 establishes dollar thresholds for public project contracting in accordance with the California Uniform Public Construction Cost Accounting Act (Public Contract Code §22000 et seq.).

Subsections (A) and (B) set limits for projects that may be performed by city forces or through informal bidding, while subsection (C) establishes the threshold for projects requiring formal bidding.

Under Public Contract Code §22020, the State Controller is authorized to periodically adjust these thresholds to account for inflation. LMC Section 3.05.011(E) currently provides that the limits in subsections (A) and (B) automatically adjust to reflect those changes, without further City Council action.

As currently written, subsection (E) refers only to subsections “A and B,” which may create ambiguity regarding whether the $200,000 formal bidding threshold in subsection (C) also automatically adjusts when the State Controller updates the limits.

The City Attorney recommended clarifying subsection (E) to include subsection (C) as well. This amendment ensures consistency and eliminates any uncertainty that all cost thresholds in Section 3.05.011 automatically adjust in compliance with state law.

Meeting Date: 11/18/2025 Page 2 Agenda Item #IV.D
This is a minor, non-substantive clarification aligning the Lakeport Municipal Code with the intent and operation of the Uniform Public Construction Cost Accounting Act.

The ordinance is now presented for second reading and adoption.

This action is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), as it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

In accordance with the State Water Resources Control Board (SWRCB) Order WQ 2022-0103-DWQ, the City of Lakeport conducted its triennial Sewer System Management Plan (SSMP) audit covering the reporting period May 2, 2022 – May 2, 2025.

The purpose of the audit is to evaluate the effectiveness of the SSMP in reducing sanitary sewer overflows (SSOs), confirm compliance with regulatory requirements, and identify opportunities for improvement across all eleven SSMP elements.

The audit found that the City continues to demonstrate steady progress toward a structured, data-driven SSMP program despite resource and staffing limitations. Key program strengths include:

• Improved SSO tracking and performance analysis
• Initiation of major program updates, including the Sewer Master Plan and FOG Program redevelopment The report also identifies specific corrective actions to address remaining deficiencies and achieve full compliance by the next audit cycle (2028). 2025 SSMP Audit Report

EXECUTIVE SUMMARY
Purpose:

Overview of Findings:

The City of Lakeport conducted a comprehensive audit of its Sewer System Management Plan (SSMP) for the reporting period May 2, 2022 – May 2, 2025, in accordance with the State Water Resources Control Board (SWRCB) Order WQ 2022- 0103-DWQ.

The purpose of this triennial audit is to evaluate the effectiveness of the SSMP in reducing sanitary sewer overflows (SSOs), assess compliance with regulatory requirements, and identify opportunities for improvement across all eleven SSMP elements.

The audit found that the City continues to demonstrate progress toward a structured, data-driven SSMP program despite persistent resource and staffing constraints.

Key strengths include strong regulatory awareness, recent modernization of compliance documentation, active SSO tracking improvements, and the initiation of several critical updates, such as the Sewer Master Plan and FOG Program redevelopment, and the Operations and Maintenance (O&M) framework.

The City’s Utilities Department shows high operational awareness and a commitment to continuous improvement, as evidenced by field interviews and proactive program and administrative tools development. However, several program elements remain non-compliant or compliant with deficiencies, largely due to legacy documentation gaps, staffing limitations, informal practices, or procedural standardization. Each deficiency is accompanied by clear corrective actions and target completion dates to ensure full compliance by the next audit cycle.
1 of 3
Summary of Element Status:

Goals (Element I): Non-Compliant (Action Required) – The 2008 Sewer Master Plan is outdated, and no quantifiable KPIs currently measure goal attainment.

Organization (Element II): Compliant – Roles and responsibilities are clearly defined and updated, though a recurring review cadence should be formalized.

Legal Authority (Element III): Compliant – Core authority under Lakeport Municipal Code Chapter 13.20 remains adequate; updates to enforcement provisions are recommended.

Operations and Maintenance (Element IV): Compliant with Deficiencies – Core programs for mapping, preventive maintenance, inspection, and lift station O&M are active and generally effective. However, formal documentation is inconsistent, especially for GIS update logging, manhole inspection frequency, CCTV data integration, and critical parts inventory. Staff interviews confirm strong institutional knowledge but highlight the need to transition informal practices into standardized, verifiable procedures.

Design and Performance Provisions (Element V): Compliant – Standards are current; documentation and outreach on private lateral inspections should be expanded.

Overflow Emergency Response Plan (Element VI): Compliant with Deficiencies – A robust response framework exists, but performance metrics, drills, and postincident documentation need standardization.

Sewer Pipe Blockage Control Program (Element VII): Non-Compliant (Action Required) – The program remains largely inactive but is undergoing redevelopment, including ordinance updates and inspection program design.

System Evaluation & Capacity Assurance (Element VIII): Non-Compliant (Action Required) – The 2008 Master Plan is obsolete; however, a full replacement is in progress with an expected draft by October 2025.

Monitoring, Measurement & Program Modifications (Element IX): Non-Compliant (Action Required) – Data collection and trend analysis have improved through a new SSO tracking tool but require formal integration into SSMP performance reporting.

Program Audits (Element X): Non-Compliant (Action Required) – No prior triennial audits were on record; this report restores compliance and provides a foundation for future cycles.

Communication Program (Element XI): Compliant with Deficiencies – Public communication is active but lacks standardized processes for feedback, outreach scheduling, and web content management.
2 of 3
Key Corrective Priorities:

The audit identifies the following high-priority corrective actions:

Finalize and adopt the updated Sewer Master Plan to restore capacity planning compliance and support Element I and VIII goals.

Standardize Operations & Maintenance documentation, including GIS edit logs, quarterly hotspot lists, manhole inspection records, CCTV integration, and critical spare part tracking.

Activate and formalize the FOG Control Program, including ordinance revision, inspection scheduling, and County Environmental Health MOU coordination.

Institutionalize data tracking and performance measurement through consistent use of the new SSO spreadsheet, change log, and quarterly review cycles.

Conduct recurring OERP drills and develop performance metrics for SSO response and recovery efficiency.

Establish a standardized SSMP audit and communication framework with routine updates and documented public engagement.

Overall Assessment:

The City of Lakeport’s SSMP demonstrates a maturing compliance framework that continues to evolve toward full regulatory alignment. Despite limited staffing and competing program demands, the Utilities Department exhibits strong institutional knowledge and an evident commitment to system reliability, public health protection, and environmental compliance.

By completing the recommended actions, particularly those tied to Elements I, IV, VII, and VIII, the City is well-positioned to achieve full compliance and operational efficiency by the next triennial audit in 2028.

STAFF REPORT
RE: First Quarter Update, FY 2025/26 MEETING DATE: 11/18/25 SUBMITTED BY: Danielle Dizon, Finance Director
PURPOSE OF REPORT: ☒Information only ☐ Discussion ☐Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to review and file the 1st Quarter 25/26 Financial Update.

BACKGROUND/DISCUSSION:

Financial Update
Attachment A to this staff report includes summarized unaudited financial statements for the general fund, water operating and maintenance fund, and the sewer operating and maintenance fund, which include revenue and expense activity through September 30, 2025. The format in which the statements are prepared is similar to the annual budget. The schedule includes amounts available for discretionary spending for each fund anticipated to be presented in the 2025-26 audited financial statements, in accordance with Generally Accepted Accounting Principles (GAAP), as well as the amounts of anticipated ending discretionary spending expected to be available at the 2025-26 year-end. In the enterprise funds, the term “working capital” is defined as current assets minus current liabilities. For budgeting purposes, the modified accrual method is used and this is common practice among governmental agencies. Working capital is the enterprise funds equivalent of the general funds amounts available for discretionary spending.

In accordance with GAAP, financial statements in the Annual Comprehensive Financial Report (ACFR) are presented in two distinctly different ways, (1) the governmental fund financial statements and (2) government wide and enterprise fund financial statements. Governmental fund financial statements present balances using a current financial resources measurement focus which emphasizes the current available spendable resources available for appropriation. This method of accounting is known as modified accrual. Government wide and enterprise fund financial statements are presented on a flow of economic resources measurement focus which reports all assets and liabilities whether current or long term. This method is referred to as accrual accounting and is similar to the type of presentation that is used in private industry.

STAFF REPORT
RE: Truck Procurement - Utilities MEETING DATE: 11/18/2025 SUBMITTED BY: Paul Harris, Utilities Director
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to authorize the City Manager to sign a purchase order for the procurement of a 2026 Chevrolet Colorado Truck.

BACKGROUND/DISCUSSION:

The utilities department is in need of one additional vehicle to our current fleet. This vehicle would be assigned to the Utilities Director position. Vehicle WS1 was reassigned to the Utilities Superintendent position approximately one year ago. It was originally hoped that vehicle WS1 could be shared between both the Superintendent and the Director positions. Unfortunately, this has not been the case due to consistent field work requirements.

With that said, we would ask the council to approve the procurement of one additional vehicle. Quotes were requested from 3 dealerships for a Chevy Colorado 2WD Crew Cab pick-up. Matt Mazzei Chevrolet presented the lowest quote at 35,507.69. Folsom Chevrolet was the next lowest at $36,000.40, and then Platinum Chevrolet at $37,182.38.

In comparing the quotes provided, I would ask the Council to consider approving the purchase of a 2026 Chevy Colorado 2WD Crew Cab Pick-up for the amount of $35,507.69 from Matt Mazzei Chevrolet. Appropriations were approved for this purchase for this current fiscal year in the amount of $40,000.

OPTIONS:
• Move to authorize the purchase of a 2026 Chevy Colorado 2WD Crew Cab Pick-up truck from Matt Mazzei Chevrolet in the amount of $35,507.69.
• Provide alternative direction to staff.

STAFF REPORT
RE: Amendment No. 3 to Lease Agreement—910 Bevins Street MEETING DATE: 11/18/2025 SUBMITTED BY: Kevin M. Ingram, City Manger
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

City Council is being asked to approve Amendment No. 3 to the Commercial Lease Agreement for 910 Bevins Street with tenant Jeff Leard (Wine Country Compressors).

BACKGROUND:

The City of Lakeport entered into a Commercial Lease Agreement with Jeff Leard, doing business as Wine Country Compressors, on October 22, 2018, for use of the City-owned property located at 910 Bevins Street. The original lease established a monthly rent of $875.

The lease was subsequently extended through Amendment No. 1 (May 17, 2021) and Amendment No. 2 (December 17, 2024), continuing all original terms and conditions including rent rate and tenant responsibilities.

DISCUSSION:

City staff and the tenant have prepared Amendment No. 3 to the lease agreement. This amendment would extend the lease on a month-to-month basis after December 31, 2025, under the same rent rate and existing lease terms. Either party may terminate the lease upon sixty (60) days’ written notice.

Staff is not recommending a full one-year extension at this time. As the Council is aware, on August 5, 2025, the City Council adopted a resolution declaring 910 Bevins Street as Surplus Property under the State Surplus Lands Act (SLA), consistent with Government Code Sections 54220–54234. This action initiated the required State review and notice process prior to any potential disposition of the property.

Staff is currently working through the SLA process. Upon its completion, the City will be in a position to consider possible sale or other disposition of the property. Maintaining a month-to-month lease structure provides the City flexibility to respond to future opportunities while ensuring the tenant’s continued operation in the short term.

The tenant has been informed of the City’s actions and has agreed to a month-to-month arrangement, provided that the City will offer at least 60 days’ notice should the Council decide to proceed with sale or other transfer.

Meeting Date: 11/18/2025 Page 2 Agenda Item #VII.C.1

OPTIONS:

1. Approve Amendment No. 3 to the Lease Agreement with Jeff Leard (Wine Country Compressors) for 910 Bevins Street as presented.

2. Direct staff to negotiate alternative terms.

3. Tak no action.

4. Continue the item to a future meeting.

5. Alternatively, City Council could provide other direction.

ENVIRONMENTAL IMPACT:

The approval of this Amendment No. 3 to the Lease Agreement is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15061(b)(3) and 15301 as the continued leasing of existing facilities involving no expansion of existing or former use which has no potential for causing a significant effect on the environment.

FISCAL IMPACT:

Budget Adjustment Needed? Yes No If yes, amount of appropriation increase: $ Affected fund(s): General Fund Water OM Fund Sewer OM Fund Other:

Comments: There is no change in rent or lease terms. The property will continue to generate monthly revenues of $875 under the existing agreement.

SUGGESTED MOTIONS:

Move to approve Amendment No. 3 to the Commercial Lease Agreement between the City of Lakeport and Jeff Leard for property located at 910 Bevins Street in Lakeport, and authorize the City Manager to execute the amendment on behalf of the City.
