RE: Resolution Calling For and Providing For and Giving Notice of General Municipal Election and Requesting Consolidation MEETING DATE: 05/19/2026
SUBMITTED BY: Kelly Buendia, City Clerk
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to adopt a resolution calling for, providing for, and giving notice of general municipal election and request election services to be provided by the County of Lake.
BACKGROUND/DISCUSSION:
There are two City Council members whose terms will expire at the end of 2026 (Brandon Disney and Stacey Mattina). The election to fill these seats will take place on November 3, 2026.
In the past, we have been able to consolidate our elections with the County of Lake at significant cost savings to the City. The ability for the City to conduct the election itself would be impractical and much more expensive.
In addition to providing elections expertise, cost savings are obtained through economies of scale for personnel (poll workers) and publications (printing and postage).
As part of the elections process, the City must adopt a resolution calling for, providing for, and giving notice of the General Municipal Election. If the City is to request election services from the County, it must pass a resolution requesting approval from the Lake County Board of Supervisors. The attached resolution meets both of these requirements.
OPTIONS:
The City Council could provide other direction.

RE: Amend the Conflict-of-Interest Code MEETING DATE: 05/19/2026 SUBMITTED BY: Kelly Buendia, City Clerk
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to adopt a resolution amending the Conflict-of-Interest Code as recommended by staff.
BACKGROUND/DISCUSSION:
The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially. The Conflict of Interest Code tells public officials, governmental employees, and consultants what financial interests they must disclose on their Statement of Economic Interests (Form 700). It is the basis for the transparency that California's Political Reform Act requires of public officials.
Conflict of interest codes should be changed if there are substantial changes to the city's organizational structure or if there have been positions that have been eliminated or added. The City of Lakeport's Conflict of Interest Code was last revised in January of 2023, and changes were made at that time.
Upon review, staff recommends that, due to the promotion of the Associate Planner in Community Development, the Planning Services Manger should be added as a category 1 Designated Employee. A “designated employee” is an officer, employee, member or consultant of an agency whose position is designated in the code because the position entails the making or participation in the making of governmental decisions which may foreseeably have a material effect on any financial interest.
The Council can amend the Code as recommended by resolution.
OPTIONS:
The Council could reject the change or request additional changes to the Conflict of Interest Code.

RE: Ordinance Amending Lakeport Municipal Code Section
3.04.020 (Definitions) of Chapter 3.04 (Purchasing System) of Title 3 (Revenue and Finance)
MEETING DATE: 05/19/2026
SUBMITTED BY: Kevin M. Ingram, City Manager
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to introduce and waive first reading of an ordinance amending Section 3.04.020 of the Lakeport Municipal Code to update the definition of “professional services.” BACKGROUND/DISCUSSION:
The City of Lakeport has established purchasing and procurement procedures in Chapter 3.04 of the Lakeport Municipal Code in compliance with applicable law. In particular, LMC Section 3.04.050 governs how the City procures and awards professional service agreements for professional services.
Several sections of the California Government Code authorize the City to contract for professional and technical consultant services based on a person’s or firm’s demonstrated experience, competence, and qualifications:
• Section 37103 authorizes the City to contract with specially trained and experienced persons, firms, or corporations for special services and advice in financial, economic, accounting, engineering, legal, or administrative matters and to pays these experts as the City deems proper. • Section 53060 authorizes the City to contract with and employ persons to furnish special services and advice in financial, economic, accounting, engineering, legal, or administrative matters based on experience and competence if such persons are specially trained and experienced and competent to perform the special services required.
• Section 4526 similarly authorizes the City to contract with private architectural, landscape architectural, engineering, environmental, land surveying, or construction project management firms on the basis of demonstrated competence and on professional qualifications.
However, the current definition of “professional services” in LMC Section 3.04.020 only references Section 4526 above and the specific consultant work listed therein.
If adopted, this ordinance will amend the definition of “professional services” to include financial, legal, engineering, environmental, and other professional consulting services consistent with state law.
This amendment brings the Municipal Code into alignment with current legal authority and clarifies the contracting procedures applicable to procuring special services where professional qualifications and competence are essential.

RE: 3rd Quarter Update, FY 2025/26 MEETING DATE: 5/19/2026 SUBMITTED BY: Danielle Dizon, Finance Director
PURPOSE OF REPORT: ☒Information only ☐ Discussion ☐Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to review and file the 3rd Quarter 25/26 Financial Update.
BACKGROUND/DISCUSSION:
Financial Update
Attachment A to this staff report includes summarized unaudited financial statements for the general fund, water operating and maintenance fund, and the sewer operating and maintenance fund, which include revenue and expense activity through March 31, 2026. The format in which the statements are prepared is similar to the annual budget. The schedule includes amounts available for discretionary spending for each fund anticipated to be presented in the 2025-26 audited financial statements, in accordance with Generally Accepted Accounting Principles (GAAP), as well as the amounts of anticipated ending discretionary spending expected to be available at the 2025-26 year-end. In the enterprise funds, the term “working capital” is defined as current assets minus current liabilities. For budgeting purposes, the modified accrual method is used and this is common practice among governmental agencies. Working capital is the enterprise funds equivalent of the general funds amounts available for discretionary spending.
In accordance with GAAP, financial statements in the Annual Comprehensive Financial Report (ACFR) are presented in two distinctly different ways, (1) the governmental fund financial statements and (2) government wide and enterprise fund financial statements. Governmental fund financial statements present balances using a current financial resources measurement focus which emphasizes the current available spendable resources available for appropriation. This method of accounting is known as modified accrual. Government wide and enterprise fund financial statements are presented on a flow of economic resources measurement focus which reports all assets and liabilities whether current or long term. This method is referred to as accrual accounting and is similar to the type of presentation that is used in private industry.

STAFF REPORT
RE: Fourth Amendment to the Agreement between LACOSAN and CLMSD
MEETING DATE: 5/21/2026
SUBMITTED BY: Paul Harris, Utilities Director
PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:
The City Council is being asked to approve a one-year extension of the agreement between LACOSAN and CLMSD and authorize forwarding the amendment to LACOSAN’s Board of Directors for execution.
BACKGROUND/DISCUSSION:
The City of Lakeport Municipal Sewer District (CLMSD) and the Lake County Sanitation District (LACOSAN) entered into an agreement on September 12, 1995, to provide for the mutual conveyance, treatment, and disposal of wastewater flows between the North Lakeport (city) area and the unincorporated South Lakeport (county) area.
The agreement established a cooperative framework under which each agency accepts and treats certain wastewater flows from the other’s service area, shares operational and maintenance costs on a prorated basis, and coordinates infrastructure planning and system capacity.
The agreement has been amended periodically to address evolving service needs and regulatory requirements.
Amendment No. 1 modified service area boundaries, while Amendment No. 2 (adopted June 5, 2001) established financial terms related to repayment of a State Water Resources Control Board loan for the Basin 2000 Project and extended the term of the agreement to twenty-five (25) years. Amendment No. 3 (also adopted June 5, 2001) established terms for providing additional sewer service to a parcel of land owned by the Big Valley Band of Pomo Indians.
The current agreement term is set to expire on June 5, 2026.
In order to maintain uninterrupted wastewater service operations and preserve the longstanding cooperative relationship between CLMSD and LACOSAN, both agencies have determined that it is necessary and desirable to extend the agreement. The proposed Amendment No. 4 extends the term of the agreement by one (1) additional year, through June 5, 2027. All terms and conditions of the existing agreement and prior amendments remain unchanged.
Meeting Date: 05/19/2026 Page 2 Agenda Item # VII.C.1.
444999.1
This short-term extension will allow both agencies to continue providing essential wastewater collection, treatment, and disposal services without disruption while allowing additional time to evaluate long-term operational, financial, and infrastructure considerations. The potential annexation will likely impact the agreement so extending for one year appears to be the most practical approach at this time. All other terms and conditions of the existing agreement and prior amendments remain unchanged and in full force and effect.
Approval of this amendment will ensure continuity of service, regulatory compliance, and ongoing coordination between the City and County sanitation systems.
OPTIONS:
1. Authorize the proposed amendment to extend the current agreement for a period of one year.
2. Provide alternative direction to staff.
ENVIRONMENTAL IMPACT:
The approval of Amendment No. 4, authorizing a one-year extension of the existing agreement between LACOSAN and CLMSD, is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301 (existing facilities) as the continuation of operations at existing public facilities involving negligible or no expansion of existing or former use.
