BACKGROUND/ DISCUSSION:

The Parks Division maintains numerous landscaped parks, public facilities, medians, and other Cityowned properties throughout the City of Lakeport. Existing mowing equipment has experienced increasing maintenance needs and operational limitations associated with age and heavy seasonal use.

To improve operational reliability and maintenance efficiency, staff is recommending the purchase of a new 2025 John Deere Z997R commercial diesel mower equipped with a 72-inch 7-Iron PRO mowing deck and a 14-bushel dump-from-seat material collection system. The quote also includes a 42-month / 1,500-hour comprehensive PowerGard extended warranty with zero deductible coverage.

The equipment is being procured through the California CMAS cooperative purchasing contract, which satisfies applicable competitive purchasing requirements pursuant to Lakeport Municipal Code section

3.04.120(E) and provides discounted government pricing.

The total purchase price for the mower package, including all accessories, warranty coverage, sales tax, and fees, is $35,360.48.

Meeting Date: 06/02/2026 Page 2 Agenda Item # IV.D.

ENVIRONMENTAL COMPLIANCE:

The proposed equipment purchase is not considered a project under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(2), as it consists solely of the purchase of maintenance equipment and will not result in a direct or reasonably foreseeable indirect physical change in the environment.

If declined, I fully understand that any equipment listed above is not covered for customer Expenses due to component failures beyond the original basic warranty period provided by John Deere.

Note: This is not a contract. For specific PowerGard Protection coverage terms and conditions, please refer to the actual PowerGard Protection Plan contract for more information and the terms, conditions, and limitations of the agreement.

What PowerGard Protection is:

The PowerGard Protection Plan is an extended warranty program for reimbursement on parts and labor for covered components that fail due to faulty material or original workmanship that occur beyond the John Deere Basic Warranty coverage period. The agreement is between Deere & Company and the owners of select John Deere Commercial and Agricultural equipment, who purchase the PowerGard Plans for the desired coverage as indicated in this proposal.

What PowerGard Protection is not:

PowerGard Protection is not insurance. It also does not cover routine maintenance or high wear items, or insurance-related risks/perils such as collision, overturn, vandalism, wind, fire, hail, etc. It does not cover loss of income or loss of value of crops during or after an equipment failure. See the actual product-specific PowerGard Protection Plan agreement for a complete listing of covered components, and limitations and conditions under the program.

Features/Benefits:

PowerGard Protection includes the following features and benefits under the program:

Pays for parts and labor costs incurred on failed covered components (less any applicable deductibles).

Does not require pre-approval before repairs are made by the authorized John Deere dealership.

Payments are reimbursed directly to the dealership, with no prepayment required by the contract holder.

PowerGard Protection agreements ensure that only Genuine John Deere Parts are used in all repairs.

PowerGard coverage is fully transferable to future owners, with no transfer fees when coverage remains.

PowerGard ensures higher resale value and makes equipment more marketable during the sale or trade-in.

PowerGard allows you to budget your total cost of ownership, with financing available through John Deere Financial or other sources.

PowerGard helps prevent large, unexpected repair bills during later years of equipment ownership, in exchange for a smaller protection fee up front. ✔ Whether you’re running a farm, managing a business, or maintaining your property, John Deere Financial is here to support you.

STAFF REPORT
RE: Ordinance Amending Lakeport Municipal Code Section

3.04.020 (Definitions) of Chapter 3.04 (Purchasing System) of Title 3 (Revenue and Finance)
MEETING DATE: 06/02/2026
SUBMITTED BY: Kevin M. Ingram, City Manager
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to hold a public hearing and adopt an ordinance amending Section 3.04.020 of the Lakeport Municipal Code to update the definition of “professional services.” BACKGROUND/DISCUSSION:

The City of Lakeport has established purchasing and procurement procedures in Chapter 3.04 of the Lakeport Municipal Code in compliance with applicable law. In particular, LMC Section 3.04.050 governs how the City procures and awards professional service agreements for professional services.

Several sections of the California Government Code authorize the City to contract for professional and technical consultant services based on a person’s or firm’s demonstrated experience, competence, and qualifications:
• Section 37103 authorizes the City to contract with specially trained and experienced persons, firms, or corporations for special services and advice in financial, economic, accounting, engineering, legal, or administrative matters and to pays these experts as the City deems proper. • Section 53060 authorizes the City to contract with and employ persons to furnish special services and advice in financial, economic, accounting, engineering, legal, or administrative matters based on experience and competence if such persons are specially trained and experienced and competent to perform the special services required.
• Section 4526 similarly authorizes the City to contract with private architectural, landscape architectural, engineering, environmental, land surveying, or construction project management firms on the basis of demonstrated competence and on professional qualifications.

However, the current definition of “professional services” in LMC Section 3.04.020 only references Section 4526 above and the specific consultant work listed therein.

If adopted, this ordinance will amend the definition of “professional services” to include financial, legal, engineering, environmental, and other professional consulting services consistent with state law.

This amendment brings the Municipal Code into alignment with current legal authority and clarifies the contracting procedures applicable to procuring special services where professional qualifications and competence are essential.

The ordinance was introduced at the regular meeting of the Lakeport City Council on May 19, 2026.

Meeting Date: 06/02/2026 Page 2 Agenda Item # VI.A.

STAFF REPORT
RE: Designation of Area within Xabatin Park for Future Development of the Lake County Hospice Wind Phone Project MEETING DATE: 06/02/2026 SUBMITTED BY: Kevin M. Ingram, City Manager
PURPOSE OF REPORT: Information only Discussion Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

Receive a presentation regarding the proposed Lake County Hospice Wind Phone Project and consider designating an area within the northeastern portion of Xabatin Park, adjacent to the lakefront and behind the existing gazebo structure, for the future development and installation of the exhibit.

BACKGROUND/DISCUSSION:

Lake County Hospice Services has approached the City of Lakeport with a proposal to establish a Wind Phone Project within Xabatin Park. The proposed project would consist of a refurbished British telephone box containing a non-operational rotary telephone that visitors may utilize as a quiet place for reflection, remembrance, and personal healing. The project is intended to serve as a community space where individuals may honor and remember loved ones who have passed away while enjoying the peaceful lakefront setting provided by Xabatin Park.

The concept of the Wind Phone originated in Japan following the 2011 tsunami and has since become an internationally recognized form of memorial art and contemplative space. Wind Phones have been established throughout the United States and around the world as places where individuals can engage in personal reflection, grief support, remembrance, and emotional healing. The phones are intentionally disconnected, symbolizing a connection carried by memory, reflection, and the wind itself.

The proposed Lakeport installation is being sponsored and developed by Hospice Services of Lake County. The project includes the restoration and artistic enhancement of a donated British telephone box that previously stood at the Gunn House in Kelseyville. Local volunteers and artists have contributed significant time and effort toward restoring the structure and developing an artistic design that reflects the natural beauty, cultural heritage, and community character of Lake County. The exhibit is anticipated to incorporate local flora, fauna, and cultural elements while creating a welcoming and meaningful space for visitors.

The proposed location for the project is the northeastern corner of Xabatin Park behind the existing gazebo structure near the shoreline of Clear Lake. This location provides a quiet setting with unobstructed views of the lake while remaining accessible through the park's pedestrian circulation system. The site was selected in collaboration with City staff and project representatives due to its compatibility with the contemplative nature of the project and its ability to coexist with other recreational and community uses of the park.

Meeting Date: 06/02/2026 Page 2 Agenda Item #VII.A.1.

Consistency with Xabatin Park Public Art Vision
The proposed Wind Phone is consistent with the original vision established for public art within Xabatin Park.

During development of the park, the City issued a Call for Artists specifically encouraging proposals that incorporated interactive elements and community engagement opportunities. The Call for Artists emphasized that public art installations should directly engage park users, encourage participation, and contribute to Lakeport's identity as an arts destination.

Unlike traditional static monuments or sculptures, the Wind Phone is inherently interactive. Visitors are invited to enter the structure, engage with the telephone, reflect upon memories, and participate in a deeply personal experience. This interactive component aligns closely with the original artistic vision for Xabatin Park and continues to reflect an important evaluative criterion utilized by City staff and the City Lands Ad Hoc Committee when considering permanent art installations and other features within the park.

The exhibit also supports the broader goals of Xabatin Park by creating an amenity that appeals to a diverse range of visitors and user groups. While many park features focus on recreation and physical activity, the Wind Phone provides an opportunity for contemplation, healing, remembrance, and emotional well-being, further enhancing the park's role as a gathering place for the entire community.

City Lands Ad Hoc Committee Review
The proposed project and location were reviewed by the City Lands Ad Hoc Committee. Following discussion of the project concept, proposed location, and consistency with the vision for Xabatin Park, the Committee voted to formally recommend City Council approval of the proposed site designation for the future development of the Wind Phone Project.

Designation of Space
As with prior City Council actions involving future recreational amenities, public art, and community features within City park facilities, the purpose of the current action is to formally designate and reserve an appropriate location within Xabatin Park for the development of the Wind Phone Project. Approval of the proposed location establishes a clear legislative record of Council support for the project and its placement within the park.

The requested action does not authorize City funding for construction or installation activities but instead acknowledges the exhibit as an approved feature within Xabatin Park and authorizes the project sponsors to proceed with implementation in coordination with City Parks staff. Formal designation of the site will assist with ongoing project coordination, fundraising efforts, installation planning, and long-term park planning consistency while ensuring the exhibit remains integrated with the overall vision and functionality of Xabatin Park.

The proposed action qualifies for exemption from the California Environmental Quality Act ("CEQA") pursuant to State CEQA Guidelines Section 15061(b)(3), commonly referred to as the "common sense" exemption. The action before the Council is limited to conceptual planning and designation of a future location and does not authorize construction activities. Any future installation or site improvements would be subject to additional review as appropriate.

OPTIONS:

1. Approve the designation of an area within the northeastern portion of Xabatin Park for the future development of the Lake County Hospice Wind Phone Project.

2. Approve the designation with modifications to the proposed location or project parameters.

3. Deny the proposed designation.

4. Provide alternative direction to staff.

STAFF REPORT
RE: Adoption of Resolution Establishing an Internal Revenue Code Section 125 Premium Only Plan
MEETING DATE: 6/2/2026
SUBMITTED BY: Kelly Buendia, Administrative Services Director PURPOSE OF REPORT: ☐Information only ☐ Discussion ☒Action Item WHAT IS BEING ASKED OF THE CITY COUNCIL/BOARD:

The City Council is being asked to adopt the attached resolution approving and adopting a restated Section 125 Premium Only Plan pursuant to Section 125 of the Internal Revenue Code, effective June 2, 2026, and authorizing the City Manager and Administrative Services Director to implement and administer the Plan.

BACKGROUND/DISCUSSION:

The City has long provided employees the ability to pay eligible insurance premiums through pre-tax payroll deductions pursuant to a cafeteria plan established under Section 125 of the Internal Revenue Code.

The City’s current Section 125 plan was originally adopted in connection with Aflac Flex One plan documents dating from 2006. Over time, those documents have become outdated, administratively cumbersome, and broader than necessary for the City’s present benefit structure.

The existing plan materials were designed as a comprehensive cafeteria plan template capable of supporting multiple optional benefit arrangements, including flexible spending account components and other features that are not currently utilized.

To improve clarity, governance, and administrative efficiency, staff has prepared updated plan documents that restate the City’s Section 125 program in a streamlined Premium Only Plan format tailored to the City’s actual operations.

Section 125 of the Internal Revenue Code requires a written cafeteria plan document in order for employee salary reduction contributions for eligible benefits to receive pre-tax tax treatment.

While the City has maintained plan documentation through the prior Aflac arrangement, best practice is to periodically update governing documents to ensure they accurately reflect current operations, assigned administrative responsibilities, and applicable legal requirements.

The proposed restated plan:

Meeting Date: 06/02/2026 Page 2 Agenda Item #VII.B.1.
445680.1
• Continues the Agency’s existing pre-tax premium deduction program; • Replaces outdated legacy Aflac template documents with Agency-specific governing documents; • Removes unnecessary provisions relating to benefit structures not offered by the Agency; • Clarifies administrative authority, eligibility, election rules, and amendment procedures; • Improves usability for payroll, human resources, and employees; and • Preserves tax-advantaged treatment for eligible employee premium contributions.

The proposed plan is intentionally structured as a Premium Only Plan, meaning it is limited to pre-tax premium payment arrangements and does not establish flexible spending accounts or dependent care reimbursement programs.

This action is administrative in nature and does not reduce currently available employee benefits.

OPTIONS:

1. Authorize the City Manager to execute the agreement and budget amendment.

Master Plan Document

ADOPTED BY CITY COUNCIL RESOLUTION

City of Lakeport | Section 125 Premium Only Plan

Page 2 ends

ARTICLE 1 — ESTABLISHMENT AND PURPOSE

1.1 Establishment of Plan
The City of Lakeport (“City” or “Employer”) hereby establishes and adopts the City of Lakeport Section 125 Premium Only Plan (“Plan”), effective upon adoption by the City Council, unless another effective date is specified in the adopting resolution or other City action.

The Plan is intended to qualify as a cafeteria plan under Section 125 of the Internal Revenue Code, as amended, and applicable Treasury regulations and guidance. The Plan permits eligible Participants to elect to pay for certain qualified benefits on a pre-tax basis through salary reduction, subject to this Plan, applicable law, and the terms of the underlying benefit arrangements.

1.2 Premium Only Plan
This Plan is a Premium Only Plan. It does not establish or provide a health flexible spending account, dependent care assistance program, medical reimbursement account, dependent care reimbursement account, or other reimbursement arrangement. The Plan only governs whether eligible Participant contributions for approved Benefit Options may be paid on a pre-tax basis through salary reduction.

1.3 Governmental Employer Status
The City is a California municipal employer. This Plan is intended to be maintained by a governmental employer and shall be interpreted and administered consistent with requirements applicable to governmental employers and federal tax rules governing cafeteria plans. Nothing in this Plan is intended to create rights or obligations under the Employee Retirement Income Security Act of 1974 (“ERISA”) where ERISA does not apply to governmental plans.

1.4 Relationship to Underlying Benefit Plans
This Plan does not itself provide medical, dental, vision, voluntary insurance, HSA custodial, or other underlying benefits. Those benefits are provided, if at all, under separate benefit plans, insurance policies, contracts, trust or custodial arrangements, memoranda of understanding, personnel rules, City policies, or other governing documents.

If there is a conflict between this Plan and an Underlying Benefit Plan regarding coverage, benefit eligibility, claims, exclusions, provider access, continuation coverage, or benefit payment, the terms of the Underlying Benefit Plan shall control for that benefit. This Plan controls only the availability and administration of pre-tax salary reduction treatment under Section 125.

1.5 No Employment or Benefit Guarantee
This Plan does not constitute a contract of employment and does not alter the at-will, statutory, contractual, elected, appointed, or collectively bargained status of any individual. Nothing in this Plan gives any person the right to continued employment, continued appointment, continued City Council service, continued participation, or continued availability of any benefit program.

1.6 No Guarantee of Tax Treatment
The City intends to administer this Plan in good faith compliance with Section 125 of the Code and related federal tax rules. However, the City does not guarantee the tax treatment of any benefit, contribution, election, or coverage arrangement. Participants remain responsible for consulting their own tax advisors regarding personal tax consequences, including HSA eligibility and contribution limits.

3.1 Eligible Classes
Individuals are eligible to participate in this Plan if they are eligible for City-sponsored benefits under applicable City policy, memorandum of understanding, personnel rule, appointment terms, City Council action, City of Lakeport | Section 125 Premium Only Plan

Page 4 ends

or other governing authority, and if they are eligible for one or more Benefit Options under the applicable Underlying Benefit Plan.

Eligible classes generally include regular full-time employees, probationary employees serving in regular fulltime positions, and City Council Members who are eligible for City-sponsored benefits under applicable City authority. Eligibility under this Plan permits an individual to make pre-tax salary reduction elections for Benefit Options available under this Plan; it does not independently create eligibility for coverage under an Underlying Benefit Plan.

3.2 Excluded Classes
Unless specifically required by law or approved by the City in writing, individuals who are not eligible for Citysponsored benefits are not eligible to participate in this Plan. Excluded individuals may include temporary, seasonal, extra-help, limited-term, intermittent, volunteer, independent contractor, leased employee, retiree, or other non-benefit-eligible classifications, as determined under applicable City authority and the applicable Underlying Benefit Plan.

3.3 Commencement of Participation
An eligible individual may begin participation in this Plan when the individual is in an eligible class, is eligible for the applicable Benefit Option, completes required enrollment or election procedures, and makes a valid Salary Reduction Agreement or is otherwise enrolled pursuant to City-approved procedures. Participation shall begin no earlier than the effective date of the applicable underlying coverage and no earlier than permitted by Section 125 and payroll administration rules.

3.4 Enrollment Required
To participate in the Plan, an eligible individual must complete enrollment in the manner and by the deadline established by the City. Enrollment may be completed by paper form, electronic enrollment system, written salary reduction agreement, open enrollment platform, payroll authorization form, or other method approved by the Plan Administrator.

The Plan Administrator may require supporting documentation to confirm eligibility, dependent status, HSArelated information, election validity, or the occurrence of an event permitting a mid-year election change.

3.5 Failure to Enroll
An eligible individual who fails to enroll during the applicable enrollment period may be treated as having elected not to participate in the Plan for that Plan Year, except as otherwise provided by the Plan Administrator, the applicable Underlying Benefit Plan, or applicable law. The City may permit default continuation of certain elections during open enrollment, provided such procedure is administered uniformly and is permitted by applicable law.

3.6 Termination of Participation
A Participant’s active participation in this Plan ends on the earliest of the date the Participant ceases to be eligible, the date employment or eligible City Council service ends, the date underlying coverage ends, the date the Participant revokes all elections during Annual Enrollment or following a permitted mid-year event, the date the Plan is terminated or amended to exclude the Participant, or any other date required by applicable law, City policy, or the applicable Underlying Benefit Plan.

Termination of participation in this Plan does not necessarily terminate coverage under an Underlying Benefit Plan. Coverage termination, continuation, conversion, and COBRA rights, if any, are governed by the applicable Underlying Benefit Plan and applicable law.

Page 5 ends

3.7 Leaves, Rehire, and Return to Eligible Status
Participation during paid or unpaid leaves of absence, including legally protected leave, military leave, disability leave, administrative leave, or other approved leave, shall be administered in accordance with applicable law, City leave policies, applicable memoranda of understanding, and the terms of the Underlying Benefit Plans. The City may permit lawful payment methods during leave, including prepayment, pay-as-yougo payment, catch-up contributions, after-tax payment, or other arrangements permitted by Section 125 and applicable law.

If a former Participant is rehired or returns to eligible status during the same Plan Year, the Plan Administrator shall determine, in accordance with Section 125 rules and the applicable Underlying Benefit Plans, whether prior elections are reinstated or whether new elections may be made.

3.8 Dependents, Spouses, Domestic Partners, and Tax Status Eligibility for coverage of spouses, registered domestic partners, dependents, or other covered individuals shall be determined under the applicable Underlying Benefit Plan, City policy, and applicable law. Eligibility for coverage does not guarantee favorable federal tax treatment under this Plan.

If a Participant elects coverage for a registered domestic partner, dependent, or other covered individual whose coverage is not eligible for favorable federal tax treatment, the City may require all or part of the applicable contribution to be paid after-tax, apply imputed income or other taxable payroll treatment, require certification or documentation, and apply payroll procedures necessary to comply with federal tax requirements.

ARTICLE 4 — BENEFITS AVAILABLE UNDER THE PLAN

4.1 General Rule
Only Benefit Options expressly approved by the City and permitted under applicable federal tax law may be paid through pre-tax salary reduction under this Plan. The Plan Administrator shall determine which Benefit Options are available under this Plan and may establish administrative rules, enrollment procedures, payroll practices, and documentation requirements necessary to administer those Benefit Options.

4.2 City-Sponsored Group Medical Coverage
Eligible Participants may elect to pay their required employee share of premiums or contributions for Citysponsored group medical coverage on a pre-tax basis through salary reduction, to the extent permitted by applicable law. This includes high deductible health plan and non-high deductible health plan options approved by the City for participation under this Plan, whether provided through CIRA or any successor provider, pool, trust, joint powers authority, carrier, or program.

4.3 Dental and Vision Coverage
Eligible Participants may elect to pay their required employee share of premiums or contributions for Citysponsored dental and vision coverage on a pre-tax basis through salary reduction, to the extent permitted by applicable law. Dental or vision coverage may be included under this Plan whether or not employee contributions are currently required.

4.4 Approved Voluntary Accident and Health Coverage
The Plan Administrator may approve certain voluntary accident or health insurance benefits for pre-tax salary reduction treatment under this Plan, provided such benefits are permitted under applicable federal tax law and are administratively feasible for City payroll administration. Nothing in this Plan requires the City to make any particular voluntary product available.

City of Lakeport | Section 125 Premium Only Plan

Page 6 ends

4.5 HSA Salary Reduction Contributions
Eligible Participants who are otherwise eligible under applicable federal tax law may elect to make salary reduction contributions to an HSA through payroll under this Plan. HSA contributions under this Plan are employee salary reduction contributions only, unless and until the City separately authorizes employer HSA contributions under a separate policy, benefit program, resolution, memorandum of understanding, or other governing authority.

HSA salary reduction elections are subject to applicable IRS contribution limits, catch-up contribution rules, payroll processing deadlines, Section 125 and Code Section 223 requirements, and any custodial, banking, or payroll administration procedures required by the City’s HSA administration process. The City’s role is limited to payroll administration and related coordination. Each Participant is responsible for determining personal HSA eligibility and compliance.

4.6 Benefits Excluded from Pre-Tax Treatment
The following benefits are not eligible for pre-tax salary reduction under this Plan unless the Plan is formally amended and applicable law permits otherwise: disability income or wage replacement insurance, life insurance, legal service plans, non-health voluntary benefits not approved by the Plan Administrator, health flexible spending accounts, dependent care assistance programs, and any benefit prohibited from cafeteria plan treatment under applicable law. Disability insurance premiums shall be paid on an after-tax basis.

4.7 No Guaranteed Availability
The City reserves the right to add, remove, suspend, modify, replace, or discontinue any Benefit Option available under this Plan at any time, subject to applicable law, payroll administration feasibility, collective bargaining obligations, applicable City policy, and the terms of the applicable Underlying Benefit Plans.

ARTICLE 5 — ELECTION PROCEDURES

5.1 Election Required
A Participant must make an election in the manner prescribed by the City to authorize pre-tax salary reduction under this Plan, except where the City permits passive continuation of an existing election. Elections may be made by paper form, electronic enrollment platform, payroll authorization form, written confirmation, or any other method approved by the Plan Administrator.

5.2 Annual Enrollment
The City shall establish an Annual Enrollment Period during which eligible Participants may enroll in, modify, revoke, or continue elections for the upcoming Plan Year, subject to this Plan, the applicable Underlying Benefit Plans, and applicable law. The City may establish enrollment deadlines, documentation requirements, payroll processing cutoffs, and administrative rules necessary for orderly administration.

5.3 Passive Renewal
Unless otherwise required by law, the applicable Underlying Benefit Plan, or City administrative procedures, the City may permit passive continuation of existing elections from one Plan Year to the next. Under passive continuation, a Participant’s existing pre-tax election for eligible premium contributions may remain in effect for the subsequent Plan Year unless the Participant affirmatively changes or revokes the election during Annual Enrollment or pursuant to a permitted mid-year election change.

The City may require affirmative annual elections for some Benefit Options, including HSA salary reduction contributions, even if other premium elections are passively renewed.

City of Lakeport | Section 125 Premium Only Plan

Page 7 ends

5.4 Salary Reduction Authorization
A valid election under this Plan constitutes the Participant’s authorization for the City to reduce Compensation by the elected amount and apply those amounts toward the applicable Benefit Options, subject to payroll processing rules. Salary reductions shall be applied prospectively only and shall not be retroactively effective except to the extent permitted by applicable law.

5.5 Effective Date of Elections
Elections become effective on the date determined by the City in accordance with payroll administration requirements, enrollment timing, the effective date of the applicable Underlying Benefit Plan, and applicable law. An election shall not become effective before the Participant is eligible under this Plan, the Participant is eligible for the applicable Underlying Benefit Plan, a valid election is made or passively continued, and the election can be administratively implemented through payroll.

5.6 Election Irrevocability
Except as otherwise provided in this Plan or required by applicable law, a Participant’s election under this Plan shall remain in effect for the applicable Plan Year and may not be revoked, modified, or changed except during Annual Enrollment for a future Plan Year, following a permitted mid-year election change event, as required by law, as necessary to correct an administrative or payroll error, or as otherwise approved by the Plan Administrator consistent with applicable law.

5.7 Payroll Processing Limitations and Insufficient Compensation The City is not required to implement an election that cannot reasonably be administered through payroll due to timing, processing deadlines, insufficient Compensation, payroll system limitations, incomplete documentation, unresolved eligibility questions, or other administrative constraints. The City may delay implementation of an election until the first administratively feasible payroll period.

If a Participant’s Compensation is insufficient to fully fund elected pre-tax contributions, the City may take any administratively reasonable action permitted by law, including reducing or suspending contributions, requiring after-tax payment where lawful, collecting missed contributions through subsequent payroll deductions where lawful, or applying procedures consistent with the applicable Underlying Benefit Plan.

5.8 Correction of Administrative Errors
The City may correct clerical, administrative, payroll, enrollment, data entry, system, or similar errors in a manner consistent with applicable law. Correction may include prospective adjustment of elections, payroll corrections, recovery of under-collected amounts, refund of over-collected amounts where permitted, or other lawful administrative action.

5.9 Participant Responsibility
Each Participant is responsible for reviewing enrollment confirmations, payroll deductions, election records, HSA contribution elections, and benefit selections for accuracy. A Participant must promptly notify the City of any known discrepancy, error, eligibility issue, or change affecting benefit elections.

ARTICLE 6 — MID-YEAR ELECTION CHANGES

6.1 General Rule
Except as permitted by applicable law and this Article, a Participant’s election under this Plan is irrevocable for the applicable Plan Year. A Participant may change, revoke, begin, or terminate a pre-tax election during the Plan Year only if the requested change is permitted under applicable federal law and is consistent with the event giving rise to the requested change. The Plan Administrator shall determine whether a requested midyear election change is permitted.

City of Lakeport | Section 125 Premium Only Plan

Page 8 ends

6.2 Permitted Events
Subject to applicable law, the terms of the applicable Underlying Benefit Plan, and City administrative procedures, permitted events may include changes in legal marital status; changes in number of dependents; changes in employment status or benefit eligibility; dependent eligibility changes; gain or loss of other coverage; HIPAA special enrollment events; Medicare or Medicaid events; court orders or other legal requirements; approved leaves of absence; significant cost or coverage changes where permitted; and other events recognized under Section 125 or applicable guidance.

6.3 Timing, Documentation, and Consistency
A Participant requesting a mid-year election change must submit the request within the timeframe established by the City or required by applicable law, provide supporting documentation satisfactory to the Plan Administrator, certify information required by the City, and comply with enrollment and payroll implementation deadlines. The City may deny or delay a requested change if documentation is incomplete, the request is untimely, the requested change is inconsistent with the event or applicable law, or payroll implementation is not administratively feasible.

6.4 HSA Election Changes
Because HSA salary reduction contributions are governed by federal tax rules specific to HSAs, Participants may begin, change, suspend, or revoke HSA payroll contribution elections as permitted by applicable law and City administrative procedures. The City may impose payroll processing deadlines, administrative rules, minimum or maximum payroll increment requirements, and documentation requirements for HSA election changes.

6.5 Effective Date of Mid-Year Changes
A permitted mid-year election change shall become effective on the date determined by the City, consistent with applicable law, payroll administration timing, and the applicable Underlying Benefit Plans. Changes shall generally be prospective unless otherwise permitted or required by law.

ARTICLE 7 — ADMINISTRATION AND TAX COMPLIANCE

7.1 Plan Administrator
The Administrative Services Director of the City of Lakeport shall serve as the Plan Administrator unless the City designates another person, position, or designee. The Plan Administrator shall have authority to administer, interpret, and implement this Plan in accordance with applicable law and City authority.

7.2 Administrative Authority
The Plan Administrator may interpret this Plan, establish administrative rules and forms, determine eligibility for participation, determine whether a benefit may be offered under this Plan, determine whether an election or election change is valid, require documentation or certifications, resolve administrative questions, correct errors, coordinate with payroll and benefits personnel, coordinate with vendors and service providers, and take other administrative action reasonably necessary to operate the Plan. Administrative determinations made in good faith shall control unless contrary to applicable law.

7.3 Delegation and Reliance
The Plan Administrator may delegate administrative duties to City employees, payroll personnel, human resources staff, benefits administrators, service providers, consultants, third-party administrators, vendors, or other authorized persons. The City and Plan Administrator may rely on Participant elections, certifications, enrollment records, payroll records, City employment records, vendor information, carrier information, HSA administration information, and other records reasonably believed to be accurate.

Page 9 ends

7.4 Vendor and Underlying Benefit Coordination
The City may coordinate Plan administration with carriers, vendors, voluntary benefit providers, HSA custodians, COBRA administrators, enrollment platforms, payroll systems, consultants, brokers, or other service providers. Such coordination does not transfer sponsorship of this Plan or relieve the City of retained administrative authority except to the extent expressly delegated by written agreement. Claims regarding underlying insurance coverage, benefit determinations, provider access, claims payment, continuation rights, appeals, or benefit administration are governed by the applicable Underlying Benefit Plan.

7.5 Nondiscrimination Compliance
The City intends for this Plan to comply with nondiscrimination requirements applicable to cafeteria plans under Section 125 of the Code and other applicable federal tax rules. The City may conduct nondiscrimination testing, administrative review, or other compliance evaluation as necessary or appropriate. If corrective action is required or appropriate, the City may adjust elections, reclassify contributions, limit future elections, modify benefit availability, correct payroll treatment, apply tax treatment required by law, or take other administrative action reasonably necessary for compliance.

7.6 HSA Administration
The City’s role with respect to HSA salary reduction contributions is limited to payroll administration of elected salary reduction amounts and related administrative coordination approved by the City. The City is not responsible for determining a Participant’s HSA eligibility, monitoring aggregate annual HSA contributions across multiple sources, determining whether a Participant has disqualifying coverage, determining tax consequences of HSA distributions, monitoring HSA account investments or balances, or acting as HSA trustee or custodian.

7.7 No Individual Tax Advice
The City, Plan Administrator, payroll staff, human resources personnel, elected officials, consultants, vendors, brokers, and service providers do not provide individualized tax advice and do not guarantee the tax consequences of any election, contribution, coverage arrangement, or benefit. Each Participant remains responsible for personal tax compliance.

ARTICLE 8 — AMENDMENT, TERMINATION, AND MISCELLANEOUS

8.1 Right to Amend
The City reserves the right to amend this Plan at any time, in whole or in part, to the extent permitted by applicable law. Amendments may be adopted to comply with law, maintain intended tax treatment, modify administrative procedures, add or remove Benefit Options, reflect vendor or benefit changes, correct drafting or operational issues, or address other legitimate governmental or administrative purposes.

8.2 Amendment Authority
Except where City Council action is required by law, ordinance, City policy, collective bargaining obligations, or other governing authority, the City Manager is authorized to approve amendments to this Plan on behalf of the City. The Plan Administrator may implement administrative procedures, forms, enrollment processes, payroll rules, and operational guidance consistent with this Plan without requiring formal amendment.

8.3 Right to Terminate
The City reserves the right to terminate this Plan at any time, in whole or in part, to the extent permitted by applicable law. Termination of this Plan does not require termination of any Underlying Benefit Plan unless separately determined by the City.

8.4 No Vested Rights
Nothing in this Plan creates vested rights in participation, tax treatment, benefit continuation, salary reduction opportunities, or availability of any Benefit Option. The City retains discretion to modify or discontinue benefit arrangements consistent with applicable law, collective bargaining obligations, and governing authority.

8.5 Collective Bargaining and Governing Authority
Nothing in this Plan shall be interpreted to supersede applicable memoranda of understanding, legally binding collective bargaining obligations, ordinances, City Council actions, or other governing authority. Where collective bargaining obligations apply, the City shall administer amendments or operational changes consistent with applicable law.

8.6 Governing Law
This Plan shall be interpreted, administered, and enforced in accordance with applicable federal law, including the Internal Revenue Code and related guidance, and, to the extent not preempted or inconsistent, the laws of the State of California. As a governmental employer plan, this Plan shall be interpreted in a manner consistent with laws applicable to municipal employers.

8.7 Conflict with Law and Severability
If any provision of this Plan is determined to conflict with applicable law, the conflicting provision shall be interpreted, modified, limited, or disregarded to the minimum extent necessary to achieve compliance while preserving the remaining provisions of the Plan to the greatest extent possible. If any provision is held invalid, unlawful, unenforceable, or inapplicable, the remaining provisions shall remain in full force and effect to the extent permitted by law.

Article titles, section headings, formatting, numbering, and organizational references are included for convenience only and shall not control interpretation. Unless the context clearly requires otherwise, words in the singular include the plural, words in the plural include the singular, references to one gender include all genders, and references to a person include an entity where applicable.

This Plan supersedes prior cafeteria plan, flexible benefits plan, premium conversion plan, or similar Section 125 plan documents applicable to the same subject matter, except to the extent otherwise expressly preserved by the City. Underlying Benefit Plans remain separately governed by their own controlling documents.

8.10 Execution and Adoption

CITY OF LAKEPORT
SECTION 125 PREMIUM ONLY PLAN

SUMMARY PLAN DESCRIPTION (SPD)

1. What Is This Plan?
The City of Lakeport offers a Section 125 Premium Only Plan that allows eligible participants to pay certain benefit contributions through payroll deductions on a pre-tax basis when allowed by federal law.
“Pre-tax” means the deduction is generally taken before federal income taxes (and, in many cases, Social Security/Medicare taxes) are calculated, which may reduce taxable income.

This plan only affects how eligible benefit contributions are deducted from payroll.

It does not create the underlying medical, dental, vision, HSA, or insurance benefits themselves.

Those benefits are governed by their own plan documents.

2. Who Can Participate?
You may participate if you are eligible for City-sponsored benefits and are one of the following:
• Regular full-time employee
• Probationary employee in an eligible position
• City Council Member eligible for City-sponsored benefits The following are generally not eligible:
• Temporary employees
• Seasonal employees
• Retirees
• Independent contractors
• Volunteers
• Variable-hour employees who have not yet become eligible under City benefit eligibility rules
Benefit eligibility itself is determined under the City’s benefit rules and applicable insurance plans.

3. What Benefits Can Be Paid Pre-Tax?
Eligible contributions may include:
Medical plan premiums
Dental plan premiums
Vision plan premiums
Employee Health Savings Account (HSA) payroll contributions Approved voluntary accident or health insurance benefits Examples of voluntary benefits may include:
• accident insurance
• hospital indemnity coverage
• specified disease / critical illness coverage
The City determines which voluntary benefits qualify.

4. What Is NOT Pre-Tax?
The following are not paid pre-tax under this Plan unless the City formally changes the Plan:
Disability income insurance
Life insurance
Legal service plans
Non-health voluntary benefits
Flexible Spending Accounts (FSAs)
Important: Disability premiums are deducted after taxes, which may help preserve favorable tax treatment if disability benefits are later paid.

5. How Enrollment Works
Annual Open Enrollment
Each year, the City offers an open enrollment period where eligible participants can:
• enroll in benefits
• change elections
• discontinue elections
• make HSA contribution elections
The City may require forms, documentation, or electronic enrollment.

Passive Renewal
If you do not make changes during open enrollment, the City may continue existing eligible premium elections automatically.

This helps avoid unintended loss of benefit payroll deductions.

However, the City may require active elections for certain benefits.

HSA Elections
HSA payroll contributions may require a separate annual election.

Because HSA contributions are subject to annual IRS limits, the City may require you to actively elect or update your contribution amount each year.

6. Changing Elections During the Year
Federal tax rules generally do not allow benefit election changes in the middle of the plan year unless you experience a qualifying event.

Examples may include:
• marriage
• divorce
• legal separation
• birth of a child
• adoption
• loss of other coverage
• gaining other coverage
• change in employment status
• Medicare eligibility
• Medicaid eligibility
• approved leave events
• court-ordered coverage changes
The City may require documentation before making a change.

7. Domestic Partner and Dependent Tax Information
Some dependents may be eligible for benefit coverage under City plans.

However, federal tax rules do not always treat all covered individuals the same.

For example:

A domestic partner may be eligible for health coverage under City benefit rules, but some premium amounts may still be taxable under federal law.

If required by law, the City may:
• deduct some premium amounts after-tax
• apply taxable payroll treatment
• report imputed income
You may be asked to provide information about dependent tax eligibility.

8. Health Savings Account (HSA) Information
If you enroll in an HSA-compatible high deductible health plan (HDHP), you may be eligible to make HSA payroll contributions.

Important things to know:

The City does NOT determine your HSA eligibility.

You are responsible for making sure you qualify.

You may NOT be eligible if:
• you have other disqualifying health coverage
• your spouse has certain flexible spending account coverage • you are enrolled in Medicare
• you are claimed as someone else’s tax dependent
IRS contribution limits apply.

The IRS limits how much you can contribute each year.

This includes contributions from all sources, not just City payroll deductions.

HSA tax treatment depends on your personal situation.

The City only processes payroll deductions.

You are responsible for:
• determining eligibility
• contribution limits
• tax reporting
• HSA distributions
