The Amargosa Creek Recreation Trail Project represents the culmination of efforts led by multiple departments seeking to galvanize a shared community identity; make the City a safer place for active transportation; celebrate the landscape through arts, culture, and recreation; beautify a critical natural resource; and increase multimodal accessibility for our residents, removing barriers, and making the City of Lancaster a more equitable place to live. This project unifies the City’s existing active transportation network of bike lanes and trails, vastly increasing safe access to schools, work, groceries, and public transportation hubs. This augmented sense of viability counters the inherent perceptions of the City’s urban sprawl as a primary barrier for participation in the active transportation system, while simultaneously increasing the sense of safety, pride in the desert landscape, and fosters an understanding of fragile ecological systems and the importance of their conservation.

Sgt. Steve Owen Memorial Park Hardcourt and Landscaping Improvements A.

In lieu of undertaking its own competitive bidding or proposal process, the City of Lancaster will utilize a cooperative purchasing agreement (piggyback) with Playcore Wisconsin, Inc dba GameTime c/o Great Western through OMNIA Partners Public Sector Contract. This cooperative enables public agencies to access public contracts.

B.

Award the contract for the improvements at Sgt. Steve Owen Memorial Park to Playcore Wisconsin, Inc dba GameTime c/o Great Western in an amount not to exceed $393,012.23, plus a 10% contingency.

C. Authorize the City Manager or designee to execute all contracts and associated documents, subject to City Attorney approval.

The tennis and pickleball courts at Sgt. Owen Memorial Park are over 20 years old and show signs of wear and tear. The project focuses on refurbishing and maintaining the City’s hardcourt assets to improve recreational opportunities for the residents of the community.  The use of this contract agrees with the City of Lancaster's purchasing practices for achieving the lowest pricing available. It is the staff’s opinion a competitive bidding process facilitated by the City of Lancaster would not be practicable or advantageous. Under the Purchasing Policy, piggyback contracts with other governmental agencies for professional, scientific, expert, or technical services where contracts were competitively bid are allowed.

The proposed award to
Playcore Wisconsin, Inc dba GameTime c/o Great Western
will refurbish the tennis and pickleball courts; including court re-surfacing, fence repairs, replacement of poles and nets, and landscaping.

Resolution No
.
23-55,
authorizing the City Manager, or his designee, to finalize terms, modify and execute a subordination agreement with respect to the $3,412,500.00 Lancaster Redevelopment Agency Loan, a $5,376,000.00 loan from the State of California Department of Housing & Community Development (the “Department”) , and a new loan of $1,900,000.00 from the Clearinghouse Community Development Financial Institution (CCDFI), allowing Laurel Crest, L.P. to proceed with mortgage refinance of senior loan for Laurel Crest Apartments.

2. Authorize the City Manager, with the concurrence of the City Attorney, to execute all documents to consummate the transaction, including the Department Subordination Agreement, the CCDFI Subordination Agreement, Escrow Instructions and related documents.

The City has previously issued its $11,000,000.00 Multifamily Housing Revenue Refunding Bonds (Laurel Crest Apartments) 2005 Series (the “Bonds”). The project was owned and operated by Jamboree Housing Corporation, (the “Developer”). A Regulatory Agreement and Declaration of Covenants were recorded simultaneously for the property to remain affordable for fifty- five

TEFRA Hearing/Approval of Exempt Facility Bonds for Maison’s Heights Apartments Recommendation:

Adopt
Resolution No.
23-56
pursuant to Section 147(f) of the Internal Revenue Code of 1986 approving the issuance of housing revenue bonds (the “Bonds”) by the California Municipal Finance Authority (the “CMFA”) in an aggregate principal amount not to exceed $40,000,000.00 to finance or refinance the acquisition, construction, improvement and equipping of a multifamily rental housing project located at the southwest corner of 30th Street East and East Avenue K, Lancaster, California (the “Project”).

The Borrower requests that the City approve CMFA’s issuance of the Bonds in order to finance the above-mentioned project. The Bonds will be tax-exempt private activity bonds for purposes of the Internal Revenue Code and, as such, require the approval of the elected body of the governmental entity having jurisdiction over the area where the project to be financed is located.  In order for the City to approve CMFA’s issuance of the Bonds, the City must conduct a Tax Equity and Fiscal Responsibility Act (“TEFRA”) hearing to allow for public comment on the use of the tax-exempt bond financing.  Notice of the TEFRA hearing was published in the Antelope Valley Press, a newspaper of general circulation in the community, on August 12, 2023, and the public hearing is scheduled for August 22, 2023.

Approval of the East Side Overlay
Recommendation:

Introduce
Ordinance No. 1105
, amending Section 17.20.760, 17.20.770, 17.20.780, 17.20.790, 17.20.800, 17.20.810 and 17.20.820 of the Zoning Ordinance (Title 17 of Lancaster Municipal Code), to establish the East Side Overlay.

The City of Lancaster analyzed past, current, and proposed development trends. The analysis revealed that a majority of development projects in the City are concentrated in the central and western portions of town while the eastern portion has few projects underway. Properties in the eastern portion of the City are predominantly agricultural, vacant, and/or undeveloped land. This underutilized area of the City could help respond to the high demand for industrial uses looking to build in Lancaster.  Additionally, the eastside could be developed for alternative energy projects to meet the State’s ambitious energy goals.  In order to promote and help vitalize the eastern portion, the City is proposing an East Side Overlay.  The proposed East Side Overlay would increase flexibility and development potential, as well as incentivize alternative energy and light industrial development to occur beyond what is currently allowed. In addition, it would encourage new development that would provide economic benefits to the City and its residents. The East Side Overlay ensures that multiple sites are available for a variety of alternative energy, light industrial users, among others, which would provide employment-generating lands that are highly accessible and compatible with other uses in the community.

Services such as American Sign Language interpreters, a reader during the meeting, and/or large print copies of the agenda are available. To ensure availability, you are advised to make your request at least 72 hours prior to the meeting/event you wish to attend. Due to difficulties in securing sign language interpreters, five or more business days notice is strongly recommended. For additional information, please contact the City Clerk at (661)723-6020.
