RESOLUTION NO. 23-60
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER, CALIFORNIA, ORDERING THE VACATION OF
A PORTION OF THE PUBLIC ROAD EASEMENT AS
DEDICATED ON THE MAP FILED IN BOOK 5, PAGES 470-471
OF MISCELLANEOUS RECORDS, LOCATED WITHIN
BLOCK 2 ON THE NORTH SIDE OF MILLING STREET
BETWEEN BEECH AVENUE AND SIERRA HIGHWAY, IN
THE CITY OF LANCASTER
WHEREAS, the City of Lancaster is holder of road easement rights dedicated on the map of Miscellaneous Records, filed in Book 5, pages 470-471 and recorded on February 16, 1884, in the office of the recorder of the County of Los Angeles, State of California; and WHEREAS, the City intends to utilize a portion of the public road easement to be vacated for private usage and other related purposes; and
WHEREAS, the existing road easement is no longer needed.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the City Council of the City of Lancaster, State of California, that:
Section 1. The Resolution of Intention, Resolution No. , in the matter of vacation of the above described easement in the City of Lancaster was adopted by the City Council of the City of Lancaster on October 10, 2023, at which said Resolution has established the time and place for the public hearing on said vacation of easements.
Section 2. Due notices of said hearing have been published and posted as required by law.
Section 3. All protests in this matter have been duly considered.
Section 4. That the City Council finds, from all the evidence submitted, that an easement as described in its Resolution of Intention, Resolution No. , is unnecessary for present or prospective road and other incidental purposes.
Section 5. The City Council does hereby order the vacation of the certain road easement to the owner of record as described and depicted in Exhibits A and B.
Section 6. The City Clerk is hereby ordered to cause a certified copy of this resolution attested to by the City Clerk under the seal of the City, to be recorded in the office of the County recorder of Los Angeles County.
Section 7. The City Clerk is hereby ordered to cause a certified copy of this resolution attested to by the City Clerk under the seal of the City, to be mailed to the following agencies:
