RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER, ACCEPTING THE ROAD EASEMENT FOR
APN NO. 3123-015-908 (15TH STREET WEST)
WHEREAS, on December 12, 202 3, the City Council evaluated accepting the Road Easement for street improvement in 15th Street West. Accepting the Road Easement will allow for the construction of a landscaped parkway planter in 15th Street West to proceed as envisioned in the Lancaster Health District Master Plan on the Lancaster Housing Authority owned lot.
WHEREAS, the Lancaster Housing Authority (“Grantor”) is providing the City of Lancaster at no cost to City of Lancaster (“Grantee”) for the purpose of providing road access within the depicted areas more particularly described in the legal des cription attached hereto as Exhibit “A,” under the terms and conditions of the Grant of Road Easement attached hereto as Exhibit “B,” as incorporated herein by this reference; and WHEREAS, the Housing Authority and the City Council have duly considered al l of the terms and conditions of the proposed Road Easement and believes that the granting of the road easement is in the best interests of the City of Lancaster and the health, safety, and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local laws and requirements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LANCASTER, AS FOLLOWS:
Section 1. The City Council finds and determines that the statements set forth in the Recitals above are true, correct and a substantive part of this Resolution.
Section 2. The City Council hereby accepts the Road Easement in substantially the form presented to the City Council, subject to such revisions as may be made by the City Manager or his designee. The City Manager, or his designee, is authorized to execute and record the Road Easement in generally the form attached as Exhibit “B,” together with such additional changes as may be deemed necessary and proper by the City Manager in consultation with legal counsel.
