A RESOLUTION OF THE LANCASTER HOUSING
AUTHORITY, GRANTING THE ROAD EASEMENT FOR APN
3123-015-908, (15 STREET WEST) , TO THE CITY OF
LANCASTER
WHEREAS, on December 12, 2023, the Authority evaluated granting the City of Lancaster a road easement for the construction of street improvements in 15th Street West. Granting the road easement to the City will allow for the construction of a landscaped parkway planter in 15th Street West to proceed as envisioned in the Lancaster Health District Master Plan and facilitate development on the Authority-owned lot.
WHEREAS, the Authority (“Grantor”) is providing the City of Lancaster at no cost to the City of Lancaster (“Grantee”) for the purpose of providing road access within the depicted areas more particularly described in the legal description attached hereto as Exhibit “A,” under the terms and conditions of the Grant of Road Easement attached hereto as Exhibit “B,” as incorporated herein by this reference; and
WHEREAS, the Authority and the City Council have duly considered all of the terms and conditions of the proposed Road Easement and believes that the granting of the road easement is in the best interests of the City of Lancaster and the health, safety, and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local laws and requirements.
NOW THEREFORE, BE IT RESOLVED BY THE LANCASTER HOUSING
AUTHORITY, AS FOLLOWS:
Section 1. The Authority finds and determines that the statements set forth in the Recitals above are true, correct, and a substantive part of this Resolution.
Section 2. The Authority hereby finds and determines that the Road Easement is Exempt Surplus Land pursuant to section 54221(f)(1)(D) of the Government Code because it is being conveyed to the City for the City’s use.
Section 3. The Authority hereby approves the granting of the Road Easement in substantially the form presented to the Authority, subject to such revisions as may be made by the Executive Director of the Authority or his designee. The Executive Director of the Authority is hereby authorized to execute the Agreement (including without limitation all attachments thereto) on behalf of the Authority. A copy of the Agreement when executed by the Authority shall be placed on file in the office of the Secretary of the Authority.
