Subject: Award of Design-Build Services – Public Works Construction Project No. 24-013, Public Safety Building Renovation
Recommendations:
1. Award a Design-Build professional services agreement to Bowe Contractors, Inc., of Tehachapi, CA, in the amount of $3,916,319.00 plus a 10% contingency, for Public Works Construction Project No. 24-013 Public Safety Building Renovation to design and construct renovation improvements. Authorize the City Manager, or his designee, to sign all documents. The design-build entity selection process was made in accordance with Chapter 4 of the Public Contract Code, as applicable, and negotiated in accordance with California Public Contract Code Section 22038(c).
2. Find that the City has complied with the California Environmental Quality Act. A Notice of Exemption was filed on September 15, 2023.
3. Approve an appropriation of $3,000,000.00 from Fund Balance into project string CP14BS001.CONST from GL Code 10149900.8000.
Fiscal Impact:
$4,307,950.90 (including 10% contingency); with approval of the appropriation, sufficient funds are available in the Capital Improvement Budget project string.
Background:
The Public Safety Building Renovation project will renovate the existing building located at 44811 Sierra Highway, Lancaster, California 93534, to accommodate the needs and operations of the Lancaster Public Safety Department. The Public Safety Building includes a ground floor (22,400 sf) and mezzanine (6,040 sf) for a total area of 29,440 square-feet.
The Public Works Department, City Engineering Division, solicited qualifications and proposals 1 4

through a Request for Qualifications & Proposals (RFQ&P) from design-build entities and managed the procurement process. RFQ&P #800-24 for Design-Build Services for the PWCP 24-013 Public Safety Building Renovation was advertised on September 10, 2023.
The RFQ&P included a description of design-build services requested, Statement of Qualifications (SOQ) Qualification Questionnaire and submittal requirements, Technical Proposal and submittal requirements, local preference criteria, design-build entity selection process, and other additional information. Ten companies attended the pre-qualification conference on September 20, 2023, held at the Public Safety Building. PlanetBids recorded 50 prospective bidders.
Per Section 2.2 of the Existing Community Workforce Agreement (“CWA”), this project is subject to the CWA by and between the City of Lancaster and Los Angeles/Orange Counties Building and Construction Trades Council, and the Signatory Craft Councils and Unions (“CWA”). The PWCP 24-013 contract documents were prepared, and the project was advertised accordingly. Per Section
2.6(b) of the CWA, Letters of Assent shall be submitted by the Contractor and each of its subcontractors, of whatever tier, forty-eight (48) hours prior to commencement of work, or within forty-eight (48) hours after the award of Project Work to that Contractor (or subcontractor), whichever occurs later.
SOQs and Proposal were due to City Clerk on October 3, 2023. No responsive bids were received. In accordance with California Public Contract Code Section 22038(c), this contract may be awarded to a design-build team by negotiation.
Having demonstrated their ability to deliver the recent multi-phase City Hall renovation, to the City’s satisfaction, and successfully work with the City and with the City’s Engineering Consultant, Bowe Contractors, Inc., of Tehachapi, CA, and Duke Engineering Associates of Lancaster, CA, will form the design-build entity under Bowe Contractors, Inc. The design-build entity has submitted a complete SOQ and negotiated in good faith to deliver the proposed Public Safety Building renovation scope within budget; and, most importantly, within the timeline needed to vacate the former Jethawks Stadium, where Public Safety currently resides, to allow for the renovation and conversion of the stadium for occupancy by the United Soccer League (USL).
