Recommendations:

1. Approve the Second Amendment to the Agreement between the Antelope Valley Air Quality Management District (AVAQMD) and the City of Lancaster amending Section 3 and Section 13 and Exhibit A in its entirety, to include Operational Oversight, naming Barbara Lods as the Executive Director, setting initial classification and compensation, and designating at-will employee status; and the Scope of Material and Services.

2. Authorize the City Manager to finalize terms and conditions of the proposed Second Amendment and execute the final Second Amendment.

Fiscal Impact:

None. The Agreement provides for all City costs to be reimbursed by AVAQMD.

Background:

The Agreement for services between the City and AVAQMD is for a period of five (5) years commencing on October 1, 2022 and ending on June 30, 2027, with an option to continue for two (2) more years under the same terms and conditions, unless earlier terminated, extended, or modified. This Second Amendment to the Agreement provides Operational Oversight by providing the services of a Director to act in the capacity of Air Pollution Control Officer (APCO)/Executive Director, serving as an at-will employee of the City.
