RESOLUTION EXHIBIT “B” – SAMPLE NOTICE

NOTICE OF PUBLIC HEARING
(1) FOR PROPOSED AUTOMATIC ANNUAL INFLATIONARY INCREASE TO SOLID WASTE COLLECTION RATE (2) TO HAVE SOLID WASTE COLLECTION FEE COLLECTED ON THE TAX ROLL (Proposition 218; Cal. Health & Safety Code Sections 5473, 5473.1) The City of Lancaster (the “City”) periodically evaluates its service needs, programs and operational costs before recommending rate changes to the City Council. Prior to adoption, City customers are notified by mail about proposed rate changes and given the opportunity to comment. This notice provides information related to the City’s proposed solid waste collection rate modification, outlines the public protest process and publicizes the public hearing related to the following: (1) the City’s proposed automatic annual inflationary solid waste collection fee as and to the extent permitted by section 53756(b) of the Government Code and section 13.16.090 of the Lancaster Municipal Code; and (2) the City’s proposed election to have fees for solid waste collection at single-family dwellings collected on the tax rolls. The purpose of this notice is to satisfy requirement of Proposition 218 and provide notice as required by section 5473.1 of the Health and Safety Code.

Why is the rate modification needed?
The proposed modification to the City’s existing solid waste collection rates (“Existing Rates”) authorizes automatic inflationary adjustments. Such automatic adjustments, as and to the extent permitted by section 53756(b) of the Government Code and section 13.16.090 of the Lancaster Municipal Code, are needed so the City can automatically pass through the cost of inflation. Without automatic adjustments, inflation could result in a budget deficit.

Proposed Automatic Adjustments to Existing Rates:

The proposed modification provides that the Existing Rates may be automatically adjusted during the five (5) year period following the effective date of the modification, as and to the extent permitted by section 53756(b) of the Government Code and section 13.16.090 of the Lancaster Municipal Code, to pass through the cost of inflation. The City must provide at least 30 days’ notice before any such adjustment.

When does the rate increase take effect?
If approved, the proposed rate increase would be effective as of July 1, 2024.

Public hearing and protest information:

The City Council will conduct a public hearing at which it will consider adoption of a resolution increasing solid waste collection rates as provided in this notice. The public hearing will be held as follows:
