A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER AMENDING RESOLUTION NOS. 24-34, 24-46,
AND 24-47 RELATING TO AN ORDINANCE TO BE
SUBMITTED TO THE VOTERS AT A SPECIAL MUNICIPAL
ELECTION TO BE HELD ON NOVEMBER 5, 2024,
APPROVING ENACTING AN AMENDMENT TO THE CITY’S
TRANSACTIONS AND USE TAX
WHEREAS, on June 25, 2024, the City Council (“City Council”) of the City of Lancaster (“City”) approved Resolution No. 24-34 (the “Measure Resolution”), which generally ordered that an ordinance be submitted to the voters at the general municipal election to be held on November 5, 2024, approving and enacting an amendment to the City’s transaction and use tax, directing the City Attorney to prepare an impartial analysis of the measure, setting priorities for filing a written argument relating to the ballot measure, and providing for rebuttal arguments relating to the ballot measure; and
WHEREAS, on July 9, 2024, the City Council approved Resolution No. 24-46 (the “Election Resolution”), which called for the holding of a special municipal election to be held on Tuesday, November 5, 2024, for the submission to the voters a proposed measure relating to an ordinance enacting a transactions and use tax to be administered by the California Department of Tax and Fee Administration; and
WHEREAS, on July 9, 2024, the City Council approved Resolution No. 24-47 (the “Consolidation Resolution”), which requested the Board of Supervisors of the County of Los Angeles to consolidate a special municipal election to be held on November 5, 2024, with a statewide general election to be held pursuant to Section 10403 of the Elections Code; and WHEREAS, the City Council desires to amend the ballot title and summary contained in the Measure Resolution, Election Resolution, and Consolidation Resolution, in order to comply with the statutory 75-word limit.
THEREFORE, THE CITY COUNCIL OF THE CITY OF LANCASTER DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds and determines that the foregoing recitals are true and correct. The recitals are hereby incorporated into the operative provisions of this Resolution by this reference.
SECTION 2. The ballot title and summary contained in section 3 of the Measure Resolution, section 2 of the Election Resolution, and section 2 of the Consolidation Resolution shall be and hereby is amended and replaced by the following:

Lancaster Essential Services Protection Measure
Shall an ordinance protecting Lancaster’s financial stability; maintaining essential services; maintaining 911 response; retaining businesses; maintaining veterans, senior, mental health, and homelessness community programs; by amending the city’s sales and use tax ordinance to provide automatic increase to the sales and use tax rate to the maximum permitted – whether because another tax expires, the Legislature increases the statutory maximum use tax for the City, or otherwise – be adopted?

SECTION 3. Any reference in the Measure Resolution to a “General” Municipal Election to be held on November 5, 2024, shall be and hereby is amended to mean a “Special” Municipal Election to be held on November 5, 2024; and the City Council declares enactment of this Measure to be an emergency pursuant to Article XIIIC of the California Constitution.
SECTION 4. Except as and to the extent specifically provided in this Resolution, the Measure Resolution, Election Resolution, and Consolidation Resolution shall each remain in full force and effect.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution.
