RESOLUTION NO. __________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER, CALIFORNIA, AUTHORIZING THE CITY
ATTORNEY TO FILE AND PURSUE CIVIL COMPLAINTS
FOR DRUG ABATEMENT, ABATEMENT OF PUBLIC
NUISANCE, APPOINTMENT OF RECEIVER, AND/OR
RELATED ACTIONS ON BEHALF OF THE CITY.
WHEREAS, nuisance properties, including, but not limited to properties on which narcotics activity is conducted, squatters take up residence and/or criminal activity is undertaken are a detriment to neighborhoods and the citizens of Lancaster; and WHEREAS, the Lancaster Municipal Code and California statutes each authorize the City to file civil actions to abate nuisances; and
WHEREAS, expeditious processing of such civil enforcement actions is in the City's best interest; and
WHEREAS, authorizing the City Attorney to routinely file, where appropriate, civil complaints for drug abatement, abatement of public nuisance and/or receivership actions would expedite the enforcement of California law and the Lancaster Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Attorney is hereby authorized to file on behalf of the City civil complaints for drug abatement, complaints for abatement of public nuisance and/or receivership actions, including such motions and/or applications as may be necessary or appropriate under the applicable circumstances to timely prosecute such civil proceedings.
Section 2. The City Attorney shall report the filing of any such civil actions to the City Council within thirty (30) days of the initial filing.
