The City Council reviewed this policy regularly, with the latest policy adopted on February 13, 2018, by Resolution No. 18-06.
The City's cash management system is designed to accurately monitor and forecast expenditures and revenues, thus enabling the City to invest funds to the fullest extent possible within the guidelines of this Investment Policy. The City attempts to achieve the highest yield obtainable through a diversified portfolio only after meeting the criteria established for safety and liquidity in that order. The principal investment objectives of the City are:
1. Preservation of capital and protection of investment principal;
2. Maintenance of sufficient liquidity to meet anticipated cash flows;
3. Attainment of a market rate of return;
4. Diversification to avoid incurring unreasonable market risks and;
5. Compliance with the City’s Municipal Code and with all applicable City resolutions, California statutes, and Federal regulations.
The City’s portfolio is a short-term and intermediate-term fixed-income portfolio. The maximum maturity of any investment is 5 years, with consideration of anticipated cash flow requirements and known future liabilities. The City contracts with an investment advisory service (Insight Investment) to assist in the effort to maximize the returns of the City portfolio. The City’s investments include publicly traded Treasury notes, Treasury Bills, Federal Agency Investments, Time Deposits, Local Agency Investment Fund (LAIF), and California Cooperative Liquid Assets Securities System (Cal Class) under the auspices of the State Treasurer for investment.
Funds invested in LAIF and Cal Class are available within 24 hours, and other investments are available upon maturity at full face value. These investments enable the City to meet its expenditure requirements for the next six months, as required by state law.
The City’s investment procedures are governed by Sections 53600 et. seq. of the California Government Code. Additional requirements have been placed on the City’s authorized investments by the Investment Policy (a copy is available in the Finance Department or from the (City Clerk), and all investments listed on the attached report adhere to these requirements.

Subject: Assignment and Assumption Agreement Regarding Subaru Antelope Valley and Honda Lancaster
Recommendations:
1. Approve an Assignment and Assumption Agreement with Trust Automotive.
2. Authorize the City Manager, or his designee, to negotiate, finalize, and execute the agreement in a form to be approved by the City Attorney.
G.C. Section 84308: No
Fiscal Impact:
This Assignment and Assumption Agreement will remain in effect through 2039. Throughout this time, the site will continue to operate as an automotive dealership, ensuring the ongoing generation of sales tax revenue for the City.
Background:
The Lancaster Auto Mall serves as a key generator of sales tax revenue and jobs for the City of Lancaster. As such, the City has proactively engaged in a variety of efforts to support the Auto Mall, as well as attract and retain auto dealerships.
One such initiative was the 2009 acquisition of operating and restrictive covenants from Clutter Motors for the auto dealerships now known as Antelope Valley Subaru and Honda Lancaster. Through this effort, the City secured significant upgrades to both facilities, along with a thirty (30)-year commitment for the operation and maintenance of the dealerships at these locations.
In 2017, with the City’s consent, Clutter Motors assigned its obligations under these covenants to Sully III AVP, LLC (“Sully”). Sully has continued to operate the two (2) dealerships since that 1 7
4 7
time.
Today, Sully is seeking to sell the dealerships to another experienced auto group, Trust Automotive. This sale requires the consent of the City and the transfer of the obligations associated with the covenants via the proposed Assignment and Assumption Agreement.
The covenants set forth in 2009 will remain in effect for thirty (30) years, through 2039. During this time, the sites must be occupied and used solely for automotive uses relating to new automobile and truck dealership activities, including automobile and truck servicing, used automobile and truck sales, and repair of vehicles and ancillary uses reasonably related and connected to new automobile and truck dealerships.
By entering into the proposed agreement, the City will aid in preserving local jobs and tax revenues, while also securing the continued operation of a Honda and a Subaru dealership well into the future.

Subject: Tax Sharing Resolution for Proposed Annexation No. 40-164 (04-220) into Los Angeles County Waterworks District No. 40, Antelope Valley Recommendation:
Adopt the Tax Sharing Resolution for proposed Annexation No. 40-164 (04-220) into Los Angeles County Waterworks District No. 40, Antelope Valley. Direct the City Clerk to route three (3) copies of the tax share resolution to the City Attorney and the Mayor for wet signatures.
Fiscal Impact:
None.
Background:
The property owners within Annexation No. 40-164 (04-220) are requesting water service for their properties. Before water service can be provided, the properties must first be annexed into Los Angeles County Waterworks District No. 40. Additionally, before annexation may be approved, the agencies already providing services to the sites must negotiate reallocation of the ad valorem taxes within the District.
Los Angeles County Waterworks District No. 40, Antelope Valley submitted a written request that the City of Lancaster consider a joint resolution which will reallocate the ad valorem tax revenues generated by the properties within the proposed annexation. Recommendations:
1) Approve the third amendment to the agreement between the City of Lancaster, the City of Palmdale, and the County of Los Angeles for the Antelope Valley Transit Authority (AVTA) transit service agreement.
2) Appropriate $480,000 to account 21819000.5710 for FY 24/25 budget year. 3) Authorize the City Manager, or his designee, to negotiate, finalize, and execute the agreement amendment and all future amendments in a form to be approved by the City Attorney.
G.C. Section 84308: No
Fiscal Impact:
$480,000 to account 21819000.5710 for FY 24/25.
Background:
The Antelope Valley Transit Authority (AVTA) is a public entity established on April 1, 1992, pursuant to Section 6506 of the Government Code of the State of California. AVTA was formed under a Joint Exercise of Powers Agreement (JPA). Its members consist of the County of Los Angeles and the cities of Lancaster and Palmdale. The JPA members jointly contribute capital and operating funding to AVTA each year to assist in providing transit services to the Antelope Valley Area.
AVTA is governed by a six-member Board of Directors with governance responsibilities over all activities related to AVTA. The Board is comprised of two directors from each participating 1 7

jurisdiction and meets on the fourth Tuesday of each month. The Executive Director/CEO manages day-to-day operations and implements Board policy in accordance with the duties specified in the applicable sections of the Government Code of the State of California and the JPA.
AVTA was formed to provide and administer public transportation services for the citizens of Lancaster, Palmdale, and certain unincorporated sections of the County of Los Angeles in the Antelope Valley. The Greater Antelope Valley area encompasses over 3,000 square miles, includes both Northern Los Angeles County and Eastern Kern County, and is home to approximately 500,000 residents. The Antelope Valley provides a thriving environment for economic growth and offers a wide range of benefits to businesses seeking to relocate or expand their operations.
The third amendment to the contract redefines the AVTA allocation formula for operation cost for each jurisdiction based on population. This results in an increase in cost for FY 24/25 of $479,399.
Each year moving forward, the impact will vary based on the agreed-upon methodology. The City of Palmdale and the City of Lancaster will contribute equally based on the higher allocation of the cost allocation methodology.

Date: August 27, 2024
To: Mayor Parris and City Council Members
From: Rodrick Armalin, Public Safety Director
Subject: Governor Newsom’s Executive Order N-1-24
Recommendation:
Direct staff to conform its standard operating procedures and policies to Executive Order N-1-24 regarding homeless encampments.
Fiscal Impact:
None.
Background:
On Thursday, July 25th, 2024, California Governor Gavin Newsom released Executive Order N-1-24, directing all state agencies implement plans for the removal of homeless encampments from state land and relocation of unhoused individuals, and encouraging local governments to adopt policies consistent with the Order. In addition, the Order directs state agencies to use all available resources and infrastructure to take action with the urgency and compassion the homeless crisis demands to humanely remove encampments from public spaces, prioritizing those encampments that most threaten the life, health, and safety of those in and around them.
As state agencies and Los Angeles County begin to implement this order, it is imperative the City has plans and procedures in place to compassionately remove encampments from public spaces to ensure the City does not experience a rise in our homeless numbers.
Additionally, the governor has told agencies they must comply with this order or risk the loss of state funds for essential services and programs.
In reviewing our existing ordinance and procedures, we currently meet the expectations of Governor Newsom’s executive order. Our current procedures have been in place for several years, and our ordinance was updated last year to included addressing encampments that affect critical infrastructure.
At council’s direction, staff will ensure our operating procedures and policies will remain in conformance with Executive Order N-1-24.
