From: Allison E. Burns, City Attorney
Rodrick Armalin, Chief of Police - Lancaster Police Department Subject: Ordinance No.____ to the Lancaster Municipal Code approving the Lancaster Police Department’s Military Equipment Use Policy
Recommendation:
Introduce Ordinance No.____ to the Lancaster Municipal Code approving the Lancaster Police Department’s Military Equipment Use Policy.
Fiscal Impact:
$20,328; Sufficient funds are available in account 10131000.5351.
Background:
Governor Newsom signed Assembly Bill 481 on September 30, 2021, which aims to regulate the financing, procurement, and utilization of "military equipment" by law enforcement agencies in California. AB 48 is a state requirement that all agencies disclose the purchase or intend to purchase certain listed equipment available to Law Enforcement agencies from the federal government as military surplus. The Lancaster Police Department is required to seek City Council approval of their military equipment use procedure by ordinance at a regular open meeting. AB 481 allows the governing body to approve funding, acquisition, and use of military equipment within its jurisdiction if it determines that the military equipment meets specific standards.
This ordinance is a necessary step to allow Lancaster Police Department to have a process for approval and acquisition of mainstream equipment used in modern use by police departments throughout the nation.
