STAFF REPORT
City of Lancaster
CC
14 4/8/2025
TN
Date: January 28, 2025
To: Mayor Parris and City Council Members
From: Allison E. Burns, City Attorney
Subject: Designation of an Independent Hearing Officer to Hear Appeals of Orders, Decisions, and/or pursuant to Lancaster Municipal Code section 2.44 Recommendation:

Adopt Resolution No._____ designating an independent hearing officer to hear appeals of orders, decisions, and/or determinations pursuant to Chapter 2.44 of the Lancaster Municipal Code.

G.C. Section 84308: No
Fiscal Impact:

Any fiscal impact associated with hiring or contracting an independent hearing officer will be addressed within the applicable departmental budget and is not expected to have a significant financial effect on the City.

Background:

Section 2.44.010 of the Lancaster Municipal Code permits the City Council, by resolution, to designate an independent hearing officer to adjudicate appeals concerning any decision, determination, or order for which an appeal is authorized under the Municipal Code or other applicable law.

To ensure due process and maintain impartiality in administrative hearings, staff recommends the designation of an independent hearing officer. This action will establish a consistent and transparent process for hearing appeals related to enforcement actions or determinations pursuant to Lancaster Municipal Code section 2.44. The independent hearing officer will be responsible for conducting fair and unbiased hearings and rendering decisions in accordance with applicable laws and regulations.

The proposed resolution formally designates an independent hearing officer to hear all such appeals.

This designation enhances the City’s commitment to accountability, transparency, and fair administration of its municipal codes.

Approval of this resolution supports the City’s efforts to ensure fair administrative procedures and protect the rights of property owners. It aligns with best practices for local governance and code enforcement.
