A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER, CALIFORNIA, DECLARING ITS INTENTION
TO VACATE A PORTION OF THE PUBLIC ROAD EASEMENT
DESCRIBED AND SHOWN IN ROAD DEED RECORDED ON
JULY 9, 1991, AS INSTRUMENT NO. 91-1041663 OF OFFICIAL
RECORDS, AND LOCATED ON THE SOUTHWEST CORNER
OF AVENUE L AND 5 TH STREET EAST, IN THE CITY OF
LANCASTER
WHEREAS, the City of Lancaster is holder of the road easement rights, dedicated in Road Deed as Instrument No. 91-1041663 of Official Records, and recorded on July 9, 1991, in the office of the recorder of the County of Los Angeles, State of California; and WHEREAS, the dedication was part of the conditions of approval for Tract 48978; and WHEREAS, the existing public road easement is no longer needed; and WHEREAS, the City does not have planned public developments within the area to be vacated.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF LANCASTER, STATE OF CALIFORNIA, AS FOLLOWS:
Section 1. The public interest, convenience, and necessity so requiring, it is the intention of the City Council of the City of Lancaster to vacate the public road easement in accordance with Section 8300 et seq. of the Streets and Highways Code of the State of California and Section 5400 of the California Health & Safety Code.
Section 2. The City Council does hereby declare its intention to vacate that certain public road easement as described in Exhibit “A” and shown on Exhibit “B”.
Section 3. Said vacation have been duly recommended for approval as substantiated that the road easement has not been used for its intended purposes.
Section 4. The 8 th day of July 2025, at the hour of 1:30 p.m. in the Council Chambers at Lancaster City Hall, 44933 Fern Avenue, Lancaster, is hereby designated as the date, time, and place at which a public hearing will be held before the Lancaster City Council to discuss the proposed vacation. At that time, all persons with interest in or objection to the proposed vacations, may appear and be heard.
Section 5. The City Clerk is hereby authorized and directed to post notices of said proposed vacation conspicuously near the portion of the road easement proposed to be vacated at least two weeks prior to the date of said hearing. Such notices shall be prepared and posted pursuant to Section 8323 of the Streets and Highways Code of the State of California. Further, the City Clerk shall notice the meeting and hearing in accordance with Section 8322 of the Streets and Highways Code of the State of California.
