G.C. Section 84308: No
Fiscal Impact:
There will be no impact to the City’s General Fund. All proposed dollars impacted by the Substantial Amendment to the Action Plan have previously been awarded to the City and budgeted into activities in previously adopted Action Plan and Substantial Amendments. The First Time Homebuyer Program Project (FTHB PRGM.CDBGGRANT 31022000.5656) will be reduced by $130,259.00. The same amount will be added into a new Project for the Antelope Valley Foster Friends Program (CDBG26.AVFOSTER 31022000.5656). The reprogramming of the CDBG funds to the Antelope Valley Foster Friends Program (Level Up - Gaming Center) will ensure that the City’s program funds are utilized to improve the quality of life for the City’s residents. The City Council’s approval of the recommended action adopts the Substantial Amendment to the Action Plan thereby allocating those resources into the CDBG budgets. 2 1

Background:
HUD requires all entitlement communities reciving CDBG funds, such as the City, to prepare and submit a Consolidated Plan every five (5) years to establish a unified, strategic vision for economic development, housing and community development actions. The Consolidated Plan encompasses the analysis of local community needs and coordinates appropriate responses to those needs and priorities.
The Consolidated Plan is carried out through five (5) Annual Action Plans which provide a concise summary of the actions, activities, and the resources that will be used each year to address the priority needs and specific goals identified in the Consolidated Plan. The City must submit an Annual Action Plan to HUD each year of the five-year Consolidated Plan period. The City Council adopted and submitted the Action Plan to HUD by the required deadline dates of each year.
After a thorough review of existing activities, proposed goals, and consultation with HUD representatives, the City identified the need to Substantially Amend its Action Plan by allocating funds to activities that will provide decent, safe and affordable housing, a suitable living environment, and expand on economic opportunities principally for persons of low- and moderate- income throughout the City.
Per the City’s Citizen Participation Plan (CPP), a Substantial Amendment to a Consolidated Plan and Action Plan is required when a “substantial” change is proposed as it relates to funding priorities, proposed activities, goals, and objectives. This substantial amendment to the Action Plan is necessary because the City is proposing to add one (1) new project to the 2025-26 Action Plan.
Pursuant to 24 CFR 91.505(a), a Substantial Amend requires specific citizen participation actions, including a Public Hearing and 30-day public review period, before the changes may be approved by the City Council and submitted to HUD. The Public Hearing Notice concerning the proposed Substantial Amendment to the Action Plan was published in the Antelope Valley Press on August 9, 2025. The Substantial Amendment was made available on the City’s website, Finance & Technology Information Department and City Clerk’s Office for a 30-day public review period starting on August 9, 2025, and ending on September 9, 2025.
Staff recommend amending the Action Plan noted in the enclosed Substantial Amendment. The proposed projects are consistent with the Consolidated Plan goals and will provide immediate assistance to the community.
Analysis:
The following narrative provides descriptions and other information for the proposed Action Plan activities.
Activities
CDBG First Time Homebuyer Program

EXECUTIVE SUMMARY
Background
The U.S. Department of Housing and Urban Development (HUD) requires all entitlement communities receiving Community Development Block Grant (CDBG) and Home Investment Partnerships (HOME) funds, such as the City of Lancaster (City), to prepare and submit a Consolidated Plan every five (5) years to establish a unified, strategic vision for economic development, housing and community development actions. The Consolidated Plan encompasses the analysis of local community needs and coordinates appropriate responses to those needs and priorities.
The Consolidated Plan is carried out through Annual Action Plans which provide a concise summary of the actions, activities, and the specific federal and non-federal resources that will be used each year to address the priority needs and specific goals identified in the Consolidated Plan.
Per the City’s Citizen Participation Plan (CPP), a Substantial Amendment to an Action Plan is required when a “substantial” change is proposed as it relates to funding priorities, proposed activities, goals, and objectives. This substantial amendment to the Action Plan is necessary because the City is proposing to reprogram $130,259.00 in CDBG funds from one activity to a new activity as follows:

STAFF REPORT
City of Lancaster

Date:September 10, 2025

From:Trolis Niebla, City Manager
Subject: Urgency Ordinance Declaring the Existence of a Local Emergency Related to Critical Infrastructure Impacted by Homeless Encampments and Property Maintenance Issues; Authorization for Emergency Procurement Authorizing Immediate Actions to Protect Public Health, Safety, and Welfare; and Temporarily Suspending Competitive Procurement Requirements to expedite response Recommendation:
Adopt Urgency Ordinance XXX declaring the existence of a local emergency due to homeless encampments and property maintenance issues impacting the City’s critical infrastructure, authorizing immediate actions to mitigate hazards, and suspending competitive procurement requirements to expedite response.
Fiscal Impact:
Expenditures will be incurred for emergency contracting, cleanup, and related services. Funding will be drawn from existing public works and emergency operations accounts, with additional appropriations requested from the City Council if necessary. Staff will pursue reimbursement opportunities from county, state, and federal partners wherever possible.
Background:
In 2024, the City adopted Ordinance No. 1112 with a clear mission: to safeguard critical infrastructure and reduce wildfire risk by prohibiting camping, encampments, and the storage of personal property in vulnerable areas—including near bridges, utilities, public facilities, and designated wildfire zones.
This ordinance empowered the City to take action: removing unsafe encampments, establishing secure storage and retrieval systems for personal belongings, and enforcing penalties for violations. Yet despite these measures, the situation on the ground has become increasingly urgent. 1 4
1 5
Since the ordinance took effect, City crews have cleared 575 encampments across a six-square- mile area—from Sierra Highway to 20th Street West, between Lancaster Blvd and Avenue K— resulting in the removal of a staggering 1,196 tons of trash. These encampments have contributed to growing blight, unsanitary conditions, and heightened safety risks, particularly near essential infrastructure.
Compounding the issue, two major storm events forced the City to deploy additional resources to remove encampments from Amargosa Creek, where blocked drainage and debris posed immediate flood hazards.
City staff have worked tirelessly, in close coordination with the Los Angeles County Sheriff’s Department and Fire Department, to respond swiftly and effectively. According to Los Angeles County Fire Department, they responded to 71 homeless related fires and 46 homeless related medical calls for service between September 2, 2024, and September 2, 2025. The escalating environmental and public safety impacts underscore a critical need for strengthened enforcement and sustained support.
Ordinance No. 1112 was not just a policy, it was a commitment to public safety, environmental health, and the protection of vital city services. Fulfilling that commitment requires urgent, continued action.
The proposed urgency ordinance enables the City Manager to take immediate action, including contracting services, cleaning and securing facilities, and removing hazardous debris without compliance with standard competitive procurement requirements.
The proposed ordinance is provided in Attachment A. Immediate action is required to safeguard Lancaster’s critical infrastructure and protect public health and safety. Staff recommend adoption of the urgency ordinance.

WHEREAS, such conditions also create heightened risks of fire, flooding, contamination, and other hazards to the City’s critical infrastructure and surrounding communities; and WHEREAS, delay in addressing these conditions through standard competitive procurement processes would endanger the community by prolonging exposure to hazardous conditions and critical infrastructure failure;
WHEREAS, California Government Code sections 36934 and 36937 authorize the City Council to adopt an urgency ordinance, effective immediately, if necessary for the immediate preservation of the public peace, health, or safety; and WHEREAS, the City Council finds that a local emergency exists requiring immediate action to protect the health and safety of the public by authorizing expedited contracting and response measures to protect the City’s critical infrastructure.

E. Coordinate with regional, county, state, and federal partners to maximize available resources and assistance.

The City Manager shall
A. For all contracts executed pursuant to Section 2 hereof, report the execution thereof to the City Council at or before the next City Council meeting.

Section 6. Severability.
If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions.
