Recommendation:

Approve Fourth Revised Task Order No. 1, for services in accordance with the Multi-Year Professional Services Agreement (RFQ 769-22), Service Group Category 1 – Roadway and Structures Engineering, with Kimley-Horn and Associates, Inc. (KHA), of Los Angeles, California, in the amount of $113,223.00, to provide construction support services during construction of SR-138 (SR-14) Avenue J Interchange Improvements (Phase II – Caltrans Interchange); and authorize the City Manager, or his designee, to sign all documents.

G.C. Section 84308: No.

$113,223.00, bringing the approved and authorized contract amount for KHA to $793,141.00.

Sufficient funds are available in the Capital Improvements Budget in project string CP15BR007.CONST, GL Accounts 21249900.8000.

Background:

The PWCP 20-005, SR-138 (SR-14), Avenue J Interchange Improvements (Phase II – Caltrans Interchange) will install Phase II improvements, completing the local streets improvements that started in Phase I, as well as the freeway interchange improvements to add a northbound off-ramp at Avenue J, add a southbound on-ramp at Avenue J, and other lighting, signalization, landscaping, and interchange improvements.

Project construction began on August 7, 2023, and the original construction contract included 360 calendar days. Various delays have created the need to extend the original construction contract to 876 calendar days, as construction is now expected to be completed by December 30, 2025. The extension of the construction contract necessitates the extension of the construction engineering and construction management support services.

The project is funded with a Los Angeles County Metropolitan Transportation Authority (LACMTA) grant with Measure R Highway Program Funds.

On May 22, 2023, the City executed a Task Order for construction support services with KimleyHorn and Associates, Inc. in the amount of $124,118.00.

On October 24, 2023, the City Council approved Revised Task Order 1, for the continuation of construction surveying and staking services essential for ongoing project support in the amount of $429,000.00 plus a 10% contingency. City asked KHA to provide an additional authorization request for three typical months and three heavy months of RFIs, construction meetings, and site inspections. Assume typical month = ~$7,600 and heavy month = ~15,200, for a total of ~$68,400.

The original contract allocation for Task 7 has since been used to respond to RFIs/Materials Submittals. The hours included here match the hour distribution as shown in the Project's original KHA fee proposal and are intended to fully refund the task.

Background:

The City of Lancaster is looking to complete Phase 3 of the Lancaster Health District (LHD) Infrastructure Improvements Project (Project). This phase of the Project will construct approximately 0.2 miles of new complete streets to alleviate the current burden to the existing arterial network, whilst providing necessary access to existing and proposed medical facilities.

KHA was the design engineer for the overall project, before it was split into multiple phases, Engineer of record for Phase 1, and is currently in the design phase for Phase 2. Phase 3 is the next step in implementing the City’s decision to re-scope the overall project to better accommodate current developments in the area and position itself for strategic partnerships with Developers in the future.

The project limits for Phase 3 are within the City of Lancaster near the Antelope Valley Hospital and surrounding area, which is bounded by 20th Street West to the west, and 18th Street West to the east. The scope of work includes the construction of Avenue J-5 and a roundabout at the intersection of Avenue J-5 and 18th Street West, which will tie into the improvements made in Phase 2. The proposed improvements will enhance service to the region that serves the Antelope Valley Hospital.

The proposed project is funded by several funds, including General Fund, Gas Tax (SB-1), Transportation Development Act (TDA) Article 8, Proposition A, Proposition C, Traffic Impact Fees and Sewer Maintenance District.

STAFF REPORT
City of Lancaster
CC 8
11/18/2025
TN
Date: November 18, 2025
To: Mayor Parris and City Council Members
From: Andrea Alexander, City Clerk
Subject: Approval of Ordinance No. 1142 Amending the Lancaster Municipal Code Section

11.08.060 Annual Rent Increase Formula for Mobilehome Parks Recommendation:

Adopt Ordinance No. 1142 amending the Lancaster Municipal Code, Title 11, Section

11.08.060, changing the annual mobilehome park rental increase calculation from the current formula of 60% of the Consumer Price Index (CPI) to an annual increase structure based on the annual CPI, at a minimum of 2.5% and a maximum of 3%.

G.C. Section 84308: No
Fiscal Impact:

None.

Background:

Since 1993, the City of Lancaster has regulated mobilehome park rent increases through the Lancaster Municipal Code. The current formula calculates the annual rental increase by multiplying CPI for All Urban Consumers (Los Angeles Area) × 60%. This automatic calculation has resulted in variable annual increases:

Previous Annual Rate Increase

Year Rate Effective Date
2022 2.4% October 1, 2021
2023 1.3% October 1, 2022
2024 5.2% October 1, 2023
Year Rate Effective Date
2025 1.5% October 1, 2024
2026 1.9% October 1, 2025
The current CPI-based formula creates unpredictable year-to-year variations, making it difficult for both residents and park owners to plan ahead. For example, the 2024 increase of 5.2% represented a 300% jump from the previous year’s 1.3%. Mobilehome park residents are often seniors on fixed incomes or low-to-moderate income families. These households face unique challenges, as they own their homes but must rent the land beneath them. Large rent increases create financial hardship for these vulnerable populations. Utilizing the annual CPI and ensuring a minimum 2.5% increase and a maximum 3% cap aligns with modest cost-of-living adjustments, offering protection for residents while maintaining affordability.

Although the current formula limits increases to 60% of CPI, it can still result in significant swings during periods of high inflation. The 2024 spike to 5.2% illustrates how sensitive the formula is to economic volatility.

The proposed formula establishes a predictable range for annual rent increases that balances the needs of park owners and residents, as follows:
Minimum increase of 2.5%, when CPI is below 2.5%; or, Actual CPI-based increase, when CPI is between 2.5% and 3%; or, Maximum increase of 3%, when CPI is above 3%.

Park owners receive guaranteed annual revenue growth of at least 2.5%, ensuring they can cover operating costs even in low-inflation periods. Residents are protected from inflationary spikes, never facing increases above 3%. Both parties gain planning certainty with a narrow, predictable range that eliminates the volatility of the current system.

In 2024, when CPI reached 5.2%, residents would have saved 2.2% under the proposed cap, while park owners would still receive a meaningful 3% increase.

For City staff, the amendment would reduce the administrative burden by eliminating the need for annual CPI calculations and notifications. Compliance monitoring would be simplified, and the number of disputes or tenant complaints could potentially decrease as a result of greater predictability and fairness.

In conclusion, the proposed amendment to cap annual mobilehome park rental increases at 2.5% minimum and 3% maximum would enhance housing stability for vulnerable residents, provide predictable revenue for park owners, and simplify administration for the City, while positioning the community as a regional leader in mobilehome resident protection.

At the Lancaster City Council meeting held on October 28, 2025, the City Council approved the introduction of Ordinance No. 1142 amending the Lancaster Municipal Code, Title 11, Section

11.08.060, changing the annual mobilehome park rental increase calculation from the current formula of 60% of the Consumer Price Index (CPI) to an annual increase structure based on the annual CPI, at a minimum of 2.5% and a maximum of 3%, by the following vote: 4-0-0-1; AYES: Hughes-Leslie, Malhi, Mann, Crist; NOES: None; ABSTAIN: None; ABSENT: Parris.

The City Council reviewed this policy regularly, with the latest policy adopted on February 13, 2018, by Resolution No. 18-06.

The City's cash management system is designed to accurately monitor and forecast expenditures and revenues, thus enabling the City to invest funds to the fullest extent possible within the guidelines of this Investment Policy. The City attempts to achieve the highest yield obtainable through a diversified portfolio only after meeting the criteria established for safety and liquidity, in that order. The principal investment objectives of the City are:

1. Preservation of capital and protection of investment principal.

2. Maintenance of sufficient liquidity to meet anticipated cash flows.

3. Attainment of a market rate of return.

4. Diversification to avoid incurring unreasonable market risks.

5. Compliance with the City’s Municipal Code and with all applicable City resolutions, California statutes, and Federal regulations.

The City’s portfolio is a short-term and intermediate-term fixed-income portfolio. The maximum maturity of any investment is 5 years, with consideration of anticipated cash flow requirements and known future liabilities. The City contracts with an investment advisory service (Insight Investment) to assist in the effort to maximize the returns of the City portfolio. The City’s investments include publicly traded Treasury notes, Treasury Bills, Federal Agency Investments, Time Deposits, Local Agency Investment Fund (LAIF), and California Cooperative Liquid Assets Securities System (Cal Class) under the auspices of the State Treasurer for investment. Funds invested in LAIF and Cal Class are available within 24 hours, and other investments are available upon maturity at full face value. These investments enable the City to meet its expenditure requirements for the next six months, as required by state law.

The City’s investment procedures are governed by Sections 53600 et. seq. of the California Government Code. Additional requirements have been placed on the City’s authorized investments by the Investment Policy (a copy is available in the Finance Department or from the City Clerk), and all investments listed on the attached report adhere to these requirements.

Additional years (contract year 3 and the two optional oneyear extensions) will be budgeted for during the annual budget process and will include up to a 5% CPI increase on the prior year’s not to exceed amount of the base contract.

Background:

On September 1, 2024, an agreement for Professional Tree Maintenance and Management Services was entered into between the City of Lancaster and Tip Top Arborists, Inc. Through this agreement, the PARCS department has been able to address numerous arborist needs at our various parks. However, the safety concerns of the trees at the Lancaster National Soccer Center exceed what was originally allocated in the current contract and must be addressed immediately to preserve the health of the turf and patrons at this site. It is recommended that an amendment for the removal of the trees posing an issue is approved.

STAFF REPORT
City of Lancaster
PH 1
11/18/2025
TN
Date: November 18, 2025
To: Mayor Parris and City Council Members
From: Patti Garibay, Director - Community Development
Nicole Jones, Senior Analyst – Community Development
Subject: Amendment to Lancaster Municipal Code Chapter 9.55 — Vacant Residential and Commercial Property Compliance Program
Recommendation:

Introduce Ordinance No. [XXXX], amending and restating Chapter 9.55 of the Lancaster Municipal Code to establish a unified Vacant Property Compliance Program that sets registration, monitoring, and maintenance standards for vacant commercial properties, clarifies existing residential provisions, and authorizes registration and monitoring charges to recover the City’s inspection, enforcement, and compliance costs.

G.C. Section 84308: No
Fiscal Impact:

No direct General Fund appropriation is required. Administrative and inspection costs will be recovered through the Registration and Monitoring Charges ranging from $250-$5,000. Charges and Administrative Citations are set by Council Approved Ordinance and may be modified by Council resolution.

Background:

Vacant properties—both residential and commercial—can negatively impact neighborhood stability, diminish property values, and create recurring public safety and code enforcement challenges. The City’s existing Vacant Property Ordinance (Chapter 9.55) currently provides a framework for managing unoccupied residential properties, but does not adequately address the growing number of commercial vacancies along key corridors such as Lancaster Boulevard, Avenue J, and Avenue I.

Unmonitored or poorly maintained commercial properties often attract vandalism, trespassing, illegal dumping, and blight, which require repeated City response. To address these impacts, 4919-4743-9481v2/022283-0548
staff conducted a review of comparable programs throughout Southern California—including those in Long Beach, Riverside, West Hollywood, and Pasadena—to identify best practices for balancing accountability, economic activation, and legal compliance.

The proposed amendment creates a unified compliance program that integrates commercial properties into Chapter 9.55 while maintaining the City’s existing residential provisions. The ordinance introduces several key elements:

1. Commercial Property Classifications:

Defines Stable, At-Risk, and Failed property conditions to align compliance requirements with observable site conditions. This tiered approach allows City staff to prioritize inspection and enforcement efforts while rewarding proactive property owners who maintain their sites.

2. Registration and Monitoring Charges:

Establishes administrative Registration and Monitoring Charges to recover the City’s costs for inspections, enforcement, and compliance monitoring. The program aligns with Government Code §66014 and the framework is built out to ensure full cost recovery.

3. Enhanced Maintenance and Security Standards:

Requires vacant commercial properties to maintain clear windows and façades, functioning lighting, landscape upkeep, prompt graffiti removal, and visible 24-hour contact signage. Plywood boarding is limited to temporary use; long-term security must use clear, shatter-resistant sheeting to maintain corridor aesthetics and safety.

4. Activation Incentives:

Provides an optional Activation Plan pathway for property owners to temporarily utilize vacant storefronts through displays, art installations, pop-ups, lighting treatments, or community installations in collaboration with churches/non-profit organizations that deter nuisance activity and enhance the streetscape. Properties with approved activation plans that remain violation-free for twelve (12) months are exempt from monitoring charges during that period.

5. Monitoring and Cost Recovery Section (§9.55.050):

Adds a new section authorizing the City to recover all inspection, monitoring, and enforcement costs through Council-established administrative charges. Unpaid charges may be collected as special assessments or liens, ensuring fiscal neutrality for the General Fund.

The combined framework ensures that vacant properties—whether residential or commercial— are responsibly managed, visually maintained, and fiscally accountable. The program is designed to prevent deterioration of commercial corridors, safeguard neighborhood character, and promote reinvestment while avoiding additional taxpayer burden.

D. A unit that is vacant in a multi-family dwelling unit and is not currently in use as a residence shall be secured and locked, or otherwise made inaccessible in accordance with this section.

Section 9.55.040 Violations, penalties, and performance bond.

This chapter shall not apply to a dwelling unit actively being sold or offered for rent if the unit is maintained in strict compliance with the provisions found in Chapter 8.28.

Any person (whether an individual, corporation, partnership, joint venture, or other entity) who violates any of the provisions of this chapter or who does not correct violations in compliance with the requirements of this chapter, is subject to the administrative penalty provisions of Section

1.16 of this code. Each day or portion thereof wherein the violation is committed, continued, or permitted constitutes a separate and distinct violation.

The city's authority to prosecute violations of this chapter shall be in addition to its authority to pursue remedies under Chapter 8.28 of this code, and shall be entitled to recover any costs from the property owner associated with monitoring, inspecting, and securing the subject property to meet the requirements of this chapter.

In the event the chief determines that a vacant property has violated this chapter two or more times, the chief may require the person who owns, possesses or is in control of vacant property to submit a performance bond that the city may use to abate any future violations of this chapter or other municipal code sections. The chief shall set the amount of the performance bond so that the city can secure and remediate any violations of this chapter that may arise on the vacant property.

Unpaid registration charges and monitoring charges, abatement, inspection, and enforcement costs related to a vacant commercial property may be collected as a special assessment and lien against the property.

Section 9.55.050 Community safety and protection.

The chief is authorized to waive or modify any standard or condition found in this chapter if it is determined that, under the particular factual circumstances, the change is warranted to safeguard the property or the surrounding community from impacts that are injurious to public health, safety and general welfare or to the stability of real property so as to interfere with the comfortable enjoyment of life or property, nor become attractive to unauthorized persons, including, but not limited to, juveniles and transients, nor constitute a health, fire or safety hazard.

In making this determination, the chief shall consider:

1. The history of unlawful activity at this property;

2. The overall condition of the property and structures; A-10
4913-0760-6649v1/022283-0548

3. The willingness of the property owner to comply with city requests;

4. The likelihood that the change will result in improved protection of the property and the public writ large; and

5. Any other evidence pertaining to the property and its owners, or the effects of the proposed change.

This administrative flexibility applies to both residential and commercial properties; the City Manager or designee may adopt administrative guidelines to refine thresholds and procedures for commercial activation and monitoring based on workload and calls for service.

Section 9.55.060 Vacant commercial property monitoring and cost recovery.

The following provisions apply to vacant commercial property:

A. A vacant commercial property shall be subject to a base registration charge of $250 at the time of registration or renewal; provided, however, that a vacant commercial property that is not registered within 60 days shall be subject to a base registration charge of $1,000.

B. An annual monitoring charge shall be assessed for vacant commercial properties to recover the City’s inspection, administrative, and enforcement costs in the following amounts, or such other amounts as the City Council may establish by resolution:

3. Failed Property: $5,000
C. The City Manager, or his or her designee, shall prepare an annual report identifying total program costs and revenue as and to the extent required by applicable law.

D. Vacant commercial property with an approved activation plan and that remains violation-free for twelve (12) consecutive months shall be exempt from the monitoring charge for that period.

E. Any fee or charged established by this section 9.55.060 may be increased or decreased by resolution of the City Council.

F. A chronic commercial violator may be required to post a performance security deposit in an amount determined by the City Manager, not to exceed $15,000, to guarantee compliance with this chapter.

Subject: Annexation No. 3 Into Community Facilities District No. 2021-1 (Public Services) Recommendations:

1. Open the public hearing and receive public testimony and property owner protests for the proposed annexation territory into Community Facilities District No. 2021-1 (Public Services) and the authorization to levy a special tax within the proposed territory.

2. Adopt Resolution No. 25-XX annexing territory to Community Facilities District No. 2021-1 (Public Services), authorizing the levy of special taxes and submitting levy of tax to qualified electors.

3. Adopt Resolution No. 25-XX declaring results of a special annexation election, determining validity of prior proceedings, and directing recording of amended Notice of Special Tax Lien.

G.C. Section 84308: No
Fiscal Impact:

The 2026/2027 Fiscal Year Community Facilities District No. 2021-1 (“CFD 2021-1”) special tax rates are not yet available. However, the 2025/2026 Fiscal Year CFD 2021-1 special tax rate for Single-Family Residential Outer Zone is approximately $963.08 per residential unit. Based on this figure, the estimated annual revenue that will be received by the City of Lancaster (the “City”) for all 214 residential units in Annexation No. 3 will be $206,098.34. CFD 2021-1 includes an annual Consumer Price Index (“CPI”) adjustment; therefore, this amount will escalate over time. The process for annexation is funded by the developer and no General Fund monies are used for this effort.

Background:

By Resolution No. 22-60, the City Council established CFD 2021-1, a Mello-Roos Community Facilities District with the intention that future development within the City would annex into this district. The special taxes collected from the property owners within the district are to be used for the funding maintenance and operation of public safety services, fire services, lighting, parkways, streets, roads, open space and any real property or other tangible property with an estimated useful life of five or more years that is owned by the City.

The annexation territory, Stoneridge Ranch (the “Project”), proposed for annexation is owned by Southwood Limited and is generally located south of W Ave K-8, north of W Ave L., west of 52nd St W., and east of 57th St W. The Project includes the development of two hundred and fourteen (214) single-family residential units and four (4) lots utilized as basins. The boundary of the annexation includes the area within the assessor’s parcel map 3204-006 as depicted in Exhibit A.

Willdan Financial Services completed a comprehensive special tax analysis that took into account the types of properties proposed for inclusion in the CFD currently, and in the future through annexations, and the City’s maintenance budgets to arrive at the proposed levels of special tax amounts on the various land uses and created CFD 2021-1 in 2023. As part of the annexation process, the City contracts with Willdan Financial Services for the preparation of the necessary resolutions and balloting procedures for the annexation.

Resolution No. 25-53 was adopted on October 14, 2025 and set the public hearing for November 18, 2025. The adoption of the attached resolutions annexes the territory into CFD 2021-1, submits the levy of the special tax to the qualified electors, and declares the results of the special election. This is the final step in the annexation process; and since the conditions of approval for the development require it to annex into CFD 2021-1 and Southwood Limited owns the parcels, a majority protest of the annexation is not anticipated.

Once the annexation is complete, the property owner of the Project will be required to pay annual special taxes for CFD 2021-1, beginning in Fiscal Year 2026/2027 as itemized on their property tax bill in accordance with the rate set forth in the Rate and Method of Apportionment of Special Tax.

F. EXEMPTIONS
The City Council shall classify as Exempt Property: (i) Public Property, (ii) Property Owner Association Property, (iii) Assessor’s Parcels with public or utility easements making impractical their utilization for other than the purposes set forth in the easement, including but not limited to property designated for open space, trails, pathways, parks or park and recreation related facilities, (iv) property reasonably designated by the City or CFD Administrator as affordable housing, and (v) property reasonably designated by the City or CFD Administrator as Exempt Property due to deed restrictions, conservation easement, or similar factors.

The CFD Administrator shall promptly review the appeal, and if necessary, meet with the property owner, consider written and oral evidence regarding the amount of the Special Tax, and rule on the appeal. If the decision of the CFD Administrator requires that the Special Tax for an Assessor’s Parcel be modified or changed in favor of the property owner, a cash refund shall not be made but an adjustment shall be made to the Special Tax on that Assessor’s Parcel in the subsequent Fiscal Year(s) to compensate for the overpayment of the Special Tax.
