Background:

The City entered into a PCA with the U.S. Department of the Army in September 2004 to provide design and construction services, as well as Federal funding, for several potable water projects within the City. The PCA specified a cost-sharing requirement of not less than twenty-five percent (25%).

On February 23, 2010, the City Council approved Amendment No. 1 to the PCA to reflect the addition of several recycled water projects within the City. The cost-sharing requirement of not less than twenty-five percent (25%) applies to these projects as well.

Under the PCA, the USACE completed recycled water line design and construction of IFB No.

W912PL-10-B-008, North Valley RW1 (PWCP 08-038 Phase 1B Recycled Water Improvements), designated as “Section RW1” in the PCA. The City Council accepted the recycled water improvements on September 10, 2013.

The City and the U.S. Department of the Army, Corps of Engineers, have not pursued funding for additional projects listed in the PCA. As such, the U.S. Department of the Army has submitted the attached letter to closeout the PCA and bill the City for the remainder of its share of expenditures.
