Sewer Service Charge - Parcel Audit and Methodology Review Dear Nicole:
Harris & Associates (“Harris”) appreciates the opportunity to continue our work with the City of Lancaster (the “City”) in support of the Sewer Service Charge program. As the City’s consultant for annual administration and re- engineering services, we have a strong understanding of the existing charge structure, supporting data, and operational considerations. This proposal builds on that work and outlines our scope of services and estimated fees for evaluating the existing Sewer Service Charge and supporting potential refinements.
The Harris team regularly works with staff across multiple City departments and has an established familiarity with the City’s processes, data, and policy objectives. We also bring extensive experience with fee and special tax district law and Proposition 218 requirements. As the City’s partner, our team offers the following advantages:
Project Commitment. We understand the importance of timely execution and clear, consistent communication.
Our ongoing role administering and re-engineering the City’s sewer charges allows us to efficiently integrate this effort with existing workflows while keeping City staff informed of progress, issues, and key decision points.
Qualified Staff. Our team includes professionals with diverse technical backgrounds and decades of experience in municipal and district finance. This depth of experience enables us to work effectively with City staff, elected officials, and stakeholders, while minimizing demands on staff time and ensuring continuity across related efforts.
Proven Success. Harris has successfully completed numerous Proposition 218–related analyses and district evaluations throughout California. Our experience administering and updating assessment and fee programs has reinforced our reputation for thorough analysis, clear documentation, and adherence to statutory and schedule requirements.
PROJECT UNDERSTANDING
The primary objective of this engagement is to modernize the apportionment methodology for the City’s Sewer Service charges, ensuring defensibility under Proposition 218. Key considerations include (1) defining a sewage unit, and (2) developing a method of apportionment based on wastewater flow generated by land use. The flow can then be expressed as a sewage unit and applied to each parcel.
Under this approach:
A Sewage Unit (SU) equals the flow generated by a typical single-family residence (260 gpd per LACSD). Land uses are assigned flow factors based on LACSD classifications.
Harris & Associates, Inc Sewer Service Charge - Parcel Audit and Methodology Review 2 of 3 Costs are apportioned proportionally to estimated flow.
This method aligns cost of service with system demand and can be tailored to City-specific conditions.
SCOPE OF SERVICES
Task 1 – Parcel Audit and Methodology Review
The Consultant shall conduct an audit and methodology review of parcels subject to wastewater charges, using the City-provided sewer connection dataset as the authoritative basis for inclusion. The audit and review shall include:
Cross-referencing the City’s sewer connection records with the existing parcel database to verify that all parcels with a sewer connection are included and that no parcels without a connection are present. Identifying and recommending adjustments to sewer units, where appropriate, based on observed land use characteristics and available data.
Reviewing the District’s current approach for consistency with Proposition 218 and considering recent legislation and relevant case law affecting proportionality, special versus general benefit, and defensibility.
Task 2 – Sewage Unit Definition and Apportionment Evaluation
Based on the parcel audit and available data, Harris will evaluate up to two alternative approaches for defining a sewage unit as a standardized measure of wastewater flow, consistent with methodologies used by large regional sanitation agencies, including the Los Angeles County Sanitation District. The evaluation will consider flow-based metrics that reflect relative wastewater generation by land use, including average and peak flow characteristics, as supported by available data.
Harris will assess allocation metrics that may include residential unit counts, building square footage, occupancy indicators, and available water usage data, as appropriate by land use. Harris will prepare a technical memorandum summarizing the evaluated sewage unit definitions and apportionment metrics by land use, including key assumptions, data limitations, and compliance considerations.
Task 3 – Meetings with City Staff
Harris will participate in two virtual meetings with City staff to support the parcel audit and review findings. Harris will attend two City Council meetings to present recommendations to City Council and/or assist City staff in addressing comments and questions.
Task 4 – Report of Findings
Harris will prepare a Report of Findings summarizing the parcel audit results, apportionment evaluation, and recommended refinements to improve accuracy and defensibility under Proposition 218. The report is intended to inform City and District decision-making and does not constitute adoption or implementation of revised charges.
Responsibilities of the City
a. Provide sewer connection dataset.
b. Designate a project manager to manage and coordinate the project. c. Provide legal review of all documents
d. Make available records, documentation, and any other available information necessary for the project.
Harris & Associates, Inc Sewer Service Charge - Parcel Audit and Methodology Review 3 of 3
PROPOSED FEES
Harris will complete the Scope of Services for the lump sum amount of $12,500.
The fees herein assume that the scope of work will be completed within 6 months of the execution of the agreement. If the time frame extends beyond 6 months, additional fees may apply. Any additional fees will be discussed with the City ahead of implementation.
HOURLY RATES
Any additional services outside of the agreed upon Scope of Services will be billed on a time and materials basis.
Our 2026 hourly rates are reflected below.
Hourly rates are subject to increase by 4% each year, beginning on January 1, 2027, if this contract continues into subsequent years.
Harris has the experience, ability, and professional excellence to make your project successful. We look forward to working with the City. If you have any questions regarding our proposal, please feel free to contact us, our phone number and emails are included below.
Sincerely,
Harris & Associates, Inc.

SCOPE OF SERVICES
Harris has prepared the following scope of services to support the City in increasing the existing Special District rates.
Phase 1 – Analysis and Report
Sewer Service Charge
Task 1: Capital Facilities Plan Assessment
This task will identify all capital improvements including annual replacements, additions and improvements to the City’s wastewater collection system for impacts and inclusion in the 5-year rate study. Alternative capital project prioritization and methods of financing the City’s improvements will be evaluated. Specific subtasks are:
Task 1.A: Capital Program Review
Harris will review capital facilities plans, the current capital improvement program, and other available information regarding needed replacements, improvements, and expansions of the wastewater system. Harris will work with the City Engineer to prioritize internal City projects to be constructed within the study period to make sure expenditures assumed in rates yield desired impacts, can be feasibly executed, and are aligned with the City’s strategic initiatives. We will review for reasonableness the cost estimates of the City’s needed capital improvements.
This task will likely require an iterative process with the capital funding strategies developed in Task 1.B below.
Depending on the impacts of our preliminary capital funding plan, the initial capital prioritization schedule may be adjusted to align with feasible project execution, funding, and associated rate impacts. We will prepare up to three (3) scenarios for City consideration.
Harris will evaluate and recommend appropriate reserve requirements to be maintained on an annual basis for capital projects. This evaluation will be performed under Task 2.A- Financial Policies Review.
Task 1.B: Develop Capital Funding Strategy
Financial impacts of executing the capital program are often a major driver of utility rate increases. As such, we will structure the capital funding analysis to allow for alternative prioritization of projects to evaluate rate changes under different project costs, timing, and funding options.
Based on the initial findings and recommendations of the Capital Program Review, Task 1.A above, we will design a preliminary capital funding strategy intended to feasibly execute the capital program with rate impacts consistent with City goals. We will evaluate an appropriate combination of resources such as grants, low-interest loans and bonds, annual operating revenues, sewer capacity fees, cash reserves, direct contributions and special assessments. We will prepare up to three (3) scenarios under alternative prioritization schedules and/or funding options for District consideration.
This analysis will span a 15-year study period to enable development of a cash flow analysis that includes impacts of capital projects beyond the 5-year rate study.
Associated funding rate impacts will be identified for inclusion in the Revenue Requirement Projections, Task 2.
Docusign Envelope ID: CB8ED85B-FD3E-42DE-9776-95508A97CCCF Harris & Associates, Inc Special District Re-Engineering and Balloting Services 4 of 11 Task 2: Revenue Requirement Projections
This task will develop a multi-year revenue requirement forecast to determine annual rate revenue needs to fund the capital program, operating and maintenance costs, fiscal policy achievement, and other financial obligations of the wastewater utility. Specific subtasks are:
Task 2.A: Financial Policies Review
Conduct a policy evaluation to determine existing practices which should be maintained and explore alternative practices that might further City goals in funding utility obligations. This task will begin with a high-level historical review to use as a baseline for policy evaluation. Consistent with industry best practice for a policy framework, we will address financial performance, infrastructure replacement funding, debt management, and cash reserves.
At a minimum, our evaluation of cash reserves will include:
• Operating Reserves
• Rate Stabilization Reserves
• Pure Water Program Reserves
• Capital Reserves
• Debt Service Reserves
We will evaluate the need for each reserve or policy, the basis for any minimum reserve targets, and the financial impacts for establishing any new or revised policies. Sensitivity analyses will be performed to assess customer impacts and revenue risk for all policy implications.
Task 2.B: Operating Revenue Projections
Review and project rate revenues based on the existing level and structure of rates, incorporating the projected number of customers and service requirements. Historical growth trends, quantity of service provided, and patterns in customer service characteristics will be evaluated. Recent studies of population trends, growth and new development will be reviewed and used in making projections of customers and associated demand. We will review and project other operating revenues from miscellaneous sources such as interest earning, miscellaneous services, or other sources.
Task 2.C: Operating Expense Projections
Forecast operating and maintenance costs of the wastewater utility including local collection costs and regional treatment costs. We will review historical financial operations and the current budget to form the baseline for this forecast. We will incorporate any additional O&M expenses for known or anticipated requirements such as additional staffing, deferred maintenance and new or enhanced program initiatives, as well as estimates of annual cost escalation.
Task 2.D: Cash Flow Analysis
Integrate total revenue requirements inclusive of financial policies, existing debt service, capital funding impacts, and the operating forecast to develop an annual operating cash flow for the utility over the 5-year and 15-year planning periods. Compare projected requirements against projected revenue under existing rates to determine annual adjustments needed to provide financial sustainability over time. Develop a multi-year rate adjustment strategy consistent with the City’s goals. A sensitivity analyses will be performed to evaluate the impact of alternative capital funding strategies and other input parameters as appropriate. Major cost drivers and necessary rate adjustments will be summarized and illustrated graphically.
Docusign Envelope ID: CB8ED85B-FD3E-42DE-9776-95508A97CCCF Harris & Associates, Inc Special District Re-Engineering and Balloting Services 5 of 11 Task 3: Prepare Reports
Harris will prepare a report summarizing data sources, assumptions, methodologies, findings, recommendations and supporting data, including the 5-year schedule of rates for the selected rate structure.
The methodology will include direction on calculating fees per City Municipal Code 13.08.125 (C) and (D) to allow the City to collect revenues on new development, before they are added to the County tax rolls.
Task 4: Meetings and Presentations
Throughout the course of the project, we will meet with City staff at key junctures to review data and other critical inputs, study progress, and draft and final analyses and recommendations. We anticipate up to two (2) meetings with City staff to review interim results and obtain direction for finalizing the study. These meetings are assumed to be conducted through virtual meetings.
Lighting Maintenance District
Task 5: District Evaluation - Analysis of Funding Needs Task 5.A: Review Financials
Working with City staff, Harris will review past financials and future funding needs for the Lighting Maintenance District, to gain an understanding of the desired levels of service and where the funding falls short.
Task 5.B: Special vs General Benefits
Harris will review and identify special versus general benefits that the Lighting Maintenance District improvements and services provide, based upon a review the assessed parcels, annual budgets, recent court decisions and pending challenges.
Task 5.C: Assessment Methodology
Harris will prepare the assessment methodology. The methodology will be compliant with Proposition 218 and consider the types of parcels that make up the Lighting Maintenance District and the improvements and services provided. The assessment methodology will ensure that the proportionality requirements of Proposition 218 are incorporated into the calculation of the assessment.
Task 6: Prepare Engineer’s Report
Prepare the Engineer’s Report for the increased assessments to include the following items:
• A brief description of the existing and increased assessment, • Description of improvements and services funded by the assessment, • Estimate of costs for lighting services funded by the assessment, • Method of Apportionment for the assessment,
• Identify and quantify general versus special benefit, • Description of an annual escalation factor for increasing the assessment, • A listing of parcels and their maximum assessment amount.

Landscape Maintenance District No. 1
Task 8: District Evaluation - Analysis of Funding Needs Task 8.A: Review Financials
Harris will review revenues, expenses, and capital improvements that will be covered under the Landscape Maintenance District, to gain an understanding of the desired levels of service and where the funding falls short.
Harris will rely on information provided by the City.
Task 8.B: Special vs General Benefits
Harris will review and identify special versus general benefits that the Landscape Maintenance District improvements and services provide, based upon a review of the assessed parcels, annual budgets, recent court decisions and pending challenges.
Task 8.C: Assessment Methodology
Harris will prepare the assessment methodology. Drainage Benefit Assessment District
Task 11: District Evaluation - Analysis of Funding Needs Task 11.A: Drainage Rate Analysis and Boundary Map
Harris will conduct a detailed review and analysis, which will include:
Identifying an assessment methodology consistent with the requirements of Proposition 218 and recent court cases.
Identifying current funding needs, including annual maintenance and future capital funding needs for the improvements as they reach the end of their useful life. Identifying annual operating and capital reserve levels. Identifying necessary rates based on the services provided and current fund balances. An annual escalation factor will be included.
Prepare an updated boundary map to be included as part of the Storm Drain Rate Analysis Report.
Harris will rely on the City to provide planned storm drainage equipment and capital improvement projects, such as the storm drainage master plan and operation maintenance cost estimates. In the absence of available operation maintenance costs, Harris will review previous year’s budget revenue and expenditures for storm drain to develop estimates. Harris will review provided documents for completeness. Harris will calculate the revised fee and provide the draft calculations to the City for review. Harris will meet with City staff to review our findings and recommendations relative to changes to the costs to be included, current assessment methodology, annual inflation index, and rates. Harris will provide up to three alternatives to the assessments rates, revenue, and service levels. It is assumed that the Storm Drain Rate Study will consider the areas served by the City’s storm drainage system as one uniform benefit area. If the City desires to consider developing individual drainage fee rate structures for individual or grouped zones, it will be considered additional to the scope of work and will require additional fees.
Task 12: Rate Analysis Report
Following finalization of the new storm drainage fee, Harris will prepare a Drainage Rate Analysis Report, which will include the following:
Historical information, including the existing storm drainage fee for each parcel. Basis of the proposed new storm drainage fee
Method of apportionment
Revenues raised and use of funds.
New assessment roll, including the proposed new storm drainage fee for each parcel. Boundary map
The Drainage Rate Analysis Report will be prepared by a licensed professional engineer certified in the State of California possessing expertise with post Proposition 218 benefit assessment. The draft report will be submitted Docusign Envelope ID: CB8ED85B-FD3E-42DE-9776-95508A97CCCF Harris & Associates, Inc Special District Re-Engineering and Balloting Services 8 of 11 to City staff for review and comment. Harris will review the document with the City and will incorporate one set of consolidated comments into the report. Additional iterations of the report will require additional fees.
Task 13: Meetings and Presentations
Throughout the course of the project, we will meet with City staff at key junctures to review data and other critical inputs, study progress, and draft and final analyses and recommendations. We anticipate up to two (2) meetings with City staff to review interim results and obtain direction for finalizing the study. These meetings are assumed to be conducted through virtual meetings.
Phase 2 – Balloting Services
This phase assumes that all four of the Districts proceed concurrently. Additional fees may apply if the Districts hold their Protest/Public Hearings on different dates.
Task 1: Preparation of Notice of Protest/Public Hearing and Ballots Following the Resolution of Intention, Harris will assist the City Staff in preparing, printing, and mailing the Notice of Protest/Public Hearing and Assessment Ballots to mail to all property owners subject to the Special Districts, as required by Article XIIID of the California Constitution.
All drafts will be provided for review and approval by City staff and the City Attorney.
Harris will coordinate printing and mailing services to mail individual ballots to all property owners within Special Districts, as required by Article XIIID of the California Constitution. Bar-coding will be utilized to facilitate the tabulation process.
Task 2: Protest/Public Hearing
Harris will attend one (1) City Council meeting for the Protest/Public Hearing to assist City Staff in addressing the City Council and to assist City Staff with tabulating the protests and ballots. Additional meetings can be added an additional fee.
If there is a majority protest, then all proceedings to increase the fee will be abandoned.
If there is no majority protest, the City Council may approve the desired action and levy the Special Districts for collection on the property tax bills. Harris assumes that City Staff will be available to assist with the opening and sorting of protests and ballots, if needed. City Staff and the City Attorney will need to be available throughout the process to address issues that may arise in the tabulation process.
Task 3: Ballot Tabulation
On the date(s) specified on the assessment ballot, the assessment ballots will commence to be tabulated electronically with the use of bar-coding equipment and a computer program that simplifies the process and automates the result summaries. A laptop computer and staff members will be used on-site for ballot tabulation.
The balloting results will be prepared summarizing (by number of parcels and assessment amount) the total ballots received, and the percentage in favor and against. If less than 50% of the voted assessment amount is against the assessment (if there is no majority protest), then the City Council may approve the desired action and levy the assessments for collection on the property tax bills. Harris will provide four (4) staff members for two (2) consecutive days. If additional staff or days are required to tabulate ballots, additional fees will apply. Harris assumes that City Staff will be available to assist with the opening and sorting of ballot envelopes. City Staff and Docusign Envelope ID: CB8ED85B-FD3E-42DE-9776-95508A97CCCF Harris & Associates, Inc Special District Re-Engineering and Balloting Services 9 of 11 the City Attorney will need to be available throughout the process to address issues that may arise in the tabulation process.
Task 4: Meetings and Project Management
Harris will coordinate with the County throughout the duration of Phase 3. In addition to the meetings mentioned above, Harris will meet virtually with County staff up to two (2) times to discuss the project status.
Phase 3 – Community Outreach Support - OPTIONAL
Gaining property owner support is key to a successful rate increase. Harris will coordinate with a public relations firm and/or City Staff to engage property owners. Harris has included time for coordination with either the County or public relations firm through the public outreach process. Harris’ scope for this phase includes the following tasks:
Harris will coordinate with the City to provide background information that is needed to inform property owners of the City’s special districts financial status, facilitate communication and feedback, and educate property owners of the potential solutions. It is important to provide materials to facilitate communication and feedback from community members on their options and paths forward. Such materials will include the following:
Strategizing on key messaging.
Providing information for flyers and Frequently Asked Questions. Providing information to facilitate the creation of a project website. Responding to inquiries and information requests from community members. Providing information for City or public outreach presentations and attendance at up to two (2) in-person community meetings. Additional meetings can be negotiated and attended on a time and materials basis.
Responsibilities of the City
a. Designate a project manager to manage and coordinate the project. b. Provide legal review of all documents and prepare all Resolutions. c. Provide City Attorney availability during protest and ballot tabulation. d. Provide staff to assist with protest and ballot tabulation. e. Make available records and documentation in conjunction with preparation of the rate analysis, and any other available information necessary for the project. This includes, but is not limited to, costs of improvements and budget information, reports of documented costs. f. Schedule meetings, as required.
g. Take the lead on community public outreach efforts unless City decides to hire a public outreach firm.
