A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER RENEWING THE CITY’S MILITARY EQUIPMENT
USE POLICY
WHEREAS, on September 30, 2021, Governor Newsom signed Assembly Bill 481 (“AB 481”) into law establishing Government Code § 7070 et seq. which requires law enforcement agencies to adopt a military equipment use policy prior to taking certain actions relating to the funding, acquisition, or use of military equipment as defined by the law; and WHEREAS, on March 25, 2025, the City Council adopted Urgency Ordinance No. 1128 (“Ordinance”) approving a military equipment use policy pursuant to AB 481; and WHEREAS, Government Code § 7071(e)(1) requires the City Council to review its Ordinance approving the funding, acquisition, or use of military equipment at least annually and vote on whether to renew the Ordinance at a regular meeting; and WHEREAS, Government Code § 7072 requires the Lancaster Police Department to submit to the City Council an annual military equipment report for each type of military equipment approved by the City Council within one year of approval, and annually thereafter for as long as the military equipment is available for use, which was presented to the City Council on February 24, 2026; and
WHEREAS, the City Council shall determine, based on the annual military equipment report submitted, whether each type of military equipment identified in that report has complied with the standards for approval set forth in its Ordinance; and WHEREAS, the City Council has reviewed the annual military report submitted by the Lancaster Police Department and determined the military equipment has complied with the standards for approval set forth in the Ordinance; and
WHEREAS, the City Council desires to renew the Ordinance by resolution of the City Council as set forth below.
THEREFORE, THE CITY COUNCIL OF THE CITY OF LANCASTER DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council hereby finds that all of the foregoing recitals are true and correct and are hereby incorporated and adopted as findings of the City Council as if fully set forth herein.
Section 2. Based on the annual military equipment report submitted by the Lancaster Police Department, the City Council hereby determines that each type of military equipment identified in that report has complied with the standards for approval established by applicable law and the Ordinance.
Section 3. The Ordinance is hereby renewed.
Section 4. The City Clerk shall certify to the passage and adoption of this Resolution.
