A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LANCASTER, CALIFORNIA, CONTINUING TO AUGUST 11,
2026 THE PUBLIC HEARINGS ON THE FISCAL YEAR 2026-
27 LANCASTER SEWER SYSTEM SERVICE CHARGES AND
ANNUAL REPORT AND ON THE PROPOSED SEWER
SERVICE CHARGE INCREASES, AND DIRECTING
PUBLICATION OF NOTICE
WHEREAS, pursuant to Ordinance No. 876 and Health and Safety Code sections 5471 and 5473, the assessment engineer has prepared and filed with the City Clerk the annual Engineer’s Report and report describing each parcel of real property receiving sewer service and the amount of the charge for each parcel for Fiscal Year 2026-27, and a public hearing on the charges and the report was set for July 14, 2026, at 1:30 p.m.; by Resolution No. 26-25, adopted May 26, 2026, the City Council also initiated proceedings to increase the sewer service charges and set a public hearing on the proposed increases for July 14, 2026; and notice of the proposed increases and of the July 14, 2026 hearing was mailed to the record owner of each identified parcel on May 30, 2026, not less than 45 days before the hearing, as required by Government Code section 53755; and
WHEREAS, Health and Safety Code section 5473.1 requires that notice of the filing of the report and of the hearing thereon be published pursuant to Government Code section 6066 — once a week for two successive weeks, with the notice period complete at the end of the fourteenth day following the first day of publication — prior to the date set for hearing; an insertion was published in the Antelope Valley Press on July 7, 2026, and the City Council desires that the full publication cycle prescribed by Government Code section 6066 be completed prior to the conclusion of the hearings; and
WHEREAS, on July 14, 2026, the City Council opened the noticed public hearings on the annual charges and report and on the proposed increases, received public testimony, and determined to continue both hearings, without closing them, to the Council’s regular meeting of August 11, 2026, so that the required publication may be completed prior to the continued hearings, with written protests against the proposed increases to remain receivable until the close of the continued hearing; and
WHEREAS, Health and Safety Code section 5473.4 provides for the filing of the endorsed report with the county auditor on or before August 10 of each year; the Auditor-Controller of the County of Los Angeles, by written consent dated July 10, 2026, on file with the City Clerk, has consented to acceptance of the City’s filing following the continued hearings on August 11, 2026;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LANCASTER DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The foregoing recitals are true and correct.
Section 2. The public hearing on the Fiscal Year 2026-27 Lancaster Sewer System Service Charges and the annual report filed pursuant to Health and Safety Code section 5473, and the public hearing on the proposed sewer service charge increases, are each hereby continued to Tuesday, August 11, 2026, at 1:30 p.m., in the Council Chambers, 44933 Fern Avenue, Lancaster, California. Both public hearings remain open, and written protests against the proposed increases may be submitted to the City Clerk at any time until the close of the continued public hearing.
Section 3. The City Clerk is directed to publish notice of the filing of the report and of the continued public hearings pursuant to Health and Safety Code section 5473.1 and Government Code section 6066, stating the August 11, 2026 hearing date and time, with the first insertion published no later than Tuesday, July 28, 2026, and a second insertion at least five days thereafter and no later than Tuesday, August 4, 2026. The published notice shall include a statement of the 120-day period prescribed by Government Code section 53759(d).
Section 4. The City Council finds and declares that the Auditor-Controller of the County of Los Angeles has consented in writing to the acceptance of the City’s filings under Health and Safety Code section 5473.4 following the continued hearings; the written consent is on file with the City Clerk and is made a part of the record of these proceedings.
Section 5. The City Council finds that some property owners returned assessment ballots, written protests, and related materials for the several proceedings noticed for July 14, 2026 in interchanged envelopes. The City Clerk is directed to open all returned envelopes, to sort their contents by proceeding, to treat any written protest pertaining to the proposed sewer service charge increases as received when first delivered to the City Clerk, and to retain custody of all returned materials. Assessment ballots and other materials pertaining to assessment proceedings that are not being pursued shall be preserved in the records of the City Clerk without tabulation.
Section 6. The City Clerk shall post the order of continuance as required by Government Code sections 54955 and 54955.1 promptly upon adoption of this Resolution.
Section 7. This Resolution shall take effect immediately upon adoption.
