Date:July 14, 2026
To: Mayor Parris and City Council Members
From:Andrea Alexander, City Clerk
Subject:Approval of the First Amendment to Development Agreement (DA) No. 18-01 for the Avanti South Specific Plan (SP 15-02) (DA NO. 26-002) Recommendation:

Adopt Ordinance No. ____, adopting the First Amendment to Development Agreement (DA) No. 18-01 for the Avanti South Specific Plan (SP 15-02) (DA No. 26-002) to extend the term by seven years for a maximum of 27 years and restate the construction milestones.

G.C. Section 84308: Yes
Fiscal Impact:

None. The public benefits and concessions established in the original development agreement (DA No. 18-01) remain unchanged.

Background:

On September 11, 2018, the City approved Development Agreement No. 18-01 for the Avanti South Specific Plan. The development agreement became effective on April 23, 2019. As part of the development agreement, the City received public benefits including one-time payments for units constructed and the developer received concessions including reduction in impact fees associated with individual developments. In order for the development agreement to remain in effect, construction milestones were established which the developer was required to meet.

The developer has requested an extension to the development agreement to allow for a total possible term of 27 years from the effective date of April 23, 2019. Additionally, the construction milestones have been restated to align more closely with the new term of the development agreement. Specifically, the developer is required to start construction no later than December 31, 2032, and complete a minimum of 300 units no later than December 31, 2034. If 2 4

the construction milestones are not met, the development agreement would expire.

This is the only extension to the development agreement being granted. If the developer desires to seek additional time, concessions, etc., or if the development agreement expires, they would need to enter into a new development agreement.

At the Lancaster City Council meeting held on June 23, 2026, the City Council approved the introduction of Ordinance No. 1152, adopting the First Amendment to Development Agreement (DA) No. 18-01 for the Avanti South Specific Plan (SP 15-02) (DA No. 26-002) to extend the term by seven years for a maximum of 27 years and restate the construction milestones, by the following vote: 5-0-0-0: AYES: Castellanos, Mann, White, Hughes-Leslie, Parris; NOES: None; ABSTAIN: None; ABSENT: None.
